Complaint: Filed a recent complaint pertaining to same issue. Dyck O'Neal has continued to erroneously report my account late for the last 2.5 years. I am paying them on time and have been for the past 2.5- 3 years. Balance is almost paid off and I am in the process of buying a new home and am not able to due to all the lates they continue to report every month. Every time I call customer service they are rude and do n't provide any assistance they only yell at me.

Complaint: XX/XX/XXXX I purchased my current private residence and originally had XXXX mortgages ( first + second XXXX ) with " XXXX XXXX '' XX/XX/XXXX. 1st was for {$480000.00}, 2nd for {$120000.00} Within 1 year the 2nd mortgage was transferred to another lender and then both mortgages ended up with XXXX XXXX XXXX around XX/XX/XXXX. We had XXXX loans with XXXX at that point, a 1st and a 2nd. I still have the papers and XXXX loan numbers. XX/XX/XXXX my husband and I filed for chXXXX with the help of XXXX XXXX XXXX, discharged XX/XX/XXXX. We had stopped paying the 2nd XXXX mortgage around XX/XX/XXXX. We learned from XXXX that they charged off the 2nd mortgage. After the XXXX discharge we never heard about the 2nd mortgage again, no correspondence whatsoever. On XX/XX/XXXX we received a letter from a company called " Dyck O'Neal '' claiming possession of a lien against our property. On XX/XX/XXXX XXXX XXXX XXXX sent a " Qualified Written Request '' to Dyck O'Neal on our behalf. Until today there is no response. On XX/XX/XXXX my husband went to the XXXX recorder 's office to search our property 's records. He found out the following : 1. A record recorded with XXXX recorder on XX/XX/XXXX showing that in XX/XX/XXXX a transfer of 2nd mortgage from lender " XXXX XXXX '' to a company called " XXXX XXXX XXXX '' in Texas took place. These documents were recorded with the LA recorder 's office 2 months after XXXX XXXX XXXX had sent them the " Qualified Written Request '' Dyck O'Neal never responded to. Besides, to our knowledge XXXX XXXX could not have transferred this 2nd mortgage as the original 2nd had been moved to XXXX other lenders and it ended up with XXXX before our chXXXX filings in XX/XX/XXXX. 2. Another record dated and recorded with XXXX recorder on XXXX/XXXX/XXXX showing a transfer of this same 2nd mortgage from " XXXX XXXX XXXX '' to " Dyck O'Neal, Inc. '' dated XX/XX/XXXX. On XX/XX/XXXX I received another letter from Dyck O'Neal similar to the letter they had sent in XX/XX/XXXX, claiming possession of a lien against our property. Again no response to the Qualified Written Request my attorney had sent in XX/XX/XXXX.

Complaint: Dyck Oneal has been reporting on my credit report a collection in the amount of {$32000.00} which is not mine and Dyck Oneal is illegally transacting business in the State of Ohio by continuing to try to collect a debt from me and I am a resident of the State of Ohio. According to the Ohio Secretary of State : Ohio does not have a specific requirement for collection agencies or debt buyers to be licensed in the state. However, any business, regardless of location, that " transacts business '' in Ohio is required to register with the Secretary of State. Dyck Oneal is not registered to do business in the State of Ohio.

Complaint: For 2 years, since XXXX, Dyck-O'Neal made my life unbearable with incessant phone calls and letters alleging that I owed a debt to XXXX XXXX that they were authorized to collect ( attached ). Uncountable times, I responded and advised them that I did not owe XXXX XXXX any money but they continued to harass me. Several times I called the number I was advised to call but the harassment continued. Then I applied for credit and was denied and informed that it was largely because Dyck-O'Neal had reported this debt on my credit ( attached ). My credit score dropped as a result of Dyck-O'Neal 's reporting. I contacted XXXX XXXX and they confirmed to me that I did not owe them any money and that they had not authorized any collection from me ( attached ). I confronted Dyck-O'Neal again and they wrote me a letter on XXXX XXXX, XXXX simply stating that they have ceased collection activities ( attached ). No apologies. No compensation for the emotional and financial stress they put me through for 2 years!

Complaint: About XX/XX/XXXX Dyke O'Neal started trying to collect a deficiency amount on a mortgage that had been improperly foreclosed by XXXX XX/XX/XXXX. XXXX has since admitted violating the required procedures for foreclosure and I was compensated by XXXX different federal settlements from the mortgage lawsuits. XXXX shows my balance as {$0.00}. No Deficiency judgement was ever sought or obtained for this amount by XXXX or Dyke O'Neal and Tennessee has a 2-year statute of limitations for such filings under Tenn Code Ann 35-5-118. Dyke O'Neal is aware of this law but has continued to report this to XXXX and XXXX as an unpaid collection. I have disputed this with XXXX bureaus and XXXX has remove it but not XXXX. This has hindered my ability to obtain a mortgage using my VA loan. Dyke O'Neal is unresponsive about this. This is an unfair collection attempt by a 3rd party for a balance that the original lender agreed to remove under the federal settlement.

Complaint: I have been in an on going situation with Dyck O'Neal for debt collection from a foreclosure I had in RI. I purchased the home in XXXX of XXXX with a mortgage secured by XXXX, the mortgage was then assigned to XXXX XXXX. The home was foreclosed on on XXXX XXXX, XXXX. In XXXX of XXXX I received notice from Dyck O'Neal they were collecting the debt owed. Since then we have had a few conversations. Complaint: XXXX I had XXXX to move from XXXX, XXXX to XXXX XXXX, XXXX. I moved entering into a buy out house program by the XXXX. The XXXX only offered $ XXXX on a house that I owed $ XXXX and was worth $ XXXX. I was short by $ XXXX. I was already living in XXXX XXXX when I found out about this shortage. XXXX advised I sign a promissary note for the $ XXXX for the bank would not right off the remaining balance even thou I was put in a short sale process to sell the home. I came to the closing with the the $ XXXX from XXXX and my promissory note showing paid off in full. Months later my credit was hit with a foreclosure attached to it. The XXXX per a BRAC law said they could not reimburse me the $ XXXX because I had not lived in the house 2 years. Upon being hired I was never told the base would be closing or I would have to move. Key information in deciding to build the new house we lived in. We were advised by a lawyer to file bankruptcy to get rid of the $ XXXX we owed Dyck O Neal. We did so. However XX/XX/XXXX the bankruptcy was dismissed. Judge told lawyer that a company or bank can not not double hit a individual. What he was saying is our credit was ruined with the foreclosure for 6 years and then on top of it we were being asked to pay $ XXXX for a house we no longer owned. The judge said this is not right. The judge could not fix my credit and I would be stuck with that for 6 years but advised the lawyer to send letter to Dyck o Neal that I am not responsible for payment of the $ XXXX. A request to cease collection efforts was sent to Dyck O Neal in XX/XX/XXXX. In XX/XX/XXXX we moved to XXXX, XXXX. XXXX XXXX we the foreclosure/short sale fell off our credit as well as bankruptcy information. However, every month over the last 6 years Dyck O Neal has banged my credit lowering it from an XXXX score to XXXX. This has hurt us over the last 6 years where we can not get a credit card, car or house. We went to banks in XX/XX/XXXX to purchase a house since the stuff dropped off our credit except the Dyck O Neal debt. Not one bank would give us a house loan even with back up from our lawyer saying we are not responsible for the debt. All banks mentioned that the removal of this debt from our credit report was crucial. We have tried multiple different methods with no results. In XX/XX/XXXX Dyck O neal claims they matured the loan to the full amount owed but mis-represent this on our credit report. We have disputed this and it has not been corrected. Per the statue of limitations Dyck O Neal can no longer attempt to collect on this debt. This has done significant damage to our credit for 6 years by them misrepresenting a foreclosure on our credit report for the 6 years and also attempting to collect up and beyond that. They misrepresented that we came to the closing of the loan on our home with all intention of showing a full payment so we would not have to short sale a home and have bad credit. They not only damaged our credit but want to collect per the promissory note after doing such damage and was not supported by a judge for their actions. They continue the threat to sue but the statue of limitations has exceeded the time they can do so. We would like to resolve this issue in any way possible has it has done great damage to our family for over 6 years and continues to be a problem.

Complaint: Debt was discharged during short sale. In XXXX we sold our investment property in a short sale with XXXX XXXX. We later received a XXXX from the lender, for the cancelled debt amount of {$8000.00}. Immediately after the short sale, we also started receiving statements from Dyck O'Neal regarding this same shortage as though the cancelled debt was now owed to them. Not fully understanding the situation, my husband paid their invoices for over a year until he was advised by our accountant that we would not be responsible for both the cancellation of debt and the reimbursement of the short sale funds. We stopped making payments after XXXX XXXX. At the close of escrow we were required to sign a promissory note for {$8000.00} but we understood that we would either receive a cancellation of debit XXXX or the possibility of having to pay the promissory note. We were also advised that Oregon is not a " recapture '' state so it was very unlikely that the lender would attempt short sale recapture.

Complaint: In the process of closing on a Short Sale, our attorney informed us that XXXX required us to sign a Promissory Note or the Short Sale would not be approved ; basically extortion. We had no choice but to comply. However, the Promissory Note we signed was for payment to someone called Dyck O'Neil, a company in Texas. The Note was very poorly constructed and look like a scam to us. In checking the company 's website, there is no indication they are affiliated with XXXX ; a very poorly constructed website. We requested that the company invoice us for the payments and also asked that they provide XXXX documentation that shows the money is indeed going to XXXX. They refused. We have no way of knowing if the Note is legitimate and wo n't pay on it until we do. Of course, Dyck O'Neil is now reporting missed payments to the credit bureaus. Is this form of extortion truly legitimized by XXXX?

I paid the full one time payment requested at the time. Paid in full the amount offer proposed and arranged by the debt collector. And find out that they reported me to the credit bureaus negatively for paid less in full well I actually paid in FULL my debt under their enticing offer! AT NO TIME, they reported to me that they would report this negatively to the credit bureaus otherwise I would have refused and kept my monthly payment. They should have reported this as paid in full! Or disclosed their bad intentions against me.
