Complaint: I received a letter on my front door from a company who claims they a second lien on my house. I am unaware of this company and need to know if they are legit. When i first purchase my home i had two mortgages but later to my understanding i refinanced and combined the debt. This company by the name of Dyck Oneal claims they bought the account from the second lien holder. They never sent me any packet info neither have i signed any paperwork within the last ten years. Now they have sent a payment book and threaten to report to the credit bureau if i don't pay. I would like to know can they open an account that is over ten years old and do they have a lien on my property? They are demanding payments from me now.

Complaint: In XX/XX/2018 this collector XXXX XXXX appeared on my credit report as a late payment. I had no idea who they was and what debt I had with them so I had to call and reach out first. Once I got in contact with this agency I was told who they brought the debt from and made it into a unsecure loan with them with past due balance of XXXX late payment of XXXX dollars. I never got one notice from this. Agency about this debt they have failed to set up a formal payment agreement and just decided to put a late payment on my credit report. My second call to them was asked for documentation of payment plan set up with them she failed to send me this information and claim the XXXX dollars is the same Payment I was paying to who they brought the debt from. Well this is invalid due to them postings this documentation they claim they sent me in the XXXX site and shows the payment was only XXXX weekly which is only XXXX monthly so the payment are wrong let alone me and this said agency did not make and agreement on a payment plan I refuse to pay this back until these late payments are taken off my credit report and Handled the correct way

Complaint: Had a debt that was 2 years three months old. It was sold to a loan agency. The debt was transfred from credit debt and reported as a loan debt by dyck oneal inc. They reported I did not pay a personal loan for the past 3 months and have impacted my payment history for personal loans. This was not For a personal loan..and was mever a loan of any type. They never contacted me about this change. I called the company on XX/XX/2018 they were not able to give me a answer as how they can do this. Only that they bought the previous company.

Complaint: In XX/XX/XXXX, my ex-husband, XXXX XXXX XXXX, XXXX and I signed a 10 year promissory note which was due to be paid in full in XX/XX/XXXX/XX/XX/XXXX due to the short-sale of the marital home. We had been legally divorced for 6 months, living in separate homes/addresses, and separate bank accounts. For the first 3 years of this repayment period, Dyck O'Neal only sent bills to XXXX. Repeated calls to Dyck O'Neal were unsuccessful. I was always told that it is there policy to only send the bill to the first person on the account. For three years I wrote, " Please send me a copy of this bill so I can pay on time. '' Once they began doing that, I received monthly bills and payments were sent consistently. XXXX consistently paid $ XXXX/month over almost 8 years. My amounts were varialbe over the years, sometimes minimal, sometimes extra. In XX/XX/XXXX, XXXX has a small XXXX as the result of XXXX XXXX XXXX for 2 1/2 years and was at the VA Hospital in XXXX XXXX XXXX, VT. I was not notified of this by my former step-children until my repeated phone calls to him to check on his well-being. I spoke to XXXX, via phone, and told him that I would send the entire monthly amount and he said that he would pay the balance of the loan.
On XX/XX/XXXX, XXXX passed away due to his XXXX XXXX XXXX XXXX. I never received another bill from Dyck O'Neal and assumed that XXXX had followed through and paid of the loan. I was notified by XXXX XXXX that my score had gone down and a past 30 day payment was reported.
I have filed a complaint with the credit bureaus on three separate occassions and won each time. Dyck O'Neal negative reporting was removed, but they keep putting it back on my account. If I'm late 30-60 days, please explain to me how we've paid this debt off 2 YEARS early. I've called Dyck O'Neal customer service again and warned the rep that if they reported the account as late again that I would be filing a formal complaint. Please help fix this for good. They still have not fixed their policy of only notifying the first person on the account despite knowing that we were divorced and living separately before even signing this promissory note. At this point, my credit has been repeatedly and negatively impacted over the years.

Complaint: I recently received a writ of execution for my personal residence and personal property for a paid in full mortgage and a debt not owed. ( See attached XXXX XXXXXXXX XXXX documents. In XXXX of 2015, Dyck-O'Neal 's attorney debt collector filed a writ of execution for unoccupied, unencumbered Real Property but failed to pay the Sheriff to finalize and collect his judgment. Now, instead of refilling his writ of execution for the previous, unencumbered and unoccupied, real property worth far more than its illegal judgment, XXXX 's counsel has decided to harass and attempt to forcibly take our occupied home where I take care of my ill mother solely to harass, abuse, and extort money not owed. Our personal residence has two mortgages which encumber or secure the property for the amount it is worth placing mortgagees, including XXXX XXXXXXXX XXXX, XXXX, in jeopardy to an illegal debt collector extorting us for money owed. I have sent an offer again to the illegal debt collector 's counsel for clear and free, unencumbered unoccupied, real property or raw land, previously sought by writ by the illegal debt collector 's counsel, but the attorneys will NOT respond to any messages to settle the illegal debt for money not owed using my unencumbered and unoccupied real property previously sought by the illegal debt collector 's counsel for money not owed. How do I stop the insidious harassment of attorneys who will NOT stop threatening us because we reported their crimes of using fraud to extort money not owed? Failing to act on the original writ, causing three ( 3 ) more years of interest to add up on the illegal judgment, is another crime of abuse, harassment, and extortion for money not owed. In 2015, I filed a Quash for the property writ, in opposition Dyck demanded I give alternate property to the sheriff and therefore I was Denied. At that point, Dyck was able to collect its illegal judgment for money not owed but failed to do so by not paying the sheriff and allowing the writ to expire. The Sheriff said Dyck 's Counsel " NEVER showed up to pay for the Writ of Execution ''. It is illegal to harass us by now choosing our residence which fully encumbered, serving as security for two loans, one mortgage from XXXX XXXXXXXX XXXX and another private promissory note, while I have unencumbered and unoccupied real property, raw land in the same county, worth far more in value than the illegal judgment? I would appreciate a response to the pressing issue of abuse, harassment, and extortion for money not owed. Thank you.

Complaint: I had previously tried to get Dyck O'Neal to correct their improper reporting on my credit reports. This last time they finally listed the original creditor which proves they are indeed a collections account. Yet they are not listed on my report as a collections account but rather as an open loan. So this makes my account look like I haven't made payments on a recent loan these past 120-149 days. The first deliquency was XX/XX/2016. This is basically termed, 'parking a debt ' to make it appear newer than it really is and is thus illegal. I have told them I am willing to pay the debt provided they furnish me a true validation that they own the debt ( not just them saying so and not a contract with the XXXX or bill, but a purchase agreement between them and the XXXX or a simple letter from the XXXX on XXXX company letterhead ) AND they correct the illegal parking tactic reporting they put in my report. Just correct what is wrong. That's it. No deleting, just accuracy. I even asked if I could disputed the inaccuracy and they just not reply, because they are wrong, but they declined stating they must accurately report to the agencies by law, though they are inaccurately doing so. I'm running out of available options and feel that the company 's tactics infringe on my rights.

Complaint: This company has failed to provide me with adequate information to assist me in investigating the alleged debt of {$360.00}. I have also reached out to the company and provided them with enough time to provide me with debt validation.
They sent me a document that was seemingly manipulated ; consequently, I requested pages 1, 2, 4, 10 and 11 of what appears to be a Purchasing Power Agreement as evidenced by the attached letter and proof of delivery.
I am eagerly awaiting proof that this alleged debt is mine and has not been paid. Failing which, I implore Dyck O'Neal, to undue all negative action that it has taken thus far.
It is to be noted that this is not a duplicated complaint but this refusal to supply documentation to validate the alleged debt is contrary to the FDCPA. Furthermore, it appears that Dyck O'Neal has deliberately withheld material information relating to this case because pages 1, 2, 4, 10 and 11 were missing from the inadequate documentation they sent me through CFPB following my previous complaint ( s ).

Complaint: In late XX/XX/XXXX/Early XX/XX/2018, I requested a debt validation from a collection company and they sent me information from the original creditor. I also submitted a dispute online with all 3 credit reporting agencies, XXXX, XXXX and XXXX. I received a status report that Account information disputed by consumer, meets FCRA requirements. The collection agency then reported on my credit report as an open installment account currently past due 120 and 180 days late. This is not the original creditor and I have never entered a contract with DYCK O'Neal. I tried disputing this with XXXX again on XX/XX/2018 around XXXX central standard time. They replied that no such dispute ever took place despite me providing the email file number for the dispute. I asked them to send me the information the collection company sent them to verify the account information was accurate. They replied that the company sent no such information to which I replied, then how did you guys agree it was accurate without any information or validation? The supervisor, XXXX XXXX, then stated it was NOT a collection account but the original creditor, which is FALSE. Dyck O'Neal is a collection company and should not be able to report monthly current past due late payments nor represent themselves to the credit reporting agency as the original creditor. XXXX refused to do anything but dispute it again. They stated it was not their job to investigate disputes and whatever the creditor told them, they simply report.

Complaint: Dyck-O'Neal, Inc. filed over 1000 cases in Maryland using fraud from National Mortgage Settlement cases. Many Maryland families have been enslaved for life with 100,000. - 300,000 plus illegal judgments. It is time for action by authorities to demand restitution for crimes committed by substitute trustees NAMED in the National Mortgage Settlement.
The Department of Justice knows about these crimes and should be issuing indictments and arrest warrants for the NMS 15 ( a ) violators ; any criminal act. I reported these crimes prior to this communication and your answer was less than acceptable given the dire circumstances of the victims.
I have been intimately involved in more than one of these cases with good results proving FRAUD. For way to long these NMS crimes have been allowed to continue. It is time to act for the citizens ( over 1100 ) in Maryland alone, obtain some justice. Looking the other way when crimes have been committed with substantial evidence to prove the cases is just another crime. I look forward to a easy process to prove over

Complaint: I had a {$5000.00} promissory note assigned to me in the short sale of my condo back in XXXX. Dyck O'Neal was the debt collector in charge of servicing my note. From the beginning, communication was poor. I began paying on my promissory note In XXXX of XXXX. I set up an autopay and each month, from XXXX of XXXX through XXXX of XXXX, Dyck O'Neal was paid the agreed upon monthly amount. In XXXX of XXXX, I began receiving late payment notifications in the mail, which confused me since I was on autopay. When I called Dyck O'Neal and inquired, they told me my account was fine and my monthly payment had been received. I continued to sporadically receive late payment notifications, and another time when I called, I was told my loan needed to be modified and they would send me the paperwork. Twice, I never received the paperwork they said they sent. So even though I paid Dyck O'Neal every single month, my account was in default. They never once told me this would affect my credit, and that my account was showing late payments month after month on my credit report. Whenever Dyck O'Neal would try and contact me, it was during working hours, and they would never leave messages. I finally did modify my account this year and ultimately paid the remainder off just to be done with them. I am extremely upset that my credit has been destroyed due to their lack of communication and mixed messages that I was told over the past 5 years. I never missed a month in payments, and I don't believe my credit should be impacted by this company.

Complaint: I settled with my mortgage company on the short sale of my home. An amount was agreed upon but no timeframe or monthly amount due was part of the agreement. Only that the debt will be paid in a reasonable time. Dyck Oneal purchased this debt and converted it into a monthly payment with a fixed term without my consent. If payment is considered late by them, a negative remark is placed on my credit report. Constant phone calls are made to my home and relatives asking when payment will be made. My credit is now damaged by this company and causing financial hardship.

Complaint: In XXXX we sold our home in XXXX Ca. The mortgage company said they would give us a no interest loan for the difference in the selling price of our home. We agreed to do it as I didn't want to jump on the foreclosure bandwagon, that was happening at that time. Another reason I agree is there was no advisory language in the agreement, which meant to me that this would not be reported to any collection agency. The money amount on the Promissory notice is different from the written amount. The payment for the note was {$1200.00}. I paid {$50000.00} on this note for my mortgage at XXXX XXXX XXXX. Then I lost my job after 34 years. XXXX went out of business in the real estate scandals that went on in XXXX. They sold the note to Dyck-O'neal, I contacted them in XXXX and told them about losing my job and offer a settlement after many emails I finally received a response and their answer was no, they would not except my offer. I went to an attorney and showed him the note and explained that was a note regarding my mortgage and I was told by the attorney that this note was illegal for many reason and that it was being report incorrectly, it was being reported as an account when it was actually a mortgage loan. I fought for years with Dyck O'neal in XXXX they sent me a notice saying that the debt is unenforceable due to the expiration of the applicable statute limitations. My husband was employed throughout this fiasco, I ask Dyck-O'neal on several occasions to take this to court so we could deal with it legally, they choose not to do it. I believe it's because they knew this was an unenforceable agreement. I am in the process of buying solar for my home and because of their derogatory mark on my credit and my Husband XXXX XXXX credit it is stopping us from purchasing it. I have written to the Credit Bureaus disputing this account and they will not remove it because Dyck-O'neal keeps saying its a debt owed to them. Our credit is perfect no missed payments, no collections, the only mark we have is for a contract that is unenforceable.

Complaint: To Whom it May Concern, Upon looking at my credit report. I found a collection item from Dyck Oneal. In which their were no collection items on my credit report at all. I have no knowledge of the amount, don't know who it is from, have not applied for any credit with this company therefore I don't owe them any debt.
Once I found this debit on my credit report I call the number that was listed. I was not able to get in contact with anyone. The phone will ring and then I am asked to leave a message. I called more than ten times and it was the something. I left a message and I have not had a return call.
Per my investigation this company deals with loans and mortgages in the state of Florida. I am not a resident in the state of Florida and never been. I also found that this collection agency is in violation of the FDCPA, CCPA. This collator is not licenses in the state of pa and is in violation of all laws.
