Complaint: I want to file a complaint to report how paying off my mortgage with XXXX has damaged my credit report. I had two offers of payment rejected. The first was an offer of total payment of {$14000.00} in two checks ( 1 ) was check # XXXX for {$12000.00} & ck # XXXX for {$1500.00}. dated XX/XX/XXXX.This offer was rejected by Green Tree XXXX
A second payment was tendered to Green Tree cashiers check dated XX/XX/XXXX in amount of {$17000.00}. Was mailed return receipt. This offer was rejected. Attorney XXXX of XXXX., XXXX FL XXXX handled negotiations and is holding the check. It has been since XX/XX/XXXX and this lingers on my credit report. I have copies of check if you need confirmation. 3 years later I pay my taxes and insurance while my loan continues to be sold to different mortgage companys constantly selling the loan. XXXX sold to Green Tree who sold to DiTech and etc.
This damage to my credit after paying loan off continues to linger on my credit and needs resolved so I file this complaint.

Complaint: We have not been properly notified about changes to our account. When questioning the changes and trying to get clarity on them, we were instructed to write a letter of dispute. Which we did in XXXX of 2016. We have never received an answer, we call every week. The proper changes to our mortgage have never been updated and we continue to get passed around. They have actually told us not to make a payment because they do n't know what the recalculation payment amount is. Ditech is a fundamentally flawed and fraudulent company and we need outside help as we have exhausted all options with them.

Complaint: My mortgage was sold by XXXX to Ditech in XX/XX/2016. The last mortgage payment I made to XXXX was never transferred to Ditech, so as soon as my account transferred I was considered " late ''. I called and wrote Ditech to no avail. I ended up making double mortgage payments for XX/XX/XXXX in an attempt to stop them showing I was late in paying my mortgage. It has been over a year and I thouight they had finally cleared this up, but just looked at a current statement and it shows accumulating late fees. THE PAPERWORK I RECEIVED WHEN MY MORTGAGE WAS TRANSFERRED TO DITECH INDICATED THAT THEY WOULD NOT CHARGE LATE FEES FOR 60 DAYS AFTER A MORTGAGE WAS TRANSFERRED TO THEM. They have committed fraud because they did not honor this agreement.
I have NEVER knowingly paid anything late in my entire life. My credit score is over XXXX. Why can they not clear up their accounts and just be honest? Why did I never receive notification that they thought I still owed them a late fee?? In this situation with Ditech, I even made a double mortgage payment ( once to XXXX, and once to Ditech, which should n't even have been owed if they knew their accounting system from a hole in the ground ) to avoid a late fee, or being caused to look like a deadbeat.
It enrages me that mortgages can be bought and sold seemingly at random and the consumer has no choice whatsoever in who services their mortgage. This is the hugest financial transaction that 99 % of us will ever have. Why ca n't it be done right?
XXXX, I revere you. Please help with this issue. It is n't just me, but umpteem consumers that are getting shafted by this morgage servicing XXXX.

What am I asking for? : ( 1 ) Ditech removes the bogus " late fees '' from my account ( 2 ) Ditech sends me a letter of apology and an acknowledgment that what they did was in violation of their own policies ( 3 ) Ditech is put on some kind of watch list so if they continue doing this to me or any other consumer, they face harsh penalties and/or jail time for everyone in the C-suite ( 4 ) A bill is introduced to make mortgage servicing " cramming '' a federal offense punishable by massive penalties and jail time for executives

Complaint: I have yet to receive the full refund of my escrow account since closing XX/XX/2016. The full amount is {$2000.00} and I only got a partial refund of {$340.00}. I have not cashed the check yet since it was not the right amount. Greentree / Ditech new I was refinancing since they were notified that I needed the payoff amount of the loan. Since I was refinancing I needed to pay off my property taxes before closing so I paid the full amount of my property taxes that was posted XX/XX/XXXX and Ditech the XX/XX/XXXX. Attached is my notes.

Complaint: I had a short loan from Green Tree XXXX now Ditech Financials. I was getting monthly statement from them since XX/XX/XXXX till XX/XX/XXXX that stated that I do n't owe them any money ( Principal or Interest ) to them till XX/XX/XXXX as I overpaid in XX/XX/XXXX. I can send proof of Statements. Statement says no Principal & No Interest till XX/XX/XXXX.
In XX/XX/XXXX as I was going to be charged Interest again I paid out $ XXXX balance and was waiting for their closing statement, when they told me I still owe them {$4200.00} as I had not paid any principal in last two years. My loan was interest only loan.

Complaint: Have a mortgage which change servicing rights to Ditech. In the loan docs it states in correctly that the insurance was to be escrowed. In the mean time Ditech failed to pay my taxes on time and due to a city property tax mistake my taxes were over paid by {$2300.00}. I have since changed the escrow and requesting the insurance not be escrowed. The taxes are now being refunded directly to Ditech and I have requested the make a one time payment for the insurance. The previous servicer failed to pay the insurance for 9 months. Now I am requesting the they make a one time payment to my insurance and discontinue future payments, and calc esrow going forward correctly without the insurance. Been since XX/XX/XXXX trying to get them to get someone to correctly get it write in my account 4 call 12 representatives. On top of it I am a 30 year financial services exec with years at XXXX for the XXXX, I well understand this business but the agents and system at Ditech gets on one who understand all aspects of this error. They will now include it in the escrow and will not issue a one time payment without changing the escrow analysis. It 's around around in circles.

Complaint: I was supposedly approved for a loan modification on my mortgage with DITECH. I completed by 3 trail payments by XX/XX/XXXX. Since then, I have been paying the trial amount each month but can not get them to answer questions about the status of my final loan documentation. I can not get my rep to call back with any coherent response, and all I get are letters in the mail pushing back a " resolution '' time by 14 days each time.

Complaint: My client paid off his loan on a mobile home trailer in XX/XX/2017. Ditech Financial, LLC claimed to have mailed the original to the property address, but inadvertently left off the trailer number. Therefore, the title had not been received. Ditech then sent copies, where were useless, since the Department of Motor Vehicles is requiring originals. When he called to request that a duplicate original be sent to his current address, he was informed that the title had been sent the original lien holder, XXXX, located at XXXX, XXXX, LA XXXX. THIS COMPANY IS NO LONGER IN BUSINESS. Subsequent requests have since been made for the lien release and original title to no avail. The Department of Motor Vehicle is requesting the original title. Ditech refuses to send the original title to property on an account that has been paid in full. Every phone call is to a different customer service representative who is rude, impatient and armed with false information. The customer service representatives refuses to let you speak to a supervisor and claim to take notes at the time of the call. When you call back to ask about the status based upon notes taken during the last call. There are no notes in the system.

Complaint: Ditech charged me the wrong amount from XX/XX/XXXX through XX/XX/XXXX. In XX/XX/XXXX they finally reallocated my payments and credited an overdue HAMP incentive. Almost 15 months overdue to be exact. I disputed the error forever including on this board many many times. They reported me late to the credit bureau 3 times even though they charged me the wrong amount. All my mortgage statements had incorrect amounts due. They waived the late fees but failed to update my credit reports even though I have told them repeatedly of the error and even submitted a copy of the letter from them acknowledging this. My credit score has dropped considerably from this. They are intentionally harming me I believe in retaliation.
