Complaint: I have recently received a certified letter from my mortgage lender indicating that I may be foreclosed upon soon. However, for the past 5 years I have been in a Chapter XXXX bankruptcy and all payments have been made through the Trustee, who by the way has been attempting to MAKE the mortgage servicer Ditech refinance my loan due to the high interest rate, however they continued to indicate the application was incomplete and refused to refinance. I have a statement from a month ago indicating that my loan was not only up to date but paid ahead, and I have an email from my loan servicing stating verbatim, that they doubled my escrow account balance when they put the loan on their system and they owe me over {$12000.00} and was supposed to send me a refund, therefore, I asked my attorney to dismiss my bankruptcy, which he did. Not more than a week later, the loan servicer reversed all payments from the account and according to my online access they state I am past due over {$43000.00} and they have recently sent me foreclosure warnings. I have telephoned them over the past few weeks and spoken with representatives over a recorded line at work where all calls are recorded where they have admitted that someone has done something wrong and needs to be corrected, however I just received a certified letter from the lender, Ditech with regarding to possible foreclosure. In addition, in that same week after they reversed all payments they updated my credit report as being past due on my home loan and my score dropped from XXXX to XXXX . In addition, they claim they have advanced {$44000.00} but no one can tell me to whom they paid these funds.

Complaint: Complainant is the only living heir of the deceased borrower on loan secured by her home. Due to a default on payments, a foreclosure case had been filed. On XXXX, Complainant submitted a full loan modification application to XXXX ( " XXXX '' ). On XXXX, she received a trial payment plan offer to begin on XXXX. After three payments, the loan was to be permanently modified. Complainant signed the offer and sent in payments for XXXX and XXXX. On XXXX, she received a phone call that the loan was transferred from XXXX to Ditech. She made the XXXX payment directly to Ditech. Per Ditech 's request, Complainant 's counsel ( XXXX ) repeatedly sent a signed third-party authorization and release to Ditech in order to communicate regarding the loan modification. Ditech repeatedly could not find the authorization and would not communicate with Complainant or XXXX. After difficulties communicating with Ditech, Complainant made her fourth Trial Plan payment ( XXXX payment ) to the attorneys representing Ditech in foreclosure against the property. Complainant made her fifth Trial Plan payment ( XXXX ) directly to Ditech. Communication difficulties with Ditech continued. On XXXX, XXXX received permanent loan modification documents from Ditech by mail. The permanent loan modification was in the name of the Estate of Complainant 's father. Complainant was told that she would need to apply for an assumption once loan was current. The signed permanent loan modification documents were due XXXX. There was no notarization required on the documents. Complainant signed the permanent loan modification documents and returned them by XXXX overnight on XXXX. On XXXX, Ditech informed Complainant 's counsel that they needed her to execute an assumption simultaneously with loan modification because she is not the named borrower. Ditech scheduled a notary to come to counsel 's office on XXXX to notarize the documents. On XXXX Complainant took off from work to come sign the documents with Ditech 's notary. No notary showed up and the Ditech representative that answered when counsel called to check on what happened did not know about a notary and said there was no authorization on file. Eventually, counsel spoke with XXXX at Ditech who apologized for failing to schedule a notary. Counsel asked for the documents to review before signing but was told that Ditech may not be able to provide them ahead of time. Ms. XXXX continued to make plan payments. After hearing nothing further from Ditech regarding scheduling a notary, counsel contacted Ditech several times in XXXX regarding the permanent loan modification documents. On XXXX, XXXX was told that the documents would be mailed. On XXXX, XXXX contacted Ditech. Loan modification documents had not yet been sent. On XXXX, XXXX contacted Ditech. Loan modification documents had not yet been sent. Ditech said they would fax the documents. XXXX received a fax from Ditech on that same day but the documents were incomplete. There were no signature pages. XXXX called Ditech on XXXX XXXX and XXXX asking about the loan modification documents but they were never sent. To date, Complainant has not received the permanent loan modification documents or assumption agreement for signature.

Complaint: Ref : Ditech Financial LLC - Acct XXXX We received billing statements ( Attached ) for XXXX supplemental taxes from The XXXX County Tax Assessor Collector and XXXX County Municipal Utility District in XXXX, 1st Time to Receive these Statements, for our property at XXXX, TX XXXX. After receiving these billing statements, we paid these supplemental taxes promptly. Unfortunately, Ditech Financial ( Ditech ), our mortgage company, also paid these supplemental taxes in XXXX without any communication or contact with us. Now there are overpayments on our accounts with these two taxing authorities. We do not have an escrow agreement or account with Ditech. All of our property tax payments, required insurance coverage/payments, and mortgage payments have been made on time since we purchased this property. After contacting Ditech on XXXX, we were informed that we would need to reimburse these overpayments to Ditech and they were forcing us to maintain an escrow account with Ditech. From our own research, we have determined that one of the overpayments to one of the taxing authorities will be reimbursed to us and therefore we reimbursed Ditech for one of its overpayments for these XXXX supplemental taxes. However, the other taxing authority has stated that Ditech will have to apply for a refund of its XXXX supplemental tax overpayment ( Attached Documentation ). We have submitted the refund payment we received to Ditech along with a letter, attached, explaining the payment and the need for Ditech to apply for the refund of Ditech 's overpayment. In addition, we have explained in the letter that all property tax payments and insurance coverage/payments will be maintained by us with no escrow account. Ditech is forcing us to pay for an unauthorized overpayment they made to a taxing authority and forcing us to pay into an escrow account that we have not agreed. Can you help us stop Ditech from forcing us to make these unauthorized tax and escrow payments?

Complaint: My name is XXXX I had a mortgage thru XXXX contract on a mobile home because of having XXXX illness I was out of work for a couple of months and had fell behind on my house payments and lot rent. When I got back to work I had gotten my lot rent caught up and had called Greentree who bought out XXXX andXXXXXXXX had offered to pay {$500.00} for three weeks and I would have been up to date on my house payments, but they refused the money offer so they broke the contract. And now a company called ditech has taken over the account and is trying to collect the money that is left owed on the trailer which I do not live in cause they would n't accept the the money and me and my wife had to get out. The trailer was sold to another party. I had told ditech what happened and told them to go after Greentree. They will not leave me alone. Account number is XXXX right now I am on social security XXXX and on state XXXX for the insurance I 'm in XXXX. I had my XXXX. And last month I had to have XXXX. I wish for ditech would go after Greentree they broke the contract not me, and I am not paying for something that I do n't have anymore.

Complaint: DiTech continues to make false statements concerning my account. First, they state that the escrow analysis done in XX/XX/XXXX, at the time of my modification, went up just after I finished making my 3 trial payments, when my taxes and insurance premiums actually went down at that time. Second, in XX/XX/XXXX, a complaint was filed and Ditech responded to stating that there was an escrow overage on my account and an overage check was sent to me. Since I never received a check, I filed an additional complaint to find out why they made a false statement. They then responded that they actually did n't send me a check. I still have not received the overage check. Third, DiTech continues to report me late with the credit bureaus when my account HAS NEVER BEEN PAID LATE. When I served my last complaint in XX/XX/XXXX, regarding why none of my account representatives return phone calls even though I left many dozens of messages and called on a daily, hourly basis to XXXX XXXX, x XXXX, XXXX XXXX x XXXX, XXXX x XXXX, XXXX x XXXX, XXXX x XXXX, XXXX x XXXX, XXXX x XXXX, XXXX x XXXX, and XXXX x XXXX. With all of the calls placed to each of these representatives, none of them ever ONCE answered their line. Many of them would have a voicemail that was full and no message could be left. When I finally did speak to my account representative and others, they always promised a phone call back, never mentioning that there was a " cease communication '' on my account. When XXXX XXXX called me for the first time in XX/XX/XXXX ONLY in response to a CFPB complaint, she apologized and said she would get to the bottom of this and get back to me. I advised and she confirmed that the " cease calls '' was removed from my account. Just as I advised XXXX x XXXX to do MANY MONTHS EARLIER. I was only informed in XX/XX/XXXX that my request needed to be in writing, which I faxed within minutes of receiving this information. It seems as though DiTech is using this as just another excuse as to why my account has been mishandled from the beginning. Again, if they are using the " cease calls '' as an excuse not to call me back, why did I receive a call from XXXX XXXX or even XXXX who actually did call back on a couple of occasions to let me know he was still waiting for the research to come back on my account? This behavior is very suspicious. I also forgot to mention that I sent a fax directly to XXXX XXXX, the Paralegal responding to these complaints to discuss the misinformation that he continues to place in his responses. Of course, I did not receive a call back from him either. Again, due tot the fact that I was trying to work out what ever discrepancies may have existed on my account, and the fact that DiTech continues to report misinformation, they must cease from reporting my account late with the credit bureaus.

Complaint: Despite having a mortgage with Ditech Financial for less than 20 % of my home 's value, they took it upon themselves, with no approval from me, to open up an escrow account for my property & school taxes. I have always paid these taxes though sometimes I pay them late and I was late at the moment Ditech decided to establish this unauthorized account on my behalf. I reject that Ditech has the right to open up a XXXX account without my approval. This seems very similar to the highly publicized XXXX incidents.

Complaint: An attorney is trying to collect money deposited with the clerk of the court as compensation for the taking by the town of a small portion of the collateral property under eminent domain. The mortgage was discharged in bankruptcy in 2011 and therefore the bank or its representatives such as this attorney may not legally collect these funds to pay down the debt. The mortgage holder had been previously contacted regarding this issue and advised me that they did not have a department to discuss legal issues with and that they were unable ascertain any course of action in the matter. Now that there is money to be had, they want to step in with their attorney and grab it.

Complaint: XX/XX/XXXX we had scheduled our mortgage payment to be auto deducted on the XXXX of the month. I was nervous and did n't want it to be late so I called in and paid the payment over the phone before the auto-deduction. I asked the girl specifically several times if the auto deduction had been cancelled as I did n't want to have the payment deducted a second time. She swore that it would not be taken out again. Good - all was good to go. But the next day, they DID AUTO DEDUCT THE PAYMENT AGAIN. It overdrew my account. I called up Ditech and they said there was n't much they could do until the payment came back in XXXX or 4 days. I could not have my account be overdrawn for 3 or 4 days so had to make a trip to the bank, get my banker to reverse the auto deduct as he could see that the payment had already been made. He did have the payment reversed, I got my money back, my account was back in the black and all was good - or so I thought until today. I am trying to get my mortgage reworked and in doing so the loan office saw that Ditech had reported us late for XX/XX/XXXX, the same month that all of this happened with Ditech double billing my account. I called Ditech again today. They said that I would have to get the evidence from my bank that the payment had been double billed and then they would " take a look at it and see if they could do anything ''. So not fair! The onus is all on me when they made the mistake AND they are counting me as being late because all they show is the the payment was returned and they are counting that as a late payment which is not true. I do n't think any of this is fair and do n't see why I am the one who has suffered all of the penalties on this mess and they are the ones who screwed it up. I do n't understand how this can be right! I hope that there is something that you can do about it. Also, we are in XXXX County, XXXX where a major natural disaster came through a couple of months ago in the form of terrible, devastating tornadoes. Our home did not suffer a lot of damage - some but not enough - but we own our own business and work here in the same area. The tornado caused a lot of businesses to have to shut down due to damage which has impacted our ability to make money. I called up Ditech again and explained the situation and told that during Hurricane XXXX when our county was declared a disaster area ( as it has been now ) we were given a couple of months reprieve to get things back up and running. Ditech said they could take the late payment for XX/XX/XXXX, the one I was worried about, and spread it over 6 months. That sounded like an okay solution. ( The only other solution they offered took 30 days to even get started! ) I said I thought that would work. Now I have found out that for every month we spread this one payment over - up to 6 months- we will be considered late. So that could be another 6 months of late fees and late payments reported on our credit report. I ca n't believe that this is all they can do when a tornado causes damage - that is an act of God and there is nothing we could do about it! I would like to have a solution given that does not make us look again, like we are just not paying our mortgage. Ditech Financial XXXX!!!!!!!!!

Complaint: My husband and I own a XXXX XXXX XXXX property which is encumbered Ditech and, despite dozens of contacts with Ditech, we have been unable to get them to release the property. Ditech 's failure to respond may harm our ability to honor a contract on our home, which is currently marketed for sale. After 15 phone conversations, emails with 7 different departments and faxes to three different fax numbers, Ditech has failed to respond to our request. Our home and our neighbors ' home were misidentified on the property assessor requiring modifications of the deeds of trust and legal descriptions of our XXXX properties. The other mortgage holder, the two owners and the title company have prepared and signed each and every required document yet Ditech continues to encumber our property. We are unable to honor a contract on our home until Ditech responds to one of the dozens of phone messages, e-mails or faxes we have sent over the past two months.

Complaint: My husband and I are trying to pay off our mortgage. We made a payment XXXX in XX/XX/XXXX to go to principal only. They only applied XXXX to principal and the rest on insurance which makes no sense because our insurance is through the payment and is up to date. I called and the representative said that was a mistake and it was fixed and would show up on the account in five days. So when I called back in five days it was not fixed. She told us that the request was put in but never completed and she would put in another request and would take another five days! We have been trying to pay this off since XX/XX/2016! We have gotten the run around for months and we have been lied to over and over. We have had this loan for over twenty years so we sent in a offer to pay the loan to see if they would take less. We were told they approved this offer then they ordered XXXX appraisals of the property. After some digging we found out that they only do appraisals in a foreclosure. We called back only to find out that not only was the pay off request not sent in also the lady we talked to does n't work there any more. We are at our wits end and need help. Thank you

Complaint: Ditech has denied that it knows who I am in response to the last complaint, when my name and my address ( of the home which has the mortgage they own ) is clearly stated on the complaint. Characteristically, it demands the account number just to be difficult. For the company 's information ( it does NOT need me to tell it this ), the account number is : XXXX. Not only is it charging me late fees of {$120.00} regardless of the fact that I paid on the due date ( and late fees are not stated to be {$120.00} ), but I paid up the account in full to include all of their fraudulent charges last month, and this statement has not deducted ANY of that, and STILL shows me as owing the same amount as before. I believe that there is a serious problem with their systems and this is suspicious. They need to be audited by people who are very familiar with technology and can examine their code. If you need someone, I can go with the inspectors. I develop software for a living. I 'd like to remind the person reviewing this complaint that immediately before changing its name, Ditech used to be named Greentree. Greentree was fined by the government for a total of {$63.00} XXXX for unlawful / fraudulent charges and failing to maintain programs. It seems that Ditech has continued its business practices, attempting to use the name change to deflect suspicion. This will not work long term.
