Complaint: I am requesting debt validation for a {$41000.00} charge off that is currently reported by Ditech to my credit report ( XXXX, XXXX and XXXX ) and associated with my property XXXX XXXX XXXX XXXX, XXXX XXXX, CO XXXX. I am also requesting that Ditech immediately discontinue attempts to update my credit report with the incorrect address XXXX XXXX XXXX, XXXX XXXX, CO XXXX and remove my ex-wife, XXXX XXXX, as a joint owner of this debt ( account XXXX ). Ditech is incorrectly reporting my ex-wife, XXXX XXXX, as a joint owner on this debt which is causing her information to erroneously appear on my XXXX/XXXX/XXXX credit reports. I have disputed this address numerous times with Ditech directly due to an identity theft case that has been reported and filed with the XXXX of XXXX, CA police ( attached ). I have also disputed this with XXXX, XXXX and XXXX but have failed to prevent Ditech from continuing to report the XXXX address, causing mail with personally identifying information ( Social Security Number ) to be directed to this address in error.
Ditech has stated that they are the current owner of the {$41000.00} debt for account XXXX, purchased from XXXX XXXX XXXX XXXX/XXXX/XXXX. XXXX XXXX XXXX is the former lien holder/mortgage servicer of the 1st and 2nd mortgage to my property XXXX XXXX XXXX Place, XXXX XXXX, CO XXXX and is the only lien holder on record for this property. XXXX XXXX XXXX is a defunct unit of XXXX that forced many subprime loans to go into default, including the defaulted 2nd mortgage in question that has been purchased and reported to the ( 3 ) Credit Reporting Bureaus by Ditech ( formerly Green Tree ). XXXX successfully removed my ex-wife XXXX XXXX from her financial and legal obligation to repay either loan but failed to provide Ditech any documentation of the removal following the sale to Ditech on XXXX/XXXX/XXXX. XXXX XXXX XXXX has never reported the 2nd mortgage to my credit report nor my ex-wife 's credit report until the sale of the defaulted 2nd mortgage to Ditech on XXXX/XXXX/XXXX. Ditech began reporting to the credit bureaus against XXXX and I both in XXXX.
XXXX XXXX is not on the title and 1st mortgage of XXXX XXXX XXXX XXXX. In fact, we have been divorced since XXXX and have not lived in the property together since XXXX. The reason the home went into default was because my ex-wife 's parents had a lease-to-own contract for XXXX XXXX XXXX XXXX and failed to pay the 2nd mortgage with XXXX per agreement. The contracted ended and I moved back into the property in XXXX XXXX. XXXX refused to let me do a loan modification and hardship to cure the deficiency on the 2nd mortgage as they stated I needed to be in default prior to approval of the loan modification. My last payment with XXXX was XXXX XXXX when I applied for the loan modification. I called to find out my status, which was declined, but never received anything in writing stating my ability to appeal the rejection within 30 days. I contacted XXXX numerous times to have the letters resent as they were never received as XXXX confirmed over the phone. The loan was forced into default.I never received any letters of acceleration, missed payment, or default from XXXX. I never received anything in the mail regarding the sale of my 2nd mortgage to Ditech until Ditech sent its first notice in XXXX to a MA address I was renting at.
XXXX 's mortgage center in XXXX, FL was contacted on XXXX XXXX and XXXX XXXX XXXX regarding the loan serviced by Ditech. On XXXX XXXX, an agent for XXXX stated that notification letters regarding the rejected loan modification application, default and accelerated payment due to the default were mailed to XXXX XXXX XXXX XXXX. The agent proceeded to say that I was given " plenty of opportunity to work with XXXX on curing the deficiency '' because I had been granted a loan modification which allowed me to do so. This is false because a loan modification would require that I receive the necessary tax documents ( 1099 or 1098 form ) to file with the IRS for the XXXX tax year. On XXXX XXXX, the next agent I spoke with at XXXX regarding the loan could not see the loan modification documents or any documents related to the 2nd mortgage serviced by Ditech. The agent stated that Ditech is the owner of the defaulted 2nd mortgage purchased on XXXX/XXXX/XXXX, and that the letters I never received from XXXX regarding the default, declined loan modification, and acceleration were sent back to XXXX " Return to sender : not deliverable '' despite the address being correct ( XXXX XXXX XXXX XXXX, XXXX XXXX, Colorado XXXX ). The agent stated that Ditech purchased the loan and would have all the documents necessary to correct the credit reporting that Ditech is providing to XXXX/XXXX/XXXX against my credit report as well as my ex-wifes, XXXX XXXX. She recommended I follow up with Ditech as they would have all the documents to make my dispute.
XXXXs negligence has caused irreversible damage to my credit report in their failure to provide Ditech with the appropriate documentation necessary for accurate credit reporting. As of XXXX XXXX, Ditech stated the only documentation they possess regarding XXXX is a loan application with my ex-wife XXXX XXXX name on it. A loan application is not enough to prove valid ownership of a loan. Ditech is unable to provide me with the documentation that would support XXXXs claims and provide me a resolution to correct the credit reporting against myself and my ex-wife XXXX XXXX.
Ditechs inability to validate the debt due to lack of documentation destroys the property value of my home as XXXX can not remove a lien on a property that XXXX does not own. I can not sell or refinance my property as this issue clouds the clear title I would have to guarantee a new mortgagor or buyer of the property. Mail is being incorrectly forwarded to an address containing my social security number, which further compromises my financial integrity as a victim of identity theft.
I demand that Ditech remove the debt from mine and XXXX XXXX credit reports entirely or remove XXXX so that my identity is no longer compromised by reporting the incorrect address.

Complaint: My mortgage servicer, Ditech has failed to send my mortgage statements to me for over a year. Ditech has been sending my statements and all other correspondence to my attorney despite several requests by bot me and my attorney. On or about XXXX XXXX, 2017, I sent Ditech a Notice of Error concerning this issue, but they have not corrected it. My attorney never told Ditech to send the statements to her and the previous foreclosure action, which was settled by way of a loan modification, has been discontinued, so there is absolutely no reason for Ditech to continue to send my correspondence to the attorney and not to me.

Complaint: This is a new complaint but it follows my last one which was : XXXX. After my last complaint that the bank was foreclosing because I did not sign the appropriate papers. I am pleading with you for help. The following are my issues : 1. DITCH Foreclosed again!
2. Although the bank did respond to you, I did not get anything from the bank until after the foreclosure on Monday, XX/XX/XXXX.
3. The Atty General 's office of Missouri wrote a letter to the bank and asked the bank to postpone the foreclosure so I can reapply for loan modification.
4. I reapplied and I also set in the original paperwork.
5.The bank sent an e- mail to the atty general 's office on XX/XX/XXXX that they are requesting a postponement and will get back to him.
6. I called the bank onXX/XX/XXXX and asked if they got everything i sent in as far as the original papers and the loan modification papers.
7. The bank told me on XX/XX/XXXX that they got my papers and everything is ok and I am being put back on the same mortgage payments as before. I asked them if I will get that in writing and they said " sure '' in the near future.
8. I am in Chapter XXXX and my attorney took the house out of the plan while I was in loam modification. I was paying my mortgage every month without any problem. My attorney told me that if I am having a problem with the bank and the foreclosure he can put my house back on and I will be protected from foreclosure.
9. He did n't do it bec the atty general 's office told me that everything seemed like ok and it looks like its being postponed and if they hear anything they 'll let me know.
10. And the bank told me I was ok and no foreclosure. SO my atty did not file to put the house in my bankruptcy which would have protected me if I knew they made a decision.
11. I also was n't able to go to the auction which i understood i could have bec i did n't know it was still on.
12. The Bank did n't tell me or the atty general 's office what they decided until after they sold my house and THAT IS NOT RIGHT! I could have taken care of things. AND the bank told me they are not doing it.

Complaint: Under the CFPBs new rules, dual-tracking when the servicer moves forward with foreclosure while simultaneously working with the borrower to avoid foreclosure it is restricted. Servicers can not start a foreclosure proceeding if a borrower has already submitted a complete application for a loan modification or other alternative to foreclosure, and that application is still pending review. A loan Modification packet was submitted on behalf of the client on XXXX/XXXX/XXXX to your office. It was confirmed the documents have been recieved with your office. The borrower complied with all request for documents. Your office informed our office on XXXX XXXX that additional documents were needed and the file is in review. Yet there is a active sale date. As stated above you are required to postpone or cancel the sale date while the file is in review.

Complaint: I did a modification and my mortgage company said they assessed the home for XXXX and when I received my XXXX county tax assessor for my home my home was valued at XXXX and that is a big difference for what my mortgage company stated. I also reported that I had a drop in income and medical problems in which is causing financial distress and felt nothing was done about that problem. In addition, I felt that my loan mortgagor stated fraudulent reports about the value of my home to keep my mortgage payments up.

Complaint: XXXX does not report two of my mortgages-both of which are open and current. I have filed 3 disputes trying to correct the problem and get the same results each time.
My most recent disputes were filedXX/XX/XXXX ( one for each mortgage company ). I received a response from XXXXXX/XX/XXXXstating that they resolved one issue and that the account is closed. And the other mortgage they can not find so it is not reporting.
I 've contacted both mortgages who say they are reporting to XXXX each month.
I would like the history corrected for both mortgages.

Complaint: Please help me. I have tried for over 6 months to get a modification with Ditech and was finally told they had everything they needed two days later I got a denial letter stating they were n't approving my modification because my hardship was n't temporary. Sir I had a hardship last year that is now resolved and i have the ability to maintain this mortgage. I have the past due funds for ditech and they agreed few months back to take them but started foreclosure and now there are attorney fees. I have had to hire an attorney now myself and this money could be applied to my mortgage, I have a very small past due amount at this time with ditech and I have appealed the denial letter in a timely fashion. I have done everything asked and I still need help getting this issues resolved before mediation in XX/XX/XXXX.

Complaint: Ditech financial continues to scam their customers. Recently, they raised my late fees from XXXX dollarsa few months ago to $ XXXX the last few months and now it is $ XXXX I just found out on their website. They have never notified me of the increasing late fees. They increase the late fees at will, in order to make you appear to be behind on a payment or not have paid a " full payment '' so that they can put the payment in unapplied funds. How high will they be allowed to randomly increase late fees? It used to be that a late fee was part of the contract I signed with my mortgage company and enver increased. With Ditech though, they will increase the late fee significantly whenever they feel like it. They have harassed me with things of this nature ever since they took over my loan from XXXX XXXX XXXX. They are harassing me now because I filed bankruptcy and they want me to do a modification. I will not do a modification. I gave them one chance for that and they played games by refusing to send me a form I needed to fill out. They also can know that I will not do a modification that is more than 30 years and will not lower my interest rate. They are wasting paper. I do not believe they should be able to increase a late fee randomly like that without notifying me in writing. Nor should they be able to increase the late fee to make a payment amount incorrect. Also, they purposely scam people on their statements being inaccurate. Currently, they are unlawfully holding $ XXXX in unapplied funds because I was unaware my late fee went from $ XXXX to $ XXXX. Still, the $ XXXX is more than the $ XXXX and should be released. They constantly rip me off on my mortgage interest deduction by holding finds in unapplied funds, unlawfully. Please hold them accountable for violating the law. Also, they should not be allowed to raise late fees on a monthly basis. This is XXXX and I hope Ditech company XXXX and XXXX XXXX XXXX XXXX XXXX where they belong. XXXX, Cheats, frauds. Also, I am supposed to speak with reps in the bankruptcy department. They are never there, nor do they ever return phone calls. I do not believe these reps are actual people. Many times their voice mailboxes do not work. I have not once ever received a call back from these people that I am REQUIRED to talk to. I highly suggest they get their XXXX in their office and on the phone if they are not fake identities.

Complaint: XX/XX/XXXX XXXX XXXX XXXX c/o XXXX XXXX ( P.O.A ) XXXX XXXX XXXX XXXX, Ga XXXX The purpose of this letter is to file a complaint against Ditech LLC ( servicer ) & XXXX XXXX ( investor ).
Around XXXX or XX/XX/XXXX, XXXX XXXX had contacted Ditech ( servicer ) for some assistance on the mortgage payments. XXXX XXXX advised the representative the mortgage payments are almost amount received for her SSI. Thus, XXXX XXXX is experiencing financial hardship due increase of expenses around the house. The representative confirmed that Ditech can aid with this request, but XXXX XXXX is required answer a few questions to see if qualified to receive some forms from XXXX XXXX to aid with her request of a manageable mortgage payment.
I, XXXX XXXX, am XXXX XXXX XXXX, and I assisted my mother with answering those questions & filling out the forms ; however, XXXX XXXX or I was not advised the main requirement required to be approve for assistance from Ditech & XXXX XXXX. XXXX XXXX & I was never advised by all the representatives & supervisors from Ditech, letters from Ditech, missing documents from Ditech & XXXX w/ XXXX XXXX XXXX Ditchs response from the file compliant, XXXX 15 days investigating against Ditech , emails from XXXX , and phone calls with XXXX that we were advised that XXXX XXXX mortgage payments must be 60 to 90 days delinquent before providing any assistance.
Therefore, our thought process is why send the forms for assistance twice, why tell us what documents were missing, why send all the required documents & forms for assistance, and why do a 15 days investigation if Ditech & XXXX w/ XXXX XXXX both knew XXXX XXXX mortgage payments were not delinquent & the account would not be approved because of this reason.
When XXXX XXXX called Ditech onXX/XX/XXXX to see why, and a representative stated it was XXXX XXXX who made the decision & that maybe my mother should sell her home if she could not afford her home. However, XXXX w/ XXXX XXXX stated it was Ditech who made the decision, and it was nothing XXXX XXXX could do as an investor. Then XXXX XXXX refused to provide XXXX XXXX with a supervisor, that all supervisors have a set schedule, the supervisors do not wait after XXXX to speak with consumers, and stated did advised XXXX XXXX of the 60 90 days delinquent.
Thus, I reviewed all letters, documents, & emails very careful before writing this letter, and it was nothing said about the 60 90 days delinquent requirements. Now, XXXX XXXX mortgage payments are going to be {$860.00} w/ a SSI income of {$800.00}. All the letters & documents stated some kind of assistance would be provided ; however, we only got a rejected letter.

Complaint: I was approved for a hardest hit program in ga Georgia underwater homes my award is XXXX this check was sent to ditech financial in XX/XX/XXXX to be apllied to my principal, it was applied, I am continuing to send in my regular monthly payments which are not being applied and going into a suspense account. their explanation is that the system is not updating due to the large amt from the program, my check from XX/XX/XXXX XX/XX/XXXX and XX/XX/XXXX has not been applied, even though it shows on my statement that I am not late I am getting collection letters and notices on my front door from them. when I call they say ignore the notices.no one calls me, I am calling every other day for the last month when the collection letters start coming. I am afraid with these people not knowing how to handle these programs that they have accepted and now not knowing how to process my payments I am going to go into foreclosure even though they are saying no I want. does their collection people know this, they cant even transfer you to them or they explain what is going on and not to harass the customer. this is another night mare from XXXX, I am an over age senior and think they may try and take advantage. if someone would communicate I would feel a little better. we are resolving the problem does not help me.. the amunt for the 3 months is XXXX now, they are saying just continue to send your regular amt of XXXX please help me find out why my checks are not posted to the acct and going in to suspense.
