Complaint: Dear Sir, Ditech is my 2nd mortgage company. I was XXXX for 8 months. I applied for hardship loan modification, sent in all the paperwork. When I started working in XXXX I called to let them know. they requested paperwork for modification. They kept losing my paperwork and assigning different relationship managers. I followed up constantly. This went on for several months. Today, I called and they said my modification was denied because Im working and make enough money to support my monthly payment. they now want me to pay {$7000.00}.

Complaint: My spouse and I have had to have you intervene on several occasions concerning our home mortgage in the hands of Ditech Financial, LLC, and their incorrect reports of us not paying our mortgage payments, charging us copious late fees, threatening foreclosure on our home, reporting this incorrect information to the credit bureaus causing damage to our credit, etc. This company continues to remove all of the incorrect information when you get involved, only to turn around and do the exact same thing within 3-4 months. They are now claiming that we 're 3 months in arrears, claiming we did n't pay in XXXX of XXXX, XXXX of XXXX and XXXX of XXXX, which we have cashed checks from the bank to prove otherwise. And the continued late fees they continue to add onto our account is insane when you consider this is their accounting error. Not only have we made every single payment ( as our complaints before ), but we 've paid every single payment early. At this point, they are also trying to get more money from us by sending us letters regarding our escrow balance being too low, which is incorrect as well. We 've had this problem with Ditech going back to XXXX of XXXX, where they applied our XXXX ( XX/XX/XXXX) and XXXX ( XX/XX/XXXX) payments both to the month of XXXX ( XX/XX/XXXX ), as they admitted on many occasions. This became an issue when Greentree sold/merged with Ditech and we are simply sick to our stomachs having to continually deal with their fraudulent reporting/record keeping. This has caused medical conditions to flare up, costing us more and more money as well. We believe Ditech needs to be shut down, we 've read the countless complaints others have posted, including losing their homes to this company from their fraudulent practices. Enough is enough and something NEEDS to be done. We can not even refinance through another lender because of these problems!

Complaint: In febuary I entered into a loan modification period with Ditech mortgage company. The first payment was due XXXX/XXXX/XXXX. We made the first payment on XXXX/XXXX/XXXX for the XXXX XXXX due date. The second payment on XXXX for the XXXX payment, the third payment on XXXX for the XXXX payment, XXXX payment on XXXX for XXXX payment, XXXX payment on XXXX for XXXX payment. Soon after we made the XXXX payment, ditech sent us a letter stating our modification was finalized and we were due on XXXX XXXX. We already paid XXXX 's payment on XXXX. They did not apply our payment made on XXXX for XXXX. They charged us twice for XXXX month. We paid XXXX on XXXX and they also charged us again for XXXX after the finalizing of he modification and did n't consider the payment we had just made. It seems it had just gotten lost in the process and no one looked closely enough at our account to adjust for the payment we made. We continued to make a payment on XXXX payable for XXXX, but they are saying we are a month behind now and charging us late fees. I have called 3 times and have been argued with and finally after the XXXX time, the person named XXXX, stated that I was right and confirmed with the supervisor that I was correct. His explanation was that no one had looked closely at our account and it definitely needed to be fixed. They requested an audit the end of XXXX. I am continuing to get late notices and it does n't appear to be resolved. Can we please have help on getting this resolved? It is extremely urgent this is cleared up, because they have taken {$1200.00} of our money and will not apply it correctly or return it to us. I 've attached a photo of the payments made from our bank account. A copy of the trial modification letter with schedule of payments to be made, and a copy of the finalized modification page showing payment amount due on XXXX for {$1200.00}. We already made that payment on XXXX due on XXXX for XXXX.

Problem with a credit reporting company's investigation into an existing problem

Complaint: My name is : XXXX XXXX XXXX XXXX, XXXX XX/XX/XXXX XXXX file number : XXXX Ditech acct number : XXXX SS XXXX XXXX I became aware of a gross error on my credit report and am shocked that after numerous attempts to correct it, little effort has been made by XXXX, who has only filed an electronic dispute, or Ditech, who admits to performing no researching before simply sending it back as verified. I became aware of this error through my membership with XXXX XXXX 's Credit monitoring program, which costs XXXX per month, which notifies me of negative information on report and promises help in resolving it. I sent substantial documentation which should be enough to delete this error. As an XXXX of 33 years, I ca n't believe they are ignoring this information. I tell you that not to flout my credentials but to stress that they routinely just put in for an electronic verification when the circumstances do n't call for it. Ditech did nothing to research the accuracy of their information. Even when I produced Court Orders ( attached ), they still did not change report and did not explain why they did not change it. Because of this, I am seriously concerned about the manner in which they are investigating legitimate consumer disputes. Please review my documents which prove that this should not remain on the record. I appreciate your assistance. I am shocked that a major credit bureau did little to help a paying customer ( although that should make no difference ) and that both of these entities are getting away with ruining consumers lives. Please review the iron clad info I have in this case. I have run it by several consumer credit attorneys at XXXX as well and have been told that they agree with my assessment. Also, the amount of time derogatory info remains on a report should not vary depending on who that consumer is. The following errors occurred, which I would like corrected : ( 1 ) DITECH was reporting the status of my account as DEROGATORY. I have no late payments, according to their own report. ( 2 ) Ditech reported that I had a DISMISSED BANKRUPTCY, and is using the closed date of the account ( I just refinanced with another company ) as the date when the 7 years will begin wherein the negative info will come off report ( report states " Estimated month that this item will be removed : XX/XX/XXXX ''. ) In fact, I had a DISCHARGED Bankruptcy, which is, as you know, far different than a DISMISSED Bankruptcy, which is indeed a derogatory status. Here are the FACTS and attending documents which support my claim that the information is inaccurate and being willfully misreported. Furthermore, XXXX, from XXXX looked up the length of time a Chapter XXXX discharged Bankruptcy remains on a report, and verified that it is 7 years from the date the consumer first filed for BK. I sent XXXX 1 ) the proof of initial Ch XXXX filing date ( XX/XX/XXXX ) ; 2 ) proof that my Ch XXXX bankruptcy was discharged & not dismissed ( Court Order ). Apparently, despite my best attempts, XXXX did not understand the difference between a Ch XXXX dismissed BK versus a discharged BK. Furthermore, XXXX did agree that NOTHING about the Ch XXXX should be reported seven years after the case is filed. Since my case was filed on XX/XX/XXXX, any reference to a BANKRUPTCY should not be permitted. In this case, the creditor put it in the remarks section where such info is often overlooked. XXXX told me that the remarks section is only used for the creditors private use. Clearly, since it is part of the public credit report, this is inaccurate. XXXX asked for this info to be verified electronically several times. This is not the type of info that can be verified electronically, as it involves remarks sections, etc. Ditech came back with " INFO REMAINS ''. There was no attempt on either DITECH or XXXX 'S PART to insure that the info was properly reviewed and accurate. This caused me higher interest rates, denied loans, and emotional distress. I find it odd that this derogatory info only appeared when I closed the account. Prior to that it was all flawless and no reference to Bankruptcy or dismissed BK whatsoever. It only appeared when we parted ways. I can give you more FACTS and US Attorney 's names to prove that there was a great deal of bad blood. I also wish to point out that for most of this loan they were not the servicer, and were In essence, my account was disputed several times with XXXX and they allowed the inaccurate info to stay. I have, on several prior occasions, faxed them proof that ( 1 ) my Ch XXXX BK was begun on XX/XX/XXXX, which should cause all references to be deleted on XX/XX/XXXX. XXXX from XXXX should verify that he looked it up to verify length of time. I received a DECISION from XXXX dated XX/XX/XXXX which stated that they had concluded their report and that the DISMISSED BANKRUPTCY WAS TO STAY. It also stated it would be removed on XX/XX/XXXX -- fourteen years since I filed Ch XXXX- two times the normal time XXXX allows is their policy and procedure manual. At this point I need your help or will be forced to file for intentional infliction of emotional distress and a bevy of counts which accompany willful misreporting of a credit report. Even Ch XXXX Bankruptcy 's, in which the debtor does not repay, only remain on report for 10 years. Finally, when the information was deleted on the credit report for a day or two, the scores themselves would not change. I am sending a report with no derogatory info re : Ditech but the scores show the underlying reasons and deduct the underlying points. I am asking that this manner of reporting info not on credit report be stopped. Thank you for your time and consideration.

Complaint: I began a modification 2016. After 6 months and no communication I found that not all documents sent were received. The modification was denied. I then reapplied and it was cancelled AGAIN stating not all documents were received. I have receipts that show all items were faxed and received. After a year of dealing with the modification I was told that I did not make enough money and due to my debt to income ratio the modification was denied. I re-submitted my most recent modification as I was now working full time and could more than qualify me. During this period I was told that my house is in foreclosure and a date has been set. This is a violation of my rights and I can actually sue as a a modification was in process and a foreclosure was initiated. I was then told that my modification was denied because a payment could not be established lower than the previous payment. I informed them that I could accept the same payment or higher now that I am working full time. They told me that that was not in the guidelines why they do modifications. I told them you would be helping me by refinancing the amount that is past due and that would help me. Nope, bring the loan current or foreclosure. I can not not believe the poor service I have received. I have a new agent for this account on a monthly basis. I receive no communication during the modification process. I believe that at this point they just want the foreclosure. The modification was just lip service. I counted on that modification to help me when I fell behind because of part time employment.I obtained full time and yet that has no bearing. I live with my two children and we are soon to be homeless. I am not a person that does n't pay their bills. I have a XXXX and have always worked but fell on hard times. Their greeting on their phone messages states they are there for the victims of Hurricane Harvey ... ..what about the current customers that have fallen on bad times? I would n't wish these sleepless nights on anyone!!!

Complaint: InXX/XX/XXXX my former husband and I contracted with XXXX XXXX to install an inground pool. For which we secured a loan in the amount of {$15000.00} plus through XXXX XXXX which is now Ditech. XX/XX/XXXX we increased the amount of the loan to {$18000.00} plus so we could include a fence. Instead doing a modification on the loan they recorded a second deed of trust without releasing the first. In XXXX when the loan was satisfied they issued a certificate of satisfaction and referenced the loan number and account number of the 2nd deed of trust but referenced the deed book and page number of the original deed of trust. I am trying to refinance my home and my title company XXXX XXXX found these 2 unreleased deeds of trust in a title search. I have been calling Ditech daily and have emailed since XX/XX/XXXX to try to clear this up without any success. Customer service is very rude and the lien release dept has no phone and will not respond to emails. I am not able to close on my refi and am in danger of having my rate lock expire. My title company XXXX XXXX has emailed and faxed all the information over to them to explain what is wrong and what needs to be done to correct this but Ditech still can not understand and to my knowledge has not done anything to rectify this problem. We requested a letter from customer service referencing both account number that these accounts have been paid off and they have intent to release but after a few attempts and still not receiving what we need I feel these deeds of trusts will never be released.

Complaint: My home burned on XXXX XXXX XXXX. I finally got the insurance check and over-nighted it to DiTech Claims Dept., XXXXXXXX XXXX XXXX XXXXXXXX, XXXX XXXX, SD XXXX ; on XXXX XXXX XXXX. DiTech received the check and marked my loan paid off on XXXX XXXX XXXX. DiTech issued me a check for the overpayment of ( {$62000.00} ) on XXXX XXXX XXXX and I received it on XXXX XXXX XXXX. However, the check had been issued with my XXXX husbands ' name - and - mine on it, making the check worthless. I called DiTech and explained the problem with the check to them. I was advised to over-night the check back to them and given the address. I was told that it only takes 7 - 10 days to reissue a check. I sent the check back on XXXX XXXX XXXX. I received the titles to my burned double wide in the mail on approx. XXXX XXXX XXXX, since DiTech had taken the money and paid off my mortgage. I called Customer Service ( XXXX ), on XXXX XXXX XXXX, spoke with XXXX. I was told that the check was received and forwarded to Payoff on XXXX XXXX XXXX. This time I was told that the check would be reissued in 10 business days. XXXX XXXX XXXX XXXX, I called again and spoke with XXXX. I was told that the claims and payoff departments were arguing over who had to reissue the check. I was told to call back and speak to the claims dept. I did, and spoke with XXXX. After some checking, I was told again that I should have the check in 7-10 days. On XXXX XXXX XXXX, I called again and spoke with XXXX, then transferred to XXXX ( XXXX ) in claims. XXXX said that she was checking with her mgr. and would call me back with more details. * She never called back. * On XXXX XXXX XXXX, I called again and spoke with XXXX in claims and was told that they had nothing about it and to call customer service. I did and spoke with XXXX. She got an attitude with me and said that there was no check. I have been drug around for two months. DiTech has had a copy of my XXXX husbands ' XXXX certificate since he XXXX four years ago. Our titles said - or - NOT - and-. All they had to do was reissue the check with his name then - or- my name. My granddaughter and I have been drug around enough.This has caused me an enormous amount of stress. This company is intentionally dragging this out. PLEASE Help.

Complaint: Former Complaint XXXX - DITECH FINANCIAL LLC After several months, Ditech apparently corrected their inaccuracy of the above complaint ( XXXX ). I visited the company website on XXXX XXXX, XXXX to review the changes and adjustments after they acknowledge their mistakes, which triggered this ordeal. I found that the past due payments were cleared and the payment amount is up to date. Notwithstanding for my surprise, I realized that Ditech generosity was shallow because what they did, after admitting their mistakes, pass all fee charges and escrow errors to my principal amount, which increased from {$110000.00} on XXXX XXXX, XXXX to {$110000.00} on XXXX XXXX, XXXX. Meaning that they didnt solve the problem, they just passed the burden to my principal account, at my cost. These are their last sentences from their letter on XXXX XXXX, XXXX, which I uploaded : Your concerns regarding your loan account have been escalated to upper management. The payments made to the loan account will be reallocated and the escrow account will be corrected. Any late fees will be waived and any negative information that has reported to the Credit Bureau Reporting agencies will be updated. Not sure this action was fulfilled??? Please allow additional time for corrections to reflect on the loan account. I did and I found the above surprise!!! Ditech sincerely apologizes for any inconvenience this has caused. Is not an inconvenienced because they passed the fees and escrow issues to my principal account. Apologies based on my expense???????? Seriously?????? Best regards

Complaint: Please refer to my original complaint regarding Ditech : complaint XXXX ( this should have never been closed as it has yet to be resolved ). I have yet to receive an explanation as to how they received a copy of an auto loan agreement I had with XXXX. I have yet to receive their business license number to practice in the state of California. I have yet to receive a copy of the notice they have provided to all credit bureaus indicating late payments are to be reversed. Since my complaint indicated above, Ditech has provided a notice of servicing transfer dated XXXX XXXX, XXXX to be effective XXXX XXXX, XXXX. I have never..ever.received such a short notice ( please see attached ).
