Complaint: On XXXX XXXX my home was a total loss due to fire ditech ( green tree ) has continually harassed me with foreclose notices, giving me wrong payoff amounts, charging me wrong inflated amounts, now they are holding my overage money for 30 days so they can collect interest on it form there banks my family has no where to live and no food nothing!!! These people are Complete CROOKS!!! They need to be stopped they have been sued before they need to be shut down NOW!! Please help they are stealing from me left and right please stop them if there are any class actions against them please let me know, each person that works for them are JUST as guilty and need to be held accountable.

Complaint: Ditech lied in their response to my last complaint. There should be no late fees from XXXX as all past due amounts through XXXX/XXXX/XXXX were paid on XXXX/XXXX/XXXX. They were paid the ENTIRE amount they claimed was owed. I have recordings to prove they are lying. They need to try again because I can prove they lied in response to you.

Complaint: When i tried to set up a payment arrangement they would tell me I do n't have to pay cause I am not obligated I was like I am living in the house what do you mean then they explain its not a requirement I am still trying to work things out and the reps are not assisting in anyway I asked them to assist with putting the past due on the back of the loan and as of today 's date no one has assisted me.

Complaint: As noted in a previous complaint, the company was dual-tracking during the loan modification process. First application was denied and the appeal was denied but they referred the account to foreclosure during the process before decisions were made. They denied this of course, even though the account was referred to foreclosure after the appeal was submitted but before a decision was made on the appeal. The new issue is that the company encouraged re-applying for assistance, so we submitted a new application. They contacted us that they needed updated pay stubs.These were submitted on XXXX XXXX, well before their stated deadline they gave to " preserve our protections. '' As of XXXX XXXX, we have not received any further information from the company as to the status of the second application. We have left messages with our account representative numerous times asking for an update, but we have not received a response. It is beyond the deadline for them to have given us a decision but we have not received any information from them. We are assuming they have proceeded with the foreclosure process despite not following the proper procedures.

Complaint: I had a mortgage with Ditech and refinanced with another lender in XXXX. I am due a refund from Ditech for my escrow account and have yet to receive my refund. Ditech said they issued a check on XXXX and when I called at the end of XXXX I was told they could not report it lost until 30 days. I called on XXXX and they supposedly reported it lost and were issuing me a new check. I called on XXXX and they said they would transfer the money directly to my checking account with in XXXX business days. It is now XXXX and I still do not have my refund.

Complaint: XXXX/XXXX/XXXX Re : Ditech Financial - Failure To Pay Property Taxes To whom it may concern, I was notified by Ditech that my loan payment was changing due to an escrow surplus of {$6800.00} from my mortgage statement date of XXXX/XXXX/XXXX. Ditech listed my loan as tax exempt ; my property is not exempt from taxes.
I then started calling Ditech regularly beginning XXXX/XXXX/XXXX to resolve the discrepancy between the exemption status and my loan payment. It was at this time that I researched my loan parcel through the county, only to uncover that Ditech had n't paid the first installment of my taxes due in the amount of {$3100.00}, there was a penalty amount of {$140.00} on top of the amount due and the second installment was due in the amount of {$3100.00}. I 'm also in the process of refinancing this loan to a more affordable monthly payment with a new lender, and in order to close this refinance the tax bill had to be paid.
I spoke to XXXX on XXXX/XXXX/XXXX who said the county said I was tax exempt, but I explained to her that the documents Ditech received that said I was exempt from taxes were read wrong. The year prior, the XXXX asked for 136 sq ft of my property, to widen the road in front of my house. The little bit of land XXXX less than 3 ft ) was tax exempt, NOT my whole house.
I spoke to XXXX at the county assessor 's office to help clarify the issue, he said Ditech was provided the appropriate documents to pay the taxes due, that they clearly explained the parcel number change and that only a small portion of the parcel is tax exempt ( the 3 ft in front of the house ). The county provided the updated parcel number to Ditech along with the documents necessary which show the taxes due.
I then spent the next month and a half on the phone for hours on end to help Ditech pay the unpaid tax bill with phone calls on XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX ... hours on top of hours to rectify the escrow account, pay the taxes and correct my loan. I have spoken to XXXX XXXX a XXXX in the XXXX, TX XXXX XXXX ), XXXX XXXX a XXXX too XXXX, XXXX XXXX XXXX also a XXXX in the XXXX XXXX ). I have had several escrow account reviews, all of which are incorrect, with the initial review showing a surplus to now a shortage in epic proportions.
During the course of my phone calls to rectify the unpaid tax bill, I requested the surplus check in the amount of {$6800.00} to be returned to me on XXXX/XXXX/XXXX so that I could pay the unpaid tax bill myself. I received the check on XXXX/XXXX/XXXX and paid the tax bill on XXXX/XXXX/XXXX in the amount of {$6300.00}. Proof of payment is attached. My escrow account at the time my surplus check was received had a balance of {$670.00} XXXX this was my money leftover after the funds were distributed to me XXXX.
On XXXX/XXXX/XXXX - Ditech then advanced my escrow account {$5700.00}, paid my taxes a SECOND time, thereby using the balance of my money in the account of {$670.00} and what they advanced me to drain my escrow account and pay the taxes I already paid, causing a huge shortage.
I have been diligently keeping track of my escrow account and when I saw this duplicate payment I immediately notified them. I was told it would take 30 plus days to request the check back from the county, receive it and correct the escrow - but I do n't have 30 plus days to wait, so I put a stop payment on the original payment I made and asked the tax county to apply Ditech 's check to pay the taxes.
At this point, because of the escrow advance of {$5700.00}, my escrow account now stands in a SHORTAGE OF {$9000.00}! I was notified I have two options to reduce this : option 1 is to pay the shortage of {$9000.00} and the other is to spread it out over 12 months thereby increasing my mortgage payment to {$2700.00}.
This is completely unacceptable. I will lose my house, lose this refinance opportunity, all because Ditech read the tax documents wrong, refused to pay the tax parcel bills, refused to pay the penalty of {$140.00}, refused to correct my escrow account and now I 'm in a shortage of {$9000.00}! This company has no moral backing, every person I have spoken to knows nothing of what is going on, I have been unsuccessful at rectifying the lender 's mistake and now it will cost me my house.
This is my last ditch effort, before I hire an attorney. My lender has been entrusted to pay my tax bill with the escrow money I put in monthly, only to take it upon themselves to refuse to pay the bill, refuse to correct their error, and then change my normal mortgage payment of {$1700.00} to {$1100.00} and now up to {$2700.00} because of their negligence handling my escrow funds.
I would like Ditech to reimburse my escrow the money they " loaned '' me, in the amount of {$5700.00} along with the {$670.00} I had in there, totaling {$6300.00}. The error was made by them, they should run a new review of my escrow account after they replace the funds and correct my loan payment.

Complaint: Original loan in XX/XX/XXXXwith bank XXXX XXXX, sold to secondary servicers, from XX/XX/XXXX until the other servicers went under and XXXX XXXX XXXX brought all their loans. In XX/XX/XXXXXXXX sold my loan to XXXX ( XXXX XXXX XXXX ) XX/XX/XXXX to XX/XX/XXXX.
Then Ditech XX/XX/XXXXtoXX/XX/XXXX. Now another servicer ( XXXX XXXX XXXX XXXX XXXX ) XX/XX/XXXX currently. I have had only two modifications : one in XX/XX/XXXX and then one just recently XX/XX/XXXX. Now they have sold my loan to another servicer. One thing that I discovered when I had my last modification, was that XXXX still owned the mortgage ( ditech ). Just recently, I received a email stating that I sent a letter to request to pay my own escrow? I have never given anyone nor have I sent a letter to request to pay my own escrow. Question, why are they doing this and do I have any recourse to stop the continuous selling of my loan? Attached you will find supporting documentation.

Complaint: I co-signed for my daughter on a mobile home and filed bankruptcy in the year of XXXX on the account but the account number was somehow changed. Therefore, a collection agency still continues to harass me for the debt. ( My daughter has since then moved on leaving a balance owed. ) The collection agency has been given this information as well as credit bureaus but both have ignored the complaint.
Please help me resolve this issue.

Complaint: I have a loan through DiTech, who is servicing my current mortgage. I am in the process of refinancing to another lender. That lender requested a payoff from DiTech 9 business days ago. I called DiTech and they acknowledged they received the request 9 days ago, but appear to not have an answer why they wont provide either the lender or myself a payoff amount. I have submitted a request online and via phone with DiTech as well. I can not access that information on their website ; the message on the payoff tab says " unable to process ''.
The co-lender on the loan, my ex-wife, filed bankruptcy years ago which affected the estate. That bankruptcy has since been discharged in the courts by the Trustee and the Judge. DiTech has been notified.

Complaint: Complaint against Greentree now known as Ditech Greentree took over our home loan on XXXX XXXX 2013 Here is the reason I am writing : Greentree called repeatedly at least 4 to 6 times daily on both my husbands cell phone and my own cell phone. The worst of it was not that they called, but when you answered and spoke with them, they did nothing but be little, harass and bully you. It was hard for me to understand why it became such a " personal attack '' rather than a business call. Many times I would be passed through at least 3 - 4 people during the same call and each would put their own spin of harassment on it with calls lasting up to an hour or more. I would be utterly exhausted when it was over. I was told I had 3 hours to get my payment into them, do whatever I had to do, call people, a bank whatever, but if I did not have the full payment within 3 hours, I would be foreclosed upon. I was terrified. I was told " It was coming across the desk the next day and they ( the person speaking ) was going to recommend it be foreclosed upon. '' I was asked if I wanted a short sale or if I would give them a deed of trust. It was so intense that I would get off the phone and hardly be able to function. This happened many times and to my husband as well and I have no doubt this played a part in contributing to his health issues. We were scared to death. Imagine losing your home, the only thing you have. If you could hear the recorded conversations that took place, you would understand what it was like to be badgered and berated. I was not trying to avoid paying. I had no intention of not trying to pay. It was horrible. I actually had a Greentree representative yell at me over the phone in a real display of anger, at which time, I actually asked them, " why are you yelling at me. '' I finally had to refuse to take their calls as it was affecting my health and emotional well being. As I began ( after seeking counsel, to realize the statements they were making were false and misleading and designed to make me give up my home. I was not being told the truth.
False and misleading information. I was told over the phone when making a payment, that Greentree would not accept my payment unless I also gave them 2 post dated checks. Greentree did not apply my payments. I was told in a conference call with XXXX XXXX XXXX XXXX ( XXXX ) representative that the reason Greentree was not applying my payments was because I was several dollars short ( even though, I paid the monthly statement amount ) and that I was not to worry because Greentree was offering me a trial modification. All of this is documented in my emails with XXXX. I was advised to make a complaint with the state of Maryland as to why my payments were not applied, which I did, and Greentree responded to the inquiry by the state as if I were in a trial modification and they were simply following the prescribed rules governing modifications. However, I never once, requested, applied for or signed any documents with regards to obtaining a trial modification. Frankly based on all that had taken place, I was afraid to sign anything with them. I read the paperwork they sent to me and it was filled with loop holes and misleading statements. In my opinion, it was written to confuse and deceive the homeowner into thinking they were " approved ''. I would not sign. I did not trust them. Bottom line. This is also attached.
Greentree Monthly billing statements were completely confusing to follow and understand. They way they set it up and changed it around made it virtually impossible to follow. Everything they did was done in a calulated method to promote foreclosure. I have also attached copies of these statements as well as a list of the payments I made. For the consumer, this is very difficult to follow and understand. My atty, XXXX XXXX requested a spread sheet of all payments which is nearly impossible to figure out and reconcile. Greentree took my payments and paid my house insurance and taxes ( which I normally paid directly ) which in turn took the money that I sent for the monthly loan payment causing me to fall further behind. Of course I did n't know this until I started investigating. They also changed my payment amounts accordingly.
I qualified for reduced taxes based on my income in the State of Maryland, but they took taxes for the amount billed prior to my tax reduction. It was several thousand dollars in difference.
My privacy was breached. A Greentree representative called my brother in law, my daughter and my church to ask questions about me. My church has helped us with a payment and because of that Greentree had their information. They had a representative named XXXX, who actually called and asked my church if they were doing a fund raiser for me, trying to get more money. I had no idea and had not given any consent for any of these calls. I wonder to this day, if others were contacted. I found out about these when these people called to question what was going on.
There would be numerous people taking pictures of our home, bringing letters to our home etc. It never ended.
I understand that we were late, it was a difficult situation we faced. My husband and I both worked for a non profit and lost our jobs due to the economy at the time. He was not well which complicated matters.
I 'm certain based on my experience, this was not a isolated case, but rather the norm for Greentree. It was not until I had to spend money that could have been used toward my mortgage that some of the harassment settled down. I want be be compensated for the emotion abuse as well as been given false information in the behalf of Greentree that could have caused me to lose my home and become homeless.
Ditech is now the name of the Greentree and was who I paid off when I sold my home.
However, if they in any way do business in this manner, they need to be shut down. It 's taken me a while to be able to address this, it brings back so much stress.

Complaint: THIS IS A NEW COMPLAINT. Prior complaint XXXX was rejected due to a document not showing when scanned and sent.
This complaint is being filed on behalf of XXXX & XXXX XXXX, they purchased their home home a year ago. The owners work long day hours which makes it difficult to make contact, and they are not familiar with how they can correct this alleged payment issue.
Mortgage is with Ditech who has the correct phone numbers, address and emails.
The entire monthly payment with impounds is made via AHC ( automated pmt ) and have all been made timely.
The Servicer/Lender made no proven, documented effort to notify the homeowners by any means regarding ANY changes to their monthly payments due Ditech. There was no form of communication received from Ditch that the real estates taxes had increased and to adjust the monthly payment, this is what the tax service fee at closing is for -to notify all of what will be due upon the next cycle and make adjustments as needed.
Their was @ {$30.00} increase to the taxes monthly, that the owners needed to pay. Without any proven documented communication the payment was rejected ( see attached ), then charged late fees.
When viewing the attached monthly statements please note that there had been sufficient funds to cover the shortage regardless, then notify the Owners to increase their auto- payment amount thereafter.
