1. Got out of non-jury trial XXXX XXXX, XX/XX/XXXX which I knew before walking into Judge chambers I was going to lose. To get an idea of what typically occurs @ these non-jury trials just imagine a handcuffed monkey trying to beat a Lion in a caged fight.

One Hundred Per Cent ( 100 % ) Foreclosure Fraud : Forged and Notarized Original Mortgage signatures, Plaintiff lacks legal standing ( mortgage sold off originally by XXXX XXXX Bank to a trust ), robo signing. Their was the biggest lying straight face robo testifier from XXXX XXXX XXXX I have ever witnessed, it is sad and unacceptable how all their lies, fabrication were allowed into evidence while our strongest evidence by defendants Forensic Expert/Witness testifying original note is 100 % forgery denied her testifying at trial, XXXX due process.

Complaint: My account was sold to Caliber Home Loans from XXXX XXXX around XXXX of 2014. My payments were automatically deducted from my bank account each month on time. There was never any concern by having it set up this way, and never any issue with the payment being automatically sent to Caliber Home Loans. Interest rates began to drop around XXXX of 2014 and I tried refinancing the loan. The company I worked with on the refi had me call Caliber to retrieve the final payoff amount on the loan. During this phone call I mentioned I was doing this to refinance the loan for a better interest rate. From that day, working with Caliber has been a nightmare, they are doing everything they can to prevent me from refinancing and leaving their company. It started with them claiming payments were never received, remember they are automatically sent from my bank account and never a problem before. Here is what they do, they wait until after the 30 day mark to tell me they never received the payment so I have no time to re issue a payment then, they report me 30 day late to the credit bureau. I call them to disbute and they end up agreeing with me then going and removing the 30 day late from my credit but it takes another month to clear. And by this time they " lose '' the following months payment and the cycle never ends. So every month I am falsely reported to the credit company then they remove it but I am delayed from refinancing. It is now XXXX and I have been trying to refinance since XXXX. In XXXX they refused to disperse my taxes to my county tax collector. My taxes are included in my mortgage each month and I rely on Caliber to be responsible to send the payment in. They were did not pay it until the XXXX of XXXX when they were due on the XXXX. I began receiving late notices in the mail from my county tax collector. The payment issue has gotten so bad every month that I now make all payment to a supervisor over the phone in person, ( XXXX XXXX ) they charge me {$15.00} to do this, I give them direct bank routing and account numbers and they give me a confirmation number, then after that 30 day mark they report me to the credit bureau for never making a payment. I called the bank to see if there was an error and the bank said there was never any attempt to withdraw funds from that account. So Caliber is intentionally losing payment, falsely reporting me to the credit agencies, and refusing me the right to refinance my home which I do have a right to do. I looked online and there are hundreds of people with their very similar stories. XXXX not letting them refinance, losing payments, false reportings, and refusal to call back, return emails, and cant get to a supervisor to discuss the issue. People have sued this company because of the stress they have caused them. I have a young family and dealing with these people has been an unbearable stress on us. In addition XXXX is hitting us with endless notices in the mail about what to do when facing forclosure. Non stop notices that are simple letters in ordinary envelopes but they send them through a delivery service so I have to sign for them, well I work full time. I am a teacher and I can not be home to sign for mail. I worked this out and the letter was just a notification, no need for me to sign anything. My account is totally current despite having to send multiple payments each month, their dishonest business tactics, harassing letters of foreclosure and determination to take my right of being able to refinance away from me. I am seeking legal help and I do want compensation from these people. I encourage you to look up their customer service rating and reviews online, there are even former employees who say they had to quit because of how dishonest they are, how they trick people into losing their homes. These people are criminals.

Complaint: Recently on my credit report I see a record for " Caliber Home Loans ''. The credit item shows a status of " Derogatory ''. I have called the number XXXX listed on my report for this company. I get a representative who asks my name and when they try to verify my address I explain I have never done business with them. the Rep will hang up on me. I have researched this company name and at one time it was called " Vericrest ''. Four years ago I had a mortgage with Vericrest Financial but sold my home for a profit. This company is reporting a derogatory item on my report when I have never done business with Caliber homes. The Vericrest Mortgage was closed four years ago as a sale. No foreclosure, a sale for profit. Each time I call Caliber as soon as I provide my name they hang up on me. I want this company to remove and stop reporting bogus info about me to the credit bureau.

Even though this loan almost put me and my wife into bankruptcy in XXXX XXXX, and XXXX file foreclosure in XXXX XXXX. On XXXX XXXX me and my wife send XXXX XXXX XXXX a letter in pursuant to Section 6 of the RESPA.
Demand was made for all records electronic or otherwise, assignment of ours mortgage, promissory note or servicing rights to our mortgage including any such assignment on MERS.
All deeds in lieu, modification to our mortgage, promissory note or deed of trust from the inception of our loan to the present date.
The front and back of each and every canceled check, money order, draft, debit or credit notice issued to any servicer of this account for payment of any monthly payment other payment escrow charge fee or expense on this account.H XXXX did not send us the proper answers back for our request.

Complaint: The previous mortgage service company never honored a XXXX loan modification of reducing my rate from XXXX to 5 %. At or near the end of XXXX, they agreed to reduce the rate to some crazy low number, write off excess deferred interest and drop our payment. We never received confirmation of the changes and they sold our mortgage to Caliber Home loans. We received a letter from Caliber in XXXX XXXX that said we should expect a welcome packet. We never received this. I tried calling the phone number attached to the paper but since I did n't have an account number, I kept getting disconnected. After MONTHS of not receiving a mortgage statement, I assumed my previous servicer had done what was requested initially and reapplied the excess payments and paid our mortgage ahead by a year. At the end of XXXX, I came home to a letter attached to my front door that stated the property appeared to be vacant and to call a number for XXXX if it was not vacant. I called and let them know the house was obviously not vacant as there was furniture, food etc in the house. I asked her who was responsible for saying my house was vacant, she said the mortgage company. I asked her who the company was, she indicated she did n't know. She would not provide me with a phone number or even a name. On XXXX/XXXX/XXXX, XXXX came into my home, changed my locks and winterized my home without my knowledge or consent. Their was a phone number left on my front door and I was FINALLY able to contact the mortgage company. I spoke with a XXXX XXXX at XXXX who seemed very apologetic, did not offer me an explanation and gave me the code to the lock box with my keys in it to MY HOUSE. We do not occupy the house full time right now but we still have a lot of things in the house that is our private property. On XXXX, we were looking for some specific items and started to realize things were missing. XXXX not only came into our home unauthorized, they stole about {$5000.00} worth of tools and coins. They placed locks on our lawn equipment so that we could not keep our yard manicured. We filed a police report with XXXX XXXX police, the following day, I contacted XXXX XXXX again. Asked her the status of my loan. The house is NOT foreclosed, no sale date pending but is in the starting process of foreclosure. We have NOT received a mortgage statement since the last servicer! There has been NO indication of a foreclosure. She only wanted to refer me to customer service. I do n't even have the phone number, only her direct number. We contacted XXXX at XXXX and they would not provide us any info about the person who entered our home and stole our things and destroyed our house.

Complaint: I am submitting this complaint to address the ongoing dual-tracking violations and to get answers as to why there is still a sale date on my file since submitting a complete RMA package in XXXX XX/XX/2015. Caliber has violated the following federal laws established for the sole purpose of protecting borrowers ( consumers ) like me from the exact violations outlined below : FDCPA - threatening unrealistic consequences with a pending sale date RESPA - dual tracking violations for keeping a sale date with a complete RMA UDAAP - unfairly marking a RMA as " incomplete '' to further escalate foreclosureFDCPA VIOLATIONS OVERVIEW Caliber Home Loans continues to keep an unrealistic sale date of XXXX XXXX, XX/XX/2015, on my file even though a sale date on that date would violate my consumer rights and is not possible due to denial appeal rights and/or government mortgage assistance laws.
RESPA VIOLATIONS OVERVIEW Caliber Home Loans continues to violate federal dual-tracking laws by simultaneously working with me to avoid foreclosure while moving forward with foreclosure as evidenced by a complete package received ( see attached letter from Caliber dated XXXX/XXXX/XX/XX/2015 ), per XXXX ( Agent ID # XXXX ) on XXXX XXXX, XX/XX/2015, and the refusal to remove the sale date scheduled for XXXX XXXX, XX/XX/2015
UDAAP VIOLATIONS OVERVIEW Caliber Home Loans continues to state that they do not have to remove the sale date since my complete package was not received more than 37 days out from the sale date but the truth is that Caliber Home Loans put the sale date on my file after an initial RMA was submitted and within 35 days of the sale date, making it impossible for me to satisfy the deceptive 37-day excuse as it is a lie with a side of abusive business practices.
Per the consumer rights violations identified above, I 'd like for Caliber Home Loans to answer the following questions so that all parties involved can get a better understanding of Caliber 's standard operating procedures to address wrongdoing and adjust expectations moving forward:1. WHAT IS A COMPLETE PACKAGE?
a. At what point is a request for mortgage assistance ( RMA ) application considered " complete '' per Caliber and the CFPB 's dual-tracking laws established to protect struggling borrowers like me?
b. Who determines the " completeness '' of the package, the single point of contact or the underwriting representative, and how is the borrower ( me ) informed? How long am I given or do I have per Caliber to satisfy the request for documentation?
2. HOW CAN A BORROWER LIKE ME SUBMIT A COMPLETE APPLICATION OR RMA XXXX OR MORE DAYS PRIOR TO A SALE DATE WHEN THE SALE DATE IS PLACED ON THE FILE WITHIN ONLY 35 DAYS OF THE SALE DATE?
a. If the sale date was placed on the file on XXXX XXXX, XX/XX/2015, then how can I submit a complete package 37 days in advance of the sale date?
b. How can Caliber 's dual-tracking defense be that I did not submit a complete application or XXXX at least 37 days from the sale date when the sale date was placed on the file less than 37 days from the sale date ( XXXX XXXX or XXXX as it is unclear as to the exact date so pleased see attached )?
All requested documentation has been submitted and the requests that are being made are subsequent requests after receiving a complete package per Caliber 's correspondence, which should warrant the removal of my sale date ; all subsequent documentation has been submitted to date. To reiterate, I will be afforded an opportunity to appeal a decision or denial so the stated sale date of XXXX XXXX, XX/XX/2015, is not realistic and can only be construed as harassment or a threat, which now warrants an FDCPA complaint for violations.

Complaint: Over a year ago my mortgage was transferred from XXXX to Caliber Home Loans. It was a very tumultuous time period because I 'd filed for bankruptcy BUT my home was NOT included and I always paid as agreed. Apparently, per Caliber Home Loans over 2 years ago XXXX XXXX XX/XX/2012 XXXX they said that I did n't make a payment, which is not true because my payments were made automatically using automatic bill pay set up with my credit union. My credit union shows the payment made per the history provided. As of recently, I am receiving mortgage statements equating to the missed payments plus late fees that they just tacked onto my account. Everytime I call Caliber loans, I speak with a different representative who provide a different story regarding my account and want me to agree to pay the late charges when I was never late. Also, prior to this discovery, they were not reporting on my credit report and NOW they want to report derogatory information which absolutely not true. Please provide the necessary assistance I need because I will not pay XXXX for payments Caliber say I missed in XXXX XX/XX/2012 to XXXX. I 've always paid my mortgage.

Complaint: On XX/XX/XXXX XXXX assisted me to pay {$1100.00} mortgage to CALIBER HOME LOANS due to my financial hardship.
On XX/XX/XXXX, since I did not know when " XXXX '' can pay my mortgage on my behalf in XX/XX/XXXX back then, to avoid penalty, I also paid {$1100.00}.
Because of this incident, I ended up pay XXXX mortgage payments for the XX/XX/XXXX, so I called and spoke to a customer service rep. at CALIBER HOME LOANS around XX/XX/XXXX and asked her to apply my XX/XX/XXXX payment of {$1100.00} the full amount as principal to my loan account without charge me any of interests, as it was my extra payment for the year XX/XX/XXXX. She agreed, and she told me that our conversation was recorded, and said that she took care of it already. I asked for a confirmation, she said no need to have confirmation, I should see it on my FOMR XXXX of the year XX/XX/XXXX.
However, when I received FORM XXXX for the year XX/XX/XXXX, I found out that Caliber Home Loans did not apply my XX/XX/XXXX extra payment to principal ; but to charge interests against it as well. Thus, I called on XX/XX/XXXX to verify with a customer Rep. her name is XXXX. She was very rude, and told me that Caliber Home Loans would never re-adjust my loan nor to refund me the wrong charges of the interests on my XX/XX/XXXX extra payment of XX/XX/XXXX. I asked to speak to her manager, she hand up on me. Then when I called back, the phone just keep on routing to others, I was unable to reach to their manager for this matter.

XXXX/XXXX/15 I made the arrangement with a representative who told me I would be sent a letter to agree to and sign to get the deal going ... .I never recieved a letter to sign, however I did recieve a letter XXXX the wrong dates and amounts I had agreed to. the letter said the money was due on XXXX XXXX or I would be in default and the amount due is incorrect ... ..
In the meantime my wife is handling all the business of the loan, altho the loan is in my name, I sent a letter of authorization on XXXX XXXX, 2015, They have not uploaded it as of yet and they refuse to speak to my ; wife, I was unavailable to give them verbal authorization and was sure of the fact that I had sent the authorization and they would speak to her. they told me that the letter of authorization was there but has n't been uploaded yet so they wo n't speak to her, allowing us to clear up the situation ... the letter threatens me with default if the money is n't in on XXXX. Complaint: I had a mortgage with XXXX acct. # XXXX which was sold to Caliber acct # XXXX. In XX/XX/XXXX they force placed insurance on my account and for YEARS I sent that I had had proof of insurance and they kept misapplying my payments towards escrow shortage rather than my mortgage & charging late fees. Finally in XX/XX/XXXX I spoke to someone with some sense and they mailed a check to me for theforce placed insurance. SInce in the interim they had sold th loan to XXXX ( Now Caliber ), when they sold the loan they transferred the incorrect amount. Therefore when I would send my payments to Caliber they kept returning them to me stating the payment was not enough to cover the debt.
XXXX sent the reimbursement check made out to XXXX AND THEY ( XXXX/Caliber ) STILL returned the check to me stating it was n't enough.
I finally thought that this nightmare was over last year, but it has continued to be an ongoing nightmare and my account keeps accumulating late fees & my payments continue being returned with them stating it is not enough to cover the debt. I have had to hire an attorney who also gets the run around. I have contacted the attorney for Caliber and even he can not get an answer from Caliber.
Caliber states that they can not waive the previous late fees and misapplied funds because that it what was sent to them by XXXX.
What I need:1 ) XXXX to correct the misapplied payments, remove the late fees, update the credit bureau and report the correct balance to Caliber.
2 ) Caliber to waive the late fees, update my credit bureau apply the escrow credit balance and accept my payments for all of the payments that I have sent & have returned to me. I have this amount in my account and just want this nightmare to be over.
