Complaint: received loan modification and was asked to pay money up front. I paid it. Have n't missed a payment. It comes directly from my bank. Mortgage company keep sending letters stating that my monthly payment is behind. Also my note has increases from XXXX dollars to XXXX dollars to XXXX dollars per month. Interest is now XXXX percent. Initially offered modification with interest at XXXX percent and monthly payment of XXXX dollars. Bought house for XXXX dollars about XXXX years ago but now owe XXXX dollars. XXXX companies were involved : XXXX, XXXX and now Caliber Home Loans.

Complaint: I purchased a primary home with mortgage and put 10 $ % down. I had to get PMI on the loan. I requested the LTV ratio at which we need to get PMI released from the Loan and I have written evidence from Caliber Home Loans stating if I pay down the Loan to 80 % they PMI will be released. We paid the loan to below 80 % and they they denied our request and said we need to pay it down to 75 %. We just paid it down to 75 % LTV and now they are making us get an appraisal to redetermine the LTV. The regulation requires them to automatically cancel the PMI with two years good payments, no late payments, and 75 % LTV ; all of which we have satisfied. The XXXX XXXX XXXX guidelines allow PMI to be released if you make betterments or improvements to the property and get an appriasal which would show the Value is higher and thus the LTV ratio could be lower than 75 %. This requirement is not necessary if you are just paying down the principal!

Complaint: To whom it may concern : I have lived in the state of Florida all my life and am an active member of my community. I provide public service to my church and have served my country in the XXXX XXXX as a XXXX. I have owned my home since XXXX of XXXX, but I am now in danger of losing it to foreclosure due to a predatory loan and lender 's unwillingness to rectify the problem. After using XXXX loans to purchase this home, I decided to consolidate in XXXX and refinance the property with the purpose of controlling my interest rate and payment and also to use a little cash to do some home improvements. The bank appraised the home for $ XXXX at the time of the refinance and the Loan was for $ XXXX. I felt safe by leaving a sizable amount of equity in the home which would allow me to sell the home or refinance in the future if better rates became available. I also thought I was getting a 30-year fully amortizing loan, but it turned out to be a 50-year partially amortizing loan with a balloon payment due after 30 years!!! I would never sign up for this kind of loan knowingly. I started to suspect a problem a couple of years into the loan when I noticed that I was hardly making a dent in the principal after paying so much money ( XXXX I believe ). I was struggling anyway due to the economic downturn that had occurred, so I contacted XXXX ( who eventually changed their name to Caliber ). I got nowhere with them for the next two+ years!! I was told at XXXX point that I could n't get any modification help unless I was behind on my mortgage ; so after trying until XXXX, I decided I had no choice but to stop paying into this predatory loan. Once I fell behind, I applied for a modification a couple of times. Each time, the only offer I was given was XXXX that offered short term relief for a couple of years and then a reversion back to the same loan terms with a large amount added to the end of the loan. The offers also restricted my future rights to attempt to modify the loan. I believe my loan qualifies for some program out there. My property has lost about 25 % of its value since I bought it, and about 50 % of its value since I took this loan out. I am a XXXX and am doing fine financially, at least well enough to maintain a reasonable mortgage loan. Add in the predatory nature of this loan, and I should actually be a prime candidate for modification, but XXXXCaliber has shut the door on me by not offering any real solutions to this problem. I have been attempting to Short sale the property since XXXX XXXX but Caliber is not cooperative. Now I 'm facing a foreclosure sale on XXXX/XXXX/XXXX!!! This could have been resolved years ago ; I 've talked to so many different representatives trying to get this fixed and move forward. I never intended to defraud anybody, and I 'm not looking for charity. But this loan is not fair!!! All I ask is to be given a fair chance at the modification programs that are supposed to be made available to citizens like myself whose tax dollars bailed out these lenders. Any assistance that would allow my family to keep our precious home would be greatly appreciated. Thank you for your time.

Complaint: The mortgage in question began on or about XXXX the XXXX, XXXX. I wondered how I was approved for the loan from XXXX with my credit the way it was and my debt to income ratio ; and they told me my wife at that time did not have to sign the note. Bad decision. Went to XXXX XXXX/XXXX/XXXX to what I might could do to stay in my home. Had to apply for a modification, after that had to file bankruptcy ( chapter XXXX ). I was discharged XXXX XXXX, XXXX. There was a class action lawsuit against XXXX during this time that I never could get the true facts of who and what it included. I basically heard nothing from XXXX after the bankruptcy except for a monthly statement that was as stated on it ( for informational purposes only ). But did not receive this statement every month. This went on for about three years. Next thing I know I receive a letter from Caliber Home Loans on XXXX XXXX, XXXX that stated that the prior owner had sold the loan to XXXX Master Participation Trust on XXXX XXXX, XXXX. Not long after that, well about 3 months I received a mortgage statement dated XXXX/XXXX/XXXX from Caliber Home Loans saying amount due {$70000.00}. Of course I was floored. Wow. So I started wondering what to do since work had been bad and basically my only source of income had been unemployment.. Found a job not long afterwards but not enough income to afford the payments without a major adjustment to something concerning the mortgage. Went back to housing Counseling on XXXX/XXXX/XXXX to look at options to prevent foreclosure and stay in my home. On XXXX/XXXX/XXXX sent a Qualified Written Request Letter to Caliber Homes Loans. I received a response letter back on XXXX/XXXX/XXXX, some requested information was answered other requested information was tagged as ''PROPRIETARY INFORMATION ''. I sent back a response letter on XXXX XXXX, XXXX requesting any and all options for LOSS MITIGATIONS that might be available to me. To date I have received a response from Caliber Home Loans, but no answer to the Loss Mitigations Question. I also sent a letter of REQUEST FOR INFORMATION on XXXX XXXX, XXXX. The last letter that has been sent to Caliber Homes Loans c/o XXXX XXXX was sent on XXXX XXXX, XXXX also requesting again Loss Mitigations options available to me and Documents of Legal Transfer of Property from Household Finance. Have not received a response to date except for the 5-day acknowledgement letter. However on XXXX XXXX, XXXX went to my foreclosure hearing in XXXX County North Carolina and the XXXX XXXX XXXX granted the foreclosure sale to be XXXX XXXX, XXXX. I am now in the process of trying to appeal the decision because I found in the paperwork given to me at the hearing that XXXX XXXX XXXX XXXX, XXXX changed the SUBSTITUTION of TRUSTEE to XXXX XXXX XXXX, XXXX XXXX days before the Court Date. Is that legal in North Carolina? Or is it legal to have XXXX substitution of trustees on the same Deed of Trust?

Complaint: Mortgage check was sent on time and cashed by Caliber Home Loans. A notification of past due amount on XXXX showed a balance of XXXX higher without explanation. A call to customer service on XXXX revealed this to be due to the recalculation of escrow impounds but insisted on a check which could not be delivered the same day. A follow up call on XXXX expedited bringing the account into balance using a routing number for the balance due but no guarantees were made regarding reporting to credit bureaus. Unapplied funds and the additional payment are to be posted later today ( XXXX ) and a late fee will be removed from the account. The account does not show contact with credit bureaus has been made at this time, however, I was told the account will show partial payment at the end of the month and may be automatically be sent to credit bureaus between XXXX and XXXX of the month. Online statement balances show incorrect amounts due to not displaying a late fee and applying the late fee to future payments ( screenshot is available ). A dispute letter was faxed and mailed on XXXX requesting:XXXX Get all payments made and received by XXXX applied to the loan account ( mortgage payment cashed on XXXX and escrow shortfall paid via routing number ) XXXX. Verify that no contact has been made with credit reporting agencies. XXXX If contact has been made with credit reporting agencies regarding past due amounts. XXXX The submission must be reversed as per RESPA rules regarding disputes. XXXX The submission is requested to be permanently reversed as all payments for the loan principal and interest have been made and all escrow amounts have been paid in good faith within the grace period. XXXX. Receive a correct explanation of total escrow charges including current total annual escrow amount, current balance, and impact to regular monthly payment. XXXX. Correct total on the online statement to reflect the current state of the account and render totals correctly.

Complaint: Initially we applied for a loan modification with XXXX XXXX. The temporary loan agreement was sent to us by XXXX XXXX and we made the XXXX payment on the agreement, but the loan was literally sold the next day. The new servicer Caliber Home Loans called us a few days later and asked what our intentions were since they were denying our original temporary modification agreement. We never received an exit letter from XXXX XXXX, and now we were faced with a new servicer not willing to except any agreement we had with XXXX XXXX. Their solution was for us to reapply for a loan modification with them from scratch. We have been in a back and forth battle trying to get a modification. After a few months they wanted us to send them more money, and they would look to continue with the original modification we had with XXXX XXXX. We asked XXXX to put it in writing, but they never did. We have now attempted XXXX times to get a loan modification with no avail. With contacting a HOPE and a Housing Counselor, it looks like our FHA loan has turned into a conventional loan. Both the Hope and Housing Counselors did not understand why our loan type changed from FHA to conventional. It 's both the counselors understanding that this loan type should not change without a refinance ; no refinance was ever done by us to change the FHA type loan. We have requested that Caliber Home Loan look into this dispute by sending them our closing statement and the FHA loan number we 'll provide the same to you. It seems they are calculating my Debt to Income ratio not in accordance with FHA guidelines. We are facing a Sheriff 's sale on XXXX/XXXX/XXXX, and we have used all our postponements in working with them. We are requesting that you look into this matter, so we can maintain our home.

Complaint: I have been contacting Caliber Home Loans XXXX times since XXXX XXXX in order to obtain an escrow analysis. My loan started in XXXX at which time the XXXX XXXX was not yet applied. It was applied around XXXX XXXX and I have asked to 1 ) have a reduction in escrow ( ultimately monthly payment ) and 2 ) be refunded an overpayment which is as of today is approx {$1600.00} and each month {$300.00} is added to this amount. I keep being told each time to wait XXXX days and nothing happens. Complaint: I am filing a complaint due to the issue of my mortgage bank being uncooperative with me in order to settle up on my payments and avoid foreclosure on my home. Fives years ago the co-owner and I split up and he left the home. He cut all ties financially with me and quit his job making it difficult for me to keep up on payments. I applied for a hardship program through XXXX a little over a year after we split. But it still was difficult and eventually I was unable to make payments and provide for my children. Last year my mortgage was bought out by Caliber Home Loans. They sent me a payment agreement consisting of interest only payment with escrowed insurance and taxes. I was interested in this of course. When I contacted them they informed me that the co-owner had to sign the agreement also. I informed them of my situation and they still would not work with just me on saving my home. Because myself and co-owner were not married there was no distribution of property when the relationship was dissolved. I was left with all the bills and providing for the child we have in common. Again two weeks ago on XXXX XXXX I contacted them concerning the possible foreclosure and my application of loss mitigation. I provided them with everything I could. The only document they were missing and required was a signed letter from the co-owner stating he would sign the modification. Which they were well aware of in my application letter that he refused to do due to going through family issues concerning child support. With all this information I believe that Caliber should assist me without the consent of the co-owner as I am the one still living in the home and paying the bills. The ending result as of XXXX XXXX the courts have granted the bank counsels motion to appoint a referee and grant a judgment of foreclosure. I do not want to lose my home that I share with my children. The only home my son, the child we share, has ever lived in.

Complaint: My complaint is with CALIBER HOME LOANS. We bought our home in XXXX. Our mortgage was with XXXX XXXX and then XXXX. With XXXX, in XXXX, my husband incurred an injury that required surgery and recovery time. During that time we never missed a mortgage payment. However we did miss a quarterly property tax payment. In XXXX XXXX XXXX sent us a letter that we had defaulted on our loan. We contacted them immediately to work out a way to catch up on the taxes ( still continuing to pay the mortgage payment ). At the time, they were very nice saying they had a whole department to help people like us and they would work with us to give us a loan modification. I submitted all paperwork and I continued to pay my monthly mortgage. In XXXX XXXX, XXXX told me to stop paying my mortgage. They said I no longer had a loan and my payments were not going toward my house. They never returned any payments I made either. I stopped paying. This dragged out for years as I was shifted to different people. With every shift I would start all over again. They still sent me monthly statements. XXXX I tried to pay my bill ( to show that I could and wanted to. ) They refused my payment XXXX times. After ups and downs and a meeting with the court, XXXX led me to believe I had fulfilled all their requirements, I had showed them I could afford the house and they said I could expect a loan modification in about a month. That never happened and XXXX XXXX, they informed me the were selling my house on XXXX XXXX, XXXX. After communications with our lawyer they canceled that sale date and for the first time XXXX sent us to the underwriter under HAMP guidelines. They said we should have a new loan within 14 days. Before the underwriter could complete the process, our loan was abruptly sold to CALIBER HOME LOANS. CALIBER said that they do n't participate in the HAMP loan program and promptly set a new sale date for our home of XXXX XXXX, XXXX. CALIBER sent me a letter on XXXX XXXX saying it was my right to request an independent review and during that time they could not continue foreclosure proceedings until the independent reviewer had made a determination. I immediately faxed them that that request. They received it and canceled the sale date. However on XXXX XXXX they set a new sale date of XXXX XXXX. I called them and said I had stopped the sale date and the foreclosure proceedings with an independent review ( they would n't tell me who was conducting the independent review ). I said surely they could not have conducted and made a determination between the letter they sent on the XXXX and the schedule of the new sale date on the XXXX??? They then said, actually, while they have a record of me faxing something over to them on XXXX XXXX, they could n't find my request for an independent review so none was being conducted and they were selling my house. I said, " but I stopped the XXXX XXXX sale with exercising my right to an independent review! If you got nothing, why did n't you sell my house on the XXXX?? '' The " supervisor '' on the phone said he did n't know why they canceled the sale date. He said there was something in the notes about an appeal of the denial but he said, " We are selling your house on the XXXX. There is nothing you can do ''. So on XXXX XXXX, I filed Chapter XXXX Bankruptcy to stop the sale. CALIBER has done nothing but lie and deny. They wo n't return calls, they loose paperwork, and they will not tell us who owns our note. They changed our monthly mortgage payment from {$2100.00} ( XXXX in XXXX XXXX ) to {$5700.00} ( CALIBER in XXXX XXXX ) but wo n't say why even though all our paperwork says our loan will not change even when the servicer changes. They gave me a primary contact person but he is never available to talk to and he wo n't return my calls. They do n't want my payments. They want my house.
