Complaint: This is a follow up to Complaint # XXXX ( now CIT ) responded within days of your having contacted them. They have sent several letters, we have spoken several times on the telephone, the bank has acknowledged that they have no legal standing to continue to hold their lien against our home. Despite their promises to resolve the matter, today, three months after our initial contact with you and 20 months after we first requested that the bank release the lien, as of XXXX XXXX, 2015 the lien release has not been recorded. This morning I spoke to XXXX XXXX XXXX to express my dismay at the delay. I pointed out that if this were a sale, the transfer would be recorded in three - five days. He said he had no explanation nor was he able to contact anyone else in the bank who might have some insight into how to move the process along and reach a resolution. I appreciate the Consumer Financial Protection Bureau 's assistance and can say without equivocation that it was your involvement that moved the bank to begin a dialogue. I hope that you are equally able to help them solve this in a timely manner.

XX/XX/XXXX ( incomplete ) 'Settlement Agreement ' : Incomplete, that is, without the required and several times requested " Loan Modification Agreement '' documents by OneWest Bank for XXXX ' XXXX loans : a ) XX/XX/XXXX 'Settlement Agreement ' between XXXX and OneWest Bank was signed . And ( b ) only a settlement memorandum was added ( signed by OneWest Bank, XXXX XXXX, XXXX VP ) The originator of the incomplete settlement documentation since XX/XX/XXXX is lead attorney, XXXX . XXXX XXXX XXXX, XXXX Note : OneWest Bank Mortgage Services, a div. of OneWest Bank, XX/XX/XXXX, MERGED WITH CIT BANK ; and became 'OneWest Mortgage Servicing, a div. of CIT BANK. And after many letters and requests regarding the 'incomplete'XX/XX/XXXX settlement agreement : The XXXX filed complaint with the Consumer Financial Protection Bureau ( CFPB ) XXXX/XXXX/XXXX. XXXX/XXXX/XXXX XXXX were notified by OneWest Mortgage Servicing/CIT Bank, XXXX XXXX that the 'Loan Modification Agreement ' ( XXXX ) documents were being prepared. And XXXX received the XXXX documents XXXX/XXXX/XXXX ; signed and returned to OneWest/CIT on XXXX/XXXX/XXXX. We have been asking OneWest/CIT Bank a ) based on the loan modification agreement 's own verbiage which states on top of cover sheet : '' THIS MODIFICATION IS TO BE EXECUTED IN DUPLICATE ORIGINALSONE ORIGINAL IS TO BE AFFIXED TO THE ORIGINAL NOTE AND XXXXORIGINAL IS TO BE RECORDED IN THE LAND RECORDS WHERE THESECURITY INSTRUMENT IS RECORDED '' And b ) based on the Title Insurance XXXX Form XXXX, '' a title insurer will require that the following be satisfied : Receipt of ( 1 ) verification of recording of satisfactory modification of the deed of trust insured ( " Modification '' ) which modification has been properly executed by ( a ) the current record owner ( s ) of the Land, and spouses, if any ( b ) the current record owner ( s ) of the Indebtedness evidenced by the deed of trust ; and ( c ) the current trustee or substitute trustee of the insured deed of trusts ... Complaint: Financial Freedom 'the reverse mortgage specialist ' has been giving my XXXX-year old mother the run-around for the last three months since she notified them she vacated her home with a 'no fault ' home equity conversion mortgage ( HECM ) , in trying to complete Financial Freedom 's 'streamlined ' deed in lieu of foreclosure process. My mother is on an extremely limited income and can not continue paying for this property while Financial Freedom gives her the run-around in trying to complete the process. Financial Freedom has placed a lock box on the house and told us we can not access, yet they refuse to complete the deed in lieu of foreclosure process and they refuse to tell us what the next step is to complete the process of getting this HECM reverse mortgage/home out from under my mother 's name and responsibility. SHE HAS VACATED THE HOME! As of now it 's completely stuck in Financial Freedom 's limbo and every time we call customer service and that department to speak with a manager or the specialist handling the account they say that everyone is a meeting or on break or on lunch and will return our call but a manager or supervisor NEVER calls us back. Every time we call, we get a different answer where the deed in lieu of foreclosure process is at and no one can tell us what the next step is to complete or what is needed to complete it. They are intentionally trying to delay the process and even an email from their legal office says they are purposely delaying for an unknown reason. Please help. My XXXX year old mother is losing her faculties and health is failing. This predatory and deceitful practice by Financial Freedom is taking its toll on her health and her finances. I have power of attorney for my mother and her estate and have provided that to Financial Freedom already. PLEASE HELP US.

Complaint: Mortgage Loan XXXXTo Whom It May Concern : I have submitted settlement offers regarding the above loan to Indymac Mortgage Services five times since XX/XX/XXXX. On XX/XX/XXXX I received a counter offer from Indymac in the amount of {$19000.00}. I agreed to this offer and was in the process of arranging a wire transfer when the account manager, XXXX XXXX stopped returning my calls. I was able to contact XXXX again on XXXX/XXXX/XXXX and was told to resubmit the {$19000.00} offer in writing which I did. I never received a response. On XXXX/XXXX/XXXX I received a call from XXXX XXXX informing me that the debt had been discharged and they were now in charge of collection on the account. The account XXXX, XXXX XXXX directed me to submit a settlement offer. I continued to submit documents over an over without a proper response or a settlement conclusion until a call to XXXX XXXX on XXXX/XXXX/XXXX was rerouted to a new collection company called XXXX XXXX XXXX. They informed me that they are now in charge of collection on this account. I resubmitted documents to them several times between XXXX/XXXX/XXXX and XXXX/XXXX/XXXX. On XXXX/XXXX/XXXX XXXX XXXX and XXXX XXXX, both of XXXX XXXX XXXX informed me by telephone that the offer was denied, but there was a counter offer of {$120000.00}. When I asked them for proof in writing from Indymac they refused to provide it and told me the full balance was now due. I never received anything in writing from Indymac or XXXX XXXX Services that they are in charge of my account. I do not know if this is a legitimate company as they will not share their address or domain. In addition they will not share with me the actual denial letters or counter offers that they claim were generated directly from Indymac. I have spoken to several representatives at Indymac who claim that XXXX XXXX XXXX still services the account and that they have the authority to settle the account on behalf of Indymac. Once again I am not able to reach anyone at XXXX as all of their calls are rerouted to XXXX XXXX XXXX. I am requesting that Indymac Mortgage Services contact me in writing with the reasons for each settlement denial, the documents used to make the decisions and the full name, address and contact information for the collection company that is charge of my account.

She died intestate, my grandson asked me to be the estate administrator, so I hired an attorney and began the probate process in XXXX 2015. after her passing, I found out she had not paid her mortgage since XX/XX/2015.However, I could not take any legal actions ( list/sell the house, discuss issues with the lender ) until the court approved my letter of administration. It took over four months to get the court 's approval. I received my letter of administration in XXXX 2015. I listed the property with a real estate agent. She was not able to find a buyer. I recently hired a new real estate agent. he is actively marketing the property. We had XXXX open houses this week. However, interested buyers are very reluctant about entering in to a contract on a home with a scheduled foreclosure of XXXX XXXX, 2015.

Complaint: Hello, Near the end of 2011, I fell behind on my mortgage payments because I separated from my husband and finances changed drastically. I immediately applied for a loan modification. I followed through, faxed the application and all necessary documents to One West. Kept in touch with them to make sure they had received them. But every time, there was something missing, or they did n't receive my documents, or the documents had expired because so much time had passed since the first time I had sent the first documents. I felt they were playing me because I knew they had received them. They waited for all that time to go to then tell me, my documents had expired. I have read many similar stories from other homeowners and this bank. I did everything they asked me to and they still took my home, our home. My children and I were devastated whenever they would post our door and finally when they took it from us. This bank had no intention in giving me a modification. We had more than enough time to get it done before the sheriff sale. Finally, just two weeks before the sale, they told me I qualified for the modification but it was too late because the sale date was too close. I could n't believe what I was hearing. This bank has to be punished for what they have been doing to homeowners. It is not like I ignored their phone calls or abandoned my home. I need to help and want to be compensated for my loss. They wanted to take my home because the way they would gain nothing by letting me keep. On the contrary, they would get paid from the FDIC because of the deal they had struck with them. The address of the house the took from me is XXXX XXXX XXXX, XXXX, PA XXXX. BorrowersXXXX XXXX XXXX XXXX and XXXX XXXX. I would appreciate if this agency does something those heartless people who only care about their pockets. I had no money to go to an attorney, otherwise, I would 've fought them till the end. Complaint: XX/XX/XXXX Real Property Taxes XXXX are due XX/XX/XXXX. Furthermore, XXXX Citizens XXXX are entitled to defer tax obligations to a later date. Financial Freedom paid my property taxes, without solicitation, XX/XX/XXXX - at lest four moths before they were due. Please see attached tax receipts. They are now threatening me with with delinquency letters and foreclosure proceedings. Please see attached " Property Charge Delinquency Letter. " In addition, Financial Freedom is charging me for {$1800.00} rather than the {$1200.00} that I owed in property taxes for the year. This is unconscionable and a violation of our mortgage agreement. My obligation is to pay the taxes when due - XXXX has breached our contract by paying my property charges without notice. I am now trapped in a situation whereby I face the threat of losing my home over {$1200.00}.
