Complaint: I am a home owner in the state of Massachusetts. I have fallen under a financial hardship ; I been trying to work with my bank and provided them with everything they have asked for but One West Bank is refusing to assist me and this situation is putting my family and I under an amazing stress same as they did in the past. In XXXX I applied and was found eligible for a HAMP modification trial plan. I was instructed to make XXXX trial payment on time to then be place on a permanent modification ; I made over XXXX payments towrd such offered mod but I was never permanently modified, as continued making the payment then the bank stopped taking my payments and denied my modification for an invalid reason of missing income documents after I had been informed the bank had received all documentation requested and the bank violated the agreement as after XXXX trial payments I was to be permanently modified. On or about XXXX XXXX I re-applied for a HAMP, the bank acknowledged receiving all documentation requested but are denying me for HAMP stating that I failed in XXXX that is inaccurate as mentioned above I made over XXXX trial payment but was never modified. I am requesting your office to look into One West Bank behavior and review in my case

Complaint: I purchased my home in XXXX due to my mother getting older she moved in to our home. In XXXX I wanted to refinance my home and it was then that XXXX of XXXX offer us a reverse mortgage for I was using my mothers income .. I had no idea of how the program really worked. I was concern that there was no payment and that we had not received any money in our hands. However, there is no mortgage payment and my mother passes on in XXXX. I sign all the paper work at the table closing with my attorney and the bank attorney. It is my understanding that I am on the note and the deed. I had hire an attorney to guide me to no success. I am told my house is in foreclosure and there is a sale day. Please help me find out what is going on with my house. My mortgage was served originally by XXXX XXXX When XXXX closed down Financial Freedom took over. I have XXXX children. I am a single parent trying t safe my home. Complaint: After the market crash XXXX, we were in put into financial stress to manage rental house properties and our own personal home loan mortgage. Our attorney advised us to file for bankruptcy on the XXXX rental homes and the XXXX on our house. During this process our attorney, recommended we delay the filing as to improve our outcomes on the bankruptcy. Because we followed this advice, we unfortunately lost our XXXX rental properties ; XXXX through a foreclosure and the other XXXX through a short sell. We informed by the attorneys that we had reached the statue of limitations on our all of our loans. To verify this, we contacted Indy Mac ( XXXX XXXX ) in XXXX, they told us the XXXX was charged off on XXXX XXXX, XXXX. When we were checking our credit report in XXXX XXXX, we observed the second was back on our credit report. Immediately we made weekly calls in attempts to make a settlement and or arrangements to correct this issue. We submitted in XXXX XXXX a short sell settlement package to XXXX XXXX, We made numerous phone call on the status and always received the runaround and " someone will get back us ''. We resubmitted a loss mitigation request on XXXX/XXXX/XXXX. We finally received a letter dated XXXX/XXXX/XXXX stating XXXX XXXX received our paper work and needed more information, on which we complied with. We a received counter offer letter XXXX/XXXX/XXXX. Again, we made numerous calls and finally we were told XXXX XXXX had our account as per a collection agency, because One West wo n't accept our money. We contacted Penncro XX/XX/XXXX. We began making payments to XXXX to XXXX. On XXXX/XXXX/XXXX, we had received a notice that our last payment check had been returned to our bank. Called XXXX, but XXXX XXXX XXXX answered the phone. Found out they have had the loan since XXXX. No communication was made by XXXX XXXX XXXX. They advised us to refinance XXXX or short sell the house. Contacted XXXX XXXX to refinance, but showed they had nothing on any credit reports. During a 3 way call with One West and XXXX XXXX, One West refused to allow the call to be recorded. Called back One West, the XXXX stated we have now {$56000.00} on top of what we have left to pay. Because of this we ca n't refinance the original our first loan to pay this off. We have been told before by Indy Mac, XXXX XXXX, and XXXX that we have had no interest or fees. We feel this is a deceptive business practice at the level of fraud and theft. We have made our XXXX loan payments faithfully since XX/XX/XXXX and we are now more in the " hole '' than when we started. The position that the HELOC wo n't work with us as to take our money and continue to place us in position of losing our home and continually tacking more fees and interest to compounds the impossible situation. We feel have the finances to bundle up the XXXX and the XXXX if can get the loan ... BUT, because they have us in a rock and hard place, it prevents us from doing this.

Complaint: I recently refinanced the loan on a property that I own as joint tenants with my wife. I did qualify for the loan and obtained it on my name. My name is the only name on the NOTE. My complaint is regarding the instructions that the Lender gave the the escrow company as to record a Deed of Trust that indicates that my wife is also the borrower on the loan. The text of the Deed of Trust now reads : " Borrower is AT ( my name ) and ST ( my wife ) husband and wife as joint tenants '' and it was recorded on XXXX XXXX, 2016. This is obviously a mistake and has to be corrected. I requested the lender and the escrow company to change it to refer only AT as the borrower, but they refused to do so. Also, they wrongly put my mailing address in XXXX when my address is in XXXX XXXX as stated in the loan application. They also refused to correct the mailing address.

As I was preparing my XXXX Federal and State tax returns, I realized that bank never issued me a XXXX or XXXX form XXXX. I called CIT bank and was told by representative that no hard copies of XXXX 's were mailed out - the account holder was responsible for download form online. Bank representative told me that CIT Bank knowingly and willfully did not mail copies of XXXX -INT to customers. Complaint: In XXXX, I had savings account and XXXX CD 's with CIT Bank ( XXXX. XXXX XXXX, XXXX, MO XXXX ). These accounts were closed in XXXX. I waited and waited for XXXX XXXX. Finally, on XXXX XXXX, XXXX, I called CIT Bank ( CIT ) and discussed this matter with XXXX who told me that all XXXX 's were mailed on XXXX XXXX, and that the XXXX should be coming soon. I waited and waited again, but, no XXXX until XXXX XXXX when I called CIT Bank again and discussed it with XXXX who blamed it on the post office. I then asked XXXX to overnight to which she agreed. I told her that CIT is closed for me and I am not allowed to do business with the bank. I waited again and looked for it every day. On XXXX XXXX, XXXX, I called XXXX again and discussed it with XXXX who gave me the shocking news as follows : A ) The XXXX was mailed on XXXX XXXX and not on XXXX XXXX as promised, and B ) The XXXX was not mailed by overnight mail as promised but by ordinary mail. It is beyond my understanding that why CIT will abuse its customer in this fashion. First CIT violated IRS law by not mailing XXXX by XXXX XXXX. Second, CIT promised to overnight. CIT did not overnight, nor CIT informed that the XXXX will is being mailed after 4 days by ordinary mail. It should be noted that CIT terminated all my accounts in XXXX and I cut me off from the bank business ( another story that is irrelevant here ). I will submit ( by fax ) the termination letter for your information and action. I had no access to the information on the web site due to termination of my accounts. I had to cancel my appointment with my tax accountant 3 times. I will probably get XXXX around XXXX XXXX or XXXX. I may not be able to file my tax return within the time since I have an overseas trip coming soon that I can not postpone or cancel without losing hundreds of dollars. I will cost me extra money ( {$150.00} to XXXX ) to file addendum tax again. I want CIT to pay this cost amounting to {$150.00}. How can a bank delay XXXX delivery and get away with it is beyond me. CFPB should not tolerate this kind of behavior. CIT has made my life miserable causing extreme frustration, economic loss and loss of my precious time. Their license should be cancelled. They keep on violating XXXX law repeatedly. I am a XXXX American who feels extremely helpless. I just can not take any more abuse. CIT has put me and my wife to tears. Your help will be God sent. Complaint: I have a mortgage with Indymac bank which was bought by Onewest Bank Reo, LLC, my house entered in foreclosure in 2009, I received a offer from the bank to make 3 payments, after the last one we agreed to set a permanent modification, I made the on time payments by they returned my last one and I was told that they just change their maid despite that we had a signed agreement, after that unfair situation I keep trying to obtain a loan modification and they asked for documents that I sent accordingly, most of the times they responded that they did not received them, despite that we sent them by certified mail. In the foreclosure court their argument was that I did not qualify for modification but they never provided me with that information or the reasons for their denial, but the National Mortgage Settlement reinforces obligations on Onewest Bank Reo , Llc., to follow the HAMP guidelines, and in my case those guidelines never were followed, my house still in foreclosure and the bank did not submitted any information that justify my modification denial.
