Complaint: My ex and I opened this account about 11 years ago. 10 years ago I was out of work for a few months due to an injury. That is when we really started to use the card. Once I went back to work we started paying {$300.00} a month to get the card down which was more than the minimum payment. After 2 years, they changed their terms to a higher interest rate and we refused to pay the higher rate so they closed our account. After that time, we did not receive monthly statements. We knew we still owed on it, so we kept paying {$300.00} a month. 4 1/2 years ago, we got divorced and the judge asked for the balance on this card. I told him I did n't know since we had n't gotten a statement in 4 years and I did n't have a number for their customer service. The judge and the lawyers said that that was highly unusual and I should try to find the number somehow. So I did and they gave me the amount owed which was still about the same amount as what we had originally charged. There was no way that was correct. I told them that I wanted all the statements from those 4 years that they never sent us. They said they could only go back a year so they supposedly sent me those. After the divorce I could n't keep paying the {$300.00} a month so I called them to work something out. I also told them that they still had n't sent me prove that I owed this amount. The guy I spoke with told me they could adjust my payment to {$300.00} a month ... are you kidding me? Someone told me to not pay for a couple months to see if they would settle. So a couple months later I called and talked to someone else. Told them the whole story again, she was very nice and understanding. She said she could get me the missing statements and that they could split the payments with my ex according to the court docs. She gave me the address to send them to. I sent them along with a letter and the number she had given me. Nothing except them calling every day which I would n't answer because they would call my cell while I was at work. My point is, there is no way that we owed the amount they were saying if we were paying over the minimum to begin with. We never received statements, so if the due date changed, we did n't know. The account was closed, so there is no way we were still charging anything. I have not paid anything in 4 years due to the fact that they said they were getting me in the information that I requested and they have n't. So now they have charged me late charges and interest and are now threatening me with a lawsuit. All I wanted was proof that I owed the amount that they stated at the beginning. They have tried to offer me a settlement now, but I do n't even think I owe as much as that.

Complaint: My daughter has a collection agency that has garnished her account and that of her minor son. My grandson 's account was opened by me and all monies have come from me not her. She was put on the account along with me when he was an infant. I thought I had removed her but can not find any supporting documentation to prove this. On XXXX XXXX, 2017 the collection agency stripped his account of almost {$2800.00}. My daughter is XXXX and has XXXX. Pay Pal gave her a credit card even though she had n't had a job in over 10 years and was on public assistance and food stamps. They gave her a {$5000.00} limit. I believe this is predatory lending. She has no clue about finances and I was unaware of what had transpired. I do n't believe my grandson should have his money taken away.

Complaint: Cavalry Portfolio Services LLC is reporting an account that was a charge off credit card from XXXX XXXX XXXX from XXXX on my credit reports. Under Louisiana civil code XXXX XXXX XXXX XXXX the statute of limitation of debt collection of an open account is 3 years old. On my XXXX Credit report it shows that Cavalry started reporting this account on XXXX/XXXX/XXXX, XXXX and XXXX XXXX show that they started reporting on XXXX/XXXX/XXXX, Cavalry was sent a letter on XXXX/XXXX/XXXX to validate this account and provide proof that they notified me in written XXXX to XXXX days before reporting this account to the credit reporting agencies as required under FCRA. Per phone conversation with with XXXX XXXX ( supervisor with Cavalry Portfolio Services ) they are servicing the account on behalf of Cavalry SPV 1 LLC who purchased the account on XXXX/XXXX/XXXX from XXXX XXXX XXXX. According to XXXX XXXX XXXX 's records provided by Cavalry Portfolio Services the account was charged off on XXXX/XXXX/XXXX making this account past the 3 year statute of limitations of debt collection under Louisiana XXXX XXXX XXXX XXXX XXXX ) for open accounts ( credit cards ). XXXX XXXX XXXX stated that they first started reporting this account to the credit reporting agencies on XXXX/XXXX/XXXX which is a violation because under FCRA since they are required to wait XXXX to XXXX days before reporting, which he said they purchased it on XXXX/XXXX/XXXX and reported on XXXX/XXXX/XXXX ( 48 days ). XXXX XXXX XXXX stated that they sent out the first notice on XXXX/XXXX/XXXX, the second on XXXX/XXXX/XXXX and that Another company they used called XXXX XXXX XXXX XXXX started servicing the account in XXXX. XXXX XXXX XXXX was asked to provide the Bond number showing that his company was licensed and bonded in Louisiana as a XXXX XXXX but could n't provide that information. XXXX XXXX XXXX was recording the conversation and was brought aware of the many FCRA violation his company had committed from reporting false information, reporting this account before the XXXX to XXXX days required, that they had to be bonded in Louisiana, not providing the information that was asked to validate this account and that once XXXX XXXX XXXX charged off the account they sent out a XXXX required under Federal Bankruptcy Laws and that once its filed on my tax returns it satisfy any amount owed under XXXX Sections XXXX, XXXX, XXXX, XXXX, XXXX.

Complaint: Unfortunately my husband who paid all the bills and took care of all finances passed away unecpectedly XX/XX/XXXX. Prior to that XX/XX/XXXX he went to a debt consolidation company which we thought was legit. We signed the agreementa and made the payments. Unfortunately after his death, I had to seek a probate lawyer because he died without a will. She explained their practices and at that time I found none of the payments had been applied to the credit cards which meant all were already in default. She suggested I make a settlement with the credit cards. I did so with the XXXX I thought I had and had contact with. This credit card company has not made any claims to this debt until now over 2 years later. I look on XXXX and it shows XXXX balance so I assumed it was the XXXX I already paid. The only reason I found out is I have been trying to bring my credit score up and I constantly look at credit karma. There was an open collection listed on my report for Calvary Portfolio Services. I have since learned it is a debt collector for XXXX. I did make a XXXX payment to XXXX on XX/XX/XXXX which I thought settled everything. To my horror this is another account. I have ripped the house apart for any type of paper trail on this account and I can not find one piece of paper. We were in desperate financial trouble at the time of his death so I am not doubting that he opened this card. Once he passed I had no acces to any account info because it was on his work laptop which was siezed XX/XX/XXXX and I had no way of getting in it because of security measures. I did speak to Clavary today and requested account info but looking on XXXX it shows the acct closed collection/charge.
I honestly thought I was climbing out of this nightmare until I got onto XXXX. I have been getting XXXX # calls but the lawyer said they can continue to call so I assumed it was what I thought was paid off. How can a company do this? It just destroyed my credit history that I have worked so hard scraping and scrimping to repair? I am desperate for help.

Complaint: The CFOB has to put an end to the practice that allows debt buyers such as Cavalry Portfolio Services to post collection accounts on credit reports as well as the original creditor. The FICO scoring systems make no distinction that this is the same account that has been paid, they view it as XXXX separate derogatory accounts. Cavalary is reporting a derogatory collection account and the original creditor is reporting a charge off. So according to the FICO scoring systems there are XXXX derogatory accounts instead of XXXX. You have to put an end to this practice of doubling up on the damages. XXXX has refused to delete their derogatory trade line even after they were paid! I never had an account with Cavalry, I never broke a contract with Cavalry, I never had any kind of business relationship with this company. They paid pennies on the dollar for this account hoping to make a huge profit, which they did! And now even after they are paid and made a huge profit they want to continue to damage my credit for the next seven years. That is absolutely insane.
You need to reign in these debt buyers and stop letting them report the same account multiple times. If Cavalry buys this debt then the original creditor should delete their reporting. It is crazy that these debt buyers are allowed to get away with this and destroy peoples FICO scores in what amounts to an extortion racket to coerce more money from consumers. Then even after they are paid they continue to damage FICO scores, causing thousands of dollars more in interest payments.
I demand that Cavalry delete their negative trade line from all of my credit reports and you need to take a serious look at putting an end to this practice industry wide.
