Complaint: In XX/XX/XXXX, I received a letter from Cavalry Portfolio Services claiming that I owe them {$1000.00}. I responded on XX/XX/XXXX with a letter requesting that they validate the debt and they responded on XX/XX/XXXX with printouts of old account statements and a bill of sale from XXXX whom they purchased the original debt from. They did not provide an original signed contract as proof of debt so I sent them another letter on XX/XX/XXXX stating what they sent me did not meet the Federal Trade Commission 's guidelines of what constitutes proper debt validation and also this : " In the case of XXXX XXXX XXXX ( IN THE COURT OF APPEALS OF INDIANA, No. XXXX ), the court ruled that : 15 U.S.C. 1692g ( b ) ( emphasis added ). On XX/XX/XXXX, nineteen days after the date of XXXX debt collection letter, XXXX counsel XXXX sent XXXX a letter declaring that XXXX disputes your debt collection-related allegations, denies the same, and demands strict proof and verification thereof. Record at 21. As such, XXXX should have ceased his debt collection efforts immediately upon receiving that letter. Instead, XXXX proceeded to obtain a default judgment against XXXX on the debt collection claim before he had mailed XXXX the necessary verification and, thus, violated 15 U.S.C. 1692g ( b ).
XXXX maintains, however, that there was no violation of the FDCPA because he sent adequate verification of the debt [ to XXXX ] in the XX/XX/XXXX notice of claim. Brief of XXXX at XXXX. Specifically, XXXX claims that a copy of the consumer credit contract between XXXX and XXXX XXXX attached to the notice of claim provided sufficient verification of the debt within the meaning of 15 U.S.C. 1692g ( b ). We can not agree.
The contract in no way provides sufficient verification of the debt. A review of the document reveals that it identifies only the terms of XXXX loan, including a 17.99 % annual interest rate and the original loan amount of {$2500.00}. The loan agreement contains no accounting of any payments made by XXXX, the dates on which those payments were made, the interest which had accrued, or any late fees which had been assessed once XXXX stopped making the required payments. Indeed, the existing unpaid contract balance at the time XXXX sent the debt collection notice was at least {$350.00} more than the original loan amount. Therefore, XXXX violated 15 U.S.C. 1692g ( b ) when he failed to cease collection of the debt by obtaining a default judgment against XXXX after XXXX had notified XXXX in writing that he was disputing the debt but before XXXX had mailed verification of the debt to XXXX. We reverse the trial courts entry of summary judgment in favor of XXXX on this issue. '' However, they were still reporting the collection on my credit report and their response, on XX/XX/XXXX and XX/XX/XXXX to the letter I sent them on XX/XX/XXXX was the exact same printouts they sent me on XX/XX/XXXX.

Complaint: I have been complaining for a year to XXXX, XXXX that I am a victim of a fraud at a gas pump. Someone then used whatever ID they stole to obtain a {$500.00} cash advance. XXXX wants that from me plus interest and fees of {$270.00}. I have asked over and over for proof they might have as to who did this, signatures, ID used, pictures etc. They just ignore my requests that they investigate the matter and have placed the account with a collection agency called Cavalry. I made the same requests of them to investigate on XX/XX/XXXX and at this point have heard nothing. My credit is perfect, or was, but I will not pay a debt I did not incur.

In returned they sent me a letter dated on XX/XX/XXXX without any validation. They indicated " they have reviewed the dispute and find the dispute lacking in any specific facts or information which would allow them to conduct an investigation. Because the dispute alleges no specific information to form the basis for an investigation, they are unable to investigate the dispute pursuant to the FCRA. '' In addition to provide more details. Complaint: I seen where I had a collection on my credit report with Calvary portfolio. I disputed through the credit reporting agencies and all I was sent from Calvary portfolio was a debt settlement offer. I requested validation of this debt numerous times and even filed a compliant with the XXXX and Calvary portfolio comes back with the same reply that they validated and sent to my home address. The ONLY thing I have ever received from them was a debt settlement and that was in XX/XX/XXXX. I have not reviewed any type of debt validation from this company and this has been ongoing since XX/XX/XXXX. That is 4 months and still nothing showing what the debt is for, is it my debt, when and who the bought the debt from. Every compliant comes back that they previously validated. I am an honest person and I would not say I hadnt received anything if I had received something. This is a violation of my rights. A debt collector has 30 days to provide validation of an account that is being disputed. I want this removed from my credit reports and not to be sold to another company.

Complaint: On XX/XX/XXXX I submitted a payment to Calvary Portfolio Services for less than was owed in a Pay for Delete agreement. I asked before submitting any payment that this will mean the tradeline is deleted and I never have to hear about it again. This was verbally confirmed by Calvary 's law firm via phone call on XX/XX/XXXX. Calvary is now claiming that there was no Pay for Delete agreement, but this is what was agreed to with their attorneys and I quote " when I pay this it will go away and I will never have to hear about it again '' - I was assured the answer was yes and that I could submit my payment online. Calvary is unreasonably refusing to delete the tradeline, per the agreement made verbally with their lawyers, because I did not get it in writing. I do, however, have a phone call recorded and I will be looking into securing a lawyer if this tradeline does not get DELETED.

Complaint: Dear CFPB, There are four Collections accounts on my three credit reporting agency reports that are either not mine or are reporting seriously incorrect information.
For example, on my XXXX Report there are CAVALRY PORTFOLIO SERV with an open date of XX/XX/XXXX ; XXXX XXXX XXXX with an open date ofXX/XX/XXXX ; XXXX XXXX with an open date ofXX/XX/XXXXand a XXXX XXXX with a open date of XX/XX/XXXX. XXXX and XXXX have similar Collections reported.
Last year, I contacted the three Credit Reporting Agencies about these four collections but all they did was note that I am disputing them. They have not corrected or deleted them. Also, the collections agencies did not respond to my request for validation.
I know for sure that I have not defaulted on any debt for since I went through a divorce in early XX/XX/XXXX. For six years, I have made all my payments on time and so I know for sure these are not my debt as currently reported.
I am extremely worried that these collections are either not my debt or have been re-aged by the collections agencies. This practice of re-aging is a very serious violation of the Fair Credit Reporting Act 623. Responsibilities of furnishers of information to consumer reporting agencies ( a ) Duty of Furnishers of Information to Provide Accurate Information ( 5 ) Duty to Provide Notice of Delinquency of Accounts ( B ) Rule of construction. For purposes of this paragraph only, and provided the consumer does not dispute the information, a person that furnishes information on a delinquent account that has been placed for collection, charged for profit or loss, or subjected to any similar action, complies with this paragraph, if ( i ) the person reports the same date of delinquency as that provided by the creditor to which the account was owed at the time which the commencement of the delinquency occurred, if the creditor previously reported that date of delinquency to a consumer reporting agency After contacting the collection agencies and the three credit reporting agencies, I do not know what else to do. Can you please assist in me in getting these four erroneous collection reports removed from my three credit reports?

Complaint: This is third attempt at fighting off the collection of this debt I have requested from the company debt validation and they have failed to validate the debt.
The company Calvary is stating that on XXXX XXXX2014 that it sent notice under 15 U.S.C 1692g which is required by law.
They're stating themselves in the letter that it was returned as undeliverable and they're right because I never received any letter or notice.
It is also been stated that Cavalry investigated the disputes and verified the information provided, however there's no accurate information to backup their allegation.
The person stated in the account who owes the debt it showed that it was a XXXX XXXX now they're changing their allegations and saying that in the original creditor is a XXXX XXXX XXXX. I'm neither of those two names my names is XXXX XXXX XXXX requesting to have both of these debts removed from credit bureaus where they are been reported and cease collection records as they are not my debts.
