Complaint: By failing to adhere to both California law and the rules under CFPB, The party ( ies ) complained of in my initial complaint are not compliant with rules regarding dual tracking. The Parties are " covered '' under both California Homeowner 's Bill of Rights and the CFPB 's strict guidelines. I have a valid and complete loan modification package on XXXX XXXX, 2016 that has been acknowledged as received and no notice of deficiency of documentation has been received by me. I just received another Notice of Trustee during the pendency of my application. The Parties have also failed to respond to the initial complaint with competent and reliable evidence that supports all facts contained within all recorded title documents that were used against my contract rights. Specifically, the assignment ( s ) of deed of trust to an un-verified entity, Notice of Default, Notice of Trustee Sale. No authenticated evidence has been offered by the offending Parties by any person with personal, first-hand knowledge of those facts. I am not in default to an unknown, un-authenticated party that is currently in my chain of title without competent evidence to support the beneficial interest.

Complaint: In XXXX 2014, carrington mortgage became the lien holder for my mortgage which was sold and transferred from XXXX XXXX XXXX. I was never advised of this transaction either by XXXX XXXX XXXX, or carrington mortgage. When I went to make my XXXX 2014 mortgage payment at the local XXXX XXXX XXXX branch, I was advised that I needed to make my payment to carrington mortgage because my current mortgage with XXXX XXXX XXXX had been sold, and bought by carrington mortgage. As instructed, I began making my payments to carrington mortgage from that point forward. In XXXX 2014, I found out that my XXXX 2014 mortgage payment that I made at the local XXXX XXXX XXXX branch never posted to my new carrington mortgage account. From this point forward and to date, I have spent the last year and a half plus trying to resolve this concern with carrington mortgage and to no avail. I have spoken to at least three supervisor 's and three customer service representative 's, and to no avail. I was asked to provide a payment receipt for the XXXX 2014 payment that I made at the local XXXX XXXX XXXX branch, and I have provided carrington mortgage with the requested information they needed and requested in order to research my concern. These six people as listed above listened to my concerns and gave me a false sense of security for an amicable resolution. They refused to call me back, and refused to help me causing me copious amounts of XXXX problems. I have tried on countless occasions to get a higher level supervisor on the phone to try to help me resolve my concern, and to no avail. I have left countless messages for higher level supervisor to call me, and to no avail. Every time carrington mortgage calls, I repeatedly ask to speak to the CEO 's office, and the same answer I get every time they call is that they do n't have the CEO 's office phone number. Some times when I ask for the CEO by name, the carrington representative has no clue who that is. When I ask the carrington representative on the phone to e-mail the CEO 's office have them contact me the answer I get is that they do n't have the e-mail address. Every time that I initiate a call to carrington mortgage, I get the same response as listed above. Over the course of the last year and a half plus, a plethora of notes have been added to my account regarding all the phone calls that I have made to carrington mortgage, and all the calls made to me by carrington mortgage. To help strengthen my position, all of these phone calls have been recorded. I have repeatedly asked carrington mortgage every time they call to provide me with a list of phone activity on the account and they refuse to do so. carrington mortgage has also received a current monthly payment from me every month beginning XXXX 2014 above the required amount due, without fail. I have consistently made on time monthly mortgage payments to carrington mortgage every month in the amount of {$1300.00}. carrington mortgage continues to willfully, maliciously, intentionally, and consistently misapply my current and regular monthly payments, continues to charge me late fees and property inspection fees, and continues to report me as late sometimes 30 to 60 days late to XXXX, XXXX, and XXXX, along with charging me a whole host of other ridiculous fees and charges. carrington mortgage on any given day with harass me with either robo-calls three to four times a day, or they have their people call me three to four times a day. I have tired countless avenues to get a local phone number for carrington mortgage and every avenue leads me back to the same toll free customer service phone number that never lets you go any higher within the organization. carrington mortgage is bullying me and I need your help now.

Complaint: Issues I have with Carrington are the following : 1- Carrington has neglected to respond to our Faxed/Telephone/Email request for the following : Payment of {$1400.00} was made on XX/XX/XXXX to bring my property tax that I was behind to {$0.00}. Carrington had already paid property taxes for the XX/XX/XXXX/XX/XX/XXXX before I made this payment. So that from this date forward Carrington would be able to collect escrow for the next years taxes and continue to show me current. This has not been the case! Also the payment I made is not reflected in the 12 month history and the Research department was asked to work on this and had 30 days to come up with a solution to what happened and has neglected to respond. To confirm that payment was made I have the online bill paying receipt # of XXXX received from Carrington that very day [ XX/XX/XXXX ]. 2- On XX/XX/XXXX I started, with my counselor from XXXX XXXX XXXX for Homeownership, a program with Carrington to " catch-up '' my property taxes that were in the negative. The representative [ XXXX ], was going to provide a 3 year program to become current with my property Taxes. I sent a Qualified Written Request [ per XXXX 's advice ] to ask for a 5 year program to catch up my properly taxes and Carrington came up with a 3 year program instead. My problem is I have no record that I am in a 3 year program. No record of a correct escrow. The escrow is showing funds I have asked to be put on my principle [ I paid extra and made sure I requested " for principle only '' ] are showing up on Escrow and yest instead of escrow going down it has gone up. Please explain to me in simple terms how this can happen when as in # 1 above shows I was current. Also in this arrangement I confirmed with Carrington that there was no penalty for early payoff. 3- Because of the Carrington 's Escrow 's many inaccuracies, my payment [ PITI ] has never gone back to what it should be. I received a XXXX % Loan Modification through XXXX that brought my payment down to {$510.00} [ PITI ] and has never been this mortgage payment with Carrington. I would like to have an explanation of why I am not making my HAMP Modification payment of {$510.00}.

Complaint: Hi, On XXXX, from XXXX XXXX, I had a loan to purchase a house, on XXXX XXXX XXXX switched the loan to Carrington mortgage services ( they do n't have office in the state of Texas ), since then I having problems with this company because all they 're telling me is n't true.A couple of days ago I received a letter saying that they increased the home payments, I called, and they say there are XXXX reasons, XXXX reason was because the insurance went up, the other reason was because the XXXX city taxes went up, but I told them that this house is exempt of taxes because I 'm XXXX, then they change their mind saying that there is an error on the XXXX contract, I asked them where is the error because I have copy of the contract, then they changed their mind again saying for other reason not written in the contract, so they lie to many times. I 'm disable, they do n't have office in Texas, and for me is very hard to talk with a manager to ask why they lying to much. I was paying $ XXXX/ month and they increased to {$400.00}, and if I add the difference of the insurance, go to {$370.00} no {$400.00}. What action I want you to take? transfer the loan back to XXXX, but they Carrington wont do that. I need your help

We spoke on the phone and she said that this information will be taken off. When I later checked it had been corrected. Complaint: I submitted my XXXX XXXX mortgage payment via Carrington Mortgages automated payment system on XXXX/XXXX/2016 for XXXX/XXXX/2016 which was a Sunday. This was done electronically so I assumed it would post but I knew it wouldnt process until the next day. The automated system stated that payments on weekends and holidays would PROCESS the next business day. It did n't say post the next business day. So Carrington posted my payment for XXXX XXXX although even the documentation they sent me states XXXX XXXX. This caused me to receive a 30 day late on my credit. I disputed this with their research department who refused to correct the 30 day late. I feel this is unfair credit reporting and wish to have it rectified.

Complaint: I made a electronic payment online with my bank on XXXX XXXX, 2016. My bank notified me on the XXXX XXXX, 2016 and told me the payment will be rejected due to an error on the bank not telling/or putting it in writing that thier customers can not set up payments with all accounts. I contacted Carrington Mortgage to inform them of this and I was told that as long as I get the payment in I will be fine. I went to a XXXX XXXX at XXXX and paid the mortgage payment as soon as I disconnected with Carrington Mortgage. I called Carrington Mortgage back and informed them of that the payment was submitted and they confirmed they received it. I then spoke with the manager XXXX who informed me that I would need to send in the information in pertaining to my bank so it does n't go on my credit report. I sent the information in and called and confirm they received it. I was told by the resolution department and the manager that this would not go my credit report, but Carrington Mortgage sent me a letter today informing me that the late payment will go on my report even though it was my bank'statement fault and provided a letter showing that. My fiance and I are XXXX and Carrington is treating us very horrible.

Complaint: CMS LN XXXX XXXX XXXX XXXX XXXX # XXXX, XXXX CA XXXX XXXX XXXX We caught them doing some questionable things at the beginning of this transaction. Please see attached previous CFPB complaint. Escrow is trying to close today XXXX/XXXX/16. A payoff demand was ordered from Carrington on XX/XX/XXXX. We were told we would have the payoff within 3-5 days. We have called in multiple times since then ( at least 6 total ). We have gotten a different story every single time we have called. One call we were told it would be 3-5 days. The next call we were told the request was closed out and the new time frame for providing a payoff would have to start over. The rep had no ideas why it was closed out. Then it was escalated again. Then we were told we would have a payoff within 24 hours. ( we never received it ) Then we were told we would have it by the end of business that day. ( we never received it ) Then it was escalated again. Then we were told it would take at least 10 days to get a payoff. We have never received the payoff demand. We have been told a completely different story every single time we have called them. This has been escalated multiple times, as well as cancelled multiple times within their system. As of today, they are now telling us we wo n't get a payoff demand until after the foreclosure date. Is the refusal to send a payoff demand Carrington 's version of retribution for filing the first CFPB complaint? Kinda seems that way ... .. We know that Carrington has no intention to allow a full payoff of this loan. They never did. They instead want to foreclose on this property and send it to their real estate division in order to keep the equity in this property for themselves and get paid a commission for the sale. THIS HAS BEEN THEIR GOAL FROM THE BEGINNING.

Complaint: Carrington Morgage Service purchased the loan servicing of my mortgage from XXXX XXXX XXXX without notifying me of the change. I had paid the mortgage each month for years with a ACH withdrawal directly from my checking acct. When they presented the first withdrawal request to my bank in XX/XX/XXXX the bank processed the request and deducted the funds from my account. Three days later the funds were returned because CMS rejected the transfer. Neither the bank or CMS contacted me that there was a problem. In XX/XX/XXXX CMS presented another withdrawal which my bank honored. CMS accepted the funds this time and credited them to my XX/XX/XXXX payment thus showing my account 30 days delinquent. This process was repeared again in XX/XX/XXXX. At this point CMS had still not notified that there was a problem. Then in XX/XX/XXXX they did not submit a withdrawal request to my bank. I discovered the problem when I received my XX/XX/XXXX bank statement and an email from XXXX CMS had reported my mortgage 60 days delinquent. I contacted CMS and was told my bank had not processed their ACH request and that I was over {$4000.00} behind in my mortgage payments. I immediately sent them a check for the entire amount and followed a few days later with another check for approximately {$1700.00}. I then pulled my bank statements and found where my bank had in fact honored their ACH request. I have forwarded copies of those statements to CMS but they have ignored the information and continue to report I am delinquent in my payments to them. They refuse to provide me with any contact information other than a PO Box number. I have now sent them XXXX different letters explaining the situation along with copies of my bank statements clearly showing where they returned a ACH draw to my bank. They have ignored everything I have provided them and not only continue to report to the credit rating agencies I am 60 days delinquent but also to charge me late fees and refuse to accept future ACH payments.
