Complaint: Approximately four months ago I initiated a loan with Bank of America through a man named XXXX XXXX, the application number was XXXX. Bank of America assigned a closing date of XXXX XXXX. We requested this to be moved up to XXXX XXXX and they ignored that request. On XXXX XXXX and XXXX I was contacted by XXXX XXXX XXXX of Bank of America saying- after all of the underwriters had approve the loan previously- that they needed more information. The information they needed was assurance that I had more than {$40000.00} in cash reserves. I do most all of my banking at Bank of America and have roughly {$350000.00} available to me and Bank of America has access these accounts. The next day- one day prior to closing - XXXX XXXX contacted me again and said they had noted a payment to XXXX timeshares I own and I had to explain this to them. I own XXXX timeshares and I get bills every year like anyone who owns a timeshare and I paid them. I sent this information to them with a promise that we would close shortly the next day today XXXX XXXX. On Friday, XXXX XXXX, XXXX XXXX was not available nor washis supervisor. I then talked to another person, XXXX XXXX XXXX, who indicated that he would take that information and send it to the underwriter and that we would not be able to close on Monday but possibly Tuesday or Wednesday. The rate lock expires on XXXX XXXX. I fear that Bank of America after having this loan application for four months is now intentionally delaying the closure until the rate lock expires on XXXX XXXX, in order to renegotiate the loan in light of XXXX of the Federal Reserve indicating that rates will go up. I hope I am incorrect in this but I do need some assistance from someone with more clout than I have to get this loan closed in a timely fashion. I have spoken to an independent attorney and an independent mortgage broker both of whom indicate that the material they request is absurdly inconsequential and they feel the bank is not acting in good faith.

Complaint: Until approximately 2 years ago I believed that in XXXX of XXXX. I had purchased a manufactured home on a lot that would qualify for FHA financing. I was forced to stop making in payments in XXXX XXXX because of a job loss. After several years of trying to figure out why B o A refused to assist me with my very deeply underwater mortgage, I filed suit against Major Mortgage with B of A as successor in interest for appraisal fraud when I discovered that my house had been moved from where it had previously been lived in ( in violation of XXXX underwriting guidelines ) and that the appraisal was fraudulent. Several investigational activities were conducted and it was later discovered that the original title report was performed only on the lot and did not include the house. This issue was not part of my original suit. Additionally, I discovered that the State of Nevada performed an investigation in XXXX and determined that Trust # XXXX with XXXX XXXX, and XXXX and XXXX XXXX XXXX as beneficiaries did not own the house. They in fact never owned the house as claimed at the time of the alleged " sale '' to me. This issue caused the State of Nevada to have XXXX XXXX hire XXXX XXXX XXXX XXXX to find out who the actual owner of the house was at the time of sale in XXXX of XXXX. This was required so that the state of Nevada could complete the process of converting the property together with the home as real property. I was never notified of this investigation.
On XXXX XXXX, XXXX the State of Nevada Department XXXX issued an Erasure Affidavit stating that " ... XXXX was not the owner '' as the house had been repossessed. '' It seams that a XXXX XXXX XXXX XXXX was still the owner of record with XXXX XXXX as lien holder. This remained the case until XXXX of XXXX when title to the double wide was finally transferred to me. This appears to be a clear violation of XXXX rule stating that the " ... sale of a property must be from the owner of record and that the transaction must not involve any sale or assignment of the sales contract. '' Bank of AmericaXXXX Foreclosure Services filed a Notice of Default on XXXX XXXX XXXX against a mortgage contract that does not exist due to the fraud committed by the seller and as per XXXX XXXX regarding the voiding of conveyances made to defraud prior or subsequent purchasers of real estate. The filing of the NOD as well as the fact that they are ignoring my Notice of Rescission ( based on the lack of legal conveyance of the title to the house at time of " sale '' -- you ca n't legally sell a house you do n't own ) dated XXXX XXXX, XXXX is a clear indication that B of A and XXXX have no regard for the law and hope to profit against the frauds committed against me.
Mediation was conducted in XXXX, XXXX XXXX XXXX XXXX, XXXX. The local attorney contracted by XXXX XXXX ( foreclosure mill ) the day before showed up without a copy of the appraisal and without the authority to negotiate anything, but with an utter disregard for the facts regarding this case.

Complaint: I filed a claim with Bank Of America regarding an individual stealing my cards and making transactions on my cards. XXXX card was approved while the other was investigated, upon speaking to the representative they went into my other account where it was proved that fraudulent charges were made and she overrode the decision on it when I did not authorize her to even investigate that account. She was very rude and condescending as well as extremely unhelpful. I kept asking for specific documents I would need to provide to show that these transactions were not mine and she was very vague. Now she 's going to re-bill my accounts and force me to make payments on transactions that I did not make nor authorize. It 's upsetting that all my other banks were very helpful while Bank Of America has been horrible. I got upset and hung up the phone on her because it was very obvious that she was not interested in helping me and kept making attempts to get me off of the phone. Terrible service and employee from Bank Of America.

Sued w/o proper notification of suit
Complaint: I was the victim of an Illegal Debt Collection Lawsuit Mill owned and operated by XXXX XXXX XXXX XXXX XXXX, a Georgia-based law firm. From what I can tell, apparently XXXX XXXX XXXX XXXX XXXX take care of all the legal proceedings for XXXX XXXX, a company that purchased my credit card debt from XXXX, in the amount of {$3500.00}.
Back in XXXX, I went through a financial hardship, and was having difficulties maintaining my mortgage payment and keeping up with credit card debt. I had no choice but to walk away from our home and all debt. As a consequence for my financial irresponsibility, my credit score dropped all the way down to XXXX and stayed there for over 7 years, making it very hard for my wife and I to purchase things like automobiles, a new home, or get any type of new credit.
At the XXXX, nearly 7 years later, most of that bad debt started to drop off of my credit report as a result of the Fair Credit Reporting Act ( FCRA ) rules and regulations. Through secure credit cards and other means my credit score started to improve ( XXXX ).
Then in XXXX XXXX, while logging into my credit monitoring account ( XXXX ), I noticed that my credit score had dropped significantly. It was the result of a new default judgement showing up as a public record. Here are the details of this judgement : Date Filed : XXXX/XXXX/XXXX Reference # : XXXX Court : XXXX CO Magistrate Plaintiff : XXXX XXXX XXXX Amount : {$3400.00} I was never given notice of this lawsuit, nor was I ever served. I believe this debt had already exceeded the statute of limitations from the date of last activity ( DLA ). Yet, it is not haunting me, and preventing me from purchasing a new home many years later.
I also found this article published on your site related to the the unethical business practices used by XXXX XXXX XXXX XXXX XXXX, in attempt to make financial gains, through the use of questionable default judgements, at the expense of their victims.

Complaint: I noticed online I had XXXX overdraft fees of XXXX a piece to the sum of {$170.00} and XXXX overdrawn limit fee of {$35.00}, totaling {$210.00}. I set up an appointment for thursday, XXXX XXXX @ XXXX and once there explained that my grandfather was recently diagnosed with XXXX XXXX which has also affected his XXXX and only has a short time frame XXXX and so I had been having extra expenses dealing with family and my father in helping my grandfather. When I visited the branch location at approximately XXXX I waited. There was another lady that arrived XXXX minutes after me and firstly they saw her first in which she did not have an appointment. I work XXXX with XXXX so I understand formalities, but also common courtesy. I explained to the first agent ( do not know her title ) regarding what had been happening and that I am requesting forgiveness of these fees due to circumstance. She advised me that her manager would make that call and she had to go talk to her. So, she went to do that and a manager came over and immediately stated that their system would not allow them to do it, and immediately told me to open a line of credit to take care of it. I was confused and asked who is the manager and who is in charge as the first agent made it seem as though she ( the assistance or whatever her title is ) would make that decision. She immediately tries to sell me on the idea of a credit card again. I 'm thinking how is this product going to help me right now in the moment with my situation and fees that I have by opening a new line of credit and dealing with family issues. So, they advise me, the manager, XXXX would be who I would speak with. They also advise me that she would be in that afternoon. So, from XXXX XXXX I call several times but could not reach her. There was not an email on the card they provided me. So, when I did reach someone, a gentleman answered and he took my information and stated that she would call me back. Well, I never heard from XXXX. No one every called me back. Not good customer service. I have been a customer over 10 years and if these fees can not be waived I will be closing my account and moving to another bank.

Complaint: On XX/XX/2016 I received a call from a representative from the loan processing center of Bank of America regarding a recent application the under review. I believe there was premeditated intent to mislead me with the intent of gathering a statement from me with misleading questioning designed to profit their case against against me, under false pretenses this conspiring to deny me rightful credit approval has been propagated by several individuals therefore I suspect collusion. A further inquiry of this phone conversation will reveal several co-conspirators of this malfeasance of civil rights violations of fair lending? I am a minority and I demand an accounting of this habitual antagonistic contentious pattern of behavior towards under-represented people borrowing from institutions who were themselves saved with bail out money from ordinary people, like myself who pay their taxes.

Complaint: My mortgage was initially with Bank of America. In 2007 Bank of America transferred our mortgage to XXXX. In checking my credit report. My mortgage is being reported as XXXX times 90 days late in 2007. Our mortgage was never late!!! We paid Bank of America on time each and every time. They or XXXX is falsely reporting this. Also, it is listed in 2007. When XXXX got the loan they began charging us approximately {$690.00} per month in PMI on a XXXX dollar mortgage. This has to be against the law and unethical at least, price gouging a consumer. I have tried numerous times to get this straightened out with XXXX but never get anywhere. I feel we are being held hostage by this mortgage company who then just in the last two months has transferred our loan again to someone called XXXX. I have asked for our original mortgage documents, they said they would send them but I have not received them. This has been one month ago. I had never seen the late reporting from Bank of America until we went to our credit union to refinance our mortgage because we ca n't afford the payment which continues to go up and is now at {$1900.00} per month because of the PMI. Our loan officer at the credit union could n't understand why my credit score was in the 600 's until she kept looking and found the 90 days late for XXXX times being reported from Bank of America!!!! Help!!! How can I get this removed, it is false and damaging information.
