Complaint: We have not made a home loan payment to Bank of America ( our home loan carrier ) since XXXX, XXXX, and that payment was late ; for XXXX.
I was told by XXXX XXXX XXXX XXXX XXXX that for {$2400.00}, we could stop making payments and get an amended or refinance for our home loan. So in XXXX, XXXX, we stopped making pmts to BoA. Several months later, XXXX was shut down for operating illegally, and I found a non-profit corp. in our town to help us deal with BoA on saving our home. A few things contributed to our inability to make the 5 % fixed 30 year payments of XXXX $ XXXX ( incl. late fee ) - a death in the family and a forced early retirement for me. We had about $ XXXX in other debt, which ( with help ) XXXX got settled with each lender for ~ XXXX total and then built up a $ XXXX savings toward a new home-loan modification, and worked to pay off the final XXXX, which is done, and our XXXX payments have started coming in in XXXX for XXXX spouses. We have just over $ 3800/month total income now ( incl my XXXX. pension ), and this was all forseeable and could have been enough to work with even XXXX3 years ago, with a payment that would increase when the XXXX payments started to arrive each month.
We could easily save our home, but BoA said they did not have a program to make adjustments, or have a balloon pmt due later, or whatever we could have done, so i worked as hard as i could to get all other debt down, and prepare to make much larger home-loan payments. - The thing is, for the previous 20 years, I had always financially prepared for any financial hit, such as happens to almost everyone at some time ; Loss of a job, or death in the family, etc.. I had an old radio/junk collection, as an inventor, just glancing at parts & pieces of it would inspire me for electrical/mechanical design, product designs, style.. Well, weeding that collection out on XXXX could always get us thru the rough spots when unforseen bills would arrive, etc.. But, when the Banks ( BoA, etal ) threatened to crash the XXXX economy if they did not get their XXXX emergency loans in XXXX XXXX, and our economy went into a tailspin anyway ... It was MY credit rating that became affected, not theirs, and the XXXX market collapsed too. I stopped under that situation and burned out. In XXXX, an application to BoA for loan mod included {$500.00} sales in XXXX weeding out of junk, so that after expenses, $ XXXX/month more was available, and from XXXX, XXXX to XXXX XXXX, I proved I could do that, while weeding out my collection of XXXX junk. I could show BoA that i could do that, but they never asked for my records, and so then, in XXXX XXXX, my mom gifted me $ XXXX for 18 months, payments to help us qualify for a loan mod. & signed a letter to that effect. BoA wanted her financials with only # XXXX & # XXXX pmts remaining. There was so much foot-dragging by BoA, but I just kept my mouth shut and hoped for enough delay that our XXXX pmts would arrive before foreclosure time, and they did, but the delays kept being.
In all the time we have tried to deal wht BoA thru our local legal non-profit, they would accept to review the case, but would try to engage us, and did XXXX3 times ), by going around the XXXX to dealing directly with my wife & I. Everytime we sent in a new application that showed an improved financial picture, BoA sat on it until the bank statements needed updating. Delay delay, ..
But, that dual avenue approach was not right. IT was also very stressful. My wife and i are now separated and I '' m still trying to same the home for her and our daughter. It has been a long & stressful 5 years, but now BoA is selling the complete file to XXXX Bank, and all this time, they managed to not lower our 5 % fixed loan to easily under 4 % any time in the last 3 yrs, and we will be fleeced for every last dollar while BoA takes their profits all the way to themselves.

Complaint: {$3000.00} worth of CD 's purchased at Bank of America in 2005. We have the certificates and the receipt showing the transaction. BOA now says they ca n't redeem them because they purge their records, and this money must have been sent as Abandoned Property to the state of Florida. Contacted the fltreasurehunt.org, both online and by phone. They have nothing under either our son 's name or mine ( custodian, as son was a minor ). Called the FDIC, who instructed me to contact you. NOTE : When he turned XXXX, XXXX legally changed his name to XXXX XXXX XXXX. We searched the florida abandoned property under both names, as well as mine.

Complaint: I am submitting this complaint because of an ongoing " issue '' that Bank of America continues to use against me to deny my modification. When I purchase my property with my father in law XXXX XXXX XXXX in XXXX, I had an ITIN number and he had a valid social security number. The loan officer at the time was aware of this and stated it would not be a problem. In XXXX we refinance to remove my father in law and I provided my new approved social security number. Apparently, my loan was not reflecting my credit so a few months later in XXXX I went with the loan officer and he said he would fix it because BofA was sued under the National Mortgage Settlement and my loan was affected. XXXX, Bank of America started hassling me about another social security number and refuse to help with my modification. I explain the whole situation to BofA and told them when we first purchase the home the loan officer asked if I had another number from my ITIN but I was in process of becoming a permanent resident so I told him not yet. BofA made me sent different XXXX forms with my old ITIN number and new social security number. Then BofA wanted me to submit an XXXX form with the social security number that the loan officer used to refi my loan. Obviously, I had no knowledge of the old social security number so Bank of America provided me the loan number and I submitted the form so they could find out what fraud was done against my loan. Now, BofA had fixed all of this and told me my loan was under review and pending approval for modification. They ask for copies of my social security number, permanent resident card and ITIN number card. On XXXX/XXXX/XXXX, I spoke with XXXX in the loss mitigation department with BofA and informed me the sale date was pending for XXXX/XXXX/XXXX and they were no longer reviewing my loan for help despite having a complete packet. I requested a manger and was transfer to XXXX. XXXX with BofA informed me that a complete packet was received and was under review and he would submit a postponement request to cancel the sale date. XXXX said XXXX XXXX was the assigned account manager and would have ensure my sale date would be canceled since my complete packet was received 14 days prior of the sale date. I was told to follow up with XXXX XXXX within 48 hours for update and sale cancellation. I called back on XXXX/XXXX/XXXX and was informed by XXXX that my file was no longer being review and the sale date will proceed because of an outstanding issue. I asked about the issue and she said she was not able to discuss it over the phone but had mailed me a letter with the explanation and had to wait. I asked about my sale date and she said they would continue and I told her it was absurd as she refuse to tell me the issue and I had to wait to respond but if I received the letter after my home sold then it was not their fault but the postoffice. I did not like her response so I asked for a manager and was transferred to XXXX. XXXX informed me despite XXXX helping me on XXXX/XXXX/XXXX BofA would no longer work with me because of the outstanding issue with my social security and I told her it was resolved and I was under review. XXXX went into the notes and stated that because of Fraud committed they could not proceed. I told her BofA did fraud and were sued because of refinancing using robot signing and false borrower information. I always provided my ITIN number and had switch everything to my social security number once I was approved to be a permanent resident. XXXX became defensive and refuse to acknowledge why my account was under review 2 days prior and now acts like it is not BofA problem. She was trying to intimidate me and said no one would help me not even the CFPB weather the fraud was on their end it was my problem. Please help me. I have a valid social and their trying to pin their fraud on me and want to sell my home.

Complaint: I used the Bank of America App to transfer money to my friend, XXXX XXXX. On my list of recipients for person to person transfer ( using mobile numbers ), I have a few people. When I transferred {$1500.00}, I sent that money to a wrong person on my list, XXXX phone number. The problem here is..the phone number for XXXX XXXX on my recipient list no longer belongs to XXXX XXXX. I called BOA right after I transferred the money and BOA could not credit back because the person ( who has XXXX phone number ) already took the money. About three weeks after I field a claim, I received a mail from BOA, and they can not credit back because they can not contact the other party. My account record still shows that I sent money to XXXX XXXX, not the unknown person who has XXXX phone number. I have all the records regarding this issue.

Complaint: Due to an error in paperwork with my city of residence, Bank of America was served a legal notice to have nearly {$120.00} dollars debited from my account, which it followed through on. Bank of America then charged an additional {$120.00} non-refundable fee. Even though this transaction was the result of an error, it is not the city 's responsibility to refund the {$120.00} fee that Bank of America received -- an exorbitant amount that the city will not agree to, as it is more than the amount they originally sought. Bank of America representatives reminded me that the {$120.00} is non-refundable because of the amount of work it takes to process anything legal, but the fee is excessively high and I am left paying for the city 's error and Bank of America 's avariciousness.

Complaint: This is a tale of a merchant account set up by Bank of America ( BAC ) without my permission and without any due diligence.
On XXXX/XXXX/XXXX, I received from XXXX a package that contained a merchant account data input device that was sent from Bank of America. My wife also received a voicemail message from XXXX at BAC, XXXX XXXX XXXX XXXX, asking about some charges against the merchant account in the amount of approximately {$10000.00}.
On XXXX/XXXX/XXXX, XXXX called me on my cell phone and asked about charges on a merchant account. She said the account was opened in my name with my social security number ( SSN ). I told her that I did not open the account so she said she would close the account.
I immediately checked my credit reports for XXXX through a XXXX online query. None of the XXXX agencies had a record of a recent request for credit.
In a later call to BAC, I obtained the merchant account number : XXXXXXXXXXXX.
I filed a report with the local XXXX ( XXXX ) Police Department ( XXXX ) on XXXX/XXXX/XXXX. The XXXX kept the shipment from XXXX including the data input device as evidence.
On XXXX/XXXX/XXXX, I received a call from XXXX XXXX, reportedly from XXXX XXXX XXXX XXXX My cell phone said the call came from ( XXXX ) XXXX. She said she was making a credit claim as a credit collection service for XXXX XXXX XXXX in the amount of {$1900.00} against the aforementioned merchant ID account number XXXXXXXXXXXX. She gave me a reference ID number YYYYYYYY and a direct line phone number to call her back ( XXXX XXXX XXXX. I told her that the account had been closed by BAC last year ( as described above ).
I called XXXX to discuss the status of this and spoke w/ Nativa at BAC mobile support, ( XXXX ) XXXX. She said that the merchant account was closed and that the call was a phishing call and that I should ignore it. I asked her to send me a letter or an email to confirm what she said and she said that she could not do that.
I have not called XXXX XXXX to follow up on their claim.
I have been damaged by the reckless manner in which BAC opened the merchant account without due diligence and I continue to be harassed by other parties as a result of their gross negligence.

Complaint: A friend made a deposit to my Bank of America account through his XXXX bank mobile app for the amount of XXXX dollars on XXXX XXXX. The money was supposed to be on my account in less than 6 business days. We contacted both banks and they could not track the money because it already had left their system. After a week of phone calls we both went to XXXX bank and Bank of America to speak to the managers. The Branch manager at XXXX said the money had already left their system and that his " theory '' is that Bank of America accidentally put the money on a different account. The relationships manager at Bank of America said that the money never reach my account and they can not track it. I got a confirmation message on the day the transfer was made to me and my friend got a confirmation email as well. We emailed XXXX managers saying that if the money did not appear on either of our accounts by XXXX XXXX, 2016, we were going to file a complaint but neither of the managers reply or try to contact us to solve the problem. We then call the managers at XXXX banks and they basically said that they do n't know where the money is and they do n't think is their responsibility to solve the problem and pay my account or refund my friend 's account.

Complaint: There is a Fee that has n't been resolved. After speaking with Various Bank of America loan specialist, a " XXXX '' Fee of {$540.00} is still being charged to my Mortgage Loan. The employees have made up various stories to justify the fee. The reality is that the specialist themselves have no idea what this fee is. The specialist have said that " the house was in foreclosure. '' Which is not true since the house was and has never been in foreclosure. Another even had me go to the city of XXXX XXXX to discuss with them the fee the city then again said that this fee was n't coming through them. Back to my point that Bank of America has no evident proof that I should be charged this.
