Complaint: On XX/XX/2016 my checking account at Bank of America had a positive balance of {$1100.00}. During the day XXXX electronic debits were presented for payment. They were in the following amounts : {$1400.00} {$33.00} {$6.00} {$.00} Rather than post the XXXX smaller amounts to my account first, which would have been covered by the positive balance, Bank of America, in an effort to create Overdraft Fee Income, posted the largest item first, thereby creating an overdraft balance, them posted the remaining XXXX items. The result was the charging of XXXX overdraft fees of {$35.00} each rather than XXXX. On XX/XX/2016 another electronic debit for {$7.00} was posted and another {$35.00} overdraft fee was accessed. This is an egregious process. To begin with, why did they post the largest item first? Next, its unconscionable to charge {$35.00} for a sub {$10.00} electronic debit. There is no credit risk since they paid the large item and only created {$330.00} overdraft. I have been a customer of the bank for over 10 years. Had they returned the item, I would have only been accessed {$35.00} instead of {$170.00}!

Complaint: My bank of America debit card was lost/stolen/misplaced and someone has used my debit card to complete fraudulent transactions. Bank of America allowed XXXX checks to be deposited and cleared that were then realized to be counterfeit checks. ( {$580.00} x XXXX ) from a company named XXXX that I have no connection with. The checks were cleared and then the debit card was used to withdraw {$1100.00} in cash, and make large purchases at places such as XXXX and electronic stores. This counterfeit money was deposited and then taken out within an hour according to what I was told. I contacted bank of America when I realized my debit card was really lost and my online account had locked me out. Bank of America told me that I am never able to have an account with them again and that I will not be receiving my valid pay check via XXXX XXXX XXXX because my account is in the negative due to the counterfeit checks reversing. I told BOA that I would be filing a police report. I asked BOA if they can tell me the location and time of the atm transactions. I have spoken to many people and I 'm still not 100 % Positive if the transactions took place in XXXX, Delaware, or somewhere in Pennsylvania because BOA cant seem to tell. I am assuming XXXX, Delaware because XXXX XXXX XXXX is in DE, and a representative assured me there is a BOA atm inside of that casino. BOA is not helping me and do not seemed concerned at all that this has happened to me. My hard earned pay check was swallowed whole into a negative account due to counterfeit checks that BOA can barely even verify a location. I also asked if they can locate the ATM and have survelliance pulled because it was not physically me at the ATM. They said I need to deal with the police department!!! terrible! no help from the company that I have been using since I XXXX for them in 2014. please help ps : bank of America security questions - someone, ( probably the same individual who had my debit card ) actually called bank of America XXXX pretending to be me and submitted a fraud claim as if they were disputing these charges, ( before I was even aware of them ) My entire wallet was stolen and bank of America asks security questions such as DOB, full name, and extra security is often a driver 's license # ( I know this from XXXX there and from the fact that ive called them multiple times today and every single time I was asked for my DL 's # which thankfully I know by heart ) Making it very easy for someone with a stolen wallet to easily by pass security!!!!!!!!!!!!!!!!!!!!! My full name drivers license and DOB are all on the ID inside of my stolen wallet, and someone is easily calling bank of America and by passing security with a breeze

Complaint: Sometime last year I was dealing with a rep at Bank of America ( BOFA ) by the name of XXXX XXXX. I submitted a CFPB complaint regarding my home foreclosure and how I tried to modify my home loan, but was never helped. When I did a CFPB complaint XXXX helped me get my documents processed. Once everything was processed he was able to get me a trial period for payments of {$500.00} each month if my trial period was completed successfully. I finished the trial period successfully. A letter arrived asking me to sign the new loan terms and the payment amount was higher. I discussed the matter with XXXX and he said that should have not happened. He said he would fix that issue and asked me to sign and fax the document with the incorrect information. I had no choice, but to sign the document. I faxed it at a BOFA branch and received fax confirmation. During this time XXXX said to pay the {$500.00} payments because that was supposed to be the set amount. I made those payments on time every month. Time passes and I notice that the information in my statement does not make sense. I received document saying that my home will be foreclosed on/in foreclosure process. It was around XXXX when the bank stopped accepting my payments. This lead me to create another CFPB complaint about 3 or 4 months ago. At this time BOFA was requesting that I make payments of around {$950.00}, which was not apart of the agreement. In addition, the terms of the loan did not make sense. After my second CFPB complaint, another rep from BOFA contacted me ( XXXX XXXX ). She explained that somehow my initial medication agreement paper work was not processed and that 's why I was received the threatening foreclosure statements and the increase in monthly payments. She tried to help me and looked into this matter. On XXXX XXXX I received a letter with the correct payment amount for my monthly payments with a new trial period beginning XXXX XXXX, 2016. Again, I made the payments AGAIN. I found it ridiculous to go through this process again. Why could n't bank of America just fix THEIR error???? Why do I have to go through this mess again? What can I do? I am forced to do whatever they say because they leave you no choice. I have showed intent to pay. I have made a year worth of payments. On the XXXX XXXX document, I was instructed to fill out the new contract and send it back to BOFA in 15 days. I contacted XXXX XXXX explaining my issues. 1 ) the information on my credit is inaccurate because BOFA dropped the ball and did not process my original accepted modification agreement. XXXX XXXX said it is now fixed. 2 ) The maturity date of my loan does not make sense. She said my maturity date had been extended, but it has not been extended. I also was curious as to if I was in a balloon payment because I thought it was a 30 year fixed. Throughout this time, I have been playing phone tag with XXXX XXXX. Everytime we had an appointment to discuss the answer to my questions, she was never available at her appointment. Everytime I left her a message, she never responded. It would take atleast XXXX messages till she would respond. This is not fair. She said she closed the matter on her end, but she never answered my questions. Till this day the issue of my maturity date is not resolved. BOFA has sent me letters regarding my payments for my home loan that are misleading to me and to them. They should not force me to sign something that is not clear. Especially when their letters have conflicting information on it. I would like to speak to another rep. Time is of essence in this matter, and XXXX XXXX does not understand that. Now my home has a sale date of XXXX XXXX, 2016. I do n't know why BOFA is harassing me when this whole issue began because they dropped the ball by not processing the modification agreement last year.
