Complaint: This began XX/XX/2016 when I attempted to contact Bank of America to inform them, that in order to meet my new principle and interest payment on my Home Equity Line of Credit account, I would need to make arrangements for a 3rd party company to automatically draw XXXX % of the payment twice a month ; and then submit my monthly payment to BofA on my behalf. This is referred to as the " XXXX. '' I needed specific information from BofA to ensure the " XXXX '' would send the payments to the correct location with the appropriate account information. I was immediately told I could not do that ; that I would have to go through B of A 's loan modification process. I expressed, that I did not feel a loan modification was necessary ; that I really just wanted to report my intentions around how I would make my payments moving forward. I acknowledged that my process would cause the account to become 30 days late, but that was only supposed to be temporary, until I came up with the additional payment to push the account ahead. I was told by customer service, I had no other recourse but to modify the loan. I expressed that I did not want delinquent reporting regarding this account in my credit report. I was told that once the loan modification process was complete, they would clean-up negative credit listings for the account for the time I was engaged in the modification process. I found out weeks later, that information provided to me was inaccurate. I stated I wanted to get started with the " XXXX '' anyway, but was told not to because it would jeopardize the modification process. Again, weeks later, I was told that was bad advice and erroneous on the customer service agents part. Fast forward, I had to initiate contact twice about the loan modification, because I was not assigned and/or received information on who the account manager would be in a timely fashion. The second time, I was given the name of XXXX XXXX. Days later, I received a call from her. Due to limited space, I will condense this story to this : between XX/XX/XXXX and XX/XX/XXXX, though I submitted EVERYTHING requested of me by the due date ; BofA were not timely in their feedback and response to the matter. They even loss my paperwork XX/XX/XXXX, XX/XX/XXXX, then stopped reviewing the account claiming I had not submitted all the required docs. I had to submit proof to the contrary and did. Now comes the interesting part, they denied the modification. The account is now 7 months delinquent and now when I call to get assistance in resolving the issue, the only conversation they will entertain is a short sale. I have been literally transferred to dozens of departments within B of A, and the communication essentially is 'stonewall them ' and take away the property, we can foreclose on you and advice to short sale. I have requested a letter of default, which should contain all the account information I need to prove a hardship and get funds released from my 401K to bring the account current and prevent foreclosure. Still BofA continues to refuses to be of valuable assistance in this matter and flat out refuse to provide such documentation and will not attempt in any way to assist in putting me in contact with the dept that handles this type of business within their institution. This lack of effort on their part is preventing me from saving the property utilizing the only option I have available to me. Please note, Bank of America claimed as of today, XX/XX/2016 ; they have not initiated foreclosure proceeding, nor drafted a " Breach Notice, '' Everyone in their organization, is playing dumb. they foreclose, it will become much more expensive to restore the account to current standing.

Complaint: A Bank of America ATM card, issued to bank patrons, allowing a customer to access their accounts stopped working in B of A ATM machines. The card did work at the banks inside teller Windows. My branch tellers thought that strange and advised me to call the B of A telephone number on the back of the card since the card was not damaged and did work if I entered the bank. I called number on the back of the card and was advised that the account was active and that problem should not happen and they would replace the card for a {$5.00} fee. Since this card was originally issued by B of A when opening my account and thru no fault of mine the card no longer worked, B of A should replace the card instead of passing on an ever growing number of fees costing the consumer excessive financial burdens. As an additional note my local branch advised me they were getting numerous complaints from customers regarding excessive fees, that they as a branch had no control.

Complaint: I obtained my home loan through BoA ( of course they only administer it now, as it was bundled and sold to XXXX XXXX ). Over the last 3 years I have sent an additional payment to be applied against the principal of my home loan four different times, and each time the funds have been credited as future monthly payments rather than towards the paying down of the principal. Each time I must call customer service, wait on hold for 35 min. and then spend another 10 min. getting it sorted out. Each time I have been told that I have done everything correctly in the way the payment was clearly marked " Principal Only '', and that they do n't know why the " mistake '' was made in how the funds were applied. Four out of four times is not a mistake, it is a clear pattern. It appears that Bank of America wants to make it difficult for the millions of customers, whose loans they administer, to pay off their home loans early. It must not be in their financial interest to have us do so, but it is our legal right. I have already filed complaints through official BoA channels and sent letters to executives of associated departments. No improvements in 3 years. If they wanted to provide the service they claim to provide, they could easily put the right systems in place. We bailed these greedy cheating folks out in a big way, it is time they were held accountable, time for them to perform as advertised.

Complaint: Over {$7000.00} of fraudulent purchases were applied to my account. The purchases were with XXXX merchant, XXXX XXXX House. They are a mail order DVD service. I have never done business with XXXX XXXX House. I submitted all the information Bank of America required to file a claim. Bank of America has not credited my account. Worse, it is impossible to reach their Fraudulent Services department. They provide a phone number to contact them, but I have to wait hours on hold before anyone will answer the phone. When I get a representative, they tell me a supervisor is required. I am then put on hold for hours again. It seems if the system is intentionally designed to discourage and prevent cardholders from resolving fraud claims.

However, about a week to 10 days before my grace period is up they charge an extra {$6.00} for me to make the payment on line. this was not in ther terms of my initial loan agreement and I do n't see how they can charge that since I 'm not past due. I would like all these fees I 've paid refunded to me and I 'd like to know how to inquire about a class action law suit.

Complaint: Bank of America located at XXXX XXXX XXXX XXXX in XXXX, MA XXXX has chronic shortage of staff. On XXXX XXXX, I try to visit the branch in the morning but the line of customer were pressing out the front door. I left and try to visit the branch again the following morning but the line was even worse as customer are forced out the front door. This branch only employee XXXX tellers and XXXX customer service personnel while XXXX Bank and XXXX Bank on the same street staff their branch with XXXX teller and XXXX customer service persons. Why is that Bank of America under staff its branch compared to its competitors. Bank of America realize there is a staffing shortage however has not made any attempt to address this matter. In addition the bank is aware that in a XXXX neighborhood, often times the XXXX utilizes teller services at a much higher rate than its suburban branches. Furthermore, XXXX we have a large XXXX who speaks XXXX. Currently we have no XXXX speaking teller. By not having XXXX speaking teller adds communication burden and creates longer teller lines there by under XXXX. Why is it that other banks are require to fulfill XXXX XXXX XXXX but Bank of America at this location disregards its obligation under banking act. Why is that CFPB is unable to make Bank of America provide community based banking service

Complaint: Bank of America mailed me an offer advertising zero interest on credit card balance transfers. I called them at XXXX on XX/XX/2016 at XXXX EST and spoke on a recorded line with XXXX XXXX who stated she was in XXXX XXXX , Texas to inquire if they would do it for me. After running a quick credit check, I was told that I was eligible to receive a modest line of credit. I told them I was not interested in that offer and to " cancel my application '' and " I do n't want anything from Bank of America. '' At XXXX I was told " We will close the account. A letter will go out within 14 days. '' Within two weeks I received a credit card in the mail and a notice that a new account had been opened. BofA subsequently contacted me for feedback on their service. My responses were of the worst grade possible in the survey 's scale of answers. I have never heard again from BofA. It would be bad if BofA submitted anything pertaining to this matter to a credit bureau.

Complaint: I lost a card issued by AAA and told them I wanted it closed. They did so and sent me a replacement card. At the same time, I had been issued a new XXXX card and decided to use it and close the AAA card account. However, I had an auto payment on the AAA card ( $ 10 monthly to the XXXX ). I assumed the XXXX would not be able to bill the new card and would contact me. However, it seems the charge was automatically switched to the new card. I regard this as an invasion of privacy by the credit card company. They had no right to switch the auto payment to the new card without notifying me. In the past I have had problems when the card was the same but the expiry date changed, because the bank would then deny auto payment to vendors. But this new system is even worse. I should have the right to switch where I make payments.

Complaint: While my request required escalation after having been long dragged out in my many countless attempts to assume and/or resume loan after death of original borrower ( my mother ). The latest decision I was made aware of for assumption of my now deceased mothers ' loan was provided via email citing " HOEPA fail could not be remediated '', while indicating my request wouldnthen be FORWARDED to Modification Dept for review. In letter from Bank Of America dated XXXX/XXXX/XXXX, I was given notice that my request for modification is denied ( yet again ) and stated reason for denial was because I was not the original borrower of loan and loan is not assumable. Furthermore a call from XXXX XXXX last week called to ask what my intentions were in lieu of decision and inquired of me about making short sale or other. XXXX XXXX inquiry went against letter dated XXXX XXXX, XXXX notifying me I have no loss mitigation options because I am not the original borrower & loan was not assumable. I could only then appeal if I had proof of error regarding Bank Of America decision to deny my request for modification and/or loss mitigation. Well I am unsure how or what proof can substanciate policies already set forth for servicer to follow. As a successor, I am allowed SIMULTANEOUS modification and assumption, as requested. As far as HOEPA fail decision, I believe that is how simultaneous process to assume and modify will then benefit me as the recognized successor in interest. It seems redundant to me to fail HOEPA rules for the high interest rate on loan when originated by my mother and not be able to then modify loan with current, acceptable standards. Why am I not allowed to protect the equity that has been earned and is far greater in value than the total remaining debt that is owed for my mothers original loan on home which I have resided in since XXXX and am willingly and ready to assume and/or resume loan? Instead I have been provided very little guidance, little to none of the servicer rules, policies & guidelines set forth by RESPA, CFPB and/or CALIFORNIA XXXX. I have submitted previous complaint requesting foreclosure sale be cancelled and the foreclosure process itself be withdrawn because of blatant falsified declaration of Due Dilligence by BofA representative ( to communicate account in default and advise of all options for avoiding foreclosure, as required in CA as part of CA Homeowners Protection Act before the foreclosure process can begin ). My previous complaint was noting the very first violation or wrongful action by servicer after my moms death back in XXXX XXXX while this latest XXXX/XXXX/XXXX decision described in this complaint for which I believe is another wrongful BofA decision and/or servicer action & demonstrates the length of time inbetween complaints for my attempts to acquire what should have been simple to acheive, instead of thid emotionally taxing situation causing me stress and anxiety. The XXXX XXXX, XXXX letter from BofA shows example of the outcome for the denials of my many requests made to BofA to resume and/or assume loan & shows a complete disregard by BofA for following any of the guidelines and/or policies designed/created for protection of homeowner allowing receive compensatory fines.

Complaint: I made a charge with my Bank of America credit card on XXXX/XXXX/16 to XXXX ( XXXX XXXX XXXX XXXX ) for the amount of {$810.00} for XXXX car payments on my daughters auto loan. On XXXX/XXXX/16 I learned via XXXX and my daughter that to date the money had not been sent to XXXX. To date this has been triple confirmed with XXXX including at their corporate level. I have spent over 20 hours on the phone with Bank of America since Tuesday XXXX/XXXX/16 trying to resolve this and have been practically brought to tears by XXXX of transfers, holds and complete lack of tracking my missing payment. I believe there is an issue of internal fraud. Bank of America has stated that my money is in limbo and they would have it credited back by XXXX/XXXX/16. It has been over 60 days!! To date it has not been credited and the new round of phone calls I have made to Bank of America this week have not led to a complete abandonment of any responsibility to do so. I have asked for proof of the electronic transaction number ( XXXX said they should absolutely have this if they made a payment ) with Bank of America refusing to provide XXXX. Then today XXXX/XXXX/16 after being on hold for 2 hours and 40 minutes I was transferred to a " XXXX '' in the " Dispute Dept. '' who informed be that my payment went to XXXX Bank and I would need to call them to arrange a charge back. This not only was a complete new excuse given for where my missing money has gone but I nor XXXX has any affiliation to XXXX Bank!! Bank of America refuses to explain how or why my payment to XXXX went to XXXX. I never ever authorized a payment to XXXX for any reason. Bank of America refuses to provide any documentation. To date we have already paid interest on money that is in Limbo and late fees to XXXX for the payments I made on XXXX/XXXX/16 that I never knew were never sent to XXXX. We have since had to bring those payments current with additional payments and are now getting the most extreme case of the run around from Bank of America about crediting the {$810.00} back to my credit card. I talked again today to the corporate office for XXXX that for the 3rd time combed my daughters account just to be certain the payment was not applied to her account. He verified it is not. He states he has never seen or heard of anything like this in the banking industry. He, like me suspects there is internal fraud behind my " limbo '' payment but I can get no where by calling B of A. I have called every day since XXXX/XXXX/16 and each call results in 3 hours of holds and transfers. Please help.

Complaint: I have had my mortgage loan through Bank of America since XX/XX/XXXX. The loan was for mortgage only not including escrow. The escrow has always been paid by me.. In XX/XX/XXXX I paid my taxes in four installments I was on my last quarter when Bank of America decided to make the last payment at the same time I was paying it. The city took the Bank of America check and they returned my check. I right away called Bank of America as to why they had done that and they apologized and said that if I pay the fourteen hundred something back to them that they would take away the escrow from account. I continue to paid my original {$700.00} mortgage payment and paid off the escrow they had paid. But they continue to add the mortgage and escrow, I had called them to see what was going on as to why they were still adding the escrow amount to my account when I have always paid my escrow on my own they could not give me answer. I still continue to just pay the {$700.00}. This past year I paid the full amount of the taxes in full four thousand something to the city. I called Bank of America to take off the escrow amount out of my account that I had paid the city the escrow.They had asked me to send them a copy of the receipt which I did. Then said they will take it off and from now on I would only paying the {$740.00} this started XX/XX/XXXX. So the coupon on the statement says {$740.00} but at the top of the top of statement they have Total amount I owe of {$6000.00}. They send several letters to have my mortgage modified, something I do n't want to do because I have not faltered on the account or have not missed any payments. It was Bank of America that screwed up and now they want me to pay penalties and for not agreeing for them to pay the escrow when I have always paid it on my own since XX/XX/XXXX. I 've called them several times to try and get this straighten out but to no eval they continue to add they escrow to the account..
