Complaint: My estimated closing date is XXXX for a condo purchase ( today is XXXX ). All throughout the month I have been reaching out to Bank of America proactively to ask for status, to push for things to get done. For the past week, I have had to push even more because they could not come up with a closing date or provide an update on when my loan can be approved, even though I provided everything they asked me to provide. They provided me with a closing disclosure yesterday without explaining the urgency of me reviewing it ; it was only when my agent told me the importance and urgency that I realized if I did n't review it there would be implications. Luckily I reviewed it before the day was over. With 2 days to closing, and with the seller pushing for a closing date, and with me not knowing my living situation as my lease is expiring and I am to move out of my current unit by the end of the week, Bank of America 's answer is on my pushing for a closing date is as follows : " I ca n't tell you a 100 % date that this will happen because we are working as fast as we can to approve the loan. I believe there is greater than a 50 % chance that the loan will be final approved this week and an extremely high chance of final approval being done next week. '' Does Bank of America expect everyone to just be flexible with their living situations ( including my leasing office in my current unit, and the next tenant to move in ) and just pick up and go whenever they decide to come up with a closing date?? No matter how many times I pointed this out to them, my statement gets ignored. They tell me they have a backlog of applications to review. If they are so overwhelmed with applications, they should not accept that many to begin with! It is unreasonable to assume that a consumer should suffer and put their live on hold because of a bank 's " backlog '', and not provide a consumer with an expected date. For now, I have had to plan to rent a temporary accommodation and put my life on hold until Bank of America decides when it is of their convenience to come back with a closing date to us.

Complaint: I have been fighting for my home since XX/XX/XXXX. It has been in my family since XX/XX/XXXX. My grandfather passed away XX/XX/XXXX and we soon found out, his business managers had stolen millions from him and not set it up so my grandmother would be financially secure after his death.
I began to help my grandmother with payments with the intention to buy the home and keep it in the family. XX/XX/XXXX, I formally purchased this home, originally through Countrywide, but bought by Bank of America a short while later. XX/XX/XXXX, I got in a very bad car accident and found myself out of work for a few months. As soon as I started working again, I called the bank to work out getting my loan caught up, at that point it was only a few months behind. I offered to make double payments until it was caught up, but was told they would only accept payment in full. I went to work, saved up the past due as well as some extra expenses for fees and penalties, and when I went to make the payment, was horrified to find out the late fees and penalties were an exorbitant amount. I decided to start the loan modification process.
Over a period of about 3 years, I filled out multiple copies of the same paperwork, every time being told it had not been received or could not be found and that I would have to do it again. I even ended up going to the bank to fill out the paperwork and was still told they did not have any paperwork from me. I received a NOD from Bank of America and at mediation, won, because they did not have any of the original paperwork from Countrywide. Shortly after this, I joined a lawsuit against Bank of America for unfair lending practices including charging more penalties than legally allowed, as well as stalling the loan modification process to rack up past due balances and penalties. When we won and received damages from Bank of America, I thought that they would be forced to finally work with me to help me keep my home. Instead, I found out they had sold the loan to XXXX, and because it was bought in good faith on the purchaser 's end, even though Bank of America would have trouble proceeding, XXXX was able to.
I received a call from XXXX shortly after they purchased the home, asking me what my intention was. I explained to the woman on the phone I wanted to keep my home and had been trying to work out a modification with the previous lender. A short time later I received another NOD, this time from XXXX. We went to mediation where they were able to produce original documents, even though previously Bank of America admitted to not having them.
A few months later, I received notice of an auction date and finally made the hard decision to file Chapter XXXX. For the next 10 months, I paid around {$5200.00} a month. I had a complete appraisal done to show the actual value of the home, as XXXX had a highly inflated opinion on that, not knowing the materials used in building the house and not knowing the interior condition, even though I did offer to let their appraiser do a full inspection as well. Unfortunately, he overslept through our first appointment, and I ended up having my daughter the day before our second appointment.
We decided to split the difference in value and for another 8 months I paid {$6400.00} a month. After multiple requests for extensions by XXXX, I was informed the monthly payments would have to be over {$10000.00} a month and especially with a new baby, I just could not commit to that. Almost {$20000.00} went to Trustee and Legal fees, that could have gone toward my past due amount. This past Monday, my home went to auction but reverted back to the lender, who I am reaching out to in hopes we can work something out. It never should have progressed to this point and would not have, if Bank of America had accepted my payments or at least processed my modification paperwork instead of dragging it out and racking up the past due.

Complaint: Bank of America issued a XXXX cancellation/discharge of debt back in XXXX which I filed with my income tax return for that year ( document attached ). BofA continues to report the accounts to XXXX, XXXX and XXXX as charged off, closed BUT with a current past due amount. This current past due amount should be XXXX ( {$0.00} ). When I called BofA, they told me that they agree that they charged it off, issued the XXXX and do not intend to collect. There is case law on whether an original creditor can collect after they 've issued a XXXX. In the bankruptcy case : XXXX, Debtors., United States Bankruptcy Court , XXXX Tennessee, XXXX XXXX, XXXX, the Court Stated : " It is inequitable to require a debtor to claim cancellation of debt income as a component of his or her gross income and subsequently pay taxes on it while still allowing the creditor, who has reported to the Internal Revenue Service and the debtor that the indebtedness was cancelled or discharged, to then collect it from the debtor. ... ... The court does not agree with the argument that because a Form XXXX can be corrected or amended, it can not constitute an admission by a creditor that a debt has, in fact, been discharged or cancelled and that the debtor is no longer indebted thereon. Complaint: My Bank account was closed and my money has not been returned to me. The bank wrote me a letter to tell me that my balance wont be returned to me, including the direct deposits from my job.
My Cousin XXXX XXXX who lives in XXXX contacted me for help with paying for his Goods/products in XXXX. He told me that he contacted some of his acquaintance in the USA who agreed to deposit into my account any dollar amount they want to send to XXXX so that he ( XXXX ) paysthe beneficiary in XXXX Currency. This 's due to the difficulties the business Men and Women in XXXX go through in order to obtain Dollar for their foreign transactions. I agreed to help my Cousin after he promised that the money that will be deposited into my account will be from a genuine source only come from within the USA. I started receiving deposits in my account and acknowledged same before he remitted the XXXX equivalent to the beneficiary in XXXX.
On XX/XX/2016, I noticed that my account was blocked and called Bank of America. I was informed that there was a fraudulent activity on my account hence the reason for my account being investigated. They refused to tell me what it was. This went on for over a week before a Bank of America associate finally called me to intimate me that a deposit of {$2000.00} was made to my account on XX/XX/2016 which the account owner did not authorize. I have contacted my Cousin about this and he gave me a name and phone number of the check bearer which i forwarded to Bank of America.I also asked them to look up the check bearer on the bank 's camera for arrest.
Evidently, if the account owner did not authorize the said Check, then a stolen Check was deposited to my account in Florida. I am therefore seeking for an advice on how to go about this to clear my name from this and also my personal money including a direct deposit from my Job be released to me. I am willing to provide all correspondence from Bank of America and the Letter from my Cousin to me regarding this.
Thank you The bank name is : Bank of America ( THE FILE # XXXX ) XXXX XXXX XXXX XXXX-FLORIDA, XXXX XXXX
