Pursuant FDCPA cease desist all collection activities pending validation and verification of alleged debt owed. Instead of Bank of America abiding and complying with federal regulations they have taken legal actions by contracting with XXXX, XXXX, and XXXX and have conspired fraud upon i and the courts by filing forged documents, counterfeit security instruments, and demanding payment for an alleged debt i do not owe. Bank of America does not have legal standing and they have admitted to me the allege debt was never recorded.

Complaint: I have tried unsuccessfully with Bank Of America ( BA ) to resolve this issue. I must have been online in my BA account ( I have BA checking and a credit card ) on XX/XX/2016. I was paying bills. I noticed that my BA credit card showed my minimum payment due for XX/XX/2016. I went ahead and set up a transfer from my checking account of more than enough to cover the minimum payment. MY BA checking account shows that money coming out on XX/XX/XXXX. My BA credit card statement shows that money being credited on XX/XX/XXXX. I was paying bills on the night of XX/XX/XXXX. I noticed my BA credit card was still showing the minimum payment due on XX/XX/XXXX. I called the number on my credit card and talked to a reprehensive at BA. She told me that she saw what happened and did not understand why it was not showing the payment due being paid. She noted my file. I was on my PC paying bills again on XX/XX/XXXX and decided to pay an additional payment, because I had charged more than I wanted to so far that month. When I got back on after XX/XX/XXXX, around XX/XX/XXXX, my BA account showed my account as past due. BA credit card is saying since I set up the transaction on XX/XX/XXXX, It was applied to my previous statement! How can that be when it shows coming out and going in on XX/XX/XXXX? BA has a XXXX system. I have called BA, sent a letter to BA credit card dept. and went into the local branch. All I get out of BA is tough luck that is our system and it ca n't be fixed. They will supposedly waive the late fee, but I have no idea how this will affect my credit. They want me to pay an additional payment. Is this any way to run a major bank?

According to XXXX they purchased the property from Bank of America on XX/XX/XXXX. Nationstar comments on my credit report ( Foreclosure ). This XX/XX/XXXX was three year later, when it should have been done with Bank of America around XX/XX/XXXX or XX/XX/XXXX. Now it look like instead of me waiting 7 years to clear my credit it 's going to take 10 years which will be in XX/XX/XXXX. This is not only affection my credit report it is also affecting my daughter 's credit report.

Complaint: I am trying to start the process to " recast '' my mortgage. I have been on the " Making Homes Affordable '' program for the last 5 years*. The BofA sent me a notice that a " recast '' was available if we wanted to keep our mortgage payment at a lower level, who would n't? I missed the deadline for getting the notarized paper work back to them. I called the help phone number, XXXX, ( on XX/XX/2016 ) to see if I could send the request in late. I was asked to hold while the agent checked to see if they would send me new forms. I was told to check back on a daily basis to see if my request had been granted. I called back ( XXXX/XXXX/2016 ) and was told to hold, the agent checked and told me to call back as no decision had been made. I had been through this dodge before with XXXX XXXX. I was going to call back this morning to check again. Then I thought the best thing to do was contact CFPB. *You helped me before when BofA reported me 90 days overdue. With that incident I requested a posting printout from them and found XXXX major problems 1. they were posting my payments to " Unapplied Cash ''. 2. Complaint: An international transfer ( XXXX to XXXX ) took place ( XXXX XXXX, 2016 ) resulting in a {$4900.00} deficit in the amount deposited. Our XXXX lawyers said that there would be a $ XXXX bank charge and nothing more. XXXX XXXX XXXX XXXX said there would be no fee. When I asked my XXXX bank, XXXX XXXX XXXX XXXX, they said, first, they could not see what the exchange rate was ; then they said the transaction went through Bank of America and they would try to find something out but that it would be unlikely that they would get a response. I asked to speak to their compliance officer. She was out, but the gentleman from the accounting dept., then called me later with an update saying that I should file the complaint and that he had the incoming wire detail and that he would send that to customer service agent at my local branch, but that there was nothing new/more they could tell me. During my call with the gentleman from the accounting dept at XXXX, shared with me that it looked like the exchange rate applied was XXXX. I asked him if that was the correct way to apply the exchange rate and he said he did not wish to get involved. He was helpful and it was obvious that he was very nervous about making a mistake.

Filled out a XXXX for California Request ( lien search ) XX/XX/XXXX and submitted that along with a money order to pay for the lien search to the Uniform Commercial Code online portal Office in my state where I 've taken up residency ; 2.
