BofA requested authorization from me including probate administration orders and I sent the following to them and they did not respond and the CFPB closed the matter as resolved when it was not : 1. XXXX XXXX, BofA letter dated XXXX/XXXX/XXXX 2. E-mail from XXXX with successful faxing of Letters dated XXXX/XXXX/XXXX 3. Fax Cover Sheet with XXXX/XXXX/XXXX and fax number of XXXX 4. Certified Mail Receipts and One Return Receipt from BofA 5. Court Orders for Probate, XXXX/XXXX/XXXX 6. Letters of Administration, XXXX/XXXX/XXXX XXXX. XXXX Death Certificates 8. IRS assignation of Employer ID Number for XXXX Family Holding Trust ( the Estate ) dated XXXX/XXXX/XXXX XXXX. The XXXX Family Holding Trust establishing the Estate of XXXX XXXX XXXX, XXXX with XXXX XXXX /as trustee XXXX/XXXX/XXXX I am resending these supporting documents to the CFPB. Also, on the forwarded FRB & OCC complaints, I received 3 letters from the CFPB dated XXXX/XXXX/XXXX with, " the company was unable to respond to your complaint because it appears you 're involved in pending prior litigation. '' This is untrue. 1. There was a prior complaint in XXXX XXXX XXXX Court but it was stricken as if the complaint never existed. Judge XXXX judicial clerk confirmed that the tentative ruling stands and that I can re-file at any time and I will if the CFPB and BofA can not resolve this issue. 2. There is NO pending litigation. Once again : I have all right as Successor in Interest, Probate Administrator, Executor of the Estate to bring any complaints AND there is no current litigation and previous litigation was " Stricken '' with a different plaintiff AND I can bring suit again at any time as stated by the judicial clerk. Unless Bank of America can produce any order stating otherwise to the CFPB and to me, this issue is NOT resolved. The original complaint and CFPB submissions were about these Bank of America violations : Specific violations of Bank of America , N.A . : 1. Complaint: bank of america closed out my credit card due to a letter that was sent out by national debt relief program by accident. I went into bank of america to ask for help and how to get this matter resolved. the manager gave me the internal debt number and advised me to contact them directly and ask for help. so I called and the first representative explained all I needed to do was fax in the letter from national debt relief revoking their power of attorney off of my bank of america credit card account. i called back 2 more times just to confirm that this is the correct processed and they promised they will reverse my credit card account. I went out of my way and request for the letter that bank of america asked for and faxed it in to the internal dept. I then waited a few days and called them back to ensure they have received the letter. the representative that answered then stated that bank of america by policy can not help me reverse the account. I asked her why she kept giving me the run around and no answer. and then she stated that I was mislead by the other XXXX representative and they did n't know what they were talking about. I asked I called this one number that was given to me how can all XXXX agree with one solution and you are they only person that is denying me service. I am upset for being mislead and now my account which was not passed due is now in collection and hurting my credit report. I asked to speak to supervisor or manager she refused and kept putting me on hold. I asked for a number or complaint department she told me there is none. and that I would have to write a letter to the head quarters.

Complaint: I am writing about how Bank of New York Mellon violated my rights during the foreclosure of our property at XXXX XXXX XXXX XXXX XXXX XXXX WA XXXX they failed to give notice when they secured the rights to the property in auction on XXXX/XXXX/2016 the first notice we were ever given was a notice to quit the property that was dated on XXXX XXXX XXXX and served to us on XXXX XXXX, 2016 Bank of New York Mellon NEVER sent ANY correspondence to ANY resident at the address they were forcing an illegal eviction because they failed to serve notice of ownership. My complaint is that Bank of New York Mellon is the acting in an illegal manor as the Trustee holder of the Certificate of the XXXX XXXX asset-backed certificates, series XXXX I am not sure I understand the legal terms but if I understand it correctly Bank of New York Mellon is a trustee for an asset backed security and they bought the dead of trust for this asset. It is very unethical and I feel that they violated our rights. I am seeking action against the Bank of New York Mellon

Complaint: I contacted my mortgage company Bank of America and requested assistance though a home loan modification in XXXX. I was told by my customer relationship manager that I was eligible for a home loan modification based on information submitted. I sent out the required documentation once I received the packet. I called him and advised that it was taking a long time to receive the information. He told me that the info should have been sent out overnight via XXXX. He stated that he would notify management of the delay. The information instead was mailed out weeks later. This was in the month of XXXX. In XXXX 2016 I received a letter acknowledging receipt of my info. The letter also advised that if any or documentation was required, I would receive a letter spelling out requirements. I was never provided as response as to why I was not receiving correspondences as the letter stated that I would. I never received anything else from the bank. I spoke to my Customer relationship manager several times and he would advise of what the underwriter was asking for. They asked for the same info for XXXX4 weeks in a row. The separation agreement between myself and the borrower, an explanation of XXXX of the child support orders, and a few explanations of deposits/withdrawals on bank statements. I repeatedly sent over the same documentation and they continued to acknowledge that they had it yet continued to ask for it. 2 business days before the sale date they requested the other borrowers information, as in check stubs, bank statements, tax returns. Initially they told me that I did not have to submit that information and could apply on my on. A Quit Claim deed was submitted as well. I submitted the other borrowers information on XXXX and they received. I was told on XXXX/XXXX/16 that the foreclosure would be submitted for postponement due to all docs on file. The sale was never stopped. In fact on the day of the sale I was still being asked for documents. I know that Bank Of America deliberately ran the clock out on me, never providing any alternatives to the modification, nor giving me the opportunity to request any other avenue of assistance, when they had all the required info to make the determination or a decision. They dual tracked my account with the intentions of stealing my home.

Complaint: In XXXX Bank of America responded stating that they had assigned me a resolution specialist, XXXX XXXX XXXX, and that I should make contact with her. I called the number ( XXXX ) a total of five times, and I left voice messages. No one ever contacted me, or responded to my calls. I recently received a letter via XXXX stating that I did not take advantage of the assistance from their company. This was not the case. Bank of America has a way of making their customers appear as being the wrong-doer. Bank of America appear that they are helping their customers, but in reality they are not. It is not by coincidence that there are many customers who are dealing with or who have the same experience with Bank of America as I have. In addition, I was a victim when I received this adjustable mortgage. I was part of the bad mortgages that was being approved back in XXXX when Countrywide sold my mortgage to Bank of America. I 'm XXXX with a reliable job, and is capable of making a reasonable mortgage payment as I always did prior to XXXX when my terms changed. The person who sold me my home ( XXXX XXXX ) who worked with the broker to get me such mortgage is now serving prison time in a federal prison for mortgage fraud. I feel that Countrywide and Bank of America knew what they were doing when they approved these adjustable mortgages to later foreclose on people 's homes.

Complaint: On XXXX XXXX, 2016 I received an email from Bank of America, stating that they will start applying a monthly maintenance fee on my checking account. This after I have not had to pay a monthly fee for years, in exchange for an agreement to only use their ATM 's for deposits and withdrawals ( i.e. no counter service ). I have sent them a letter of objection and a copy of the email by USPS. The banks website ( and this email ) offer no opportunity to reply via email, only a postal address in XXXX, FL. I will be happy to send you copies of same. Bank greed once again ... apparently still many loopholes in the Consumer Financial Protection Act that they can drive trucks through.

Complaint: XXXX incidents : 1. I asked the bank representative why I was mailed a XXXX Visa card. He insisted I only have XXXX account, even when I showed him the XXXX cards. He got annoyed with me and shouted ( loudly ), " Why do n't you just go pay the bill! You have XXXX dollars in your account, so use it! '' He did yell out the actual balance in my checking account. 2. ATM would n't accept some of my cash, so I went inside and exchanged the bills. Same thing happened. Complaint: We have been working with XXXX Mortgage servicing aka Bank of America for a mortgage loan that has been in arrears ( long story, Countrywide and BOA takeover ) and we have been trying to workout for 8 years. The current status is I contacted XXXX the end of XXXX to let them know we have a homebuyer that is pre approved and wants our home to move in end of XXXX. We did not receive any response except a certified letter of FORECLOSURE for XXXX XXXX on our residence on XXXX XXXX i contacted Shellpoint and spoke with XXXX in Loss Mitigation on XXXX XXXX and she said the payoff was sent to us and that we would even get relocation assistance with the Short Sale. She gave me the name of our Point of Contact, XXXX XXXX with XXXX and said she was sending out the paperwork, I asked for Short Sale and Deed in Lieu of Foreclosure, just in case. YESTERDAY XXXX XXXX, we received the paperwork for Short Sale. XXXX XXXX called after XXXX ( I had left him another message last Friday ) and he said he did not know anything about a Short Sale, that the home is in the process of a bank sale. I told him, it is on the website that XXXX is working with the homeowner for a short sale and he said he knows nothing about it, so I am enclosing that information. We have been strung out all this time with BOA and now we have a buyer and they want to rush to Foreclosure. I have 8 years of history, where do we begin? I am one of the co administration of the will, when ever I call BOA I have a hard time to get in touch, they keep on saying that i am not on the account and they can not speak to me. Complaint: Bank of America has not complied with California Civil Code 2924.17 ( a ) and ( b ). On XX/XX/2013 Bank of America approved MHA HAMP and MHA HAMP TPP. Bank of America caused to be recorded the NOD without ensuring all was accurate and complete and supported by competent and reliable evidence, and after substantiating borrower 's default and servicer 's right to foreclose. Also, just to correct a typo under CFPB complaint XXXX, the correct California Civil Code is 2923.55 ( f ), not 2924.55 ( f ) as stated.
