Complaint: Bank of America processed a predatory loan modification on my arm loan in XXXX ( which was originated in XXXX ). In the modification they tack on {$27000.00} for late fees and back payment, and also 18 more years to the back end of the loan. No one ever spoke to me about the ramifications of what this modification was doing to the length of the original loan. Everything was done by fax. I was under does because my husband had died and I was on XXXX and I did n't want to be homeless. Then they SOLD my loan off to BURY what they had done. For future audit purposes. In XXXX, they SOLD my loan off to XXXX ( now XXXX ) who now informs me that it is over a 50 years on the loan. This was supposed to be a loan to help me not lose my home and not go homeless. Complaint: Complete application : necessary documents and " complete '' status are determined by servicer. California Civil Codes 2923.6 ( h ) ; 2924.10 ( b ). While no dual tracking protection is due an incomplete borrower submitted RMA application package by Bank of America, there are dual tracking protection due a complete borrower submitted RMA application package. Bank of America has represented no complete RMA application package has been received by the borrower and that the borrower has ignored and failed to comply with Bank of America representatives requests for needed or required application documents to enable a loss mitigation review since XX/XX/2012. This is a material misrepresentation known to be false at the time the statement was made and supplied to the borrower. According to the Bank of America borrowers Home Loan Modification Status iportal, the My Documents tab page of XX/XX/2012, all documents that make up the RMA application package were received. Additionally, Bank of America has since caused the destruction of these documents and their corresponding entry to the Bank of America borrowers Home Loan Modification Status iportal. Any Bank of America representative who has been assigned as the SPOC, charged with the duties and responsibilities of conducting an independent and complete review of the account records, for whatever reason, should have known a complete RMA application package was received on and before XX/XX/2012 and this ( receipt of the complete RMA application package ) prompted the initial review of XX/XX/2012 that lead to the incorrect MHA HAMP denial of XX/XX/2012.

Complaint: Bank of America has stolen money from me for years, but now I have proof. I was sent {$200.00} and {$100.00} by way of their banking app and never received the money in my account. I have done this numerous times over the past year, and it has worked fine. But for some reason, now, the money is not coming into my account. I have already spent a few hours on the phone about this and they continue to tell me they do n't see anything. I have pictures from the individuals ' accounts who sent me the money confirming the money left their account into mine. I have given confirmation numbers for both transactions and the bank told me those are n't good for anything.

Complaint: Bank of America has violated the National Mortgage Settlement ( NMS ) and is liable under the California Homeowners Bill of Rights ( HBOR ) 2924.12 ( g ). While Bank of America concedes the submission and receipt of a complete Request for Mortgage Assistance ( RMA ) application package as evidenced by the Bank of America initial review of the received as complete RMA resulting with the XXXX XXXX, XXXX incorrect MHA HAMP denial that was later GRANTED upon the Bank of America Appeals Department reviews of XXXX XXXX and XXXX XXXX, Bank of America has not provided the required five day notice to the borrower in accordance with HBOR 2924.10 ( a ). Also and in accordance with HBOR, there is no deadline for servicer 's to complete the modification process. Additionally, Bank of America can not record an Notice of Default ( NOD ), a Notice of Trustee Sale ( NTS ), or conduct a sale while the modification process is pending per California Civil Code 2923.6 ( c ). No deadline for borrower 's application. No deadline for servicer 's RMS evaluation. Therefore, the NOD recorded on XXXX XXXX, XXXX must be withdrawn by the recording of a Rescission with the XXXX XXXX County Recorders Office.

Complaint: I had deposited a settlement check from my attorney in the amount of {$11000.00} to my BofA checking account through an ATM machine at the branch. I had never deposited any bad check with BofA ever. However, they had held the funds and would not release it while I contacted them many times requested that they release partial funds so that I can meet up my bills because they 're due. Unfortunately, they came up with all kind of excused that they could n't get hold to verify with the branch. After hours of waiting on the phone, they still wo n't do anything about it. I then requested to provide me a number so that my law firm can contact and help resolve any issue they might have had and as a result they wo n't talk to him and was not helpful at all. I explained to them that the check payable to me was from a client trust account and there should be funds available. I requested that they release some funds so I can pay my bills otherwise I will get charge the late fees. Unfortunately, they would not do anything at all. This makes me very upset and there 's nothing I can do about when my bills are due and the funds available to me are being held. It is unjustifiable and unfair to me.

So as usual I made a deposit and wrote checks on that account to cover bills. Image my surprise when they held my funds from XXXX to XXXX XXXX even though it was taken out of my wife 's account on XXXX. During this time not only did I never have access to my XXXX deposit but the checks bounced and they happily took out XXXX every time to the tune of over {$200.00}. And now my accounts are messed up because of returned checks and bills are late. How could they possibly be allowed to do this ...
