But I also told they that they had credited me from the other company so I assumed they would just take the it off but no they waited three month then they take it of my account they knowingly waited that long to do that and harass me. The date does not even correspond with the situation that was at hand ( see court document for lien ). Complaint: Bank of America said i qualified for certain programs. Then in the next paragraph i was told i didnt qualify for those programs. I asked what payment i should make toward my mortgage. I was never told, i never got a call back. I have done everything Bank of America has told me to do. Yet, they lied to me and proceeded to take action against me. I received a voice message from XXXX XXXX XXXX of Bank of America 's Regulatory Complaint Servicing Department at XXXX on XXXX XXXX, 2016. He left this number XXXX and Extension XXXX and asked me to call him back. He sounded very new because he did not even know his own telephone number or extension and fumbled when trying to look these up to leave the message.
I have called this number and extension on the dates and times listed below. It is actually the number for XXXX XXXX XXXX of the bank 's Regulatory Complaint Servicing Department. I have left a voice mail each time asking for him or someone to call me back but no one has done this yet. Even though I have called multiple times the phone only goes to voice mail.
I bring this to your attention as I believe this department may be doing some kind of sham or cover up type work. Specifically making calls to CFPB complainants at late evening hours just to paper or document that the bank tried to call and resolve the issue. The fact is they have no intention of speaking to anyone or returning any calls.

Complaint: My name is XXXX XXXX and I would like to lodge a strong complaint against the Bank of America ( BOA ) for their unlawful charge of interest, despite having settled the account balance in full for XXXX of my credit cards issued by BOA.
This is not the first time that I am being charged interest after paying in FULL my statement balance before the Due Date on the statement. I 've experienced this problem with XXXX, XXXX XXXX, XXXX XXXX, etc. From my past experience with Bank of America, I know it 's a waste of time to contact their customer service to reverse this charge ( XXXX XXXX is among the few banks that do reverse the charge after a long period of reasoning with them ) because they will insist that their charge is correct and they will refuse to refund the unlawful interest charge. They will refuse to provide documentary evidence that they are entitled to such charge and neither will they provide computations on how they had arrived at such interest charge. Hence, I 'm lodging this complaint in the hope that the CFPB will take this matter up with BOA and conduct a thorough investigation into the unlawful practices of many banks that charge interest on unsuspecting customers, after settling their statement balances in full before the due dates of their statements.
As far as I know, for the 50 years or more that I 've used credit cards, both in the U.S. and overseas, only banks in the U.S. engage in such deplorable and unlawful practices. There 's a distinct difference between CHARGE CARDS and CREDIT CARDS, viz. interest on Charge cards ( like XXXX XXXX cards ) accrue from the day that credit is extended until the day the credit is re-paid in full, whereas no interest is payable on Credit Card balances if the entire outstanding amount is settled in full prior to the statement due date.
That is the basis for me to secure refunds on interest charged from banks which are willing to listen to my logic and reasoning. But I have never had to do this for credit cards issued by overseas banks ( even American banks that are located overseas ). The problem occurs only with banks operating within the U.S., as if they 're all in cahoots with each other.
As a case in point, XXXX of my credit cards from BOA ( account # XXXX ) was paid in full by XXXX XXXX, before its Due Date on XXXX XXXX, and I was disgusted to find that the current statement dated XXXX XXXX has a new balance of {$21.00}, which is the interest charged on a balance amount of {$1100.00} and I have absolutely no idea how did BOA arrive at this ridiculous amount, especially when the balance on the previous statement ( dated XXXX XXXX ) was {$1800.00} which I had struggled to pay off in full.
I 'm attaching herewith a copy of both of these statements for your necessary perusal and retention. I would be grateful if you can act on my behalf and the millions of credit card users to require BOA to provide evidence on why are they entitled to such interest charge, after the account balance is settled in full, and how did they arrive at the amount of {$21.00} in interest.
I intend to write to the Chairman & C.E.O. of BOA, XXXX XXXX XXXX within the next Fourteen Days, with a copy to the Director of CFPB, to demand for the interest to be reversed back to my account, in order to allow some time for the CFPB to commence its work on my complaint before I addressed this matter with BOA, so that they would not give me their standard reply that the interest charged is correct after their investigations and no refund is possible, which is a whole load of XXXX.

Complaint: On XX/XX/2016 around XXXX I went to bank of America ATM at XXXX and XXXX XXXX and I try to withdraw some money so I can take my kids out to eat, when I check my balance it did not seem right so I called the automated machine and I discovered that there is a transaction for the amt of XXXX at XXXX. I was surprise so I talked to Bank of America customer service and I was told that transaction happened on XX/XX/2016 and charges posted on XX/XX/2016. I asked the customer service agent to see if I can file a fraudulent claim on the account because I did not authorize that transaction and I requested to close my account and send a new card. I took all the money out of the account and an agent advised that their claims department was closed due to observation of Labor day holiday and to call on the next available business day. On Tuesday XX/XX/2016 I called bank of America and I did file a claim I was told that may take 10-30 days of process. I did not receive the paper work until XX/XX/XXXX that same day I faxed the necessary paper work that was requested by the bank. On XX/XX/2016 I received a letter stating " We 've completed our review of the reference claim and have determined that no error has occurred in this instance " so therefore the temporary credit was previously applied to your account will be removed by XX/XX/2016.
I called Bank of America today spoke to Fraud agent XXXX who told me that the only way they can review my case is if I can submit a police report and I told her no one have made mention that I need to file a police report regarding this, I ask why is it necessary when I know I can not be in two places at one point during all the day of transactions mention above I was at work all day and right after work I do have to pick up my kids from after school program and there is no time in between for me to drive all the way to XXXX XXXX at XXXX store and shop ( XXXX store # XXXX XXXX XXXX XXXX XXXX XXXX Arizona XXXX ) I spoke to supervisor her name is Page and she adv. they determine that there is no fraudulent because I am only disputing XXXX transaction that day. And also the card is never used after that XXXX particular transaction, my reply to the supervisor was " I am a honest person I 'm only disputing the transaction I know I did not process and authorized '' XXXX then she mention well the thief then did not re use your card after that transactions. And I said well I have closed the account and took the all the money out after I found out there is someone else using my card without my knowledge and I also mention I do n't know on How / why / who could it be. So the supervisor after further investigation said due to the fact the transaction still took place in XXXX they can not see that there is a fraudulent. I am entitled to be protected under Reg E the bank was notified in a timely manner of my loss / theft and i know as a consumer I should not be penalized for someone else actions. I would like this case presented to the bank in a timely manner and my money returned to me as owed.

Complaint: It appears that there is a major flaw in Bank of America software. Intentional or unintential not sure. But a deposit of a Check of Friday, or Saturday would not clear due to the bank holiday on Monday XX/XX/XXXX, would not be processed until Tuesday, which means the funds would be available on XX/XX/XXXX, well Bank of America software does not assume the holiday as it make on the deposit slip and online that the funds would be available on the XX/XX/XXXX but they are not, I understand why but do not understand why they posted wrong. Complaint: We purchased our home XXXX XXXX. The mortgage that was given to us from XXXX had XXXX parts. One of them was a fixed mortgage and the other had a 2 year ARM. When we went to refinance at the end of the 2 year we had discovered that it was 50 year mortgage with a balloon payment of {$250000.00}. We had no idea. In hind sight, at the closing we briefly saw the amortization schedule and asked about it but we were told " oh you do not want to see that it will just make you sick if you see all the interest that you will be paying '' This is the first house we ever purchased so we did n't question it. If we had been encouraged to look at it and given the opportunity to ask questions we would not be in this situation.
We refinanced with a local bank, XXXX, which in turn was sold the mortgage to Bank of America. In XX/XX/XXXX I, XXXX, lost my job. We applied for a modification with BoA. Like many others we had sent in our " financials '' ( taxes, bank statements, pay stubs, utility bills, and hardship letter ). We sent it to them at least 10 times. It kept getting " lost '' or " not received ''. We had to file Chapter XXXX to stop them from foreclosing. XXXX XXXX we began a " trial modification ''. XXXX XXXX we got a permanent modification. We were paying on time at a comfortable payment. XXXX XXXX BoA sold our mortgage to XXXX XXXX XXXX.
XXXX told us everything will remain the same. After our first payment we received a letter stating that they our payment was going up because our escrow had a deficit. I have the escrow report from BoA showing that we did not have deficit. I faxed it to XXXX upon their request.
I was told by both companies that I had to call the other. XXXX kept telling me that they had to go by what BoA reported to them. They would tell me to call BoA. I would call BoA and they would tell me they no longer service our mortgage and they could n't help us we had to call XXXX.
XXXX will not accept payments from us. They accepted sporadic payments ( 5 ). Thus leaving us in arears.
After reading through the RESPA-CFPB Consumer Laws and Regulations it appears the both companies have not adhered to the laws and regulations. On many of the regulations.
We have an acquaintance here in town who is an attorney and we asked her if she could help. She specializes in XXXX but said she would try to help. She sent a letter which turned into another letter and then another. Here we are 2 years later ( well past the 30 day period allotted after a qualified written request was submitted by my attorney ). She has been going back and forth with both companies. We had an agreement that we signed and sent along with a certified bank check about a year ago. XXXX sent the package back to us with no explanation. There have been other agreements sent to us but the language in the agreements were protecting XXXX and not us.
I have placed complaints to the Banking Commission, FDIC, OCC, Attorney General, XXXX, Senator XXXX 's Office. I reached out to anyone who would listen. This is affecting not only XXXX and I but our children. I have looked on the consumer affairs website and see many people in the same or similar situations.
I have kept records of every letter, statement, certified mail receipt, etc. from XX/XX/XXXX to date.
We would like to resolve this and move forward. Ultimately, we would like to be absolved of any and all debt from BoA and XXXX. After almost 7 years of XXXX and frustration we feel that it is a fair resolution.

Complaint: I received a call from the Bank of America fraud department on XXXX/XXXX/16 at XXXX asking to confirm if recent transactions were made by me. I confirmed that they were not and and they stopped the card from working so no more transactions could take place. They advised me that fraud had taken place and confirmed what transactions were done by myself and which ones were done by an un-authorized fraudulent person. The un-authorized transactions were XX/XX/XXXX XXXX XXXX XXXX {$44.00} XX/XX/XXXX XXXX XXXX {$13.00} XX/XX/XXXX XXXX XXXX XXXX {$20.00} XX/XX/XXXX XXXX XXXX XXXX {$53.00} XX/XX/XXXX XXXX XXXX XXXX {$120.00} XX/XX/XXXX XXXX XXXX {$90.00} I was told that I did not have to fill out a police report and they would handle the investigation and I had nothing to worry about. At the time of speaking to the representative they also notice a transaction on my joint account I share with my husband for {$1.00}. I was talked into not filling out a claim for this transaction as it was so small. I received the credit back for the un-authorized transactions. A few days later the money was removed from my account for which Bank of America did an investigation into the claim and said that they did not think the charges were fraudulent. They said this was based on several things which include the proximity of the transactions to our home location, the history of debits, and that the pin number was used for the XXXX XXXX XXXX charges. I called as soon as we noticed they removed the money from the account to speak to the fraud department. At this time I was told by department that they decided against my case because the transactions happened close to my house, a pin number was used for the XXXX XXXX charges and previous history of my account. At this time they also told us that we should have filed a police report as it would have helped with the case, which was not told to us when we first reported this. Again we were told we did not have to file a police report and were never told that it could in some way help to prove that I did not make the transaction. They also told us we should have filed the {$1.00} transaction on my joint account as fraud as well which I was talked out of doing while talking to the claim department. After the money was taken back by Bank of America I called a third time and they said that I should write a paper with everything that happened with time stamps and any extra info we had that could prove that I was not the one who made the transactions. I was told to sign it and date it and fax it to the fraud department. Again this was not asked of us the two previous times we asked them to look into the claim. Along with the police report they seem to ask me and tell me different information everytime I call. I also asked the manager of the fraud department why I would be responsible for all of these transactions when the card was marked as fraud and the account closed as soon as Bank of America called to confirm the transactions. This happened the same day that the transactions took place. While researching the issue I read that according to the electronic funds transfer act I would only be responsible for at the most {$50.00} of the transactions. When I asked about this they said they do not have to follow the rule because their investigation showed no fraud because a PIN was used. So the people ( bank ) that have to follow this regulation can get around the regulation just by saying they researched it and thought it was not fraud? This seems odd as it lets them decide in their own favor so they do n't have to pay fraud claims. I also wanted confirmation to how this act worked as it seems to read any unauthorized transaction whether the pin was used or not was covered if you did not authorize the transactions. Bank of America seems to be closing fraud claims unpaid often with the same response of location and a PIN being used.

Complaint: On XXXX/XXXX/16 I purchased a diamond and tanzanite necklace and ear rings from XXXX XXXX on the island of XXXX and placed the charge on my Bank of America Visa Charge Card. When I returned to the XXXX I had the necklace appraised and found that I had been cheated and defrauded. The diamonds were actually white sapphires. This is a very serious crime. I have all of the documents of the transaction, including XXXX XXXX 's description of the pieces as well as their formal appraisal of the jewelry. XXXX XXXX refuses to refund my money, even though I have emailed them all of the incriminating documents and a Bank of America supervisor told me that since the transaction is over 60 days old, that there is nothing they can do to reverse the charge. I need your assistance in applying pressure on Bank of America to reverse this charge from my credit card account. I will gladly supply them with the documents which prove my claim. I have many other avenues to explore if the bank continues to refuse to help me. Bank of America 's name will most definitely will be dragged in to other sources of complaints if I am forced to peruse them. I just want my money back. Complaint: I have been banking with Bank of America since XXXX or XXXX. At this present time, I find Bank of America to be the biggest criminals out there. In XXXX I opened up and IRA with this company, and I guess the interest rate was okay at the time. Currently my money only nets me {$1.00} a month. On the other end, I have a credit card with this company and they are earning over {$600.00} a year in interest off of me. This is a deplorable way to treat a customer, in fact it is a crime if you ask me. They send out correspondences stating you can get 0 % interest for a certain amount of time, but it is a trap only to get the consumer to pay more interest. I feel that everyone should know about this, this is a trap to keep consumers in debt. Bank of America is for hard working people, but they do not care at all about their clients.
