Complaint: BoFa was supposed to close my home loan on XX/XX/XXXX. BoFa 's underwriting department decided on XX/XX/XXXX to change the terms of my loan, and classified my home as non-owner occupied. They told me I need to pay a 25 % down payment, they took away {$2000.00} in lender credit and charged me {$2100.00} in loan amount points. They changed my interest rate from 3.375 % to 3.500 %. BoFa had a promotion going on that if I brought in $ XXXX in new money to BoFa, then they will give me a .25 % reduction in my loan. I brought the $ XXXX over to BoFa and my new interest rate should have been 3.125 %. Underwriting never gave me an explanation on why my place is considered non-owner occupied. I told BoFa that I do n't plan on moving. The seller was purchasing another property, so I did not have time to shop around for another bank. I had no choice but to close with BoFa. BoFa dragged out closing this loan, and I closed on XX/XX/XXXX. I purchased the property that I lived in for the last two years, and the owner did not involve a realtor in the sale of the property. I kept telling BoFa that the non-owner occupied classification was a mistake, but they would not correct this. The loan officers told me that underwriting has already made their decision. It is not right they told me this right before closing. I have no idea how to fight this or what my rights are at this point.

Complaint: Bank of America has provided me with a written document dated XXXX XXXX, 2016 from their paid legal advisor represented as the CFPB iportal uploaded CFPB Complaints response to multiple CFPB Complaints I have lodged related to my home loan mortgage account during and throughout the MHA HAMP modification process between XXXX XXXX, 2016 through XXXX XXXX, 2016. This document has not been uploaded to the CFPB iportal to date and therefore can not to be considered a response to any of the CFPB complaints. Additionally, the document and attachments do not address the concerns presented within the CFPB complaints lodged related to my concerns throughout the loss mitigation processes to date. Because Bank of America has engaged in unfair, poor, and deceptive practices, I have no way of knowing what I have been presented with is the final resolution of my concerns or not and just another of Bank of America 's tactics to solicit what they want. There has not been a Rescission recorded withdrawing the NOD with the XXXX XXXX County Recorders Office to date.

However, I shared my story with Bank of America by certified mail, and I have not heard from them yet. I even wrote XXXX and they do not have any record of me. However, XXXX on the other hand say they do have a record of me. Moreover, I am consistently getting denied a bank account. I also have settled my debt with Bank of America. I paid {$190.00}.

Complaint: I took out a home equity line of credit on XXXX of my properties about 12 years ago. After about 18 months I began repaying the loans by sending the bank what my statement said was the fully amortized monthly payment ( some months I sent more than this amount to speed up the repayment process ). After 10 years - at the end of the line of credit period the loan was to lock and the balance was to be repaid in equal monthly payments. I expected this to happen and had already been paying the fully amortized payment. When Bank of America notified me that the line of credit period was expired, they also notified me that the monthly payment had changed and was TRIPLE what they had been telling me for 10 years was the fully amortized payment. The statement I continued to received showed the same payment I had always been making so I assumed the letter was a mistake and continued making the payments as always. After 3 months I was notified that my loans were in default. After contacting the bank, they insisted I was in default. I explained the statement I had been receiving for 10 years but they ignored my pleading and said they did n't have access to a copy of the statement and their records were correct. They would n't let me send them a copy of the statement and said pay up or they would foreclose. After several calls, the bank finally said the statements had been wrong for 10 years but the only option I had was to make the higher payments which I could n't ( and still ca n't ) afford or apply for a loan modification. Since my credit report then showed I was 4 or 5 months behind on 2 mortgage payments and no other bank would consider refinancing me, I submitted applications for modification. After several months of calling them and sending them volumes of documentation, they said they had all they needed to make a decision and would contact me in a week or 10 days. The time passed and upon contacting them again they informed me that the modifications were declined. When I asked why they said it was because some of the documents were over 90 days old and were no longer current. I protested it was n't my issue -- that it was because they took too long to process the request. They agreed that I could resubmit the application if I desired. I immediately resent all the documentation they had requested but they refused to process both of the loans at once. They insisted to do one at a time and it would be faster. The rep said he would get it done in two weeks. It 's been three months and they told us two weeks ago that they finally have everything they need ( again ) and we still do n't have an answer. In the mean time, we decided to sell the XXXX property that they would n't accept a modification app for because this one was taking so long that it scared us. We ended up selling the property for about {$20000.00} less then it was worth and losing what had been a $ XXXX/month positive cash flow that was part of my retirement income just to get out from under BOA. When we requested a loan payoff at closing we discovered - unknown to us - that it was in foreclosure! We are still awaiting the approval of the loan modification of the remaining loan and fear that BOA will again foreclose on this property without notifying me ( like they did the one I sold ). This whole loan modification process has to date taken 18 months which seems totally unacceptable to me.

Complaint: I went to a Bank of America ATM at a local branch on XXXX/XXXX/16 to withdraw {$2100.00} from the ATM. I was not able to make the withdrawal since the amount I requested was over the daily withdrawal limit for the ATM. My only choice at that time was to go into the branch and withdraw the cash from my account at the teller line, which is what I did. Also on XXXX/XXXX/16 I went to a Bank of America ATM at a local branch to withdraw {$2300.00} from the ATM. I was not able to make the withdrawal since the amount I requested was over the daily withdrawal limit for the ATM. My only choice again was to go into the branch and withdraw the cash from my account at the teller line, which is what I did. The type of account that I have is an electronic only account which means that I do not get charged a monthly fee as long as I use electronic means like online and ATMs to access the account. If I do use bank personnel like a teller, I get charged a {$8.00} monthly maintenance fee on my next statement date. Bank of America should not be able to designate an account as a no fee checking account and then charge a fee if the transaction you request can not be completed electronically. This is like having a free parking zone for 5 seconds which is actually allowing you to park free but the functionality of the parking space is designed to charge you for practical usage. This practice should be disallowed at Bank of America. If an account is designated as free for electronic usage then the bank can not restrict the usage by electronic means OR the bank can not charge for in-person/teller usage if the electronic means provided by the bank does not allow your transaction to be processed.

Complaint: In XXXX Bank Of America bought my ( XXXX ) mortgages from Country Wide Home loan. Prior to this point in my life I had a great credit history. My score was a XXXX and I had numerous credit accounts and equity in properties. Bank of America took over my ( XXXX ) mortgages on XXXX XXXX, XXXX first payment to Bank of America. As of XXXX XXXX, XXXX ( 6 ) months later, they had My ( XXXX ) mortgages ( 9 ) months delinquent. XXXX consecutive, on XXXX XXXX on another, And XXXX on the XXXX. All of these payments were made on time, I have the proof. Receipts and checks they cashed. My credit score went from a XXXX to a XXXX and I lost all my credit accounts. I am a vet that owns a small XXXX, this was devastating to my lively hood and business. For the past 6 years I have been trying to recover from this XXXX error From Bank of America. I tried to refinance in XXXX but Bank of America had ( XXXX ) delinquencies on my accounts a XXXX credit score and nobody would even consider me. Since then I had to modify my house mortgage to get it out of foreclosure, They added over {$120000.00} to my mortgage and have to pay on it for 40 years XXXX. My investment, retirement property I owed {$62000.00} on in XXXX would have been paid off by XXXX. Now this is in foreclosure and going to be sold and the balance is {$150000.00}. After the modification of my house last year I built my credit score back up to a XXXX in the begin of XXXX. Then what a surprise Bank of America reports I am 3months 90 days delinquent on my mortgage. XXXX XXXX, XXXX XXXX, XXXX XXXX. Bank of America denied they made any reports to the credit bureau. My credit dropped back down to a XXXX. This is listed at the top of my report ( 90 days past due as of XXXX ). I just noticed Bank of America is checking my credit score monthly. This makes it clear to me that they are deliberately making these false reports to knock my credit score back down. I am currently trying to refinance my investment property ( For double what I owed on it ) to keep it from going to foreclosure sale. With a XXXX credit score this is nearly impossible, plus Bank of America constantly recording false delinquencies to the credit bureau. Consumer Financial Protection Bureau Director XXXX XXXX, states consumers should not be collateral damages in the mortgage transfer process. Mortgage companies have a legal obligation to protect comsumers during loan transfer between mortgage servicers. I have been paying for this transfer since XXXX when it was transferred. I will be paying for it for the rest of my life! This company is disgusting!!!!

Complaint: Bank of America inconsistently deducts monthly maintenance fees from my checking account on arbitrary days. I attempted to discuss and resolve this issue with them today ; however, they could not provide any logical explanation as to why this date varies from month to month. This inconsistency creates a financial burden, impacts my budget and makes it difficult to keep my account balanced.
