Complaint: First of all I, XXXX XXXX purchased my former Childhood home back in XXXX XXXX ( XXXX XXXX XXXX XXXX WA XXXX ) on an Owner Contract from XXXX XXXX ( XXXX ) which had a " Clear Title '' for the sum of {$85000.00} purchase and sale agreement was for {$80000.00}. My Closing Documents show that I had given {$8500.00} down. For some reason my monthly payments by they 're figures after all costs was $ XXXX. 30 yr arm. My Closing Documents call it a HUD Loan. It took my until now, 12 yrs later to find out this is n't correct. My interest rate changed the first two years three times. I never got to shop for my own insurance or Lenders. They changed my closing costs three days before closing from est. {$3500.00} to {$85000.00}, as a first time homebuyer I had no clue. My insurance on the home was $ XXXX. flood insurance another $ XXXX. and the title co. At the closing was XXXX XXXX XXXX in XXXX WA XXXX said this was the only Lender the Agent ( XXXX XXXX ) had so take it or leave it. My Broker was n't present at the closing or either was an Attorney. How was I to know after meeting the XXXX " conditions '' to get approved. And they said I need Title Insurance, WHY, that gives me no protection, they did n't say Mortgage Insurance at all. They called it an XXXX loan. So Decision One Mortgage made me pay {$660.00} and {$170.00} to them under two different loan # s. And they said mine was a 2 yr. ARM. my interest rate charged before that. So every year for the next 8-9 year I 'd make a principal payment of {$600.00} to {$800.00}. So I gave them an extra payment a year every time I did this my Lender would change. So after 10 yrs. I dealt with Decision XXXX, XXXX, XXXX, XXXX, XXXX XXXX XXXX, so XXXX XXXX XXXX in XXXX started sending payments back and offering me a XXXX Mortgage at 11 % to 18 % all communication stopped. They claimed to not handle my loan. Fast forward to now. XXXX closed all branches that I ever used fro XXXX to XXXX WA. So i recieved an eviction notice by the Sheriff on XXXX/XXXX/XXXX. Every inquiry I 've made since then to find out why has resulted in the term " Sheriffs Sale ''. So I handwrote the court a letter ( XXXX XXXX XXXX County Superior Court XXXX XXXX vacated the Stay on the Writ. Now I found that my 10 yr. old son was the one given THE most important Court Date of my Life. Which was intitiated by Bank of New York Mellon c/o XXXX XXXX XXXX by XXXX any XXXX. Now at this point my County value had went from {$50000.00} up to {$110000.00} do to the contraction upgrade I performed. Now, when all communication ended as I mentioned I was told by XXXX branch Pres. Stated " that I 've paid on the principal so I 've made XXXX extra payments over 8 yrs so relax '' his words Exactly. I have a carbon copy of the last payment they sent back. No consultation at my property address EVER, BY ANY OF THE XXXX LENDERS, WHY.? We even had FEMA disasters XXXX times in XXXX XXXX over the course of 7 yrs. XXXX Floods XXXX XXXX mph storms. Never an insurance agent or Lender Rep. My County assessed value even after these events was up to {$110000.00} I had it on the market, did n't sell fast so I took it off market. That 's also another factor in the communication. Bank of NY and XXXX were n't ever mentioned to me. I work away from home sometimes for weeks at a time. So they served these papers to a child which is why I missed THE ONLY CHANCE I EVER HAD. THIS WAS STATED BY XXXX XXXX. Why a different XXXX? I never got a minute in Court or under Oath to " Answer '' the " Complaint '' or, since the posting on my door stating Notice Of Trustee Sale, on XXXX XXXX XXXX. Why does it showing as sold on XXXX XXXX XXXX. Court Documents show original Notice XXXX/XXXX/XXXX. I have Documents showing XXXX with a Loan Modification up until the end of XXXX XXXX, and another stating stay in the home. THEY JUST STOLE OVER {$60000.00} in Equity from MY House, I DEMAND ACTION on BANK OF NY NOW

The documents were faxed to BOA on Tuesday XXXX/XXXX/16. XXXX has attempted to upload information in the equator system but BOA has NOT set up the file as promised. I am concerned that as in the past BOA will run out the clock and cause us of filing late when we have been trying.

Complaint: Bank of America has been in direct violation of the Credit Card Accountability Act of 2009 by constantly applying payments in excess of the minimum required payment to balances with lower APR. After multiple calls, BOA associates have acknowledged the issue and promised to fix it, but nothing was ever done. Furthermore, I 'm fairly certain that the same incorrect interest charges are applied to XXXX other customers. This issue has been going on for more than a year with my account specifically, and I simply have no choice but to file this complaint.

Complaint: On one night of my stay at the XXXX this XXXX ( Friday, XXXX XXXX ) I took my friends to XXXX. The bill of {$3300.00} I put on my Visa, which I handed to the staff, along with my license, to take and charge. I signed for the {$3300.00} and went on my way. However, I noticed after I got home the following week that there was a separate charge for {$630.00} on my visa, a charge that I did n't authorize. Visa sent me copies of both receipts, which to my surprise were both signed. The signature on the {$630.00} is not my signature. Visa is refusing to credit me because XXXX had a copy of my license, which I readily admit I handed over to pay the {$3300.00}. I want the {$630.00} refunded to my Visa. Visa says there is nothing they can do because its a " he said, she said '' situation. I contacted the merchant and they also refuse to refund the fraudulent charge. Visa is supposed to protect its customers from fraud.

Complaint: I went to my local Bank of America branch on Monday, XXXX XXXX, 2015 at XXXX PM. They had only XXXX teller window open. The line was so long it went out of the branch doors. I could see XXXX different bank employees walking around the bank. They were talking and laughing as if they did not even see the line. When I finally got to the teller window they told me they did not care about my wait and I should use the ATM. I called the same branch the next day to speak with the branch manager about my experience. I called the branch 4 times and no person answered the phone. They also do not have any voicemail or a way to leave a message. Finally, at XXXX XXXX, on the fifth phone attempt a branch employee answered the phone. She told me that the branch manager had gone home for the day! I requested a return phone call from the branch manager and the employee took the message. We are now towards the end of the next day and I have not heard from her. I just called the branch again, and once again, no one answered the phone. I just called the XXXX number for Bank of America and their representative said there is no way to relay my message to the branch. They said that the bank wants to cut expenses by minimizing human staff. I feel that this is unacceptable. Bank of America was XXXX of the banks that helped created the Financial Crisis. As a result of the Financial Crisis, they became XXXX of the largest banks in America from both acquiring and putting smaller banks out of business. I feel they have an obligation to our XXXX and our XXXX to provide a reasonable minimum level of customer service. Thank you for listening!

Complaint: This is my SECOND complain about Bank of America. I did contact my bank several times about cancellation MIP but they refused to do so even after my first complain to your agency which I submitted on XXXX/XXXX/XXXX. Today I received phone call from XXXX XXXX Resolution Specialist Regulation Complaints Bank of America. He told me that he can not cancel MIP because of my outstanding balance. I bought my house on XXXX/XXXX/XXXX when it was appraised as of XXXX/XXXX/XXXX at {$210000.00}. Per FHA REGULATION my MIP MUST be automatically canceled " WHEN THE LOAN-TO-VALUE RATIO REACHES 78 % OF APPRAISAL VALUE BASED ON THE ORIGINAL AMORTIZATION SCHEDULE ''. ( see attachment ). Which means that 78 % from {$210000.00} appraisal value ( see attachment ) is {$170000.00}. On XXXX/XXXX/XXXX my balance was {$170000.00} but on XXXX/XXXX/XXXX my bank again charge me {$130.00} of MIP. And after my complain to your agency on XXXX/XXXX/XXXX they charge me again on XXXX/XXXX/XXXX {$130.00}. I am a citizen of this country and I refused to be ABUSED by Bank of America and their employers who stilling money from hard working people. I will never stop complaining until bank of America return my money. I will go to a media, I will get a layer, I will reach FHA loan administration and let them know how Bank Of America abused their power and stilling money from people. And after that I will take my mortgaged to a different bank.

Complaint: I am struggling to get Bank of America to remove my private mortgage insurance. I have also had difficulty getting them to provide an explanation for why it is not being removed. I have called and talked to them about 5 times and was getting a run around. My mortgage has been below the XXXX % threshold for about 5 or 6 months now. My account is up to date, I have never been late on a payment. In fact I am slightly ahead and my paynents. I 've explained to them what I have read on the Consumer Financial Protection Bureau website and in the homeowner protection act of 1998 and explained how I interpreted it and have asked them to explain to me why I did not qualify to have it removed or to explain what it is about the law that I am misinterpreting and they have not been able to provide a satisfactory response to that but continue to charge me private mortgage insurance. XX/XX/XXXX I was finally told that it would be removed in XX/XX/XXXX. I have paid my for XX/XX/XXXX and when I go online I see you but I 'm still being charged for it in XX/XX/XXXX. I feel that I am being taken advantage of however I can see that I might be misinterpreting the rules so I was hoping to be able to have someone explain to me if what is happening is allowed or if I 'm being taken advantage of. I recently purchased a new home and my new lender told me that based on my situation they should have already removed the private mortgage insurance.

XXXX took the funds out my debit, and my wife 's! They should of just been from my wife 's account not mine! I just noticed, Because I am - {$72.00} and I said how! So I call and the guy tells me I ca n't do anything for you right now! I do n't know if Bank Of America does n't like me for filing a complaint on the way they handled my case before! I love this bank and I hate to fill these complaints out, but I do n't have much money and ca n't afford these set backs, and crazy fees, and shadiness these banks do!

Complaint: I was sent a solicitation by Bank of America to refinance my mortgage. I would like to do so. This would reduce my remaining 17 years to 15 years at a much lower fixed rate than my current 5.5 % mortgage. I own a full floor of a XXXX story building in XXXX originally offered as XXXX condominium units with full exclusive ownership of all adjacent common elements and we occupy it as our sole principal residence as if it were XXXX unit. It is worth approximately 8 times its value on our purchase in 1997, possibly more. Our refinance amount would be $ XXXX or thereabouts ( we do not want to borrow against any equity ). In NY state, there is a large transfer tax. However, this refinance would not be a transfer to another lender. It would just be a refinance, which BoA solicited. The fact that our floor can be used either as XXXX units or as it currently is XXXX unit, is only a positive to its value, and therefore, only lowers its risk to BoA. BoA however claims that this status ( XXXX units, XXXX of which we bought simultaneously in 1997 under condominium contract terms that make clear the optionally single use rights to the full floor ) PRECLUDES BoA refinancing for us. Whatever rule is being applied concerning the use of our real estate as XXXX units versus XXXX unit is a bogus rule, I believe, being used to obstruct us from refinancing our loan conveniently with our current lender, and to impose multiplied transactions costs on borrowers, by forcing the borrower into a complicated rigamarole, refinancing via a third party, which would entail additional agency fees. As our credit is excellent and our payment track record perfect with BoA and all prior lenders from whom BoA inherited the loan, and the property is worth about 15 times the mortgage amount, I do not understand why we the borrower should be victimized by a senseless corporate rule that has nothing to do with financial risk to the lender.

Complaint: Bank of America has a section on its website where you can " check for customized offers. '' I did and based on the wording, the website made it seem as though the bank was pre-qualifying me for a credit card, and with this confidence I applied and was denied adding a hard inquiry into my credit report. The wording for the " check customized offers '' section makes it seem as if consumers searching for credit are pre-qualified for the credit cards listed because one is not able to see the credit cards until entering information such as name, social security number, date of birth etc. This is very misleading for consumers and costing them a hard inquiry which then affects their credit score! Bank of America must stop this misleading practice, essentially billing a " customized offer '' as a pre-qualification offer of sorts.

When they took over they notified me that our previous lender, Bank of America, had not applied our payments to our loan for at least 2 years. Because I am under Chapter XXXX bankruptcy I am protected AND BOA sent me a statement each month showing payments were received and I was paid in full each month. So I reached out to BOA and they sent me my 2 year payment history - I 've looked through it and ca n't figure out where my payments were sent. BOA denies any fault however, XXXX XXXX refinanced my loan to catch the loan up and make up for the 2 years of missing payments. My problem is I ca n't get BOA to accept fault and tell me where my payments went. I 'm even considering getting a lawyer involved but I do n't want to if I do n't need to.

Complaint: My loan was listed in the Federal law suit filed by the, Department Of Justice against the banks. The banks agreed to settle the law suit that was initiated. As per the XXXX XXXX 2016 settlement {$8.00} to {$16.00} XXXX dollars went to investors and home owners for mortgage fraud. I am filing a claim for payment of {$9.00} XXXX Dollars ( XXXX ) that is rightfully my fairs hare of the {$16.00} XXXX Dollar Settlement awarded on XXXX XXXX, 2016. My loan was included in the Mortgage Bond Settlement with Bank Of America and XXXX for property XXXX, NY XXXX. The loan was not a viable loan, the loan violated XXXX, RESPA, REGULATION Z, TILA, FAIR HOUSING based on AGE DISCRIMINATION. I was taken advantage of. The loan was a predatory loan. Also, the bank never provided me with the Good Faith Estimate prior to issuing the loan. Both Title company and the Bank refused to give me copies of any of the documents they presented to me for me to sign. I did not receive any documents prior to closing, during closing or after the closing. Please advise and forward all the proper documents needed to file a formal complaint and request for my fair share of the {$1600.00} XXXX Dollar Settlement.

Complaint: Bank of America is prohibited from collecting fees during the loss mitigation processes. Dual tracking protections apply to Requested Mortgage Assistance ( RMA ) applications per California Civil Code 2923.6 ( g ). Prohibited fees during loss mitigation are not to be collected. Servicer may not collect any late fees when a complete loan modification application, other foreclosure alternative, or appeal is pending, or when borrower is compliant with any foreclosure prevention alternative plan per California Civil Code 2924.11 ( f ). Bank of America and their representatives has engaged in unfair debt collection as evidenced by the XXXX XXXX and XXXX XXXX Bank of America provided account records including, by not limited to, payment histories aforementioned. Bank of America has assessed fees to this home loan mortgage account amounting to tens of thousands of dollars, including fees incurred by XXXX XXXX XXXX XXXX ( XXXX ) in their roles as both debt collectors ( from XXXX XXXX to XXXX XXXX ) and beneficiary trustee ( from XXXX XXXX to present ). Complaint: Bank of America has had ample time to consider my complete as received Request for Mortgage Assistance ( RMA ) application package of XXXX XXXX. Bank of America, their representatives, and servicer can not record an NOD, an NTS, or conduct a sale while the application is pending per California Civil Code ( XXXX ( c ) ) and, if application is denied, until 31 days after providing borrower with a written denial per California Civil Code XXXX ( XXXX ) ( XXXX ). While there is no consistent or well established Bank of America deadline for borrower 's to submit an RMA application, I submitted a complete RMA application package and all other Bank of America requested documents on and before XXXX XXXX, XXXX without delay. Bank of America has decided not to provide a written determination to the XXXX XXXX RMA from the Bank of America Appeals Department to date. While there seems not to be any Bank of America deadline for servicer 's application evaluation and no established deadline to process an appeal, it does n't take over four years to come to a decision and issue a written determination and direction unless the bank has decided to park and stall the modification process indefinitely. However, this park and stall tactic is at odds and inconsistent with the recent efforts to collect on this home loan mortgage account. Bank of America, their representatives, and the servicer may not record an NOD, NTS, or conduct a sale until the later of : 1 ) 15 days after the appeal is denied ; or 2 ) 14 days after modification is offered. As a borrower must accept an offered modification within 14 days or offer is considered rejected per California Civil Code XXXX ( XXXX ) ( XXXX ), the same standard is to be placed upon the bank and servicer. Since Bank of America has declined to timely process a complete RMA so as to complete the modification process, Bank of America and their representatives and servicer forfeit rights to decline an evaluation, issue a written denial, and foreclose. Bank of America has not offered a MHA HAMP TPP based on the XXXX XXXX RMA before or after XXXX XXXX. Thus, I have never rejected a modification in accordance with California Civil Code XXXX ( XXXX ) ( XXXX ) because I have had no option and opportunity to accept or reject a modification timely presented to me by Bank of Americ based on my XXXX XXXX RMA.
