Complaint: On XX/XX/2018 at or around XXXX, I received a phone call from a blocked number stating that they are from the county, and are wanting to meet up with me to have me sign a legal document, and that I am being sued by the company filing the paperwork. I was instructed to call ( XXXX ) and reference a file number. The number provided is for a collection agency called XXXX. XXXX informed me that it is a debt with a company called " Account discovery systems '' who hired them to collect a debt from the originator ( XXXX ). When I asked XXXX to validate the debt, they asked for my email to email me the validation. I denied- as I wanted to send them a formal letter asking for proof of the debt. They denied providing their address and claim that they're not allowed to provide their address. I had stated that I want proof that I owe the debt, however the person who I was speaking with, became irate, and belligerent stating that they will close my case and suggest legal action if I don't pay.

Complaint: XX/XX/2018 a guy named XXXX called and left a voicemail on my phone stating he need to get ahold of me for paperwork to be sent to my employer for verification. At no time in the voice mail did he identify as a debt collector or state what the call was about. I called back on the XXXX XXXX XXXX a recording told me to hold for the next person again never said it's a debt collector. Then a guy who said his name was XXXX XXXX answer and again nothing about being a debt collector was said. At this point I didn't know who they are or what they need I asked for XXXX as he instructed in the message. The guy said he was gone for the day but he works closely with him what do i need. I told him about the message and then started that i felt like this is a debt collection and if it is that is against the law for them to not identify as such. He then got very rude and stated that he could not help me that I would need to call back tomorrow of wait for the next call from them if I wanted to know what the matter was about. He then hung up on me. I called back and informed him that if he was indeed a debt collector to seize and desist their attempts to contact me over the phone or with my employer. No information was given over the voicemail about what debt it was rather the caller, XXXX XXXX, stated that a creditor wanted to receive information about my income and assets and wanted to contact me first before she calls my employer. Complaint: On XX/XX/XXXX, I received a message from XXXX XXXX XXXX or XXXX, and the message stated : We have attempted to contact you on several occasions. Due to your lack of response, we are filing a claim against you in the County Court System. If you want to speak with us regarding this matter then please call us at XXXX. I then returned their call to see what this was about. When I called I spoke with XXXX, he said that he was attempting to collect two debts from me. The first one was from a bank, XXXX XXXX XXXX XXXX for {$150.00}, which he said was File # XXXX. The second account was for a credit card, XXXX XXXX, XXXX XXXX XXXXXXXX XXXX XXXX, for {$460.00}, which was their File # XXXX. I told XXXX that I do remember those bills, now that he brought them up, but I explained that I have had very poor health and that I only receiving Social Security XXXX. I further explained that most of my Creditors have placed me on a " Hardship repayment Program ''. I told him that I would be willing to pay them but I can only afford a very small amount for each debt. Then, I asked how they got the files or debt, he said they received the files from ADS-Account Discovery Systems. I said to him that I am confused and I am not really sure who I should be legally paying. I also told him that I will only be able to pay by money order, because that is how I pay all my bills. He had a big problem with that. He said that I must pay with a credit or debit card. I told him that I could not do that. We argued back and forth, so he then transferred me to his Floor Supervisor named XXXX XXXX, I went through all the same information with him, and I told him that I was not even sure if I should be paying them these payments, because I was not sure if they were the correct people to pay. I also told him that I could only pay by money order. But, he told me that I better not send money orders because they will not accept it. He said they only take credit or debit card payments. Finally, he transferred me to another person named XXXX XXXX at XXXX, he said that he was a Director. I spoke with him for a while and I told him all the same information, that I was not even sure if I should be paying them the money. I also told him that I can only pay by money order. Finally, I gave him my credit card, the only one I had left, which did not have much of an available balance, because they basically bullied me into giving them this info. They badgered me, and badgered me until I did. Now, I myself worked in a XXXX XXXX XXXX departmentr for over 15 years for a XXXX XXXX XXXX XXXX XXXX, so I am not a person that would easily be pushed into such a thing. But, they were relentless, and because I am in very poor health, I just finally gave in. Now, XXXX XXXX XXXX promised to send me an email detailing all the payments that I would need to pay, he promised it would show all the information that I needed. When I received the email, it was incorrect. It stated that I would make payments of {$20.00} per month plus an XXXX fee for the XXXX XXXX XXXX, XXXX account # XXXX, which I had agreed to that amount ; however, the other debt for the Credit Card account of XXXX XXXX XXXX XXXX XXXX XXXX XXXX acct # XXXX, the email stated that I would pay the whole account in full, which I did not agree to do. I agreed to pay them in small payments of {$20.00} per month. I then immediately sent them back an email stating that I did not agree to those terms of repayment. Then, I began to call them again. I called them and I could not get XXXX XXXX, so I spoke with XXXX XXXX, and I explained that the terms of repayment were wrong on the email that I received, I explained that it stated that I would repay the amount due in full in the amount of $ XXXX for the XXXX XXXX XXXX XXXX XXXX XXXX, for the Total XXXX cc. I told him how I am very sick and on Social Security XXXX and that I can only afford the small payments on each of the two accounts of the agreed upon amount of {$20.00}. He said that he would speak with XXXX XXXX and have him resend it out to me. On XX/XX/XXXX, I called back to check to see why I had not received the corrected email, and corrected details of the terms of repayment. I was able to speak with XXXX XXXX, who very rudely told me that they are not handling the accounts any longer. He told me that I need to call Account Discovery Systems-ADS and he gave me the number to call of XXXX. So, I then contacted ADS, and I spoke with a XXXX, he said that they did not have the accounts there with them at Account Discovery Systems, and that I needed to call XXXX. I told XXXX that I had called XXXX just moments before, and they told me to call ADS. XXXX called XXXX XXXX XXXX himself. He said that they would be calling me in a short while. Within a few moments, I received a call from XXXX XXXX, with XXXX XXXX XXXX, he said that he was a Director. After I told him all that had happened, he said that he would make sure that I was sent the email, and that it would reflect the correct information, and the correct amounts to be repaid. I did receive that email, and it looked to be correct. Within the email, there was an address to mail the payments to. So, I purchased two money orders, and sent the two money orders via postal mail to the stated place to mail the payments to which is : XXXX XXXX XXXX, C/O XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX, XXXX XXXX. I mailed them on XX/XX/XXXX in XXXX XXXX, XXXX, and the post office told me they would arrive to XXXX, XXXX on XX/XX/XXXX. They were both due on XX/XX/XXXX. I waited until XX/XX/XXXX and then called XXXX, I spoke with XXXX XXXX, I began to tell him that I had mailed both money orders on XX/XX/XXXX, and that the post office said that they would arrive to XXXX, XXXX on XX/XX/XXXX. XXXX told me that they did not have the accounts any longer, and that I need to call ADS at XXXX. I then began calling the other company, but all I ever get is a voice mail system. I have left messages with the other company name ADS with two people, one is named XXXX XXXX, and the other being XXXX, a Manager. I keep asking for someone to call me to tell me if they received my payments. No one from ADS calls me back, and I have been calling them for one week. As for XXXX, they would not confirm that they received my payments. So, I need someone to tell me who I should really be paying, and who received my payments that I mailed to them. It might only be {$40.00} to them, which they had said was the lowest payments that they have ever agreed to accept, but to me being that I am sick, this is alot of money. This XXXX dollars could buy my diabetic supplies, and I have chosen to send it to someone toward two old debts. I just need to know that it gets applied to the correct accounts, and that the correct people are being paid for these old debts. Someone please help me! These people are pushy, and unprofessional, and I am not really even sure that they are the legitimate recipients of my payments. And, I am not even sure that they received my payments. Where are they? Again, someone please help me!

Complaint: On XX/XX/2018 during the early evening I called by a XXXX who left a voicemail. He stated that he was XXXX from ADS and that he was attempting to locate me. Did NOT mention this involved a debt. he went on to say that I had until the next morning to call him at his direct number for they would contact my employer and family members to try to locate me ... obviously not something I want, that's embarrassing and that makes me look bad. I called XXXX direct line that he provided in the voicemail and I requested something validating the debt. He point-blank refused to do so, telling me he had no obligation to do so, claiming that I had received documents in the mail and said that they had sent plenty of emails to me in which they had read receipts of ( which I NEVER received ). I had told him that I did not receive emails and he kept arguing with me and started to raise his voice. He told me that I was going to get my wages garnished at one point.He was literally yelling at me by the time I requested a supervisor, in turn making a snide comment. I have unfortunately fallen on hard times, and have had dealings with debt collectors before ... before good night, I have never had anyone threaten me or yell at me like XXXX did. Complaint: XX/XX/2018 at XXXX XXXX - I was finally able to get this Debt Collector, XXXX, on the phone. I had to XXXX this phone number to find out information on this company and it appears that the name of the company connect to this number is Account Discovery Systems , LLC, XXXX XXXX XXXX XXXX, XXXX, NY XXXX, https : //accountdiscoverysystems.com/contact/. They were very rude to me on the phone. I asked them to send me information on this debt in the mail along with a validation of this debt as I no longer have this Kia Sportage they referenced in their voicemail message and that XXXX XXXX XXXX XXXX XXXX XXXX had recently sent me a check for about {$40.00} in the mail recently regarding this account. They claimed that they were not representing XXXX but another third-party collection agency. This left me confused. They also refused to send me anything in writing regarding what they claimed I owe. They said that I was refusing to pay a debt I owe because I was asking for information on a debt that they claim I owe to a third party that is not even XXXX whom had recently sent me a check and for which I have the legal right to request information. They also threatened me with legal action since they said that I am refusing to pay a debt that I don't have any information about. As far as I am concerned my business with XXXX should be completed with the sending of this check in the mail to me. Their refusal to send me any information in writing regarding this debt that they claim I owe, their refusal to send me a validation of this debt are all business practices that goes against the Fair Debt Collection Practices Act. Also a quick XXXX search of this number reveals that this company has been sued multiple times and has had several complaints placed against them for unfair debt collection practices : https : XXXX, https : XXXX XXXX & XXXX & XXXX & XXXX & XXXX, https : XXXX, https : XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX ... This company has called me previously and I told them that I can give them a one time message. So today, they called and I explained that I have nothing to do with this and please do not call me again. The caller named XXXX proceeded to argue with me and tell me that because I was used as a reference they can continue to call me and they will unless I provide updated contact info on the person they're trying to reach. I then proceeded to tell them that I will have my attorney call them for them cease and desist from calling me. I explained that I have nothing to do with the debt and that I am not the one who they should be calling. He repeatedly told me that because I was put down as a reference.

Complaint: This collection agency called myself and my sister at XXXX. A voicemail left by a XXXX XXXX stated " giving you a call in regards to a petition of garnishment filed against you by XXXX XXXX. Prior to submitting the paperwork on your behalf I just want to go over with you because you do qualify for a settlement on the loan. '' This collection agency has no right to contact my family over an old debt. The agency also has no right to do ANYTHING legally on my behalf. They are not my lawyer and have no permission from me to act on my behalf. Also, according to my credit report, when this debt was sold to a collection agency, a payment was made that re-aged this debt illegally. The payment was made on XX/XX/2017 completely without my knowledge. I will also be filing a complaint with my state 's attorney General as well as New York state 's attorney general, and the XXXX. Complaint: I was contacted by Account Discover Systems, LLC attempting to collect a payday loan debt on behalf of XXXX. I was told the amount I owed was {$8000.00} during the call the collector after only me saying yes to my name and date of birth which he gave out mentioned my employer, names of family members and complete social security number. I do not believe this debt is mine. I do not believe the loan was from a legally licensed lender in the State of Oklahoma and do not understand how such a collector has and is willing to give out my personal information. I have already disputed this information with XXXX XXXX XXXX, XXXX previously. I have requested the lender cease and desist all phone contact with myself, any assumed references and my employer. I have requested validation of the debt, calculation of the amounted owed which was stated as {$8000.00} and the license of the collector original lender validation of the collectors ownership of this presumed debt. They had impersonated a federal attorney, threatened to " serve me papers '', and contact my family members in another state to discuss my debt. They used the phone number XXXX on XX/XX/XXXX in an attempt to collect this debt. I told them they could just go ahead and serve me papers if they were really a federal attorney. Today on XX/XX/XXXX, I went around contacting my old creditors to pay off my bad debt, I only had one bad debt left to pay, and I found out it was bought by a company who then used Account Discovery Systems debt collection service, which is how I've deduced that they are the company responsible for these illegal actions, to collect this debt. Complaint: On XX/XX/18, my mother and step father received a call at their home number from this company stating I listed them as a reference and they were trying to reach me. My step father answered and took the number and extension to give to me, thinking it was a job, based on how the call went. I was given the information and before I could call, they got in contact with my mother on her cell phone. First of all, the home number they called was never given to them nor do I even have the number to give out. My mother spoke with someone named XXXX XXXX and he told her she was listed as a reference and proceeded to give the names other references that they were trying to reach to her. First of all, this is not something that they are allowed to do, to my knowledge. They further stated they have been trying to reach me and my boyfriend but our numbers were shut off. They are correct in that regard, however, those numbers were just shut off about 2-3 weeks prior and I never received a call before that ( I do screen my calls and voicemails and never received one from this company ). My mother passed along the information and told me they were after a debt for something else. I called thinking it was a debt for something else so I wanted to resolve it. She mentioned they were about to garnish me and that this was a courtesy call to let me know that the garnishment would be filed on this coming Friday, XX/XX/18. AS I was super busy and had a lot going on, I called back immediately to handle this and was also multitasking during the call, this will come into play later. I have had a few debt garnishments and know the process and in my busy state, it lapsed my memory that this is not the normal procedure. I called XXXX back to see what was going on and was a little annoyed and concerned they gave so much information to someone that was not me. XXXX XXXX answered the phone and I explained I was responding to a call to my mother and he immediately knew who I was and stated " I have the last four of the SSN as XXXX. '' Again, this should have rang a bell right then but I was doing about 5 things at once and it didn't register that he never asked me any verifying information. He proceeded to state it was a courtesy contact because they were putting in a garnishment order on this coming Friday. I expressed concern that I had no idea that I owed this debt and had never received any calls or mail regarding this debt or that it was purchased from the original creditor. He gave two addresses, one a past address and one my current, and I advised that the current one was correct but I had not received anything at any address and had always put in a forwarding notice. He glossed over that and went into payment options. He never asked for an updated phone number, being as the one they had was wrong, and started talking about settlement options and payments and again the garnishment order. I was very flustered and told him that I had no idea I had a debt owed and he mentioned that they had tried to auto draft it from my bank at one point ( I never gave anyone permission to do that! ) and it was returned either for NSF or a closed account. My account has never been closed and I was never informed that a transaction was attempted as my bank does provide overdraft protection. I told him I would discuss the options with my boyfriend and get back with him on what I decided. He urged me to decide quickly as I only had until XX/XX/18 to stop possible garnishment. He told me he would have his manager send me the payment terms so I could read them. I called back later after discussing the terms and deciding to pay as garnishment would put me in a severe financial bind. I called back and spoke with XXXX XXXX. He then asked me to verify the last four of the SSN, which he gave me in the first call and I could have been anyone at that point, I gave it to him and we set up the arrangement and discussed future settlement options and he mentioned in the first call about using a tax refund and so forth because it was that time of year, that threw up a red flag as to why they are just now contacting me. I set up the arrangement and he stated I would get updated terms ( the dates were wrong on the first ) within an hour or two. I never received the updated terms and it has been about 17-18hours. I did have time to sit and process the call last night and noticed a lot of issues with this call that has made me question if I truly owe anything. I looked through my old phone and paperwork ( I am a paper hoarder of sorts with bills ) and saw no notices of the debt being purchased by this company and no notices from the original company either. I did some research this morning, as it has been a number of years since I worked collections, and found they are required to contact me within 30 days, by mail, that they purchased this debt and give me a chance to dispute it. I never received that paper nor have I ever received a single bill, notice, or phone call. I am extremely concerned that so much personal information was given to a third party and no one truly verified I was who I said I was nor addressed why I was never contacted before the week they were to send me to garnishment. I'll admit, I got panicked at garnishment and wanted to stop that possibility and gave my CC number to set up the arrangements, which I now worry was taken by a scammer after reading these other complaints. I reached out to the manager XXXX XXXX asking for the original purchase date, all attempts at contact and dates of all calls and letters sent and the addresses and phone numbers contacted. I feel as they tried to prey on the fear of garnishment in people and used that to get a fast payment. They were willing to settle for way less than even the original debt and that is very concerning, as well. I do know that the garnishment process is longer than they let on and in my distracted state I forgot that. I have never received a single payment demand/notice nor have I received a court summons for debt court for a garnishment order.

Complaint: Account Discovery Systems has been repeatedly calling third parties ( all of which are my boyfriends family members, and I do not even have contact information for ) in order to gain contact with me. They contacted the other individuals prior to attempting contact with me. I called back XXXX XXXX on XX/XX/17 at XXXX, pst and she explained that since she had made contact with me, she will no longer call other people. After our phone call, she emailed me a document with payment options and I emailed her back explaining that I would not be able to commit to a payment until the end of the month. Since our phone conversation and email exchange, she has continued to contact people stating that she is trying to contact me but has made NO attempt to contact me personally regarding the collection debt. I feel as though she is using this tactic to try to embarrass me into calling her to settle this debt. She is now harassing the same people by repeatedly calling them even though she has spoken with me and emailed me. After receiving word that she contacted my boyfriend again today, and she contacted his father twice this week, I emailed her requesting that she stop harassing these people and I will be filing a complaint against the company.
