Complaint: GMAC vehicle lease turned in date of XXXX XXXXGMAC company is absorbed by Ally. Credit Bureau never reflected lease termination when dealer sold vehicle to new owner as a sale vehicle. Credit Bureaus shown I owe {$9200.00} as of XX/XX/XXXX. Negative derogatory remarks for outstanding amount owed. Ally would never correct information to reflect positive account. Vehicle was purchased as a sale by new owner XX/XX/XXXX for XXXX paid over {$900.00} in sales tax in XXXX XXXX County where vehicle was returned. Same owner who purchased the vehicle XX/XX/XXXX currently still owns the vehicle. All transactions took place in XXXX Fl. The sale occurred before the credit bureaus were notified I owe remaining balance as of XX/XX/XXXX. GMAC went out of business Ally took over their obligations. No one at Ally will talk to me to resolve this issue in the last seven years. Florida Vehicle Title number XXXX sale date XXXX for vin number XXXX for XX/XX/XXXX XXXX XX/XX/XXXX XXXX. Anyone who runs the vin can see this same information of the current owner name and address who paid XXXX and over {$900.00}! in taxes. Clearly Ally never updated GMAC records as GMAC went out of business. I am left to carry the financial burden and negative credit bureau mis information.

Complaint: I purchased a XX/XX/XXXX XXXX XXXX XX/XX/XXXX financed by Ally XXXX and directly setup auto pay through the website to ensure that not only was my payment on time, but I was paying extra every month with the intention of paying the principal down, and paying the loan off early. After 4 months I realized that my extra payments were n't being applied to the loans principle amount so I called. Then I was informed that this " could not be done automatically '' in any way, shape, or form. I was told that if I wanted the extra paid to principle then I would have to phone them every single month and literally demand that extra be applied to the principal. It is there policy to apply that payment " forward '' to a time that doesn'teven exist yet, so as to maintain the " status quo, '' and not lose a single penny in interest that would have accrued on the principle loan amount. This policy of forcing customers to call every single month to have that extra money applied to the principal is, in effect a firm of bullying and harassing their customers into just giving up and letting them charge interest on money that was already paid them! I can provide documents showing how my payments were paid in advance, and applied to periods of time that do n't even exist.. yet!

Complaint: Sale of vehicle repossessed never documented with transfer of ownership to relieve debt of monies owed affecting credit bureau information and negative credit worthiness. Ally failed to update consumer information after numerous requests to update sale of vehicle and update consumer file on accounts ( Joint ) creating negative information in credit bureaus affecting credit worthiness. XXXX XXXX Vin number XXXX ownership change never reflectedXX/XX/XXXX ownership change. Title XXXX. XXXX/XXXX/XXXX vehicle was in excellent condition in XXXX, hence the vehicle still being driven nine years later. Ally never updated their records when the vehicle was repossessed and then resold to reflect monies paid from sale of the vehicle. Numerous complaints are on the Internet of how Ally failed to account for sale of vehicles on accounts for many individuals affecting credit worthiness and collection amounts placed in credit bureaus without resolve. Nor do they respond to complaints or itemize charges for outstanding monies owed in the amount of {$3600.00} or show transfer of vehicles updated in real time when they occur. Ally provides one letter with total amount owed without explanation of charges or updates sale of vehicle ownership information leaving the financial burden on individuals affected by their lack of follow through or accounting of records on consumers.

Complaint: Over the last several years, I have been getting repeated phone calls from Ally Financial regarding debt owed by a person with the same last name as me, and whose wife has the same first name as mine. On each call, I have explained that I am not the debt holder and asked Ally Financial to stop calling me. I have been unsuccessful in getting them to stop. The most recent occurance took place XX/XX/XXXX 2015, when they called and hung up. I called them back to learn it was the collection service. I asked to speak to a manager at that time and explained the situation. She assured me it would stop. I recieved another call less then 24 hours later on XXXX XXXX, 2015. Again, the caller hung up when I answered. I called back and spoke to the same manager again, who again assured me it would not happen again. When I inquired as to how they even got my number, she explained that they have a " tool '' that they use to find possible relatives to debt holders. I explained to her that I have repeatedly told them that I do not know the debt holder in any way and should not be linked to them. As I result of their actions, we have had to take out identity theft insurance for the last several years, and have had some complications with my wife 's credit report.

Complaint: My father passed away in XXXX. He had an auto lease agreement with Ally Financial. We contacted Ally Financial to notify them of his death and get their guidance on what options we have to proceed. In conversations with Ally, they advised us to return the vehicle to the auto dealership. We asked about any financial liability to my father 's estate if we returned the vehicle. Ally advised us that we should not expect any financial liability upon return of the vehicle. They stated that they would sell the vehicle at auction. We expressed concern that they would not attempt to get fair market value and pass the cost on to us. They assured us that this would not occur and not to expect any further expense. With this understanding, we returned the vehicle as instructed. Less than a week after returning the vehicle, Ally send us a notice requesting payment of {$4900.00} having auctioned the vehicle in a closed auction to their business partner at a heavy discounted price. Less than a week after that they had already referred the matter to a collection agency ( XXXX XXXX XXXX ) who is attempting to collect this as a debt of my father 's estate. We do no think this debt is the responsibility of my father 's estate, since we did as they instructed and Ally provided mis information to us in the process before Ally made a poor business transaction upon which they had on interest in gaining good value. Their instructions and information precluded us from taking other options, such as transfering or continuing the lease that would have been more financially vialbe. We contacted Ally about this and they agreed that they should not have told us not to expect expense and that we were provided with bad information by Ally 's own customre service professionals. However, Ally told me that they sold the debt to XXXX XXXX ( a collection agency ) and now we have to deal with a collection agency moving forward. We think this is unfair to have been mislead by Ally, who immediately assigned their loss to my father 's estate without any agreement or dicussion and then proceeded to sell that debt to a collection agency before making any attempt to settle the matter with my father 's estate. Ally also confirmed that if they had sold the vehicle for a profit they would NOT have provided my father 's estate with the proceeds. Instead, they sell the vehicle and keep the profit if there is XXXX or attempt to pass the loss along to customers in a transcation that is not conducted in a fair manner attempting to get market value, but is rather under an agreement with their business partner ( auto dealership ) whom they have additional business arrangements. Then immediatley sell the debt ( missasigned to the estate ) to a collection agency to begin harrasing people. If there is to be a fee or penalty on the return of the leased vehicle, Ally should have made it clear what that is likely to be. Instead, they told us to return the vehicle and not expect any further expense despite our raising the concern of having any further expense before we return the vehicle.

Complaint: I have an auto loan with ally auto. my XXXX 2015 loan payment was processed as a principal only payment, they then sent me a late notice and a notice of intent to report negative information to credit bureaus. they also deducted a finance charge of {$79.00} from the payment, as they do for my regular monthly payments. while trying to rectify the situation they stated that the whole of the XX/XX/XXXX payment was applied to my unpaid balance and that they were going to adjust the balance and take a finance charge. I pointed out to them that I was looking at my payment history and that a finance charge was already deducted from the payment. so far I have not got a fair resolution to this problem. lastly they applied a {$13.00} late fee to my account.

Complaint: I have paid my car loan every month on time and my car loan company has reported me 30 days late for the past 3 months. On my credit report it stated I was 30 days late for XX/XX/XXXX on XX/XX/XXXX. I am in the process of purchasing a home. I am unable to proceed because my credit score and report have been negatively affected by the false reporting. I have contacted the loan company and was on the phone for an hour and a half with no resolution. I was told it takes at least 20 days to research the problem. This is causing myself and my family major problems in getting a mortgage for a property that we want to buy. We risk loosing the opportunity to purchase what we want because of the negative reporting in error. As you can see in the attachment of my payments there is only XXXX late fee assessed and it is in XX/XX/XXXX. This was not late as you can see it was paid on XXXX XXXX.
