Complaint: I made a payment to the loan service, ACS, but it was not applied to my account and they reported a delinquent payment to the credit agencies. Now my credit is almost below XXXX. I have had issues with this loan servicer for over 4 years. Their website does not work, and so I made a payment over the phone but it looks like the payment not applied correctly.

Complaint: ACS and XXXX XXXX conspired to illegally capitalize interest on my loans by removing the loans from Income Based Repayment ( " IBR '' ) and placing the loans into either forbearance or deferment status. XXXX XXXX holds the promissory note, ACS ( or XXXX ) is the servicer. ACS also hides its actions by placing the loans into " accounts '' or " packets '' that are not available for viewing on its website when I am logged into my account. ACS has attempted to prevent my loans from continuing in IBR every year through difficult to meet deadlines, although I have continued to meet the deadlines, yet ACS refuses to acknowledge IBR for certain loans. And, ACS has sent statements that my forbearance or deferment has ended, when none of my loans are supposed to be in forbearance or deferment, and I was mislead to believe the loans are in IBR. The amount of interest being illegally capitalized is between {$60000.00} to {$80000.00} currently, and this amount does not include principal amounts of loans. After 25 years the original loan amount will be eligible for forgiveness, but the interest that ACS causes to accrue illegally will be my payment and the IRS will collect this amount. Accruing interest in this manor is illegal. I attended XXXX, XXXX between XX/XX/XXXX-XX/XX/XXXX. Virtually everyone was pushed into loans with XXXX XXXX. I provided XXXX XXXX with proof that XXXX illegally inflated my tuition to qualify me for loans that I did not qualify for, but XXXX XXXX has not responded to this information yet.

Complaint: I have XXXX loan servicers. ACS and XXXX XXXX. I sent them both the same application packet with my pay stubs so they could get a picture of my situation. XXXX XXXX used this information correctly and thus provided me with the correct monthly payment amounts, which I am paying. ( XXXX $ /month ). ACS came back with a payment that does not, in any way, reflect my income situation at the time the Income based Repayment plan application was submitted. ( $ XXXX dollars ) This is the second year in a row that I am having this problem with them. Last year it was the same starting point as that of what I am dealing with now and last year, after going through hoops, it ended up being XXXX $ per month. ( Finally, the same as what XXXX XXXX calculated my payment to be for XXXX initially. ). I 'm making a little more money now as reflected in the XXXX payment that I make to XXXX XXXX. But, it 's the same story with ACS for some reason. Why do I never have this problem with XXXX XXXX??? They need to use the same income information that XXXX XXXX used. That is federally mandated! It is the SAME federal repayment program used by XXXX companies and the same exact information was sent to XXXX of them. The only difference was I replaced each company 's name on the fax. I should not have to go through this two years in a row. This signaled to me that something is up at ACS and they need to be aired out.

Complaint: I have had three phone calls from the same ACS Education Service from XXXX, XXXX three days in a row. Each time, I verfied my identity. I attempted to call ACS in XXXX, XXXX, and they deny it and take no responsibility. I can prove otherwise by my phone log. Three calls, three days. What 's worse, I only have around {$100.00} left on the entirety of the loan. It 's ridiculous! AND ... they were trying to collect, at first, over {$200.00} and did n't have record of last month 's payments.

Complaint: XXXX sent a false loan verification over to XXXX XXXX in XXXX stating that I took out a loan in the amount of {$420.00}. In fact the loan was canceled in XXXX and I have proof of it, while providing that proof to the bank they have refused to send the money back that was taken. They have also retaliated by submitting false information to the credit bureau stating that this account was late and defaulted by reporting rolling XXXX lates to all three agencies. I have since disputed asking for the note that was signed for this loan amount of which they have not been able to provide.

Complaint: ACS has been reporting late status on my credit report when said loans were in forbearance. The loans in question have been reported incorrectly for XXXX different periods. The first instance was XX/XX/XXXX through XX/XX/XXXX. The second was reported XX/XX/XXXX through XX/XX/XXXX. The third instance was XX/XX/XXXX through XX/XX/XXXX. The information changes from XXXX credit report to the other. XXXX, XXXX, XXXX all have different information. ACS has been impossible to talk to. I give them my information and they say they do n't service my loans and hang up. One lucky time i was able to get my account number. Than she realized that they do n't service my loans anymore and ended the call. It is not only frustrating that i ca n't talk to someone about my loans, it 's even worst that they can wreck someones credit with no re-course. I feel like I have no rights. If a company can keep reporting negative information they should still service and provide service to the day they no longer can reports such information.

Complaint: I paid off my XXXX Student Loan over two years ago. I am now being denied credit because the servicer ACS is reporting that I am XXXX-days late in making a payment. I have tried numerous times to reach out to ACS to fix the problem but I can not get a hold of an actual person and now the company has been sold to XXXX and I have no clue as to who to write or call to get this fix. My end result is to get this negative information removed from all XXXX of the Credit Reporting Agencies as it is FALSE/INCORRECT INFORMATION.

Complaint: ACS in XXXX NY has been handling my loans for a long time. They currently will not take my phone calls, and their head manager will not return my calls. They refuse to cooperate or speak to me, take my payment over the phone, or assist me in any way. My deferrment period has run out, due to the misinformation, lies, or lack of knowledge of their call center staff. Its like they have hired it out to some foriegn country and/or individuals who are untrained, unaware, or under pressure to terminate loans. I am confident it is their fault that I am in this position. For years I have been asking them on numerous occassions for information about a low payment loan to repay my loans or a govt loan to repay them. I am always told that no such loan exists, they have no idea what Im talking about, and know of nowhere to refer me. As it turns out, the loan I was referring to is called an IBR, which is supposed to be offerred by their services, which I couldnt figure out, and asked for their help. I received it by chance, several years ago by one staff member who was really helpful, but I didnt understand it or where it came from, and was given no explanation or renewal process to keep it going. Of course I would have preferred to have this loan paying down my loan amount! However, I didnt know it was available, and the call center staff declared no knowledge of any such thing. Consequently, I only knew to defer my loan, which seemed the only relief, since I do not have the funds to make the huge payments. Finally the supervising manager helped me to apply for the IBR, when I appealed to her, but I was assessed a full payment of over XXXX XXXX dollars -- in the meantime, which I can not afford. I have been approved for the IBR now, which I finally understand and am thankful for, which is at low reasonable payments, but they are assessing me in default because I can not make that one huge payment that they leveled on me between the time I applied -- to when it was approved, which was several weeks. Its not fair : what has been done to me or the way I am being treated.

Trouble with how payments are handled
Complaint: I have a consolidated FFEL Loan through XXXX XXXX XXXX, XXXX, doing business as ACS Education Services ( " ACS '' ). ( Lender - XXXX XXXX XXXX ). The original loan in XXXX XXXX was for {$23000.00}. I have defaulted 3 times and enrolled in their " Rehabilitation Program '' every time to bring my loan back into good standing. I have never went into forbearance but it is listed that I did in XXXX/XXXX/XXXX. It is now XXXX and my current outstanding loan is listed at {$35000.00}. I understand that XXXX XXXX XXXX is under Federal Investigation for Loan Servicing Practices and it appears that I may be one the borrowers that have been affected. I wish I could afford an Attorney, but at this time is not feasible. Looking for any help and guidance possible. Thanks!

Complaint: Hello, I took out a private student loan from ACS Education Services in 2006. Each month I have made my payments on time. They almost always apply over % XXXX of my payment to interest and not the principal, so my balance barely goes down. When I contacted them about this they responded this, and this is on their website : Q : Why is n't my balance going down even though I am making payments? A : Payments are applied to assessed late charges ( if any ) first, then to any outstanding interest, and finally to the outstanding principal balance. You may have outstanding accrued interest that needs to be paid off first before you will see your loan balance begin to go down. Always remember that the amount of interest paid with your payments will be higher during the initial period of repayment and gradually decrease as your balance decreases. Yesterday I paid {$50.00} towards my loan, and according to them my outstanding interest was {$0.00}. I am attaching a copy of that payment and it shows that they took {$12.00} to interest. So what they are doing is unethical and possibly illegal. They are lying on their website based on the statements above. Similarly, the month before just before making my payment they indicated that I had {$51.00} in outstanding interest, but as you can see, they took {$76.00} of my payment and applied it to the interest. The remaining {$68.00} went to the principal. They did not respond to my inquiry about why so much of that payment was applied to interest. And, as you can see, in almost every one of my payments, a good deal more goes to the interest. What they are doing is unethical and unfair. They are not applying payments appropriately, and I believe it is to get more money from the students who borrowed money from them. They need to be stopped.
