Complaint: In XXXX, 2015, I called ACS, one of my private loan providers, ( note, this is not the original lender and it has been changed during the length of the loan a number of times without my consent ), to ask about options to help me while I am unemployed and without income. At this time, I received a letter which offered " the ML ( MGRS Plan ) where for 6 months your monthly payment on the private loans are reduced at XXXX % of level ( fixed ) installment followed by 6 months the monthly payment is at XXXX % of level installment followed by 12 months of interest only payments followed by level repayment for remaining term of the loans ( You must have at least 36 months of term remaining and a principal balance outstanding of {$10000.00} or more ). The request for this option is done verbally. " When I called to accept this offer on XXXX XXXX, 2015, I was told that this offer was not available to me because I had taken advantage of this in the past, time unknown, but that it was noted on my account and only available once during the loan term. Therefore, the offer was no longer valid. I asked about other options and was informed about forbearance, but this would require me to have a 1 % interest rate increase ( to an already variable interest rate ) for the 12 mos payments following the forbearance. Other than this, no options were available to help me. The man I spoke with was in XXXX and could not connect me to a supervisor, but he would have a supervisor call me within 48-72 hours, as is standard response time. I have XXXX accounts with ACS, have asked for a consolidation, and always have been denied the opportunity. I have asked for lower interest rates and have also been denied. The term of the loan is unclear and when I ask, am unable to get a clear answer. Between the XXXX accounts, the original loan amount was {$26000.00}. As of XXXX 2015, I have paid a total of {$11000.00} in interest and {$9300.00} in principal. I also have another private loan and government loan and in total pay $ XXXX/mo for student loans. I have never missed a payment. I am a XXXX, who has worked at XXXX until recently. I have tried to work with banks, Dept of Education, and other repayment companies to identify options, and feel no one is able to help me honestly understand the benefits and burdens of options nor the ramifications of decisions. I feel powerless despite my efforts, education, and patience. Is there anyone who can help? Thank you! I ca n't and wo n't pay these companies forever without some flexibility on their end.

Complaint: I am a conscientious borrower and historically have kept my student loans payments up to date. To make this easier, I changed from individual internet payments to using the bill pay service from my bank. When I made internet payments to ACS, they would divide the payment between my XXXX accounts there. When I changed to my bill pay service, they began to apply the payments exclusively to XXXX account. Consequently, XXXX account is now paid up through spring next year. But the XXXX account is listed as overdue. They reported me to the credit agencies because of the overdue account. I have called multiple times explaining the circumstance, and asked them to apply the amount necessary from the over-paid account to the past due account to bring it current. I now make to separate payments each month to keep the overdue balance from getting larger. But despite my efforts and multiples calls, they still have not transferred funds from the over-paid account to the overdue account. They have reported me to the credit agencies, which has had an impact on my credit rating. And they keep calling me and hounding me at work. I see no reason why a consumer who has over-paid ACS should be subject to the embarrassment of being called by creditors at work ; a decrement in my credit score ; and the frustration of explaining the circumstance over and over only to have ACS fail to address the circumstance. Please help.

ACS informed that they do not accept prepayments and my XXXX payment is now past due. I have paid ACS more than my monthly amount numerous times over the past year and the money has never been applied to the next month.

Complaint: My private student lender sends me a bill with a due date. The bill due date is also on my on-line account, where I pay my bill. It says that it is the first of the month. It is for XXXX loans, each of {$1500.00}. I have paid the bills by the due date with on-line payment, and the money has left my bank account, however my payment is not credited until a week later, and I have been reported as late on my credit report, even though I paid the bill by the due date. It is a " campus based '' private loan. I called with a concern about what is the due date it was vague, pay before the due date. I asked for an actual due date and they could not provide one except for pay several business days before. I asked what means XXXX or XXXX, please be clear. With a credit card it is very clear when one pays on-line -- such as payments made before XXXX XXXX. EST will be posted to the account that day, payments made after XXXX XXXX will post the next day. Banks are also clear with how deposits are handled, such as deposits made after XXXX XXXX. will post the next day. I think it is misleading to send me a bill with a due date, but in reality there 's another due you need to pay by that they wo n't give you. I submitted this complaint before and the company response was to a completely different loan.

Complaint: I took out a loan in XXXX XXXX that is being serviced by ACS. I was under the impression that the loan was subject to in-school deferment while I am completing my XXXX degree. In XXXX XXXX, I received a call from ACS informing me that my loan was past due. I informed the representative that I was in school and would not be graduating until XXXX XXXX. The rep confirmed this info with the clearing house and told me I would need to mail in a deferment form that she would send to me. I never received the form. In XXXX XXXX, the calls from ACS started again. I again spoke with an ACS rep and explained my conversation with the last rep. This time, ACS told me I could not use an in-school deferment ( and that no form had been sent or any communication letting me know it would n't be sent ) because my loan could only be defered for a max of XXXX years from the origination date. I told the rep I was unaware of this term, and asked why the original rep had not informed me of this information when we spoke in XX/XX/XXXX, after the deferment limit period. I told the rep this was deceptive, as the loan continued to be unpaid for almost a month while I was under the impression I would be receiving an intent form. I also informed the rep that I had not received any notice from ACS that the deferment was about to end. The rep told me that I could instead use a forbearance on the account. The terms of the forbearance were limited to XXXX times in the life of the loan, and can not exceed XXXX months. Because I had already used XXXX months in XX/XX/XXXX, the rep told me I could use the remaining XXXX months while I complete my degree. I asked for a copy of my promissory note and the rep said I would receive it XXXX days later. The rep told me he could not send me a copy of the alleged notice letter from XXXX XXXX informing me that my deferment was ending, as it was computer generated and not reproducable. I emailed ACS after the call asking for a copy of the note and the XXXX XXXX notice letter. I was told the same thing the rep told me on the phone. Over the next XXXX weeks, I continued to receive calls from ACS, as did my co-signer. I eventually answered and told ACS I wanted the calls to stop as I had already made arrangements with ACS with the forbearance. The ACS rep told me they legally could not stop the calls until the forbearance was processed, despite my claim of harassment and request to not be called, and that they were legally obligated to call me whenever my number appeared in the system. I asked the rep for the regulation citing this practice, and he ignored my request and told me the calls would continue. I emailed ACS to verify that this was legally permissible. I then received a call from a XXXX XXXX regarding my email. She apologized for the rep, told me she could email me a copy of the note and also generate a copy of the XXXX XXXX letter regarding the end of my deferment. However, XXXX also informed me that I could not use my forbearance for XXXX months as I was previously told, but only for XXXX months per the terms of my note. I informed her this was ( again ) ACS modifying pertinant info told to me regarding my loan from what a previous rep had told me. After reviewing the docs sent to me by ACS ( by mail as previously requested and by email from XXXX XXXX, the note does not contain the information alleged by ACS. There is no mention of a XXXX year deferment limit, or that a forbearance can only be for XXXX months at a time. Furthermore, the XXXX XXXX notice letter does not indicate my deferment had reached its term limit. It looks simply like a letter I received from ACS previously while still in school XX/XX/XXXX, and would not put me on notice that my deferment is completely out and not just pending my fall enrollment/intent to return letter. I emailed XXXX multiple times regarding the note, and have not heard back almost XXXX weeks later.

Payments were to begin on XX/XX/XXXX. This account should have been removed from from reporting agencies in XX/XX/XXXX. This information is being reported differently on all XXXX reporting agencies : XXXX : ACS/XXXX XXXX XXXX / XXXX. Reporting date of first delinquency as XX/XX/XXXXXXXX : XXXX - XXXX / XXXX ACS. Reporting date of first delinquency as XX/XX/XXXXXXXX : ACSXXXX XXXX. Reporting date of first delinquency as 60 days past due as of XX/XX/XXXXACS is telling me that I need to contact XXXX XXXX to resolve this issue. XXXX XXXX is no longer in business. Complaint: While attending XXXX University I was denied federal student grants that i had previously been granted. The next semester I was told I did n't make the deadline for turning the paperwork in even though the paperwork had been continuously sent back for missing information which I had already provided several times. I was forced to apply for a loan with ACS, which totaled XXXX to accommodate the XXXX semesters dues. I was advised by financial aid that i had exhausted my borrowers limit with ACS and I was forced to apply for a private loan and in order to continue my education I took out THIS private loan from XXXX XXXX, the following semester I was denied student loans and was told I did n't fall in the income bracket to receive aid although my fathers income had not changed and my mother did n't work and I have XXXX sisters XXXX of which were claimed by my parents. The total private loan borrowed from XXXX XXXX XXXX was around XXXX dollars. I am XXXX years old today and I have struggled working XXXX and XXXX jobs to pay XXXX school loans with XXXX and ACS since XX/XX/XXXX after my graduation. I have successfully paid in full my XXXX loan in the amount of {$3800.00}. Currently I am struggling to pay my monthly dues of XXXX with XXXX XXXX XXXX. In 2014 I paid {$440.00} in interest fees FOR MY XXXX loan alone. I currently owe more than XXXX dollars to XXXX for the semesters at school which Federal Aid was denied to me for no reason which was valid or my fault. I am struggling and can not afford my bills any longer what can I do. How can I get relief from my financial education debts.

Complaint: Following the complaint I filed last month ( Case Number XXXX ), XXXX XXXX of ACS stated that on XXXX XXXX, 2015 {$12000.00} was deposited into my bank account electronically. First, no funds have been deposited into any bank account I control. Upon discovering this, I have made repeated calls and emails to ACS and XXXX XXXX for over a week. Thus far, none of them were returned. By calling the main line, however, I was able to speak with a base level customer service employee who informed me that the {$12000.00} was sent to an account with XXXX XXXX XXXX. I have no XXXX account on file with ACS, the XXXX account I once had was closed a long time ago and all references were deleted from my end of their system in XX/XX/XXXX and updated to XXXX XXXX XXXX. I do not know why ACS sent the funds to XXXX, nor do I know who currently is holding those funds, but I do not have any accounts with XXXX and can prove that fact. Consequently, no funds have been returned to me, despite XXXX XXXX 's claim that they were. Second, I did not authorize this transaction. In fact, when I became aware of the situation, I left XXXX XXXX a voicemail indicating that I wanted to be fully informed of the financial ramifications and how interest would be calculated prior to any action. No authorization was made. Had XXXX XXXX called me back, I likely would have refused the refund or, at the very least, informed him of the proper place to send the money. Third, I have repeatedly called XXXX XXXX and the Resolution service of ACS and no one has returned my calls. I have also emailed them and have received no responses. The only success I have gained is with base level customer service, but they are unable to help me and were merely able to inform me that the money was sent to XXXX XXXX XXXX. As it currently stands, it appears that ACS has taken {$12000.00} and it appears they have no interest in even discussing the matter with me directly. Surely, if this remains uncorrected it must be a violation of civil and criminal law. I ca n't imagine you can simply seize over twelve thousand dollars without any repercussions. There must be some form of fiduciary duty in play with regard to the payments that I had already made to them. I can not imagine that ACS is allowed to erase past payments without authorization, and then send that money to a random XXXX account.

Complaint: From XXXX I attended XXXX XXXX. In XX/XX/XXXX I decided to take out a loan with ACS Education Services of which the total loan amount ( including fees/interest ) was {$5500.00} ( $ XXXX base loan and {$500.00} in interest ) The first payment I made was on XX/XX/XXXX. Fast forward almost XXXX years, I am still paying off this loan. Total payment since inception has been {$5600.00} of which only {$1500.00} has been put towards the principal and the remainder to interest. The current variable interest rate listed on my account as of today XX/XX/XXXX is 10.280 %. The minimum payment amount is {$55.00} and I 've consistently been paying {$65.00} per month and I have even made payments as much as {$100.00}. I really believe I should be done with this loan considering that I have not paid the minimum amount towards this loan. I would like for ACS Education Services to explain how are they allocating the interest vs principal amounts whenever I made a payment. The way they distribute my payments have not been consistent every month and month after month at least 80 % + of my payments are going to interest. I really need help in trying to figure out what is going on here. I really think they are stealing my money. Also I am no longer receiving statements and on the website they do not have a link where I can view my statements online. I am not sure why the government has not intervened.
