Keep getting calls about my loan
Complaint: I attended XXXX XXXX XXXX XXXX XXXX XXXX and XXXX in XXXX. I was forced to file for chapter XXXX bankruptcy in XXXX because of the lack of willingness by a student loan company to work with me on the payment amount. Just before I XXXX from XXXX, I suffered from a serious medical condition that forced me to be out of work for about six months. In XXXX the economy was starting the downward spiral, I managed to get XXXX jobs XXXX at minimum pay and eventually got a job with the Social Security XXXX in XXXX XXXX. My starting salary was {$37000.00} per year. I had my young son and a household to support. The student loan company did not care and based my payment on what I earned. I could not afford the payment thereby filing for chapter XXXX bankruptcy. I made the court ordered payments to the trustee who then sent payments to the student loan servicing company, XXXX. My bankruptcy was discharged in XXXX XXXX. What I was not aware that XXXX sold my loan to ACS Loan Services, it took ACS 4 months to inform me that they were now servicing my student loan and then informed me that they added capitalized interest of {$14000.00} onto my loan, bringing my loan amount to {$100000.00} at an interest rate of XXXX. My payment is now {$680.00} per month. I never received any kind of notices or information from the either student loan servicer that this was happening. I have tried to dispute the capitalized interest with ACS with no relief. I have been sending in partial payments of what I can afford. I have managed to make a full payment the last three months but ACS keeps charging me late fees, applies none of my payment to the principle and the balance of the loan keeps growing and the interest keeps compounding. Over 6 years I have payed XXXX and ACS about {$25000.00} and my student loan principle has never gone down, it continues to grow. This is extremely distressing, I am XXXX XXXX XXXX and will never be able to pay this off. I am not disputing that I am obligated to pay the loan, I am disputing the {$14000.00} ACS added onto the balance. I have made a good faith effort by making payments towards this loan, but, at this rate I feel this situation is hopeless.

Complaint: For nearly 8 months, ACS Education Services ( a/k/a XXXX XXXX XXXX XXXX ) has refused to complete a simple form that is required to qualify for a benefit of military service. The XXXX XXXX offers a student loan repayment program. For the XXXX XXXX to pay the loan under this program, the lender or servicer must complete a form certifying the principal balance of the loan and providing information to electronically pay the loan ( See Attachment XXXX ). ACS received this form on XXXX XXXX 2015 -- nearly 8 months ago ( See Attachment XXXX ). Despite repeated requests to ACS during these months, ACS has not completed and returned this form. ACS claims that it must recalculate the balance of the loan before making such a certification. Yet despite having this form for nearly 8 months, ACS has refused to even provide a time-frame for the completion of these calculations. Moreover, ACS has refused to allow me to speak with any person in the department that supposedly processes these calculations on the grounds that these personnel are not " telephone trained. '' Meanwhile, ACS continues to charge interest based on portions of the loan that would have been paid off months ago but for ACS 's inability to complete this form in a timely manner. Please do whatever you can to encourage ACS to complete this form and return it to me without delay.

Complaint: I have paid on a consumer credit student loan since XXXX. My school did not accept federal or private loan disbursement of funds. This was living expense. After XXXX for over 10 years I am on XXXX XXXX. Consumer loans earmarked as student loans disbursed directly to me are not dischargable in ch. XXXX bankruptcy. ACS services my loan and ca n't make discussion in regard to discharge, and they will not provide me with the of the bank who owns the loan, who makes those decisions. THE PROMISSORY NOTE HAS BEEN LOST BY THE SERVICER AND THE OWNER OF THE LOAN. THEY HAVE PAGE XXXX AND XXXX. THE TERMS ARE LOST. THEY TELL ME THEY ARE UNDER NO OBLIGATION TO TELL ME ANYTHING. IF I STOP PAYING, I CAN HAVE CONTACT WITH THE OWNER OF THE LOAN. Federal loans are discharged in my situation. In bankruptcy this is no longer a consumer loan. The rules that apply to federal loans would benefit me, but now I found out the XX/XX/XXXX bankruptcy reform only punishes those with a consumer credit loan and does not afford those of us with the private loan the benefits afforded for a federal student loan holder. OF ALL OF THE RULES PERTAINING TO CREDIT, THIS IS THE MOST UNJUST AND INCONSISTENT. THERE IS NO PROTECTION OF THE INDIVIDUAL FROM BANKS WHO CREATE LAWS FOR THEIR BENEFIT. UPON MY DEATH I AM NOT EVEN ALLOWED TO KNOW WHAT WILL BECOME OF THIS LOAN. XXXX XXXX currently claims they hold the loan, but my SERVICER will not confirm or deny. Banks can change legal documents even after agreeing upon the terms and they do n't even have to keep a copy of the promissory note.

Complaint: Confirmed IBR application and amount to be deducted for XXXX loans prior to XXXX 2016 payment due dates. Despite IBR approval, ACS deducted the full regular amount for XXXX loan -- being almost {$400.00} more than authorized. ( Deducted {$540.00} despite IBR payment owed {$160.00} ) I called and was told it would take XXXX days to issue a refund. I complained and they said they would expedite the refund. The payment was automatically withdrawn from my bank account on XXXX XXXX. I was told they would expedite the refund on XXXX XXXX and mail -- not refund directly to bank as I requested -- a check, but it 's now XXXX XXXX and I still have not received my refund. They adjusted the payment records on my account, but the money has n't been refunded. They 're charging me interest on that loan but keeping my money. Also, they incorrectly reflected my IBR payment for that loan. Now my account has the incorrect amount listed as the IBR amount owed. It shows both accounts being the same payment, when the corrected amount authorized by IBR was a few dollars higher. I do n't want to get a bill at the end of the year for the overage due to their mistake, again. {$400.00} could mean rent, car payment, food, etc. They are keeping my money -- interest free -- for over a month despite admitting they took too much.

Complaint: I am a teacher and a graduate student taking online classes via XXXX XXXX XXXX XXXX. I started taking classes in XXXX 2015. ACS Student Loan Services took over about {$24000.00} of my student loans and XXXX took the other student loans. I have approximately XXXX student loans. In 2015, I applied for an in-school deferment. I was initially denied by ACS, but I persisted in contacting them, because I knew that I was at least part time, if not full-time and therefore eligible for an in-school deferment. ACS denied the deferment, and claimed that XXXX XXXX XXXX XXXX did not meet their requirements. Over the summer I was sent an email by XXXX indicating that they now met US Dept. of Education requirements for in-school deferment. I summarily filled out another in-school deferment. They yet again denied my request. They are now threatening me with default, and wage garnishment.

Complaint: I recently learned that my loan provider offers interest rate discounts with enrollment in Auto-Pay. After enrolling, I learned that the interest rate discount is lower than initially informed. I communicated with my servicer and was informed that the different " disbursements '' in my account offer different interest rate reductions. In addition to making almost two years worth of regular payments and not knowing that I could reduce my interest rate with auto-payments, I was never informed that there were multiple " disbursements '' on my account. I have now payed over {$3200.00} in additional payments over the last 8 months that would have payed off at least one disbursement that did not offer a lower interest rate, thereby reducing my weighted interest rate faster. This is all because the information that benefits me as a consumer is not available on my servicer 's website.

Complaint: There is very little information of the interest rate benefits of scheduling auto payments on my servicer 's website ( ACS-education.com ). Specifically, there is no information on it in the pages having to do with auto-payments ( ACS XXXX XXXX ). I have been making regular payments now for almost two years. I reviewed the ACS XXXX XXXX webpage several times throughout the time that I 've been paying back this loan because other servicers I use have made this information clear. Today, I finally found the following sentence in the Info Center section of the website : " Please note that many lenders offer interest rate reductions for accounts that are enrolled in an automatic deduction program. Just send an e-mail to us and we will notify you of your eligibility. '' I believe this information was intentionally hidden for the sake of profit. I believe this information would have saved me a decent amount of money if it were more easily accessible. I emailed them today, and am looking forward to a response.

Complaint: My loan was paid off by a servicing company, ACS. I applied for a military deferment as to not accrue interest. I submitted all of my paperwork with my XXXX as well as proof of XXXX XXXX XXXX. The deferment was denied and they will not uphold their own policy. When I tried to speak with them about it, they told me to call the Department of Education. The DoE stated they have no bearing on deferments. When I called back and asked to speak to a manager, the representative gave me a last name and stated I do n't know any supervisor 's first name. I told her that 's impossible for her to not know her supervisor 's first name. I asked for her name and she refused to give me her full name as well. She told me the application was denied because my order did n't say war on my XXXX. I told her that no one 's XXXX say war as we are not in any major wars right now and the operation that we fight in can not be printed on any electronic documentation. But my XXXX stated that I was in support of an operation. They have the Department of the XXXX XXXX as the heading and it says I went to XXXX. She then went on to tell me that it does n't state what you did in XXXX. I told her ma'am, that information is classified and no orders state this either. They will not uphold their own policy and guidelines. She then went on to say well, we can put you in forebarence so you will still accrue interest. She still could not explain to me how I do not qualify for a deferment and their policy states any XXXX XXXX member in support of a XXXX.

Complaint: In XXXX, XXXX, my bank account had fraudulent charges and I needed to place a block on my account to prevent a company from withdrawing information from my checking account directly. My bank accidentally blocked my automated payments from my student loan company. As a result, it took over XXXX months to figure out the error and get everything sorted. During this time, I was calling my student loan company repeatedly, trying to process payments monthly through the online system, and receiving payment confirmations via email for each payment I submitted. When I called ACS to try and resolve why I was receiving payment confirmations, and the amount was not being withdrawn from my checking, I was receiving little information from their customer service team. I WAS NEVER informed that the payments were being rejected by my bank! I had to figure that out on my own, after several attempts to make monthly payments online. Once I figured out the issue, and a regular monthly payment went through and credited correctly, I paid the retro-active amount due for the past 4 months at one time, resulting in bringing my account current in XXXX, XXXX. I have requested repeatedly for ACS to clear the late payments from credit reports as a result of this error and I am met with indignance, snide comments and accusations that the lack of monthly payments was my fault along with the claims that they " attempted '' to contact me via mail and phone regarding the issue. No attempt to contact me has been proven on their part by phone, mail or email. The only contact I have is by email, in the form of a processed payment receipt each month from ACS. In fact, I called them each month trying to resolve and figure out what the issue is with my account. This company has hurt my credit report as a result, and refuses to correct their issue or address my concerns as a consumer regarding the lack of proper communication to me concerning my account.

Complaint: I have XXXX loans serviced by ACS Education Services -- a Perkins loan and an institutional loan. I am enrolled in the automatic ACH auto-debit program, a program which, as I understand it, is designed to assist in and ensure the timely collection of monthly payments. ACS has informed me that because I am enrolled in the ACH program, it is unable to generate monthly billing statements for my account -- either to be mailed directly to my billing address or posted on my secure online account -- prior to automatically deducting funds from my account. Such a policy prevents me from maintaining accurate and complete records and otherwise makes it difficult for me to manage my account and get timely information about my loan repayment. If ACS intends to automatically collect money from me each and every month, then at minimum, it should be required to provide me with a monthly billing statement without requiring me to un-enroll from the ACH program ( a program which is mutually beneficial to both the borrower and the loan servicer ). I further note that my other federal loans servicers besides ACS, namely XXXX and XXXX XXXX, are able to provide me with a monthly billing statement ( on their secure online portals ) without requiring me to un-enroll from their automatic debit programs. I am perplexed why ACS is thus unable to do so when other loan servicers do so.
