Complaint: Zwicker has repeatedly tried to contact me at my in-laws even though I havent lived there since XXXX, the business involved in this debt was never registered there, and XXXX had my current address and contact info on file before sending me into collections with Zwicker and Associates. More recently, they said they had tried to called me repeatedly but they never left a voicemail even though, once after they called and left a message with father-in-law, I did call them back, gave them my proper number, and gave them permission to leave messages, and also made sure they have my current address. I had to ask 3 times ( twice on the phone and once in writing ) that they stop contacting my in-laws. My mother in-law also spoke to them at least twice and told them I didnt live there. Y father-in-law spoke to them too. When Zwicker decided to sue me, they tried to deliver the court summons to my in-laws instead of me. When Zwickers representative later came to my house with it, he just threw it at the end of the driveway where I didnt even see it when I got home. Instead, my husband found it we had no idea how long it had been there. Over the phone, I agreed to pay {$250.00} a month and they started taking monthly payments out of the account. Said they would take two to begin with and then more after I returned the court paperwork. I returned the court paperwork on time and then they stopped taking the payments wed agreed upon. There was no information in the agreement saying what constituted default or that the balance being due immediately meant that they would try to take it from my checking account. To my knowledge, the did not try to contact me before filing paperwork to levy my bank account. The money in my checking account was from a federal student loan and so is not eligible for garnishment. I called them to discuss the issue and was then told that I the money had been taken because I hadnt paid since XXXX, which I had not been aware of. I thought payments were being taken as agreed since I hadnt heard anything from them. The lawyer kept telling me to hang up and call the collections department and the collections department kept telling me to hang up and call the lawyer and I got nowhere with them. Eventually, even though they had just frozen {$2000.00} of my checking account money, I was told I still needed to give them a payment ASAP. When I asked if they were going to continue to take money out of my account on a daily basis if I didnt give them a payment, they couldnt say. When I asked how the {$2000.00} didnt count as a payment, they said, Because we had to take it. You didnt give it to us willingly. I told them not to contact me again until after XX/XX/XXXX since I had no idea where I was going to find money for them. They started calling me again less than a week later on XX/XX/XXXX. Over the next week, I had to borrow money from my mother to cover my mortgage. I also borrowed money from sister to pay them {$250.00} for XXXX. After my husband and I got paid again, I sent them {$500.00} to make up for the missed months of XXXX and XXXX. As mentioned above, they called me again on XX/XX/XXXX. They didnt leave a message. They called again on XX/XX/XXXX. I answered and they asked me to pay the balance in full. I told the woman that I had a court judgement and that Id already sent them {$750.00} and that the {$2000.00} was still being held and that I had no more money for them. She said she had no record of any of that. I had to explain the entire court settlement/bank levy situation to her and then she had to go look for the checks I had sent. Thankfully she did eventually find them. She asked me if I was willing to set up a new payment plan. I told her I wanted to stick to the court judgement. She confirmed that my account is now up to date in accordance to that agreement, and that as long as I continued to pay on time, no more action would be taken. She also said that if I missed a payment by more than 30 days, it would be considered in default again. I asked her to confirm this 30-day policy and she twice confirmed that they dont take action until an account is 30 days past due. Of important note here, when Zwicker and Associates filed the paperwork to levy my bank account, it was only 28 days passed the payment due date.

We made a payment and said we would call back when we would know how much we could pay monthly. We are a XXXX XXXX XXXX by the XXXX. Zwicker and Associates notified my XXXX XXXX of the balance due on the credit card and consequently we are facing termination of our XXXX. Which we solely depend on to do business. Zwicker overzealous collector XXXX and XXXX were very disrespectful to me. Calling the government ( XXXX XXXX XXXX XXXX ) to report our debt and purchases on the credit card was very unfair and lawful.

Complaint: Zwicker And Assoc. out of XXXX, Ma are attempting to collect on an account that I defaulted on with XXXX XXXX. They have sent me numerous legal documents and filed judgements against me but as many times as I have called their office and tried to speak to an attorney, they are never available. I am only able to speak with collection agents and Managers. These agents and Managers are extremely pushy and insist on getting me to pay amounts I simply can not afford. I have a number of debts that I am trying to resolve and they keep threatening Garnishment and will only make 3 month payment arrangements so they can try to push me to higher and higher amounts. Even then, theyare clear to let me know that they will not remove the threat of garnishment unless I pay in full. They refuse to make an affordable payment agreement with me. I am going to send them what I can but am in great fear that they will garnish my wages even though I am paying them regularly.

Complaint: I was behind on all of my bills and needed to fix my credit card issue. I had recently moved into a new home and things needed to be done, one of those things was a fence for my yard because my dog ran out and got hit by a car and XXXX. So I contacted XXXX XXXX XXXX for help, I thought finally I can rest because I thought they were going to handle everything,They first told me to STOP making my payments and change my address and phone number to theirs, So that is what I did and this eventually wound up to XXXX sending all of the info to XXXX XXXX XXXX and I didnt know anything about it and I thought it was being handles until I was served with lawsuit papers. I even called XXXX and asked that they place this account ahead of my other accounts and they told me they would need $XXXX more, So thats what I gave them in addition to my regular payment so they can get this resolved. Needless to say they never resolved it and it got turned over to a law firm named Zwicker and associates. I made payment plans with them That were automatically taken out of $XXXX bi-weekly. I was never told that I had to contact them again to set up more payments. I thought this was already taken care of as I set this up with Zwicker for an auto deduction, I looked online at the XXXX XXXX court records yesterday XX/XX/18 and found that they were placing a lien on my bank account and never notified me by phone or mail that I had to set up payments again or that they were placing a lien on my account.I called and tried to get back on a payment plan and they advised me that I could not do this until I had $XXXX for them to even consider taking the lien off.

I did not receive a copy of the original settlement letter from Zwicker and Associates stating the amount and terms of the agreement. I need that from XXXX or Zwicker and Associates. They stated an amount but they did not send documents or proof of agreement. I was told the original settlement amount was 65 % of the XXXX total. That is roughly 2600.00. When I requested this in writing along with an itemized receipt I was told I would not get a letter until completion of payments ( which I was told was XXXX, not XXXX. ) Zwicker made the agreement so they should have it in writing somewhere. Something showing the total amount and not just verbal. They have already received XXXX and XXXX and XXXX are now requesting the full amount of XXXX again. Is this legal??

Complaint: I am getting repeated calls on my cell phone from this company, often times multiple times per day. The calls began onXX/XX/XXXX and have not ceased. They leave no voicemail or ever ask me to call back. They have now begun harassing a landline number that where I used to reside but no longer do. They have engaged in notifying the people at this landline the reason for their call and the amount of debt they are attempting to recover. They began calling the landline as of XX/XX/XXXX and even when being told that the person they are looking for does not reside at this location, they continue to call on a daily basis. Complaint: I informed XXXX XXXX XXXX that I lost my job after being hospitalized in XX/XX/XXXX. I had no means to satisfy the debt. They continued to call me 3 to 4 times a day. The credit card in question was never applied for. We had never signed a contract. I called Zwicker & Associates PC after I was served with papers at my home informing me that they were representing XXXX XXXX in a lawsuit against me for the credit card balance owed. I offered to pay {$100.00} a month to satisfy the debt, they refused and said they would pursue suing me. I was told by XXXX XXXX that I would need to find someone else to pay the debt for me. That they would not accept a payment agreement unless I paid half the sum owed and an exorbitant monthly fee. I asked to speak to someone else. He said no one else would be able to help me, not the attorney 's at his office, or anyone else higher in his department. He said that there was no agreement to be made and the attorneys would be suing me unless I paid the balance in full or put {$3000.00} down and paid almost {$400.00} a month.
