I've shown XXXX my social security card with my current name issued before the XXXX account was opened, and my State Drivers License with my legal name on it. I had no knowledge of the account until I received a notice to appear in court from their law firm. I go to court XXXX XXXX, XXXX. I believe this is a theft case that someone stole my identity using my old name but same social security number ; it's not only XXXX, it's a few other accounts that were also opened in XXXX.

Complaint: I AM NOT A LAWYER. I AM A XXXX XXXX. I believe I was misled about the hard copy information ( consent to judgment/ rule 11 ) they send to myself concerning the debt. Please see attached. This is a follow up to complaint numbers XXXX and XXXX. At the time I filed my original complaint, I was unable to attach the following call logs to prove I had communications with Zwicker and Associates on XX/XX/2018. I spoke with XXXX on the previous days as well. Somewhere on or the day before is where I heard him make his questionable statement. I believe it was on XX/XX/2018. It could have been the day before. I am unsure If the women on the phone told me that I need/ must sign it ( rule 11 and consent to judgment ) before she told if not I would/will be taken to court. Please investigate. What she said seems/feels threatening to me. What XXXX XXXX said about the consent to judgment form seems/feels very much misleading. Please double check our last communications. Both representatives of Zwicker and Associates have raised ethical questions and concerns to me creating a very real feeling of oppression with mental pressure and distress. I am attaching my XXXX as proof that I am a veteran. Please keep from sharing from Zwicker and Discover if possible. I also want to state that I will hold up my end of the settlement agreement faxed on XX/XX/2018 unless otherwise offered an alternative. I will not agree nor will I sign the consent to judgment or rule 11 that was dated the next day on XX/XX/2018.

Zwicker and associates ... 2 separate incidents on 2 separate calls on XX/XX/2018 in regards to myself asking about what is a " consent to release form. He stated that the consent to judgment was " basically the same letter " that was emailed to me earlier ( settlement agreement ) and that it would be my way to agreeing with the settlement for lower amount ... also, called XXXX XXXX lawyer and spoke to a woman. I asked her to connect me with the attorney to please explain the papers sent. She said that the papers were sent earlier that day ... ... in the same conversation she stated to me about the rule 11 and consent to judgment " if you do t sign it we will take you to court '' these statements are concerning to me. Complaint: I just received a notice from Zwicker & Associates, P.C, a debt collector of XXXX XXXX. This communication is to dispute owed of {$5700.00} from XXXX XXXX. My card was used without my permission by my ex husband and charges were incurred by him and other persons. I have always paid my debt timely and XXXX XXXX refused to take disputed charges off. As a result, my credit has been impacted and the debt was charged off and they refused to even file a claim. XXXX behavior violates consumer protection laws and the law firm is engaging in predatory debt collection practices. This is ridiculous, I want this deft off my credit ASAP. SO THIS IS MY FORMAL DISPUTE WITHIN 30 days.

Complaint: Initially I sent a letter to XXXX XXXX to settle my XXXX Account, due to not being able to pay it. This was on XX/XX/XXXX, and then I faxed it to their collection department as well. On XX/XX/XXXX I received a letter dated XX/XX/XXXX from Zwicker & Associates. So I sent a settlement letter to them. I tried to fax it and it did not go thru, as I learned today, I had wrong number. But when I spoke to Zwicker on XX/XX/XXXX, they gave me their supervisor 's email address XXXX to send an email authorizing them to speak with me. I did and then followed up with the settlement proposal I sent to them on XX/XX/XXXX. They advised me that XXXX XXXX has to approve this settlement and do not have to take my offer to them as it is under their quideline. In my initial conversation with them on XX/XX/XXXX I advised I increased my offer as I held back money for them due to the fact I did not know the balance. I explained to them I took out of my retirement and this is all I have due to the amount of debt, I tried to give everyone the same percentage. They threatened to sue me on that date and I questioned her on that and she said she is simply telling me that can sue me. I advised I am requesting they take my offer at that time was {$1500.00}. She refused and then I contacted XXXX XXXX again, and they advised that they could file a complaint if I wanted too, and I said no I just wanted to get this resolved. XX/XX/XXXX I spoke to Zwicker again, and got no where with them, and they have been at XXXX and can not come lower and will not take my offer to settle with what I have available to XXXX. XX/XX/XXXX, spoke to Zwicker again, and they repeatedly stated XXXX is bottom line, and I simply can't settle for this and asked them to please extend my offer to XXXX, again they state they do but this is what it is. XX/XX/XXXX, I called XXXX and they told me to send a letter to them explaining everything, which I did to their fax and outlined everything in it. She said to call back Zwicker again next day. I didn't as my conversation was not good with them on the XXXX, and I got aggravated and stressed out and I was not pleasant. So I decided I needed to let it set for a week. XX/XX/XXXX, I called and spoke to XXXX, and she checked with manager and said the best they could do was {$3300.00} ( I didn't catch last two numbers ) I said well that increased from the last time and she got off phone and came back and said XXXX and I said I can't I have the {$1700.00} that I have that I took from my retirement along with other money to pay off my debt. She said try to find money from other sources and the last time someone there told me to see if I can get it from family members ( this is not my family members debt and my father is XXXX years old and on social security ) I should not have got myself in this situation but I did and I thought I was doing the right thing instead of claiming bankruptcy by taking a loan out of my retirement to pay this off and reached settlements. I have been successful with this all but 3 accounts and this being one of them. Its frustrating, one the first person said they could sue me, and then for them to tell me to go get money from " other sources or family members '' is wrong, and finally if they are given an offer they should be required to take this offer to their client to see if they will accept. I specifically asked in my last conversation and in one other which she talked around the subject and this last one said they don't have to take anything under their bottom line. Not sure if this is true and I have done my research on Zwicker & Associates under the XXXX and I am not sure I can trust them anyways after reading this, but I want to resolve this and feel I have done what I can and when they refused to take my offer and the fact they threatened to sue me if I don't agree to their terms initially, that I'm at my wits end.

Complaint: Zwicker and Associates contacted multiple members of my family even after both them and the original creditor had both been told to not contact me. They contacted at least 3 members of my family multiple times. When they filed lawsuit they did it during the period of the XXXX required for debt validation. Even though they received a debt validation request on XX/XX/XXXXth they file suit onXX/XX/XXXXrd. They did not provide a true debt validation. They sent fraudulent manufactured statements in late XX/XX/XXXX. Even though the files were incorrect they proceeded to serve sewer service on my house. The thug they hired beat continuously on my door. I have no trespassing signs. The man peered into the windowed opening of my door over 5 feet from the floor. A trespass if privacy in XXXX. Then he tried to open my door. When I told him to leave from a side window he began kicking the glass of my storm door, and hit my porch lamp, breaking it. Further the very rotund man leaned on my porch beam and caused nails to start to to pull from its support. He shifted my porch fence by 3 inches from his intentional malicious injury to property. He then placed the papers in my mailbox. A federal crime. The lawyer an XXXX XXXX XXXX of XXXX XXXX wont tell me the name of the thug he sent to damage my house.

Complaint: The loan company XXXX XXXX, a possible Virginia based small business loan company that deals online only set up a line of credit for my business. The business never received documentation and or loan information pertaining to repayment terms and interest rates and finance charges over the time of repayment. There was no contract executed and given a copy of to me the officer of the company, and now the company is trying to sue me personally stating I signed as a guarantor. There was no indication I ever was gon na be personally responsible and there was no documentation ever asked for basis of repayment for myself personally other than banking statements for the business. There is no account ever opened up on my personal credit report and I have been served by this company with a lawsuit in a state where I dont do any business and apparently this is the state where the company has operated from, in Virginia. I am a Florida resident and my business was a Florida based business, that has been corporately dissolved.
