Attempts to collect debt not owed

Debt collection: Auto debt

Debt is not yours
Complaint: On XX/XX/XXXX I received a letter from Weltman, Weinberg & Reis Co., LPA that they were attempting to collect a debt that I owed to XXXX XXXX XXXX for damages in the amount of {$5000.00}. I sent them a letter back denying that I owed this debt as I have never been summoned to court or had a claim filed against me. XXXX XXXX XXXX XXXX has given them information that this is their Claim NumberXXXX. I received a letter from XXXX about a claim about 2 years ago and it seems that a vehicle I sold was involved in an accident in Florida. I signed the title over to the purchaser but I forgot to remove the license plate, however the registration was expired at the time of the sale of the vehicle therefore the driver was operating the vehicle on expired license plates at the time of the accident. I explained all of this to the lady I talked to and thought that was the end of it until I got this letter. I do not owe XXXX XXXX XXXX any money so I don't know why they would turn me over to a collection agency. I also don't understand why these attorneys would attempt to collect a debt without proof that it is valid.

Struggling to repay your loan

Student loan: Private student loan

Can't get other flexible options for repaying your loan
Complaint: On Saturday, XX/XX/XXXX, I received a summons to appear in court along with my XXXX year old son. ( See attachment ) I am XXXX years old and retired and my wife is XXXX years old and also retired. My sole source of income is my XXXX pension and a reduced pension from Social Security, reduced because of the Windfall Elimination Provision ( WEP ) This summons that I received involves a student loan that my son took out when he was a student @ XXXX XXXX University and I co-signed the loan application. That was back in XXXX and the lender at that time was XXXX XXXX XXXX My son had been paying on this loan in the amount of {$150.00} per month until XXXX XXXX XXXX XXXX informed him that his payments would double to over {$300.00} per month and they refused to work with him to lower the monthly payments. Since that time, my son was injured at his workplace on XXXX XXXX, XXXX and has been unable to work. He has already had one XXXX XXXX and needs a second XXXX. His sole source of income is XXXX XXXX through his employers insurance company and is 50 % of what his full time pay had been. Meanwhile, XXXX XXXX XXXX. either sold his loan to XXXX, XXXX XXXX XXXX or retained them to sue both me and my son for the outstanding balance, which they claim is {$11000.00}. I do n't feel that either me or my son are being treated fairly by either the lending institution or XXXX, XXXX XXXX XXXX in taking us to court considering the overall circumstances. From what I have been able to learn about XXXX, XXXX XXXX XXXX, they appear to be a predatory collection agency who routinely take people to court to attempt to collect debts that they are not entitled to collect.

Attempts to collect debt not owed

Debt collection: I do not know

Debt is not yours
Complaint: Around XX/XX/2012 different companies under different names started calling my about a debt. Im not sure if it is a loan or credit card. My name is pretty common so I figured it was all a misunderstanding or identity theft. I tried to explain the company the person that owed them the money was not me. They kept calling repeatedly several times a day, they even harassed my partner and family to collect the debt. I even lost a job because of the derogatory mark on my credit report.

Debt collection: Private student loan debt

Attempted to collect wrong amount
Complaint: This statement will a sort of addendum to my original complaint number XXXX.I filed this addendum with my feedback but realized that the addendum would not be acknowledge.First I want to ad something that I failed to ask about in my original complaint and that has to do with all of the money I paid on these accounts before they went into default.By the time the accounts had gone into default I had already paid approximately {$6000.00} but that money has never been accounted for.During the many conversations I had with collection agents form the various collection agencies between XX/XX/XXXX and early XX/XX/XXXX I would inquire about that money and I was always told that I would be receiving and update and accounting for that money but it never happened. Now to move forward.Basically I am still confused about what id going on with my accounts and I am becoming increasingly fearful that I will be vulnerable to whatever power the assigned collection agency has in collecting their money.I have never tried to escape my responsibility but I am being placed in a position that I should not have been placed in.When I set up my payment agreement with the first collection agency in XX/XX/XXXX I had every intention of faithfully sticking with that agreement but the collection agencies have continued to complicate this matter by changing agencies and losing my account. From XX/XX/XXXX to XX/XX/XXXX I never missed a payment. Then in XX/XX/XXXX my XX/XX/XXXX payment was returned to me which set off a whole set of negative events which I explained in my original complaint. Then during the first week of XX/XX/XXXX I received a phone call from a person who identified himself as a XXXX XXXX representing a collection agency called " XXXX '' .His telephone number is XXXX-Ext,XXXX.XXXX and I had a 30 minute conversation explaining what had happened during the history of my accounts and why whatever happened, happened. He explained that he was still in the middle of his research and would probably be finished sometime during the third week of XX/XX/XXXX.I asked him if I should go ahead and send in my XX/XX/XXXX payment which I normally sent in between the XX/XX/XXXX and the XX/XX/XXXX of each month and he suggested that I should. He told me that he would be calling me as soon as he concluded his investigation.XXXX concluded our conversation with an invitation to call him if I had any other questions.Astonshingly, the very next day my XX/XX/XXXX check had been returned to me.I of course called XXXX and left a voice message.I called XXXX a couple more times but he never returned my calls.Around or about XX/XX/XXXX to XX/XX/XXXX I received two letters from a company called Weltman, Weinberg & Reis Co. , LPA.Interestingly this is one of the collection agencies I was referred to back in XX/XX/XXXX when I was trying to find out what was going on with my accounts when my first check was returned.I was told by a representative that she could not talk to be because I " live in Arizona '' .I called this company and I was told by an operator that they indeed have my accounts and that my account manager was being managed by a person named " XXXX '' .She said that she would notify XXXX to call me the same day but he did not.I called and left messages for XXXX on four subsequent calls but he has never called me back, Their records should show that I did call. So at this point I am completely lost and I do not know where to turn.I just do n't want them to after me because of their inefficiency and mistakes in handling my accounts. Please help. XXXX XXXX

Complaint: Before I asked for debt validation, they used to call me very frequently and the language that was used was as if they were attorney 's collecting on a debt by representing the original company. After I asked for debt validation and they sent me the paperwork, the letter had, " XXXX, XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX ''. They sent this information in XXXX XXXX XXXX after I requested this information a few months ago. My main issue is that they present themselves as attorneys over the phone and in writing and this information is n't correct. Lastly, I do not claim this debt.
