She is XXXX years old an d I feel they are taking advantage. I have been overpaying the mortgage for 3 months and they accept the payments

Trouble during payment process

Mortgage: Conventional home mortgage

Complaint: I purchased my home in XXXX for {$110000.00}. We had a second mortgage of {$10000.00}. I filed Chapter XXXX Bankruptcy in XXXX . My payments were made on time during the bankruptcy. I was paying two payments to the company. One payment for the arrears and one payment for the current payment. My bankruptcy was successfully discharged in XXXX . After my bankruptcy, my mortgage company proceeds to tell me that my balance on my first mortgage is {$99000.00} and the balance for my second mortgage is {$10000.00}. I have written letters, called the mortgage company and was told someone would call me back. I have reached out to my attorney who asked me to contact the mortgage company. I 've tried contacting the Trustee who sent the payments with no response.
I was willing to work with everyone but now that I have paid over {$70000.00} throughout the plan to the mortgage company, my attorney AND the trustee -- everyone seems to not know anything and are n't trying to rectify the situation. The balance should not be the same as it was 12 years ago, when I have been making continuous payments.

Checking or savings account: Checking account

Can't close your account
Complaint: Someone who always responded to the cfpb through the United States Department of Treasury had never mentioned XXXX on the response letter which always showed some signs of forged power of attorney. Someone always claimed to be a senior corresponden t specialist. What a specialist? As a reminder, the answer to the complaint portal questionaire " Should we send status updates to anyone else about this complaint? '' is no. But I noticed that a diversion trick is in place which already disparaged the server to " Yes ''. I suspect foul play at the US senate intelligence committee or USDOJ or another intelligence agency which is rigging unidentified interest by evasion. And again., " I do not think so ''.

Closing on a mortgage

Mortgage: Conventional home mortgage

Complaint: Wells Fargo is a t it again! They have been lying to me ever since I refinanced with them 4 years ago. The most recent issue, they gave me specific instructions on how to pay off a loan. When I called today, they said that was not how mortgages are paid off and that I needed to send additional funds to a different address with a loan payoff letter. The loan has been paid and there is both money in the escrow account and extra funds that have been sent to the lender to cover all fees.

Written notification about debt

Debt collection: Mortgage debt

Didn't receive enough information to verify debt
Complaint: This Attorney a nd Wells Fargo have violated my FDCPA rights by their continued attempts to collect an alleged debt before providing validation of debt. My original request dated XX/XX/XXXX has gone unanswered. I am exercising my rights under the " Fair Debt Collections Practices Act '' as codified at 15 USC 1692, which stipulates that a debt collector must, if requested, provide validation of the alleged debt, i.e. validate the debt, per " The Fair Debt Collections Practices Act '', " FDCPA ''. The debt collector ( Foreclosure Attorney, Bank, Alleged Lender ) is mandated under " FDCPA '' to cease and desist ALL collection activity until validation of the original note is provided.
This law firm and Wells Fargo Bank are in violation of Fair Debt collection practices by continued attempts to collect this debt. All collection activity should have ceased and desisted until validation of the debt is provided. This is my 2nd request and as of XX/XX/XXXX I have yet to receive the requested VALIDATION documentation.

I have requested the following : 1. Copy of the original alleged note accompanied by an AFFIDAVIT from the alleged Lender 2. Identify to what the alleged debt pertains. 3. Provide details how the alleged debt was calculated. 4 . Provide Regulation Z, and Notice of Right to Cancel ( Truth in Lending Act ) 5. Provide copies of any papers that show that I agreed to pay the alleged debt. 6. Identify the original creditor and all Assignments from the Securitization based on the Pooling and Servicing Agreement to the original creditor. This means a valid legal chain of title from the depositor to the trust. Nobody but the Depositor ( Settler ) can transfer property to the trust. 7. Provide the agreement between the creditor and your firm which authorizes you to collect funds ( without a contract, your firm has no right to foreclose ). 8. Provide evidence that you are licensed to collect in my state. 9. Provide your license numbers and the Alleged Lender 's Registered Agent.

Closing on a mortgage

Mortgage: Other type of mortgage

Complaint: On XX/XX/XXXX XXXX XXXX asset management company, XXXX XXXX XXXX, marketed a foreclosed asset for sale. The property address is XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, FL XXXX also known as XXXX XXXX in public record. XXXX XXXX County Florida property control number XXXX. The listing identification is XXXX. The property was being offered in the first 15 days for owner occupants to make offers. All offers were to be submitted with an personally signed affidavit signed by the buyer and buyers representative that the purchaser intends to occupy the property as their primary residence and this is not a second home or an investor property. There is also a place on the Offer Cover Sheet asking if the property is for owner occupant or investor. Attached is the complete set of documents that were required to submit an offer. There were two offers on the property. The winning bidder however is an investor who did not intend on occupying the property but did sign the Owner Occupancy Affidavit. The property closed on XX/XX/XXXX. I was the other bidder and the XXXX XXXX XXXX representing myself in the transaction. Late afternoon on XXXX XXXX XXXX the same property was listed for rental by the Buyer 's agent. The listing identification is XXXX. I contacted the agent who listing the property for sale asked her if the other bidder did sign the Owner Occupancy Affidavit and also to report the property had been listed on the multiple listing service for rent the previous evening. She was just as shocked as I was because she stated she was very clear with the Buyer 's agent that this property is only available to owner occupants and that second home purchasers or investors are not eligible to bid. I then contacted the Buyer 's agent asked if she was the one who sold the property to the owner who now has it listed publicly for rent since the MLS had not been updated yet. She confirmed she was the agent. I asked if he had also signed the Owner Occupancy Affidavit. She then got nervous and stated that he is planning a XXXX Exchange for the property. I reminded her that this property was offered to owner occupants and that investors were disqualified from the bidding process at that point in the process. He signed an Affidavit under penalty of law that it was for owner occupancy and not a second home or investment. The conversation ended until I later received an email from the other agent in which she was forwarding a statement from the buyer that he " always '' intended to move in. ( email also attached ). ( also for a property to be listed on the MLS the listing broker must also have a signed agreement from the owner to list the property ) Further, in conversations I had with a member of the condo association Board of Directors and Property Manager I was informed that this buyer made it very clear to them that he intended the property to be a rental property. In his signed application to the association he checked " For rental to others '' in the Intended Use section. The application gets submitted to the condo associations usually within a few weeks of a bilateral contract - so it was submitted early in the closing process. I called Wells Fargo Fraud department immediately the following Monday morning. I told the Fraud Call Center Representative what happened. All he could do was take a message and forward to the appropriate asset manager. I never received a return call. Wednesday morning I called the Title Agent who closed the file. She did call the property manager and called me back the following day. She told me that she made the asset manager aware of the situation but is uncertain if they will do anything since the title was already sent for recording and because of the effort to investigate the deal and what is required to unwind the transaction. This is blatant fraud. The processes or lack of appropriate processes and oversight of transactions at Wells Fargo allowed this to happen and will continue allowing such fraud to continue unless it is addressed. In the case where there is an association and simply requesting the association submit the signed application to the bank could effortlessly have close this gap. To this date, the condo still sits vacant.
