Complaint: My mortgage was sold to Seterus around XXXX of XX/XX/2014. I had previously sent a payment of {$57.00} to cover an escrow shortage to my prior mortgage company. When my loan transferred, the amount of {$57.00} was credited to my escrow account as of XXXX XXXX, XX/XX/2014, however my payment was a higher amount. I contacted them on XXXX XXXXXX/XX/2014 and was told that they would not be able to credit that amount since it was received by XXXX. They proceeded to tell me my mortgage payment would be increased to {$1100.00} per month and would not be the {$1100.00}. The amount of {$57.00} was listed on my XXXX XXXX statement for the month of XXXX from Seterus as a single payment to my escrow account. Yet, I had to make the higher payment amount of {$110000.00}.

Complaint: I have a plumbing leak in my hall bathroom. I contacted my homeowner 's insurance company XXXX XXXX XXXX XXXX and filed a claim. Today I have found out that the check they issued is to me and Seterus, the mortgage service. In order to cash this check to complete the repairs to my bathroom I need Seterus to endorse the check. Upon contacting Seterus, they said we need to file a claim with them for the plumbing and water damage as we did with our insurance company. They will send out paperwork to be filed out by us and to allow 5-7 business days for us to receive the paper work. Then we need to send them back the paperwork along with the check so they can endorse it. Once they have received our claim and the check, we need to allow them 3 more business days to review our claim and endorse the check. Then they will mail it back to us and we need to allow additional 5-7 business days to receive it. This process which was started on XXXX XXXX with our initial call to the insurance company and has already taken 3 weeks and been extended by an additional 4 weeks because of Seterus, the mortgage servicer. I have no guarantee that I will even receive everything back by the week of XXXX XXXX. In the meantime we do not have full use of our hall bathroom for now a minimum of 7 weeks plus whatever the amount of time for contractors and plumbers to be able to repair the pipe, walls and tile. This is an unjust way to do business and I feel the practices of Seterus need to be investigated.

Complaint: XXXX XXXX XXXX XXXX SETERUS, INC has their insurance agency XXXX XXXX sending multiple letters ( this year to date XXXX already ) regarding condominium insurance information they have already had for weeks. The condo assoc master insurance policies were submitted more than one month ago, they are a loss payee on my XXXX policy, and the condo insurance agent spoke to them on the phone and was told all was resolved on XXXX XXXX ( XXXX attachment ), yet they continue to send more letters.

Complaint: In XXXX 2013 XXXX rental properties became vacant without notice from the tenants and breaking leases. Of course, they had to leave the property is total disrepair. Cash on hand was used to repair property for new leases. XXXX of the properties we were able to get current because the mortgage company complied with the terms of the mortgage to apply extra funds to the P & I XXXX and then late charges. However, Seterus will not comply with those terms even though I wrote them quoting the specifics of the mortgage terms. Their position is that it is their option as to how to apply extra funds. The loan could be in a current status and not accuring additional late charges if they would follow other loan servicers ' examples.

Complaint: Seterus Inc is 30 days behind on mortgage payoffs. Requests have been made by myself ( via phone and their website on XXXX/XXXX/15, XXXX/XXXX/15 & XXXX/XXXX/15 ) and by the title company doing our closing ( I do not have the dates they requested payoff ). Website states 3 days for payoff, phone states XXXX to XXXX days but when I spoke to a representative today, he stated they are at least 30 days behind, as a result we can not close on the house and the buyers may back out. Multiple websites reflect poor reviews on payoff requests. On top of that Seterus is a debt collector, not a mortgage servicer and they treat you as such regardless if you make your payment on time and pay more than what is required. By far the worst company XXXX could have chosen to service their loans!

Seterus, Inc XXXX XXXX XXXX XXXX XXXX, XXXX XXXX/XXXX/XXXX XXXX : Loan No : XXXX : TO WHOM IT MAY CONCERN It has come to my attention when talking to a local mortgage broker about this loan, and a possible modification of it, that something is happening that I am not aware of, nor has it been brought to my attention, by Seterus , Inc . I have attempted to rectify this situation on numerous occasions : I am including three separate communications ( 2 letters and one fax from my attorney ) that addressed this issue last year- none of which have elicited a response back from Seterus , Inc .
The issue to which I am referring is a complete lack of communication by your company with regard to the of this loan. In the letter I sent to you in XX/XX/XXXX I had been advised that under Section 6 of RESPA I am required to receive from you a monthly statement pertaining to my loan. The statement should advise me of any late fees, changes in mortgage payments, account and other relevant facts.I have not received anything from you, that would accommodate that action!
Despite the above efforts, I have received none of the above on a monthly basis. I have received the following : XXXX XXXX, XXXX ( An introductory letter on the letter recognizing that my spouse, XXXX XXXX has instituted a chapter XXXX that did not include this mortgage loan ). At that date there were no late charge summaries, and the loan had been assigned to you by XXXX XXXX due to her bankruptcy.

I had been under the impression from talking to your company that my monthly payment in XXXX XXXX, XXXX ( I have the name " XXXX '' ) was {$1100.00} - a late fee of {$33.00} would be assessed after XX/XX/XXXX. ( I have this information recorded on the letter the day that I called your company and talked to XXXX ). This is the only communication that I received from Seterus, Inc. that has ever mentioned the amount of the monthly payment, despite several requests from both myself and the attorney that was handling my wife 's Chapter XXXX. In his fax, he specifically mentioned that the mortgage was not included in the bankruptcy, and that your Firm was given permission to talk to the both of us at any time necessary.
At this point I began to request monthly statements under Section 6 of RESPA at the advice of my attorney so that I could understand why I was paying my monthly payments seemingly on time each month, and still getting responses that there were late fees involved as noted above. ( I will credit the actions of the USPS, and my procrastination, on occasion! ) But with no monthly communication with Seterus, I had no idea what was happening, or balances, or what actions could be taken to rectify the situation.
As an extremely concerned client of Seturus, Inc, I have been advised to contact the CFPB because there has been a complete lack of communication, transparency, not to mention the appearance of fraudulent behavior reflected in my credit rating and our lack of communication The reason being, rather than taking money from my escrow account ( you were getting a check from me every month ), solving the situation, and relating to me as required by RESPA what if any action could be expedited by me with Seturus, Inc in order resolve these issues. Complaint: Our current mortgage is with Seterus out of XXXX XXXX, Mi. About a month ago we applied to XXXX XXXX Bank in XXXX, Ohio to refi at a lower rate and shorter length. A request by the XXXX to Seterus was summited twice and and it has been almost 3 weeks and still no payoff has been sent to the XXXX. I called yesterday to Seterus and was told it would be XXXX to 2 weeks more before they could process the payoff. This is not acceptable
