Complaint: I have submitted Prior Complaints, and recently Withdrawn my Complaints against Select Portfolio Servicing Inc., however, I just received a letter dated XX/XX/XXXX, Stating " SPS Previously Received Your Request For Loss Mitigation Assistance, But We Now Consider The Assistance Request Withdrawn. We are not Considering Your Request for Assistance at this time Because : After initially asking to be considered for Assistance, you Withdrew That Request on XX/XX/XXXX. I have never, ever made any Request to/of SPS Inc, except for them to Stop Calling Me, Stop Writing me, and Stop any/all Contact with me, concerning the Property that they Purchased from XXXX XXXX XXXX, ( SPS Inc Account Reference # XXXX ), Property Address : XXXX XXXX XXXX, XXXX, Georgia XXXX. That Property was Abandoned/Turned in/Over To the XXXX XXXX XXXX, Appraiser on XX/XX/XXXX, after an on-site Joint Physical Appraisal was completed, and according to Internal Revenue Service Publication 4681, the turning over and acceptance of a Property, Any Property is Considered A Sale or Transfer, and I am under Bankruptcy Protection. Therefore, since the prior Mortgage Company ( XXXX ) took Possession of the Property, and Issued an Abandonment Form XXXX, which SPS Inc., is well aware of and has been issued a Copy, and I have no Personal Libability for that Property, SPS Inc., has no business contacting me. SPS Inc, Claims to have purchased the XXXX XXXX XXXX, XXXX, Georgia XXXX, Property, yet the Official Muscogee County Georgia Tax Commissioner 's Office, and the Muscogee County Georgia Superior Court Clerk Records show nor record of any any Property Transfer/Deed Recording? That Property is still listed with XXXX XXXX as the Lien Holder? SPS Inc., States that Property was purchased by a XXXX, DE Company in XX/XX/XXXX, yet this is XX/XX/XXXX, and no official records show this to be true. So now, SPS Inc., needs to produce some evidence of a request from me in writing for Loss Mitigation, which does not exist, or state that they have lied for the record.

Complaint: My wife, XXXX XXXX was unable to work as of XX/XX/XXXX as she was declared XXXX by Social Security and received an award letter. In XX/XX/XXXX we contacted our mortgage company to apply for mortgage assistance which the mortgage company played games having us fax and re-fax bank statements, proof of income and my wifes award letter from Social Security. We were asked to keep resend this information for least three months. After the third month we received a letter of denial for any assistance from our mortgage company. At that time we chose to sell off some of our possessions and ask our family members to help us save our home, but we continued to pay our mortgage. In XX/XX/XXXX we received a letter from our mortgage company saying that we our mortgage was going up because our county taxes went up and for two years we failed to pay escrow. This was a fairly new mortgage company as our mortgage was sold in XXXX and we never had a problem with the old company. We checked and our state and county taxes are the same. In fact the new mortgage company sent us a check for escrow over payment. Now when I send the monthly payment it says payment for unapplied finds, mortgage went from XXXX to XXXX a difference of over XXXX without any REAL reason.

Complaint: This short sale was submitted 186 days ago as a COMPLETE packet with valid offer of {$580000.00} which is in comparison to the BPO. SPS 's underwriting dept continues to ask for things they either have or do not need. Specifically they asked for a 2nd lien payoff statement, which I provided about 3 months ago. I was told they had an issue that it didn't include the property address, I explained it wont have the property address because it is attached to the borrower, not property as it is a credit card judgement lien. They then said that it would have to be remove from sale proceeds as they only pay mortgage liens, fine. I removed it. THREE MONTHS LATER underwriting is asking for a payoff statement again despite already resolving this. I have explained this to 11 people and they all understand at SPS ( customer service and supervisors ) they say they will send a message to underwriting to explain, they do yet UNDERWRITING continues to request non applicable payoffs BECAUSE THEY WONT PAY THE JUDGEMENT LIEN. This is just one of the many unnecessary delays this short sale file has endured.

Complaint: Select Portfolio Servicing is foreclosing n my house on XX/XX/XXXX. I just received an Ordinance Violation for disrepair of the roof. SPS has held this money since XXXX hey have not worked out an amicable repayment on my mortgage. I am currently on unemployment and recovering from XXXX. With the original HAMP/HARP/their loan modification program, I submitted the paperwork in a timely manner. As they requested I called every two ( 2 ) weeks. I was told their was a " computer issue '' and they could not produce the documentation. Their ombudsman stated there was no computer issue. My mortgage went from $ XXXX to over {$700.00} then up to over {$900.00} per month including insurance. I wanted to obtain my own homeowners insurance but since SPS would not release the fund for the claims, no other insurance company would insure the house. I am being forced to move from my home by the end of XX/XX/XXXX. Due to my current health conditions this is virtually impossible and may put my life at risk.

Complaint: Complaint # 1 - Failure of Select Portfolio Services , Inc. ( SPS ) to comply with NY Real Prop Actions L 1304 ( 2016 ) with regards to required proper notice as it specifically relates to a Subprime Home Loan. " Notwithstanding any other provision of law, with regard to a high-cost home loan, as such term is defined in section six-l of the banking law, a subprime home loan or a non-traditional home loan, at least ninety days before a lender or a mortgage loan servicer commences legal action against the borrower, including mortgage foreclosure, the lender or mortgage loan servicer shall give notice to the borrower ( s ) at the property address and any other address of record in at least fourteen-point type which shall include the following ... .. '' The 30 year interest rate for a mortgage in XX/XX/XXXX ; the year the loan was originated was 6.32 %. The interest rate charged at the time of origination exceeded 9 %. Complaint # 2 - Failure of Select Portfolio Services , Inc. ( SPS ) to fully respond to legitimate requests for information - XXXX XXXX XXXX. Specifically, SPS did not respond to the inquiries to the following : 1-Whether there is a pending or planned foreclosure proceeding ; 2-Sufficient proof of debt as requested on XX/XX/XXXX ; 3-If the account is registered with XXXX, state its MIN number ; 4-Copies of ALL endorsements, recording, allonges or other indicia of all transfers since note was signed. Specifically, with regards to XXXX XXXX XXXX, per notification on XX/XX/XXXX and XXXX XXXX XXXX XX/XX/XXXX by XXXX XXXX XXXX XXXX, XXXX, per notification on XX/XX/XXXX. 5-The date your firm began servicing the loan and any previous servicer ( s ) of this loan.

Complaint: I contacted my lender SPS over the phone was told they need 37 days prior to sale to have my file reviewed for loss mitigation/ loan modification assistance, XX/XX/XXXX I submitted all their requested documents on line at the SPS Portal have a third party authorization uploaded with all my income, assets, financials and they did not touch the file until XX/XX/XXXX, when I called to follow up they said the system will not accept any loan modification request that I must re-instate my loan as the sale date is XX/XX/XXXX and there isnt enough time. After being on the phone numerous times they refused to escalate even speaking with a manager in loss mitigations They said I was denied for loan modification back in XX/XX/2017 and I do not qualify for change in circumstances, even though I am self employed my income has increased and I have already filed my XX/XX/2017 taxes and know exactly my income is at least {$1000.00} a more month which could potentially help me get a modification per SPS denial letter from last year I did not make enough to qualify. I am very frusterated as I have been a good paying customer and now that I have had a hardship they do not want to assist and will not even review their protocols to see what exactly their procedures are here. I even wanted to send then correspondence in writing requesting a QWR and it took them over 2 weeks to give me the address for that. My family has lived in this house over 10 years we grew memories here I am a unmarried woman and need help and my income is solely mine and I am confident as a XXXX XXXX XXXX I can start my finacial freedom with my mortgage brought current if they just accept my application for review. I do not know where to turn the sale date of my home is set for XX/XX/XXXX, I think it is unfair for SPS to now do their due diligence to assist me rather keep repeating the same information " not enough time to underwrite a file ''. I have called and asked them to send me true denial letter that I do not qualify but the generic letter they sent me does not state anything except for validating I am calling them for assistance, I need CFP to get in contact with them and turn this around for me so that I can be reviewed for loss mitigation and since the file is complete they should be able to postpone my foreclosure sale date. Please I am desperately seeking help.

Complaint: Dear Sir/Madam : I do have a current ( Pending Complaint ), CFPB # XXXX, against Select Portfolio Servicing , Inc., ( SPS Inc. ) that I desire to have dropped by CPFB. That complaint is/has been on-going since XX/XX/. I have now asked the Bankruptcy Attorney ( XXXX XXXX XXXX ), to handle any further issues involving the home/mortgage in dispute, that was Abandoned/Turned back into XXXX XXXX XXXX, in XX/XX/, and that IRS Form is attached to this request, along with a letter to XXXX XXXX XXXX @ SPS Inc., ( XXXX ) XXXX, Option. # 3. The issues are not complex, the home was abandoned in XX/XX/, XXXX XXXX XXXX, sent out an Appraiser in XX/XX/, an On-site Appraisal was done, Joint Photos of the Property were taken, as I had invested a lot of money into getting the home " Move-in Ready '', including Brand New Heat/Air, and the Home keys were turned over to the Appraiser. I contacted Beneficial Financial and XXXX XXXX told me that the home appraised out for more than the remaining Loan balance and that XXXX would cut me a check and issue a XXXX for the difference to me, once the " Deed In Lieu '' was approved, things went downhill from that point, but XXXX XXXX XXXX, did accept the Keys, and change the Locks to the home. According to IRS Publication XXXX, Abandonment is considered a Sale or Transfer of Property, either way with me having an Approved Bankruptcy Discharge, I had no Personal Liability, and XXXX XXXX XXXX, assumed Libabiliy for that home. Now, SPS Inc, purchased the Property from XXXX XXXX XXXX, and starts to send notice of Requests To Make/Pay Mortgage payments on Property that XXXX took possession on and owns, I promptly notify SPS Inc, that they need to send those notices to Beneficial, and sent them copies of the Bankruptcy Order. SPS Inc, continued, therefore I contacted my attorney and had him send the Bankruptcy Order and Schedules to SPS Inc., they still have continued to contact me, and so the attorney is now has the matter.
