Complaint: We want XXXXXXXX XXXX XXXX investegated you are the servicer on our mortgage. Our loan was originated back in XX/XX/2006. We are victims of a predatory loan. We were misrepresented by the mortgage broker and by XXXX XXXX when this loan was originated. We have reviewed our loan with specialist in the industry and there was fraud on documents from the mortgage broker to the banks and forgery on loan documents and disclosures. Since this loan was originated this loan has been passed along from XXXX XXXX, to XXXX XXXX and now XXXX XXXX XXXX We also have checked with title specilist and Sps does not hold legal title on our home properly to foreclose on our home since title recording on purchase date and from all the loan transfers from bank to bank .The title chain is broken and not correct. We are victims of predatory lending and now we are stuck with a toxic loan, Due to all these greedy large banks and corporations trying to maximize profits on homeowners that got these toxic loans. We want to hold these corporations accountable for the problems you have caused to our family. We have tried to work with sps over and over to fix our toxic loan and it just seams to fall on deaf ears. We will continue to defend our home until there is a fix on our mortgage. Stop foreclosure activity on our home and fix our mortgage. fix our toxic mortgage. lower our principal balance / balance started at XXXX k now over 670 k. bring our account current fix this ridiculas wrong toxic loan. Complaint: My loan was recently changes from being serviced by XXXX/XXXX. XXXX to a company called Select Portfolio Servicing. In XXXX of XXXX I modified my loan with XXXX XXXX and have a 100 % on time payment history. I attempted to have PMU removed from my loan, but was notified that due to my payment history it would not be eligible for removal based on payment history until XX/XX/XXXX. I requested removal of PMI from my current servicer, SPS, who ahs recently informed me via mail that I am not eligible due to payment history. Note this correspondence was dated XX/XX/XXXX, well after I had made my 24th on time payment that XXXX. When I called SPS they stated on the phone they could not verify my payment history and did not have access to it. My PMI is eligible for removal, this is a situation I've followed closely for 2 years and their assertions are at best in error and potentially fraudulent. I have attached a copy of SPS letter and my payment history as available to me from my bank. You can see all my payments are made via the servicers auto-payment program. The payment date in their system is always before the due date and the date shown in the attachment is the posted date to my account which is often different.

Complaint: Borrower : my ex husband Full Power of Attorney : me. Court order granting FULL Power Of attorney to me, was transmitted to SPS by Previous Lender with Loan Transfer on XX/XX/2018. ) - as confirmed by previous lender on XX/XX/18 ) SPS CLAIMED DURING MULTIPLE PHONE CALLS, including today, XX/XX/18, that they did not have the Power Of Attorney on File. ( Per statement of SPS Rep & Supervisor, of the XXXX FL location ) The Attachments evidence that SPS is : - 1. Blocking me from the account - Violating a Court Order by SPS 2. Denying the POA being in the file - False Claim by SPS 3. Failed to pay Town Taxes - Violation of Loan Terms by SPS 4. Caused Delinquency Interest to Accrue - Violation of Loan Terms by SPS 5. Added the Town Property tax to the account - Violation of Loan Terms by SPS AND Fraudulent action intentional to increasing monthly payment. Property Taxes have been escrowed since XX/XX/2018 with XXXX XXXX & the loan amount AND loan terms remained unchanged, under the terms of the transfer - Violation of Loan Terms by SPS 6. The SPS Mortgage monthly statement clearly shows that the monthly amount includes an Escrow for Town Taxes & Home Insurance. Therefore the actions of SPS are ***intentional to fraudulently increasing the payor 's monthly amount in order to render the payment unaffordable and thereby fraudulently foreclose on this High Value Property *** - FRAUD BY SPS 7. I have been making regular & on time monthly payments on this loan. The loan amount includes the escrowed Town Taxes that SPS did not pay & caused a delinquency - Violation of Loan Terms by SPS SPS bought this loan from Previous Lender, due to the high equity in the subject property & the Delinquent Tax Notification is intentional to SPS fraudulently foreclosing on the property and intentionally making the payor homeless, as SPS is aware from the Court Order that the Court granted the Payor FULL authorization on this account. FRAUD + VIOLATION OF COURT ORDER +VIOLATION OF CO-OWNER CIVIL RIGHTS+ VIOLATION OF LOAN TERMS 8. The attachments & the OVER 241 XXXX Complaints against SPS, support my allegation that SPS is a SCAM company, their actions constitute Harassment and Intent to foreclose on my home.

Complaint: We started this process in 2009, we were offered a loan modification and we took it because it would make our payments cheaper through XXXX XXXX XXXX. We accepted the loan modification and made all trial mortgage payments as they requested. After making all of the mortgage trial payments, while we were waiting to get our agreement concerning the proposed modification they sent us a letter stating that we did not qualify for a loan modification. Every time we tried to speak to someone about our loan we had to wait for the XXXX and if by chance we did get to speak to anyone, the next time we were told to call there was a new person assigned to our account that knew absolutely nothing about our mortgage and if in fact we had submitted a new modification package it had to be reviewed. We have been offered stream line modifications in the past but following the advise of our attorney we did not accept them because they were such high payments. The hardship that we encountered has past and we are willing and want to make mortgage payments. The other issue is that they gave us a valuation of our home and it is {$370000.00}. and we owe a total of over {$750000.00}. We never knew the interest rate we were being charged we don't know if we have an adjustable rate mortgage????? We can make a good faith down payment as well as make regular payments. They sent us a statement with a XXXX Payment for {$3700.00} and then for XXXX the payment is {$4700.00}. It appears to adjust every three months. If we took the streamline modification would it adjust every three months? On the statement they have charges and other fees listed as {$6200.00}, then Charges/fees this period {$1800.00}? We are trying to make sense of all of this because we really want and need to save our home. We are asking for your help.Please.

Complaint: 1- SPS has failed to provide proof by affidavit upon my request, which adheres to the Laws of New York State XXXX Surrogate 's Court Procedures : " Every claim against the estate of a decedent other than claims for expenses of administration and claims of the United States or the state of New York must be in writing, contain statement of the facts upon which it is based and the amount thereof. In addition the fiduciary may require the claimant to present proof by affidavit that the amount of the claim is justly due, that all payments thereon, if any, have been credited, that the claimant knows of no offsets and no evidence of indebtedness and holds no security, except as specifically described in the affidavit. '' As the fiduciary of XXXX XXXX XXXX XXXX estate, I am requiring the claimant to present proof by affidavit. 2- In CFPB response XXXX, XXXX states , " The legal description in the Mortgage and Mortgage and Consolidation Agreements matches the legal description in the title reports dated XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. Each title report references the deed dated XX/XX/XXXX, recorded on XX/XX/XXXX, XXXX # XXXX, page 770 ( copies enclosed ). It is unclear as to whether the Deed dated XX/XX/XXXX, describes the property address of XXXX XXXX, XXXX, NY XXXX because a specific property address for the property is not set forth in the Deed. XXXX held a security interest in the property described within the Mortgage dated XX/XX/XXXX, and Mortgage and Consolidation Agreements dated XX/XX/XXXX, and XX/XX/XXXX ( copies enclosed ). XXXX sold the loan at issue to XXXX XXXX XXXX effective XX/XX/XXXX. '' XXXX has thus confirmed they have never held a security interest in XXXX XXXX XXXX XXXX, as this property does not lie in the meets and bounds of the deed dated XX/XX/XXXX, recorded on XX/XX/XXXX, XXXX # XXXX, page 770, and is absolutely not the property contained as a security interest in said loans. However, SPS continues to force place insurance and threaten legal action with regards to XXXX XXXX XXXX XXXX ; a property in which they have no security interest in. It has been well documented SPS 's actions are both fraudulent and deceptive.

Complaint: Hello, I contacted this agency earlier this year to assist me in getting my 2017 school taxes paid after my old mortgage servicer, XXXX of Virginia failed to do so. In working with my new servicer, Select Portfolio Servicing , Inc of Utah this was finally accomplished as SPS paid them. I recently received an escrow account analysis from SPS. They are claiming that when they received my account from XXXX the escrow account was short. They have raised my mortgage payment XXXX a month. After two phone calls with SPS totaling 90 minutes they are acknowledging that the shortage came from them have to pay the school taxes that XXXX didn't pay. Essentially I'm being made to pay those school taxes twice. I asked SPS why they don't go after XXXX for those monies. I was told " that's not what they do. '' I was also told that this is an " unfortunate situation '' How can I be responsible for the taxes XXXX didn't pay when I paid my mortgage every month and those taxes were part of my payment? More concerning is where are the monies that should have been used to pay my taxes if XXXX didn't use them to pay my 2017 school taxes. Maybe this should be looked at by the State Attorney General 's office. I look forward to your response. Thank you.
