Complaint: I built a pole barn on my property that wasnt there when the loan was procured. I lost the pole barn to a fire the mortgage company claims that anything built on the property belongs to the mortgage and they required to be on the insurance check I requested to see where that was written in my mortgage but they refused to provided me with documentation ... After fighting with them for a I mailed them the check XXXX XX/XX/2019 requesting to be except to have a XXXX rebuild my barn since it was paid for previously out of my pocket and state of IL does not require contractors to be licensed They refused to allow me to be exempt. I resubmitted the request a semiconductor time and was approved for little over half of the insurance check XXXX. The approval was in XXXX XX/XX/2019. I was told 3 to 5 days I would get my money. On the XXXX I called and they told its is 5 to 7 days to receive the money On XXXX I called and I was told no its 10 days and the XXXX was the tenth day. On the XXXX they called and said the funds were being release and I requested the check would be sent over night and they agreee on the XXXX I called and they couldnt tell me why the check wasnt sent yet and I just had to wait. As of XXXX XXXX they still will not release me my funds and can not give me a reasonable explanation I have had to delay shipments of rebuilding supplies away twice now and all my personnel item that should be stored in the barn is sitting out side in the weather

I will actually pay them this debt I do not owe when they refund over {$600000.00} that seems to have gone into my escrow account as it was not applied anywhere else. I suggest they get it from the XXXX XXXX XXXX XXXX or one of the three companies that appear to have been paid off twice or from XXXX XXXX who colllected AND foreclosed on my other property after it was paid in full to -apparently- another company. Complaint: My mortgage was sold/transferred from XXXX XXXX to Select Portfolio Servicing in XXXX of XXXX. I have made mortgage payments to Select Portfolio Servicing without missing a payment since this transfer although I was under Chapter XXXX Bankruptcy since XXXX of XXXX. I was discharged from the Chapter XXXX Bankruptcy in XXXX of XXXX. I began receiving phone calls from Select Portfolio Servicing that my mortgage payment was 30 days delinquent. I informed them that I had been under Chapter XXXX Bankruptcy but my mortgage was not under the bankruptcy and I had continued to make mortgage payments throughout. I forwarded 2 years of payment verification to them and they responded in writing on XX/XX/XXXX, stating they had received my information and was researching my account. Next they mailed me a letter stating the there was a payment due XX/XX/XXXX and it had not been received and they were charging a late payment of {$12.00} to my account. I then phone them and request a manager, I was connected to a supervisor and I explained my problem. The supervisor when over all of the payments that I made since the account was sold/transferred to Select Portfolio Servicing and discovered that a part of the payment I sent for the XX/XX/XXXX in the amount of {$470.00} had been applied to {$420.00} in foreclosure fees. The supervisor said the foreclosure fees came over with the account from XXXX XXXX. I informed the supervisor that my mortgage had never been in foreclosure, but that I was aware that XXXX had tried to submit a claim through the Bankruptcy Court that I had missed 3 payments in XXXX. I explained that I had never missed a payment on the mortgage and that I had documentation from Bankruptcy Court that the motion was withdrawn after I provided payment verification to the Bankruptcy Court. The supervisor advised me to forward submit my documentation, which I did on XX/XX/XXXX. Select Portfolio Servicing then responded to me by letter stating they received my correspondence, researched my account further and removed the fees. They also included a corporate advance history for my account documenting that {$420.00} in fees listed as a beginning balance had been charged to my account on XX/XX/XXXX and that a credit in the amount of {$420.00} had been applied on XX/XX/XXXX. The corporate advance history also showed 3 other fees had been charged to my account, {$420.00} in FC ATTY Fees on XX/XX/XXXX ; {$270.00} in Bankruptcy Costs on XX/XX/XXXX ; and {$150.00} in Bankruptcy Fees on XX/XX/XXXX. This same letter also informed me that my account was still delinquent and due for the XX/XX/XXXX payment, although I had mailed a payment in the amount of {$510.00}, which was credited to the account on XX/XX/XXXX. I phone Select Portfolio Servicing again on XX/XX/XXXX and requested to speak with a manager and after explaining my problem, I was told that the fees came to them with the account and that a manager was not available at that time and someone would return the call to me. I have not received a call from anyone from Select Portfolio Servicing as of date. My mortgage has not been in foreclosure and there was no claim from XXXX nor Select Portfolio Servicing listed in my Chapter XXXX Bankruptcy.

Complaint: I contacted my mortgage company during the Summer I was having issues with payment ( XXXX XXXX XXXX ) They told me I could file for a loan modification. So I got the ball rolling on that. About XXXX I was told my loan modification fell thru do to not submitting all the paper work. I talked to XXXX and asked how to fix this and was told to resubmit. So I resubmitted all the paper work. In XXXX on 2019 I was told I was approved for loan modification. I was to make 3 payments on time starting in XX/XX/2019 of XXXX dollars and some change. Then I was told my loan is with a new servicer ( SP servicing ) I called this new company in XX/XX/2019 and asked about the loan modification and how to handle this. Was told SP didn't have the paper work and to wait 60 days till they got all the paper work. So I waited a few weeks and tried calling again. Still nothing. So I called XXXX and they told me they should have received all the paperwork. I called sp a few more times and wrote a couple e-mails. The company has never responded. I explained I was worried I would miss my deadline for my trial loan modification. They didn't seem to care at SP servicing. I was in foreclosure and that was all they cared about. The customer service is XXXX. When I asked SP what to do they said wait till they get all the paper work from XXXX. I felt by then my trial loan modification would go down the toilet and I would loose my home. To this day I have never received a phone call or e-mail from SP services. I wish XXXX would kick them too the curb and take back my account

Complaint: XXXX XXXX XXXX paid both halves of my property taxes together, rather then in halves when the money was available. In XX/XX/XXXX {$2600.00} was due for my property tax, and {$3300.00} was in my escrow acct. XXXX sent a check for {$5300.00} which paid both halves the XXXX amount and the XX/XX/XXXX half. The resulting - {$1900.00} balance in my escrow didn't stop this Escrow Department from issuing another check 13 days later for the correct amount then due {$2600.00} increasing my negative balance to - {$4100.00}. The County cashed the full payment for {$5300.00} and sent the 2nd check back. XXXX Suspended my XX/XX/XXXX payment without cause or explanation. Then applied my XXXX payment to XXXX, declared me in Default late 30 days, and began sending certified letters and billing for inspections never conducted. I spent hours on the phone with XXXX or Consumer Advocate in XXXX, and he agreed we had not missed a payment, and should not be getting default notices. The account was transferred to SPS and for reasons I can't understand, they don't see the XXXX suspended funds as having an impact. The first 2 copies of my Account History of my XXXX Account were furnished to me through SPS and were obviously doctored. They read from the bottom of the page up, and have cut + paste shadows.

Complaint: I applied for a loan modification for my home. I own an auto repair business in XXXX XXXX, CA. The XXXX fire that started in late XXXX and continued into XXXX impacted my business in various ways. Many of my clients lost their homes and vehicles and had to move out of the area. I lost them as clients. Many people lost their homes or suffered significant damage and had to move away. While the fire did not burn my business down, the embers did fall on my building and cause damage. The rains that followed the fire in the winter of XXXX then resulted in floods and mudslides that also destroyed more homes. Again, I lost more business due to that disaster. Additionally, my building also suffered damage because of the rains. I lost a lot of clients and business due to the fire and rains of XXXX and because of this I had trouble making my mortgage payments among other things. I applied for a loan modification because i need help to stay in my home. My loan had been with XXXX XXXX XXXX but it was sold to SPS recently. I applied for the modification once the transfer to SPS was complete. I submitted my paperwork in late XXXX and just 2 weeks later they made a decision. They didn't ask any questions in reviewing my application. The lender completely ignored the hardship I suffered because of these natural disasters and only granted me a repayment plan that is more than double the amount of my monthly mortgage payment. How can I pay the new amount when I was struggling to pay the old amount?

Complaint: On XX/XX/XXXX, the respondent sent me a letter inviting me to apply for loan modification. Unknowing to me at the time of the invitation, they had done an appraisal on my house it has appraised at close to XXXX XXXX of the balance of my loan. The house appraised for only {$450000.00} whereas the balance of my loan was {$860000.00}. The respondent knowing fully that XX/XX/XXXX was the last year for the XXXX program that allows homeowners whose properties are underwater to refinance and their new principal would be based on the appraised value of the property. The respondent advised me while they were walking me through online application that there is a note on my file that I should be approved for XXXX program. However, after submitting my application and prior to the deadline they gave me to submit the documents they requested they sent me a letter of approval and gave me a deadline to make my first payment. Their approval letter never indicated the terms of the loan modification. No interest rate or principal was disclosed. It was after they had received my first payment that they now disclosed to me the appraisal they had done on XX/XX/XXXX. Also it was then that they disclosed to me that my loan modification is not XXXX but a trial modification. They had baited me with an XXXX program and switched to a trial loan modification in order to locked me into the higher principal balance and prevent me from going to another lender and refinance or do a loan modification under XXXX that would considerable lower my principal balance and my interest rate and consequently lower my monthly payment. This would be the second time that Select Portfolio Servicing, Inc would deliberately prevented me from participating in a federal program that would have allowed me to lower my principal balance to conform with the appraised value of my property as mandated by the government. In XX/XX/XXXX after XXXX had informed me that they had approved me for the HARP program, they colluded with XXXX and the investor for my loan to acquire the servicing of my loan. Again in XXXX of XXXX after realizing that the value of my property has depreciated further and knowing fully that the HAFA program that would allow the principal balance on my loan to be adjusted to the market value would be ending, they baited me with a promise of an HAFA program and switched it to trial loan modification after the program has ended. Thereby denying me the opportunity to participate in a federal relief program that I was eligible to participate.

Complaint: We got a home loan through XXXX XXXX XXXX in XXXX. XXXX XXXX sent us a {$3200.00} check for overpayment shortly after we closed, and sold our note to its processing company, SPS Servicing. When the first monthly mortgage bill came from SPS ( which was either XX/XX/XXXX or XX/XX/XXXX ), I noticed that our payment had decreased from {$3100.00} to a new payment of {$2600.00}. I went on line to try to figure out what had happened, and it became apparent that the initial refund was from what they thought was an overpayment to the escrow account. I called right away -- because I realized, they were now collecting {$47.00} monthly for our taxes and insurance, when they should be collecting {$460.00} each month. The person I spoke with at SPS told me to just keep paying the extra {$460.00}, and that it would go into the escrow account. So I did what I was told, and in the next statement, it showed that payment going toward the principal instead of the escrow account. Greatly alarmed, I called SPS again in XX/XX/XXXX and requested an Escrow Audit, and asked that the {$460.00} that was supposed to go to my escrow account be corrected. The person on the phone said that she would start the process for the audit, and get the money put in the right place. ( I had been using my bank 's electronic bill payer through this time. ) On my XX/XX/XXXX payment, I sent it by check and wrote on the coupon, that the overage was to go to escrow -- but of course that didn't happen. I called SPS on XX/XX/26 and spoke to someone named XXXX when I saw that YET AGAIN, the extra {$460.00} was put towards the principal, despite me sending a check and writing on the payment coupon that the overage was to go to the escrow account. XXXX seemed to have a hard time understanding why I was upset about my payment being less. She had an extremely hard time grasping the fact that SPS was collecting HUNDREDS of dollars less than I needed to fund my escrow account to get my taxes paid. She had to go talk to a supervisor for about XXXX minutes, and when she came back on the line, she said she FINALLY understood what I was saying. I requested an Escrow audit AGAIN and she said SPS would follow up by mail within 10 business days. The payment coupon for XXXX just came, and I can't figure out what they've done with the {$460.00} that I YET AGAIN designated to be applied to the escrow account. I have been dealing with these people for 5 months now, and they have promised to make everything right and have done exactly NOTHING. All of my overpayments toward my escrow are NOT in my escrow account and I have received NO correspondence about correcting these ongoing errors nor have I received any correspondence about the Escrow Audit. I will now be socked with a massive tax bill at the end of XXXX, and I am done playing with these incompetent and unresponsive people.

Complaint: I am disputing the foreclosure date or XX/XX/2019 by Select Portfolio Servcing. I have asked for specfic information on this loan from them multiple times and have not received the information that I need to make an informed decision on what I need to do with my property and my situation. There are 2 open disputes on this loan number XXXX disputing the Trust that my loan is a part of. I have spoken with the ombudsmen department multiple times about extending the foreclosure date and as of today they refuse to do so. I even had one representative from the Ombudsman department tell me it would be illegal for them to foreclose on the property with an open dispute on it. Yet they still seem to be intent on doing so. I have tried multiple times to get a clear answer from them on my situation and they openly tell me they know nothing about the XXXX XXXX XXXXXXXX XXXX XXXX other than who owns it. I need more information on that to help me with my situation and to give me piece of mind that my money is going where it's supposed to. Again I demand they give me the information I need and that this foreclosure date set for XX/XX/2019, is postponed based on the fact that there is information, that they as the collecting party should have yet they are now giving me.

Complaint: On XX/XX/18 SPS Servicing assumed our loan from XXXX XXXX XXXX. with the original loan terms still in place : Conventional 5/1 ARM, no escrow account and tied to the LIBOR. Our loan was transferred in good standing and was a simple transfer. Our loan has never been late and since transfer to XXXX XXXX, and due to their poor reputation as a debt collector, I have paid my mortgage early every month and in excess of the balance due. SPS has reported false and damaging loan terms which I was unable to fix through normal CRA disputes. In violation of the FCRA, SPS has reported our loan to all 3 Credit Bureaus with false remarks : LOAN MODIFIED NonGovt, Loan Modified and including purchase money first. When I disputed this false reporting, it was verified by SPS as accurate. My mortgage was sold by XXXX XXXX XXXX. and this loan was not a requested transfer. Furthermore, I contend that because we have nearly perfect credit scores of 820+ FICO 9, SPS Servicing reported false terms to lower our credit and attempt to retain us as a long term client by lowering our score. The reporting of Loan Modified on a credit obligation is considered a derogatory indicator by FICO Score 9 ( and within the auto and bankcard versions of FICO Score 9 ) and would trigger the negative score factor You have a serious delinquency ( 60 days past due or greater ) or derogatory indicator on your credit report. to surface.
