Complaint: Back in XX/XX/XXXX I got very ill ( i 'm a XXXX ) lost my job and my family was helping me pay my mortgage and bills. I got a modification offer letter from my bank offering to modify my current negative amortization loan for a stable loan with low monthly payment and for the current value of the property. I called XXXX XXXX XXXX my mortgagor and I was told that i would not qualify unless i 'm behind on payments for my mortgage. I had a perfect credit with XXXX scores which took me years to build and now I had to default in order to save my house. So per XXXX XXXX XXXX 's advise I did ... .I have been trying to modify my current existing neg am mortgage with my bank- XXXX XXXX XXXX for the past 4 years now. My current loan amount is over XXXX and my appraised value of the property is not even XXXX. Select portfolio services a note servicer for XXXX XXXX XXXX served me with a notice of default in XX/XX/XXXX. I applied for mediation in XXXX. I got approved for a reverse mortgage in the amount of XXXX and we sent in a pay off offer for XXXX for the current loan. SPS declined the pay off offer and countered us to send in a new pay off offer for the amount of XXXX which we did. Then they declined that offer as well, did a new appraisal and are demanding the full pay off for the current note which is XXXX. The property is over 50 % under value, I currently have a negative amortization loan which is going up every month. My house is a full rebuilt from fire has several structural defects and bank keeps asking me to resend documentations to them over and over. I 'm XXXX years old on ssi low income, my house is all I have left and keeping with with reverse mortgage would be only option for me. SPS now is asking me to send them a new pay off offer, new financial statement, new bank statements, new ssi award letter .... I have been faxing them a full set of documents as they request for the past 2 years now. It takes them 2-3 months to review and they get back to me stating that I need to send in a different pay off offer letter XXXX last XXXX I sent was for XXXX and they countered me to send them a pay off offer for XXXX AND a new set of bank statements, XXXX award letter and etc, because what they have in the file is now over 2 months old. I feel like this is a formality and nobody really cares or gives me a clear answer on what needs to be done to either modify or refinance this loan. I 'm very exhausted and now since they denied the last pay off offer through mediation which was for the exact amount that they requested, I now have an " important notice '' from the supreme court of NV stating that they will issue a certificate of foreclosure on or about XXXX XXXX ... PLEASE HELP ME! I DO N'T WANT TO GO HOMELESS AT MY AGE AND CONDITION!

Complaint: My loan with XXXX XXXX XXXX was sold to SPServicing in 2013. I requested assistance with a loan modification due to a {$30000.00} dollar decrease in income resulting from the need to relocate to assist a XXXX child. I have submitted the documentation as requested repeatedly, submitted additional documentation, and when requested updated documentation due to an almost 2 year long process. To date I have not receive a modification or resolution of any kind. I initiated this process because I was having difficulty paying my monthly mortgage payment. At the outset I was only a few months behind, however over the past year and eight months since I began the process I have fallen further and further behind on mortgage.
This company touts their caring nature and states their desire to assist in obtaining a loan modification, and prevent foreclosure, but this is not my experience with SPServicing. I do n't feel that they have acted in good faith or made any effort whatsoever to assist me although I have appealed to them in good faith. I wish to learn what recourse I have in terms of working with an agency that will truly help prevent the loss of my home and assist me in obtaining a modification that is more in line with the value of the home, a better interest rate, and a more affordable monthly payment.

Complaint: homeowner was delinquent on their loan and were protected by a C XXXX homeowners did not understand the XXXX process, they paid the XXXX plan payment but did not make their regular payments outside the XXXX plan to their lender. during this time the lender did not seek relief and allowed the homeowner to complete the XXXX plan. In XX/XX/XXXX we asked for a modification and SELECT PORTFOLIO SERVICING sent a packet and agreed to look at the client 's financial for a modification review. from XX/XX/XXXX through XX/XX/XXXX we have submitted, resubmitted the same documents over and over and have answered the same questions again and again. the client has enough verifiable income to modify the loan. SPS has been dragging their feet and lying to the client and to the housing counselor on a monthly basis. this is clearly servicer abuse and ignorance on the lender 's part. I know that they are reading from a screen and saying a lot of XXXX because they can not answer any questions about the underwriting process. we have been trying to negotiate with them for 9 months. we were told since XXXX that the modification was in underwriting then they would ask for updated information we would update them with the information and then they would punish the borrower by saying that the process was starting all over again. that 's just wrong. the lender is accepting monthly payments but keeping us in a holding pattern on the delinquency. need some action cfpb!!!

Complaint: XXXX is assigning a mortage. XXXX has no right since it does note own the note. XXXX only keeps track of mortgages. The bank representative acting as a XXXX reperesentative is assigning the mortgage. XXXX can not assign mortgages. It does not own the note and therefore can not assign the mortgage. The bank representativce does not work for XXXX, or have the rights to assign the mortage without owning the note.

Complaint: We initially had a mortgage with XXXX XXXX, every year in XXXX, they would begin harassing us for a lump sum payment, normally over {$3000.00}, regardless if our payments were up to date, or XXXX behind, then after 7 years of this, they sold our loan to another company, XXXX XXXX, and they did the same thing in the fall of last year. They only owned our loan for a few months. Now ANOTHER company bought our loan, Select Portfolio, they are now harassing us. Calling XXXX times a day, leaving numerous voice mails, coming by my house, etc. I have called back and ca n't ever get the lady that keeps calling me. I try to work full time, my husband does, also, we have XXXX children, and my mother is in and out of the hospital. I have requested numerous times a modification, but noting ever comes of it. They just make more demands. I need someone to help us, and actually listen to us, because I am afraid other have the same issue. The original company, I am sure it is in our original contract, that they could n't sell our loan.
