Complaint: SPS has insisted XXXX in their response to my last complaint and in correspondence that XXXX XXXX does not allow loan modifications. However, when SPS sends me forms to fill out, they use forms that are copies of the government forms used to evaluate individuals for loan modifications. Secondly, SPS states very clearly that they participate in XXXX and XXXX programs. This contradicts their prior statement directly and means that they have been wasting my time. XXXX and I qualify for Loan Modification based upon her XXXX and our subsequent loss of income. I have supplied paperwork to illustrate this fact. I will submit a complaint against XXXX XXXX separately.

Complaint: In follow-up to my complaint number XXXX, SPS has yet to address their correspondence and request to set-up automatic drafts of my account that was mailed to me in XXXX XXXX. Instead they continue to turn back to the excessive auto-draft, but this was not the only issue. My complaint arises from more than that singular issue, but the series of errors that SPS made and then refused to address or correct. SPS keeps stating that the only issue was their overdraft of my account which took place under authority I extended them back in XXXX. If this was truly the case, why send me a letter and form to set-up auto-drafts with my loan modification documents in XXXX XXXX in order to maintain currency on my accounts? Per SPS 's statement, this would not be necessary because supposedly they already had my authority ... though their customer service team throughout my loan modification process continually stated otherwise and that I would need to set-up a new auto-draft once my modification was complete. SPS continues to lie about their actions and responses and this is why I will continue my protest until I am made whole. It is SPS 's correspondence of XXXX XXXX that contained the instructions to complete the auto draft form, submit it, and in the interim make check payments. It is this written request and direction from SPS which made me mail payments for my XXXX and XXXX mortgage even though they had already removed an excessive amount from my bank account ( I just was not aware of it yet ). From there, SPS attempted to process XXXX these checks - not once but twice after I had already contacted them about the error in their overdraft. Despite my repeated requests for correction, SPS failed to respond for months, specifically from XXXX XXXX through XXXX XXXX. It was after I filed a complaint with CFPB that SPS slowly began addressing pieces of the fall out to me. In lieu of acknowledging their error, they preferred to refuse to credit my mortgage accounts appropriately, refused to credit me the {$110.00} in bank fees I incurred, and instead decided to report my account as late to credit bureaus because of the {$110.00} ( disputed amount ). I should not be penalized for SPS 's errors with late reports on my credit when I have not been late ... only defrauded. It is this type of unscrupulous behavior why CFPB was formed to help protect consumers against.

Complaint: In complaint # XXXX and others I proved what Select Portfolio and XXXX XXXX call a modification was actually a cash out refinance loan, and I was never given any RESPA documents showing where the funds were dispersed and never given a 3 day right of rescission as per required by Federal law. This cash out refinance was done on XXXX/XXXX/XXXX, which would be the day that my right to rescind would start. SPS has finally quit trying to deny paying off any other loans ( XXXX actually paid off my then first mortgage with XXXX Mortgage, without my knowledge or permission, but they are trying to claim that my right of rescission was effective from XXXX when I took out my original loan, which was with XXXX. How they can assert this is beyond me, because the cash out refinance of my XXXX loan was done on XXXX/XXXX/XXXX, not XXXX. I rescinded the loan in XXXX XXXX, which is well within the 3 year right of rescission that SPS admits exists. Therefore, I again demand that my loan be rescinded. I also demand that the CFPB take enforcement action against these RESPA violations.

Complaint: On XX/XX/XXXX a complete modification package was sent to SPS. ( see attached ) A confirming email was received ( see attached ) The homeowner had a sale date set for XX/XX/XXXX.Our office called SPS and spoke to XXXX XXXX on XX/XX/XXXX and she stated the docs were received and they will be sent to processing. ( pull the call as they are recorded ) On XXXX we called SPS and spoke to XXXX XXXX who stated the docs are being reviewed. ( pull the call as they are recorded ) The sale date of XXXX was postponed until XX/XX/XXXX.Our office continued to call weekly for updates on the review. Every week we were told the file is being reviewed. On XX/XX/XXXX we called SPS and spoke with XXXX XXXX who stated the file was denied, but no denial letter was sent.On XX/XX/XXXX we called SPS and spoke to " member of management : XXXX XXXX ID XXXX. We told her no denial letter was ever sent yet we have correspondence from them that the docs were indeed sent in for review. That we have all call logs and records ( see attached ) from every employee we spoke to weekly with regards to the review. She reviewed the file and stated she sees where we spoke to the employees but that NO REVIEW WAS EVER OPENED as there was a sale date on XX/XX/XXXX. She contradicted what EVERY SINGLE EMPLOYEE STATED. She continued to repeat " there was a sale date on XX/XX/XXXX we could n't review the file. '' Once the sale date was postponed what was the excuse? She than stated it had to be in review 37 days before the sale date. THE SALE DATE WAS POSTPONED, WE HAVE CORRESPONDANCE FROM SPS VIA EMAIL AND WE HAVE DOCUMENTED CONVERSATIONS REGARDING THEIR EMPLOYESS TELLING US THE FILE WAS IN REVIEW. We informed her of all that information and she continued to make excuses. She then stated that XXXX did not move the " file forward. '' SPS records the calls!!! They need to review all calls dated XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX when we spoke with XXXX XXXX, XX/XX/XXXX when we spoke to XXXX XXXX, XX/XX/XXXX when we spoke to XXXX XXXX and then XXXX XXXX.For this to happen to a file is unacceptable. This file slipped through the cracks. At this time we are demanding the sale date be postponed or we will move forward with legalaction naming SPS as a defendant in a civil suit.Mr. XXXX has had issues after issues with SPS and it is apparent that they have neglected this file. Furthermore they have discriminated against XXXX XXXX based on his race, ethnicity, national origin, language, sex, and marital status. It is very obvious that SPS would rather foreclosure on the home than assist the homeowner. Lastly, there is an open dispute with their institution from XX/XX/XXXX that has NOT BEEN resolved, yet they are still trying to sell the home. That further proves their intention regarding the home as well as discrimination against the homeowner.

Complaint: I have had numerous issues with Select Portfolio Servicing for years. They constantly take my overages that I send in with my payment and apply it elsewhere except the " Unapplied funds account '' which is where I want it to go. 2x a year I have to call them constantly and correct them. Sometimes they do it and most time they put it to other charges and fees WITH ABSOLUTELY NO DISCLOSURE TO ME AT ALL. I call them, they say they will take care of it by a said date. The date comes, and nothing is done. I ask for a supervisor and NO SUPERVISIOR IS AVAILABLE AT ALL EVER. They always want to call me back within 48 hrs. Sometimes they do and sometimes they do not, when they do not I have to start the process all over again with another supposed 48 hours. I recently talked to a XXXX ( supervisor ) on XXXX/XXXX/XXXX and she assured me it would be taken care of and she would call me back to confirm. Now it is XXXX/XXXX/XXXX and still nothing, I have received a few mtg statements since and nothing has been adjusted. This is my funds to be distributed and they distribute how they want with ABSOLUTELY NO DISCLOSURE OF FUNDS AT ALL!!! This is a clear violation of consumer mortgage laws. When I do talk to them, some say " We have a hiearchy to which we put your funds ... ..? " and some say they attend to my requests and they hang up the phone and never pursue my requests to where I have to constantly call them again and again. I have had other issues with this company a few years back asking them to confirm my previous mortgage servicing sales because I was concerned that the 2 prior servicers where sued for fraudulent mortgage practices by the US Government. Same thing back then .... no response and no answers .... and I send them registered letters back then. ... ... It is ridiculous. When it is the XXXX or XXXX of the month they are calling me for my payment .... which I am completely current on with no late payments, but when I call them with concerns ... it goes directly to the trash. Sometimes they call me back and sometimes they do not and I have to start the whole process over again and again. They also keep me in this collection status because I modified with a previous servicer. They constanty treat me like I am 150 days down in my mortgage when I am completely current every ... ... single ... .. month. I am not in collection status but they constantly refer to me as a " problem '' which is very discriminatory. Just because I am XXXX does not mean that they should treat me differently. Complaint: We have been struggling financially for over a year now. Due to circumstances, we were not able to refinance our loan as we had planned. We did attempt to obtain a loan modification. For over 4 months I dealt with mortgage company providing them, over and over again, with documentation they requested. Finally, they said they had all documents they needed and I needed to complete a trial to be eligible for the modification. They said I needed to make special payments for 3 months, which I did, on time, even a month early. They said for me not to pay anything else until XXXX XXXX. After those three months were completed, they mailed me a modification letter that I had only a couple of days to read, understand, sign and return. They modification would help a little, but it would n't have helped us in the long run. Meanwhile we were able to repair the home well enough to finally be able to refinance our home with an FHA loan. We decided that we should refinance instead. We completed all we needed to refinance the house, but when the loan officer requested our payment history from the current mortgage company, it showed we were 3 months behind in our payments, which I knew nothing of. It took two phone calls for me to find out what was happening and I ask them to fix the situation so I could refinance, but they refused. They claimed the payments I had made for the trial were just to catch up what was behind XXXX they payments were larger than my usual monthly payments ) and I still owed for XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. I paid those three past due payments in XX/XX/XXXX, however XX/XX/XXXX and XX/XX/XXXX still appear over 30 days late on my payment history and because of that NO ONE will consider refinancing our loan for another 12 months. I had no idea our payments were so far behind. I was simply doing as I was instructed my the loan company regarding the modification, which I thought would help us and the company managed to drag this situation out for months. Now we are stuck. We can not accept the loan modification, we can not refinance, we can not afford to pay the 8.9 fixed interest rate and fees on our loan. We have a nice home with excellent equity and need to refinance to pay our debts and lower our rates. All we need is our payment history modified so that we can obtain the loan. I feel like the loan modification process was not handled well, as they constantly " lost '' documents I had sent in, and was not explained well at all. I find it very unreasonable that this situation prevents us from refinancing our home.

Complaint: Dear Sir/Madam I am at my wits end and I 'm in desperate need of your help. I have tried very hard for more than 3 years to get loan modification from Select Portfolio Servicing , Inc . I have been denied all of these times because of : my income was low or I do not have enough assets to support repayment plan. I have even offered them a substantial amount of money for down payment to help a modification along. I have been to court conferences in NY and worked with HUD-approved foreclosure prevention counselor for more than 3 years. I have submitted completed XXXX applications along with supporting documents at least 8 times so far. Many times the assigned relationship manager, which kept changing, would not call for months. I lost all my business due to hurricane XXXX in XXXX and XXXX XXXX, NY was declared a disaster zone by the Federal Government. Property values dropped drastically. There was loss of rental income. My mother and father passed away. At the advice of my housing counselor, I rented some rooms to boarders and had my son move in with me and contribute to show the bank more income. They denied the application this time for too much income.

Complaint: In XXXX XXXX my wife and I applied through the Michigan Hardest Hit for assistance with our mortgage due to a reduction in income and layoffs and XXXX XXXX the Michigan Step Forward program approved us for a pay down off {$24000.00} on our principle mortgage balance. At the same time we applied with Select Portfolio Services our mortgage company to refinance the balance of our mortgage to reduce the rate and payment. We sent all our current tax returns, paystubs, bank statements, paid property taxes, proof of insurance and a written letter from my wife 's employer and was told bu Select Portfolio they would not accept the pay stubs and letter because they were hand written, we were also told that they would not accept my wife 's XXXX as verification of employment. My wife has worked for the same company for over 6 years and has kept her stubs until she receives her XXXX and we file our taxes. All we want to do is refinance our mortgage to lower the rate and payments.

Complaint: I think it illegal for Select Portfolio Services to " claim / state '' ownership of a debt and report same about that debt while it is and has been in legal proceeding since 2010. The specific being a Quiet Title action taken against XXXX Bank Home Mortgage filed in XXXX XXXX by XXXX XXXX XXXX XXXX. of NY. ( See attached ) This action precludes any possible transfer of " debt '' or " claims of debt '' from XXXX Bank to SPS and thus, makes it impossible for SPS to have any say or standing in the matter. there is and has been a QUIET TITLE Action in court with XXXX in XXXX, NY XXXX XXXX XXXX XXXX since 2010 ( decision and Order Number XXXX by Judge XXXX XXXX XXXX ) So how can XXXX transfer something it does not legally own, furthermore, how can SPS claim to have rights? let alone publish such rights without legal standing? this is clearly criminal and potentially Identity theft XXXX

Complaint: Select Portfolio send me a refund check from my escrow account. I did n't cash the check for over a month but when I did select portfolio cancelled the check. My bank charged me XXXX for a bad check. I called Select Portfolio after a 40 minute run around they said they did cancel the check. They could n't tell me why I was n't notified but stated if I faxed over the document from my bank they would reimburse me the XXXX. That was back in XXXX. When I call they just blow me off and say they are working on it.
