Complaint: New Complaint against Select Portfolio Servicing. We have received a response from XXXX XXXX XXXX XXXX regarding our complaint file # XXXX. A DISPUTE has been filed, and since XXXX XXXX XXXX XXXX has no record of us, or our loan, as to any trust, or by which XXXX XXXX XXXX XXXX has a record for security investors, and XXXX XXXX XXXX XXXX forwards us to the servicer - Select Portfolio Servicing ( SPS ), we hereby file a new complaint against SPS. While XXXX XXXX XXXX XXXX claims to be a trustee to certain XXXX trusts, XXXX XXXX XXXX XXXX can not, and does not, state that our loan was in any trust to which they were a trustee. XXXX XXXX XXXX XXXX can not, and does not, state that XXXX XXXX XXXX XXXX, as trustee for certificate holder investors, received payoff of our loan, for the benefit of investors, by us, in year XXXX, as evidenced by our mortgage payoff cancelled check. XXXX XXXX XXXX XXXX can not, and does not, provide a Mortgage Schedule for any trust, that XXXX XXXX XXXX XXXX claims to be a trustee for, by which our mortgage loan is included for cash pass-through to security investors. XXXX XXXX XXXX XXXX can not, and does not, provide any documents in their possession, either as trustee, or in any capacity, by which our mortgage loan is referenced. XXXX XXXX XXXX XXXX can not, and does not, provide a Power of Attorney for Select Portfolio Servicing ( SPS ), or any other entity, to act on their behalf. No Power of Attorney is attached to SPS assignment and discharge, recorded in our County, for SPS to act on behalf of XXXX XXXX XXXX XXXX, for such assignment and discharge recorded in our County Registrar 's Office. Such assignment was recorded in XXXX XXXX, without Power of Attorney from XXXX XXXX XXXX XXXX, by SPS, many years after actual payoff of loan by us - XX/XX/XXXX. XXXX XXXX XXXX Bank can not, and does not, state that any certificate holders/investors to any trust, by which they were trustee for, and, responsible to - by SEC filings for servicer compliance, received payoff of our mortgage payoff proceeds on XXXX XXXX, XXXX - as provided as paid by documents submitted by us. XXXX XXXX XXXX XXXX only refers us to SPS. Thus, it is up to SPS to respond as to what happened to our loan, and to our mortgage payments and payoff. At this, juncture, a referral to the Securities and Exchange Commission is warranted. The CFPB has informed that they do not refer to any other entity other than the Federal Trade Commission. Thus, we request that SPS respond to this complaint so that appropriate action may be undertaken. Not only is title to our home at stake, but, also, investors rights have been discarded, with payoff owed to them diverted, by both XXXX XXXX XXXX XXXX, and SPS. Complaint: I previously filed a complaint, Case number : XXXX, and disputed the response from the Mortgage holder, but I do not see it on the record. Two things : 1. It is true that SPS has now offered me mortgage assistance and I am in a 3 month trial program, paying about {$1300.00} a month. I am glad to be offered the option to stay in my home, but the information I provided to SPS shows my income, from a part-time job because I have not been able to find full-time employment, is about {$1600.00}. A bit unrealistic to offer me an option that leaves me nothing on which to live. 2. The response from SPS about why my mortgage is so high, higher than the purchase price, after more than 20 years remains unanswered. It was stated that I purchased the home in XXXX for {$180000.00}. Incorrect. The property was purchased in XXXX for {$140000.00}. I 'd like to an answer. Thank you.

Complaint: In reference to my property located at : XXXX XXXX XXXX XXXX XXXX XXXX, Ca. XXXX yesterday I made a follow up call to the servicer SPS, Inc ( SPS ) to confirm that they had recieved my proof of occupancy ( XXXX documents they had requested the last time I spoke to them via phone ) and SPS confirmed reciept and said the XXXX documents submitted would suffice. But they also informed me my house had been put up for Trustee Sale due to the fact that several other items were missing. This is ludicrous because they had made it crystal clear that the " only documents that need to be submitted at this point are the XXXX forms of proof of occupancy '' in my last conversation with SPS ( previous to yesterday ). And at this point it has clearly formed a PATTERN where on atleast 4 occassions SPS has led me to believe that upon submitting this or that document ( s ) my application is at that time COMPLETE only to find out later on that WAS NOT AT ALL THE CASE. So the fact is that my application has been COMPLETE now on several occassions according to THEIR OWN REQUESTS but the time passes, nothing gets reviewed and then when I CALL BACK to confirm all is on track they hit me with several " missing '' documents that they could have requested ALL ALONG - BUT CHOSE NOT TO REQUEST. In this case here are some examples : 1 ) Clarification that my brother does not live in the property. THIS WAS ALREADY CLARIFIED 5 MONTHS AGO!! I asked my brother to move into the property to PROTECT it as the last time they put my house up for sale it was overan with predatory buyers who broke the gate, the water heater ( creating serious safety issues ), broke a window on a door to the flat to get into the flat, broke into one of the store rooms and more. By putting my brother in there he was able to protect the property from these sorts of damages. Just as soon as the sale dates were cancelled he moved out. Once again - THIS WAS A LONG TIME AGO!!! 2. Clarification on XXXX XXXX XXXX XXXX XXXX, Ca. XXXX. SPS has known since XXXX 2015 that I do n't own that property nor do I have any loans on it. So if theyneeded to know this AGAIN - why now?? Why did n't they mention in any single one of the dozens of conversations and letter exchanges we 've had since XXXX when it was already clarified 3. Page XXXX of a lease. This too was ALREADY provided and CONFIRMED recieved. Moreover I explicitly asked the SPS representative before sending it " do you only want page XXXX or do you want page XXXX ALONG WITH the rest of the lease AGAIN? '' And she answered " we already have the rest of the lease so all that we need is page XXXX. '' So that 's exactly what I provided. Once again - why now are they requesting it differently?? They could have made that request in any one of the numerous phone conversations I 've had with them or more specifically in writing via mail ( Which they have not ). So to be clear I have been working on this loan modification with a purported lender for months now and yet we know that it 's quite possible they do n't even have a legal ownership interest ( both the assignments and substitution of trustee - top to bottom - are completely fraudulent and signed by imposters holding no legal, proper agency relationships ). I am doing it because I have no choice - as an enormous part of my retirement depends on saving it. And to be clear - even if I were to get a loan modification - who would it be with?? As it 's definitely clear that this loan NEVER made it into its trust by the legally binding cut off date it means that any one of several entities could come forward some day and claim an interest. In other words - I AM TAKING A SERIOUS RISK BY EVEN ATTEMPTING TO GET THIS LOAN MODIFICATION, FOR THAT REASON. Yet I 'm working on this diligently and in faith and this PATTERN is clear that SPS is not being up front in terms of the documents it needs & now I 'm being damaged by that. huh??

Complaint: Was told I could be helped to refinance my property. I was never ever late but facing overwhelming debt and taxes owed by ex spouse and and SPS services left me facing worse situation. They told me to switch my bank loan to them which was perfect credit and then promised to help me.. SPS told me I had to miss a payment so I would go into foreclosure so they could continue to help me..but the reason I even applied for help was to avoid foreclosure!! I was trying to avoid foreclosure as they promised they could lower my payments. I thought it was awful they told me to miss a payment.. Even though I had never been late.. 2years of XXXX with them caused me to lose a rental property I had since 2002 for retirement income as SPS as I am close to XXXX ... I needed the property income. They made the situation worse, my renter moved out and nobody wanted to move into a property that now was possibly going into foreclosure!! and so then to try to save my credit I desperately had to try to sell the property and even when I found a CASH buyer to buy full price they waited 4 months and finally let me sell after pleading with them to please take the offer. They did but only after charging me tbousNds and thousands of dollars to them! I never got ANY help just pure XXXX!!!! The address listed is the property address that was sold. I never got the help they offered only a lost rental for income and had to pay them thousands at the end!

Complaint: To Whom It May Concern, I have been fighting for my home for the better part of four years now. Much to my frustration, I have n't gotten very fair in my fight. The foreclosing trustee on my property went out of business and the foreclosing process was stalled for nearly a year and a half. Select Portfolio Servicing , Inc., hereinafter referred to as SPS, did not respond to my numerous requests for information and completely left me in the dark as to what was going on. Out of the blue last month, I received a substitution of trustee that informed me that the trustee handling the foreclosure on my home was being substituted for XXXX XXXX XXXX. In addition, a new Notice of Sale was recorded on my property, giving me a sale date of XXXX XXXX, 2016. This highly infuriated me. I do n't understand how SPS can take this action when they do not have the authority or right to initiate or proceed with a foreclosure against my home. After years of being frustrated from not receiving the information I requested and upon learning that due to nondisclosure of material information, my rescission rights were still available to me due to equitable tolling, I mailed a Notice to Rescind to SPS canceling my Deed of Trust and Promissory Note on XXXX XXXX, 2016. Pursuant to the Federal Truth in Lending Act, hereinafter referred to as TILA, SPS had twenty days to take all necessary steps to void my Deed of Trust or in the alternative file a declaratory lawsuit against me challenging the rescission. SPS took no action. SPS in clearly in violation of the mandatory laws are requirements under TILA. They are prohibited in proceeding with a foreclosure on a Deed of Trust that is void by operation of law. SPS received my Notice to Rescind on XXXX XXXX, 2016. More than 20 days have expired and SPS took no action whatsoever. As confirmed by a unanimous Supreme Court decision, the only thing I needed to make my rescission effective was to provide a written notice to my lender to exercise my right to rescind. The statute makes no distinction between the right to rescind in 3 days or extended as neither case nor statute give courts equitable discretion to alter TILA 's substantive provisions. Operation of law is a way in which someone acquires certain rights automatically under the law without taking individual actions or being the subject of a court order. It is held immune from courts ' equitable modification authority. Under the law, it is not only wrongful but illegal for SPS to proceed with a foreclosure on my home on XXXX XXXX, 2016. Under TILA, Lender must comply within twenty ( 20 ) days - return canceled note, satisfy mortgage, and return money to borrower or in the alternative, lenders MUST file a lawsuit challenging the rescission within twenty ( 20 ) days or their defenses are forever waived. Any other interpretation would make the rescission contingent, which is opposite of what TILA and the U.S. Supreme Court say. I believe it was necessary for me to file this complaint because it appears SPS believes it can violate these laws without any consequences of their actions. I am seeking the assistance of the Consumer Financial Bureau to assist me in taking action against SPS for violating federal law. Sincerely, XXXX XXXX

Complaint: My mortgage started at {$150000.00} with XXXX, I put down XXXX % and thought I had a decent mortgage. After XXXX went out of business, it was sold to an investor. The servicer became XXXX XXXX XXXX, I attempted a modification while being serviced by XXXX XXXX XXXX and my mortgage went to {$180000.00}, however my interest rate was 10 % with a balloon payment. My mortgage was transferred to Select Portfolio, where I was given a remodification, which brough my mortgage up to {$180000.00}. My new interest is 9 %, but after calculation, over 10 years, I have paid over {$200000.00}, my new mortgae after modification, has no pay down, I am patying interest to infinity with a baloon payment of {$180000.00} + that can come due at any time. I have tried to apply for another mortgage but because this is not FHA, I have had no success. I would like to stay in this home and have done everything I could to pay my mortgage, but this is a worst case of predatory lending, and I see no end in sight. No one can tell me what type of mortgage this is, and my questions go unanswered. I just want a regular mortgage with a moderate interest rate and a payoff date. Please help, Please
