Complaint: My wife and I are attempting to go through a Short Sale w ith Select Portfolio Servicing , In c. and XXXX XXXX XXXX , XXXX since XXXX of XXXX . We are being represented by XXXX XXXX XXXX to help us navigate this process. Unfortunatel y, SPS , Inc. has b een extremely difficult to work with and we fear that our mortgage companies have reached an impasse concerning compensation towards XXXX . We are trying our hardest to comply, but we are now desperate for outside assistance to look into our situation. Since XXXX , SPS has repeatedly denied our application for a Short Sale by stating that various fees either need to be added or removed from t he HUD-1 disclosure, and they have also stated that the asking price for the home is too low, even though multiple BPOs hav e come back with the exact value that was listed. We have repeatedly shown good faith and patience by trying to adhere to SPSs requests, but to no avail. They consistently come back with a different request nearly every 1-2 weeks. The latest request was to reduce the amount that the second mortgage ( XXXX ) would receive. In the HUD-1 it listed that XXXX would receive {$12000.00} in compensation for the short sale. This has been in the paperwork since the beginning and SLS has agreed to all versions of the Short Sale application submitted until the most recent on approximately XXXX when SPS required that the amount be reduced from {$12000.00} to {$6000.00}. We find this and other requests to be unreasonable because we feel that SPS should have notified us of all issues with the application for assistance all at one time rather than repeatedly requesting the terms of the HUD-1 be c hanged for differing reasons at every turn. Due to the reasons listed above, we believe that SPS is purposely trying to find reasons to deny the Short Sale, thus they are not following the governments guidelines for lenders to provide foreclosure alternatives to homeowners. Please help us to rectify this situation so that both mortgage companies can come to a viable solution that will allow us to sell the home.

Complaint: Im writing to express that my foreclosure need to be postponed and the assignment filed in XXXX XXXX , Georgia need to be investigated for fraud. The servic er, Select Portfolio Servicing has been informed several occasions prior to XXXX XXXX , XXXX that the loan was transferred illegally through the assignment. A Qualified Written Request ( QWR ) and Proof of Claim surrounding the mortgage loan was sent to the servicer and they are claiming that that they never received my documents. Thats the reason why Im sending it through the CFPB. The servicer refused my payment after I became 30 days late. They are trying to take my house and not acting in good faith. I want to keep my home and requesting a postponement and hopefully obtain a forbearance.

Complaint: To whom it may concern : In XXXX 2016 I was engaged in trying to get a loan modification with Select Portfolio Servicing a nd they denied me and gave me the run around. They denied and would n't approve me for a loan modification. I .hired a real estate agent and they started to market the house for me so that I would n't lose it to foreclosure. We placed it on the market with a real estate agent so that I would n't lose the equity to foreclosure. I currently have a bonefide offer on the property, with proof of funds from a qualified buyer. I have included with this, proof of funds, settlement statements, real estate purchase contract with addendum 's. Every time we have called and tried to get a postponement and sell the house they tell us they wo n't postpone the trustee sale. I 'm paying the loan off in full and they are not allowing me to sell the property and get my equity. I feel they have been very deceitful, dishonest, and misleading me for the past 6 months. Please help me postpone the trustee sale so that I can sell the house and pay off all lien holders in full.

Complaint: SPS Mortgage servicing is inaccurately reporting payment information to the credit bureau. No payments prior to XXXX XXXX should be reported for this account. The account was transferred from XXXX XXXX in XXXX of XXXX . All payments prior to XXXX of XXXX were made to XXXX XXXX and are being reported by XXXX causing duplicate payment history and the credit bureaus double counting late payments when calculating the credit score ca using the score to be lower by XXXX basis points. I have contacted SPS regarding this issue and filed disputes with the credit bureau and the information is not corrected. Original complaint XXXX was filed last year. SPS corrected my credit reporting for all XXXX credit bureaus and XXXX for my husband. When I contacted SPS to indicate XXXX of the XXXX credit bureaus were not fixed for my husband, they then reverted my husband 's XXXX report back to the incorrect reporting and then started reporting his account under my son 's credit reporting ( so n is a XXXX ). W hen I contacted them about this, they fixed the incorrect reporting on my son but never the incorrect reporting for my husband. I have been contacting them almost every month to get this resolved but they keep telling me either it is being reported ok or they have to place the account back in a dispute status to fix it which lowers o ur credit score XXXX to XXXX basis points. Each time they say it will take between 30 to 90 days to fix it. Should this not have been fixed within 90 days of the original dispute filed back in XXXX of XXXX . The inaccurate reporting is causing my husband 's credit score to be lower by XXXX basis points. We know this because when XXXX was temporarily fixed the score went up by that amount. He wants to purchase a new car but wants his credit to be accurately reflected before it is pulled. I have b een trying to get SPS t o fix the inaccurate reporting for almost nine months. They have promised to call back and never do. They say they have to place the account in a dispute status which I do not understand when this information was already disputed, they sent me a letter stating it would be fixed, and they partially fixed it. I also do not understand how XXXX and XXXX can low er my credit score by XXXX basis points as soon as the account is put into a 'dispute ' status. XXXX lowers by XXXX basis points. If I am disputing inaccruate information on my credit report, why am I being penalized. And when the account is put into dispute it is put into dispute for both my husband and myself which affects both our individual credit scores.

Select Portfolio Servicing , Inc. has an absolutely terrible reputation, as can be easily seen with a little investigation online. I am very concerned that they will have errors tha t will cause me to have bogus fees added, " forget '' to pay my taxes from escrow, fail to send my tax documentation, and otherwise make trouble. I am complaining in advance so you know who I am referring to should I have trouble with this firm, which I expect will happen.

XXXX XXXX XXXX This lead to my pro se case due to I could not find an attorney that would help me. The pro se case lead to me losing in an XXXX and losing my ability to protect my home from criminals trying to steal my home. XXXX ignoring the letter of FDCPA and the federal judge ignoring the same letter and all my pleas of help. Blocking my due process. I continued to send more FDCPA letters, RESPA QWR 's Homeowners Rights letters. Cease and Desist letters, TILA notices that were ignored. XXXX XXXX and SPS sent XXXX to file judicial foreclosure in a non judicial state to skirt around my letters. Now I am in the Supreme court of Washington asking for review by my petition through an attorney. Blocked from most of my case being claimed and only being allowed to state no standing due to no evidence at the start of the case. No authentic note undated one copy no endorsement a second copy undated with endorsement. This has caused us extreme cost and extreme stress that I am surprised has not killed me. The judges ignor hearsay evidence in the lower courts and accept false affidavits and false notes with false assignments taking away our due process to protect our home. The courts have become collection agencies for crooks with no proof of being the lender or having authority to collect the alleged debt after pulling a criminal act of modification fraud on us. We are in danger of losing our home of ov er thirty five ye ars to crooked criminals. By affidavits by crooked lying lawyers representing these crooks. Complaint: I have been attempting to do a modification with SPS.. I have a HUD counselor I am working with, and this organization does not work with the counselor. I have been told my application is incomplete, but the form on their website XXXX XXXX XXXX has only XXXX pages. I am told my form should be XXXX pages. I received a letter with the form and it had only XXXX pages. M y counselor has requested the form be faxed three times, and they refuse to send the correct form. I am current on my mortgage, but my wife can no longer work, and we have less income.. It will be difficult for me to pay my mortgage going forward. I have asked about the HARP, an d SPS will not entertain a discussion about it. This servicer is not doing their due diligence on my request for assistance. Complaint: I have b een discharged of my debt obligation to SPS Portfolio Servicing for ov er 2 years now. I have legally removed my name from the property deed and title, and mailed proof of such to the bank and conveniently one department does n't communicate with the other and claims such documentation does not exist ... and its public record. The only person on the deed and title is my ex wife, but she was NEVER AND NOT on the mortgage loan in any way what so ever nor is she financially obligated to the mortgage company at all. The bank obviously has a lien against the property until sold. SPS sends me monthly mortgage payment coupons and statements as if I were a current customer, with updates as to what 's owed, back taxes owed to them and how much to pay them, what the current escrow balance is and how much I need to pay to make it current, also sends me statements of what I owe them as far as home owners insurance they purchased in my name, and the balance they claim as I the " debtor '' owes them ... and it goes on and on ... HOW DOES THAT WORK ... WHY DOES THE BANK CALL ME THE " DEBTOR ''? When I was by law ... been released of the debt and the title of " DEBTOR '' I 'm being HARRASSED relentlessly, I WANT TO SUE and be compensated for every piece of correspondence they sent me, SENDING ME INTO XXXX , AGRAVATION, sleepless nights wondering if or what they might try ... mess with my wages, my job, I do n't know how far they will go??!!! Once I lose my job, or wages ... it would be ages for me to recover, even if they were at fault in doing so to me ... They wont stop..I told them many times. The last statement they sent me shows them claiming a balance of almost a XXXX dollars, OMG ... from an original balance of {$460000.00}!!! Now, I am discovering th at SPS, Inc. is a debt collector and just services the mortgage. I have medical issues and loss of income and can not receive any help as SPS, Inc. is not a bank, but a debt collector. I submitted all documentatio n ( XXXX XXXX ) and was just told via phone follow-up on Friday, XXXX XXXX that my request for a short pay was denied. My husband and I do not agree with the total amount due of {$250000.00} when my loan originated on XXXX XXXX for {$200000.00}. Consumers, like myself, need protection. This is my home, this is my credit. I am not behind and have made payments consistently ( no arrear s ). I need assistance to get my loan corrected with the correct amount owed or help due to my medical/financial hardship. Complaint: Ever since my mortgage was transferred t o SPS Servicing, I have had one issue after the next due to the lack of competence of their employees and well as their flat out misrepresentations. As a result, I can not trust any statements that come from them orally or in written communications. These are the issues that I have had to deal with : ( 1 ) I received a notice from my home owner 's insurance that they were cancelling my policy because SPS had not paid them despite the fact that I paid insurance in my monthly escrow ( 2 ) After being encouraged to apply for a loan modification, I was told my a representative over the phone that my payment was a certain amount. I paid my first trial payment. Then, a couple of weeks later, I was told by a separate agent that my payment was {$300.00} higher than the original amount I was told. No explanation or apology was given for this mistake. ( 3 ) After I finished the trial modification and received my final paperwork with my permanent loan amount, I called my relationship manager ( the one employee who worked on my loan modification and was most knowledgeable about the loan ) and asked if the final payment amount on my paperwork included principal and interest, taxes and insurance, and PMI. She assured me that it included all of the things. I made my first permanent payment following the modification. A couple of weeks later, I get a statement notifying me that my payments were increasing by {$270.00}. It took MONTHS for me to get a clear explanation for this only to be told that it was increased because the PMI was not included in the final paperwork given to me. Note, my relationship manager explicitly told me that it was incldued. I am left to take their word that they mistakenly left the PMI out the first time without any documentation to reflect such. Again, I received no apology for this situation. ( 4 ) Late last year, I made payments that should have been attributed to my entire mortgage ( P & I and escrow ). For some inexplicable reason, SPS reversed two payments without my permission or authorization and applied them only to P & I, which partially caused shortage of my escrow. They have sent written documentation telling me that these reversals were done at my request while their agents have confirmed over the phone that there are no notes in my account to indicate that I ever made any such request. Just today, I virtually demanded an apology from one of their employees for this lie and she refused to give me. She claims that they will reverse the payments back to what they were originally designated for. I have zero confidence that they will be able to do this without screwing something else up and further disadvantaging me. Mind you, I have been forced to make extra escrow payments in my monthly mortgage because of their XXXX XXXX . ( 5 ) Because of all these issues, on my account, I demanded a payment history so I can see exactly where my payments went. I was shocked to find that during the three months that I was going through trial " modification '' that SPS NEVER actually modified my loan. They took the same P & I that I paid prior to modification. The only thing they reduced was the money going into my escrow account. Again, this was done without my approval or consent. For three months, my e scrow was being shorted on a scam alleged modification. This is also a huge reason why I am currently making additional escrow payments. SPS wo n't admit this and represented to me that my escrow was short because of the reversals that I request ed ( wh ich as noted above, was a lie ). Sample math shows that, even if I had approved those reversals, that someone else contributed to the significant shortage that I am being forced to pay. I am demanded th at SPS ex plain why they shorted my escrow instead of modifying my loan. I am also demanding that they right this wrong and compensate me for their lies and fraudulent behavior.

Complaint: After XXXX years and XXXX months, XXXX sold our 15 year, fixed-rate mortgage to XXXX XXXX XXXX XXXX XXXX XXXX effective XXXX XXXX XXXX . XXXX sent us a NOTICE OF SERVICING TRANSFER dated XXXX / XXXX / XXXX and we received it the following week. XXXX sent a SERVICING TRANSFER NOTICE dated XXXX XXXX XXXX that we received on or about XXXX XXXX . Both the XXXX letter and the XXXX letter indicated that ACH payment arrangements would continue without interrruption. Our payment arrangement with XXXX from the time that the loan was originated until the sale date was half payments deducted by XXXX withdrawal from our checking account on a biweekly basis. After being unable to register our account on the XXXX online system between XXXX XXXX and XXXX XXXX XXXX , I called XXXX Customer Service on the afternoon of XXXX XXXX The recorded message said that the account information for newly acquired mortgages would not be availble on the online system for XXXX days but that payments must still be made in the interim as their XXXX letter also said. However, XXXX did not provide any information about the amount of the payment due or the due date. The customer service agent was able to look up our account in a separate system for newly acquired mortgages. He told me that this transition would be " smooth '' and specifically that my payment arrangements would continue as with XXXX . He specifically told me that the first ACH transaction that XXXX would have processed on XXXX XXXX , would be delayed until approximately XXXX XXXX and that regular biweekly ACH withdrawals would resume on XXXX XXXX . He told me that no action was required on my part to authorize this. The agent also told me that we would receive a phone call about XXXX XXXX orienting us to XXXX and its customer service, but did say that if we had n't heard from them by about XXXX XXXX , that I should call back. By XXXX XXXX , no ACH withdrawal had taken place and no phone call had been received. On that date we received a letter from XXXX informing us that XXXX did not offer the payment plan that we had with XXXX and that we would have to authorize a new ACH withdrawal. We were able to register our account onine on XXXX XXXX and authorize a new ACH transaction, the only option was a single monthly transaction, contrary to what I was told directly by the agent on the phone on XXXX XXXX . I believe that XXXX has deliberately provided false and misleading information and is acting in bad faith. I advise anyone whose mortgage was recently acquired by XXXX to document all contacts and retain all written correspondence. Consider hiring an attorney if you think that is warranted.
