Complaint: We originally listed our house as a short sale and sent all documents on XXXX XXXX , XXXX , to XXXX XXXX who was the servicer for our loan. The short sale was approved by XXXX XXXX , with the approval letter XXXX / XXXX / XXXX , with a close of escrow date of XXXX Our Broker was advised that the loan servicing was changing XXXX / XXXX / XXXX , to Select Portfolio Servicing. Since th e Buyer was gett ing a loan, the Buyer could not close escrow in 4 days. Our Broker then immediately sent all documents to Select Portfolio Servicing on XXXX / XXXX / XXXX , via fax supplied b y SPS ( Select Portfolio S ervicing ). The Broker followe d up on XXXX / XXXX / XXXX , to assure all short sale documents were received, however, SPS stated they had given the Broker the wrong fax number and supplied a new fax for short sale. SPS also stated that they have used previous servicers short sale approval letters to expedite a written approval from SPS to the listing Bro ker. Ag ain, our Broker sent the complete short sale package to SPS , along with a copy of the XXXX XXXX short sale approval letter. On XXXX / XXXX / XXXX , our Broker was told by SPS tha t a conditional approval was issued based on a Broker Price Opinion v aluation that was ordered and should be completed shortly. on XXXX / XXXX / XXXX , our Broker was told a written short sale approval letter would be issued no later than XXXX / XXXX / XXXX . Our Broker has called SPS every 2 days since XXXX / XXXX / XXXX , with no approval, and now SPS states it could be another 30 days based on " investor guidelines. '' A representative from SPS stated she did n't see a HUD closing statement this past Monday XXXX which was sent in with all documents prior ), and suggested the Broker forward another copy " just in case. '' Today, XXXX / XXXX / XXXX , the Broker foll owed up again and was told by the Relationship Manager on the file that since a new document ( HUD ) was logged as received today, " investor guidelines '' gives SPS another 30 days before they have to issue a written short sale approval letter to sell and transfer our property. The Broker is in fear of losing the Buyer now, and we as the Borrower/Sellers are l eft with further months of default/negative reporting to our credit record. Our Broker has lo gged dates, names, and notes of every conversation with SPS from XXXX XXXX , XXXX , to present. SPS rep resentatives not familiar with the file have continued to mis-read notes and request documents that were all sent previously numerous times. I highly suggest and request that the CFPB audit both procedures and business practices of SPS, at least with regard to short sale processing. Thank you!

Complaint: Date : Tuesday, XXXX XXXX XXXX Attention : Consumer Financial Protection Bureau Re : XXXX and XXXX XXXX Principle reduction Request Property : XXXX XXXX XXXX XXXX XXXX NJ XXXX Mortgage Loan : XXXX Select Portfolio Servicing I am requesting assistance with Select Portfolio and/or XXXX XXXX XXXX For years I have been working with them on a modification/principal reduction and it has come to my attention recently that they are attaching those fees to the back end of my mortgage and calling it a deferred principal reduction which has put my property severely under water. Per their most recent statement I owe {$610000.00} and the property values in the area are only {$310000.00}, causing me to pay almost double for my home. I have been diligent in my communications in providing Select Portfolio and/or XXXX XXXX XXXX with anything they may need to execute these requests, and they have not responded in the same way. Please see the steps I have taken over the last XXXX years and you will find that my servicer did not provide me with options to help me successfully keep my home after the financial crisis of XXXX and instead they provided me with broken communication and doubled my mortgage in the end. Please help me to save my home with my requested principal reduction. These are all of steps we have taken to get into a modification over the past XXXX years. When we originally applied for a modification it was granted from XXXX - XX/XXXX for 3 months. To get into the modification was easy to get out took over 2 years of paper shuffling with XXXX XXXX then XXXX XXXX XXXX . We sent XXXX of letters, documentation over and over again. Then we would follow up with a call to be denied time after time. Even when I confirmed they received all the paper work a week later we would be told we needed to resend paperwork again. I went so far to visit XXXX XXXX XXXX branch offices to turned in paperwork because XXXX XXXX office set up arraignment with XXXX XXXX XXXX president office. To still be told that the person we gave the paper work to no longer work for the company but to just refax it again. We have written the President of the United States for support and advocacy about the same issue with no success. I have faithfully called for over 6 years with constant stories about why we were not in able to receive a principle reduction modification. I contacted several attorney regarding they matter to help get paperwork into Mortgage Company to be told they were not successful. XXXX XXXX office contacted the XXXX XXXX XXXX , submitted our paperwork but was still told they did not recieve the paperwork. XXXX XXXX had a meeting at the XXXX center in XXXX to meet with representative from XXXX XXXX XXXX . We showed up for every meeting gave them our paperwork. Still to be told we they did not have the paperwork or we were not eligible because of debt ratio. Was advised by XXXX XXXX XXXX to work on debt ration. Se we took classes with their approved agency XXXX XXXX , cut our debt and increase income. Still not successful. Contacted a current class action lawsuit to be told were not eligible under the stipulation of the case. Our mortgage was XXXX in XXXX XXXX we requested a XXXX month adjustment because my husband overtime was effected to then be provided with a modification that was higher than our original mortgage monthly payment because it took so long from them to complete paper work. The unfair business practices have cost us dramatically our home today is XXXX we are upside down. The failure of the mortgage company to respond in a timely manner, notify us of our rights and loose hundreds of documents is unethical. We hope you can and will help us in this matter. Recently, I was informed of even more dishearten facts of unfair business practices by my mortgage company. On XXXX XXXX XXXX I called and spoke with XXXX and requested we review my current modification because I notice my mortgage amount on my credit report shifted from XXXX to XXXX on XXXX . She explained that I had received a deferred principle reduction. She stated that in XXXX I received a principle reduction on my mortgage but failed to make any payments. I asked XXXX to fax me the paper work and provided her with my fax number. Please note I was never aware that I had gotten a principle reduction in XXXX . XXXX stated she could see my husband and my signatures at the bottom of the form. She went on to explain the amounts was On XXXX XXXX I then contacted XXXX XXXX through XXXX and spoke to XXXX XXXX I asked him to call back with me to the mortgage company as a support agency to ask question because I was never aware that I had gotten a principle reduction. We placed a three-way call after verification XXXX began to ask question. Once XXXX began to inquire about the principle reduction the phone call was disconnected. On X/XX/XX ) I called back spoke to another lady but was disconnected XXXX more times that day. On X/XX/XX I received XXXX Modification paperwork via faxed but never received XXXX modification that XXXX spoke about. On X/XX/XX I was told my request was closed because there was no modification in XXXX the response was modification not found. On XXXX / XXXX / XXXX I called back and spoke with XXXX she stated that she did not see any modification in the system for XXXX but saw notes from XXXX saying she would fax me the XXXX modification information and details of our conversation. XXXX said however she did see a letter saying I was eligible for a modification in XXXX . I asked her to fax a copy ( I never received that paperwork ). XXXX said she would email XXXX ask her to call me and resend the papers she found in the system for XXXX principle reduction modification papers work. On X/X/XX I called back for an update on my paper work and was informed that they were waiting for an upload into the system from XXXX XXXX XXXX . I then faxed a written request for my entire file to be sent from Country Wide, XXXX XXXX XXXX and Select Portfolio on XXXX XXXX XXXX because of the constant delays. Then requested to speak with XXXX because she was able to see the documents but no one else was able to see it in the system. X/X/XX I called and spoke to XXXX told him I never got a call from XXXX . He stated he would email her again. I also confirmed they had my written request for all my paperwork. XXXX stated copy of XXXX modification was sent and then they case was closed. I asked him to not close my case and to send me all of my paperwork . X/XX/XX I called again and spoke to XXXX reviewed all my notes and asked again why was n't XXXX modification sent. I confirmed they had the correct fax number. XXXX stated she saw all the previous note but she was unable to find any documentation dating back to XXXX through XXXX . She then open up a task but I should plan to get a response XXXX XXXX but no sooner. At this point, I know I need support from an agency that regulates mortgage companies because all other effort have failed. XXXX XXXX provided me with your contact information to file a complaint against Select Portolio. I need them to find all my documentation regarding any/ and all modification of principle reduction. If would also assist me in understanding what happen over these past XXXX years. Are we eligible for a principle reduction but instead was enrolled into a deferred principle reduction plan. This problem on my home started back in XXXX , when XXXX XXXX XXXX illegally assumed our note from XXXX XXXX to the XXXX XXXX XXXX which was closed in XXXX . XXXX XXXX went into receivership XXXX XXXX , XXXX XXXX purchased all the assets at that time and our note was not assigned to the XXXX XXXX XXXX XXXX by XXXX XXXX , however the XXXX XXXX XXXX XXXX is claiming ownership with XXXX XXXX , XXXX , XXXX XXXX XXXX and Select Portfolio Servicing Subservicer. Complaint: They contacted me to help get me a modification to save my home to stop the foreclosure on my home. On X/XX/2017 I gave them money for {$1500.00}. The next payment was on XX/XX/2017 for the same amount then another payment were due me and my son we did not send that payment. Then this man call me fro m SPS Serviceing by the name of XXXX XXXX he stated to me that I was about to loose the modification. That was set fo r twenty yea rs at {$1300.00} A month so me and my son would not loose our home. He said that we must send in {$900.00} dollars. We call sps serviceing they never heard of XXXX XXXX XXXX I have his phone number XXXX XXXX a widows. My husband was a XXXX vet. Please help me get my money back thank you.

Complaint: I noticed the mortgage statements I receive from the alleged mortgage servicer, Select Portfolio Servicing, states on the bottom of the letter " This is an attempt to collect a deb. All information obtained will be used for that Purpose. I made payments with this servicer not knowing if they were a debt collector or mortgage servicer. On XXXX XXXX XXXX I sent a lett er to Select P ortfolio Services to verify who the v erify the allege creditor and asked for name, phone, and address. In response on XXXX XXXX XXXX , they have returned a letter stating tha t XXXX XXXX XXXX XXXX is referred as the " investor '', " creditor '', and/or " note holder '' of the account. They r efuse to give me contact information because its proprietary information. I do not recognize XXXX XXXX XXXX as a creditor. On XXXX XXXX XXXX , I have sent a letter to Select Portfolio Servicing Inc ( SPS ) t o validate and verify the debt. My first problem was identifying SPS. T he letters I receive from this company states they are a Mortgag e Service c ollecting for a loan but on the bottom of the letter it states it is an attempt to collect a debt. I tried to speak with a representative, a recording played stating this is a debt collector attempting to collect to collect a debt. When i spoke with the representative I never received a clear answer as to if they were a debt collector or mortgage servicer. I want to verify who was the original creditor and who is collecting on the debt. SPS claimed XXXX XXXX is creditor but XXXX XXXX is the noteholder/investor. They never provided name, address, or phone number of any of these alleged creditors. I personally calle d XXXX XXXX XXXX XXXX , t hey claim to have no information of this debt. I emailed XXXX XXXX regarding this debt. In response they stated that loan information I have given them was for XXXX XXXX and are not in business. I discovered a letter XXXX XXXX XXXX from XXXX , the original servicer, the release of deed to secure debt stating the debt is paid in full and release of lien. But I never received notice from the original creditor th at SPS or XXXX XXXX XXXX XXXX is going to collect any debt for them or on their behalf. There is no evidence that I owe any loan or debt to XXXX XXXX .

Complaint: XX/XX/XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ks, XXXX XXXX XXXX XXXX & XXXX select port foilio -XXXX can you help with unanswered question on my mortgage please? i live in XXXX kansas and i 'm in need of some quick answers and help with my mortgage. i am not sure who or where to turn to. i have sent out packets and i faxed documents and emailed people and phone calls and so much over the years. well i was reviewing mortgage sites to see if any problems have once again become a problem in the mortgage world cause it seems as if mine has never stopped. i am on XXXX and i purchased my home inXX/XX/XXXX and at closing there were 2 forms of documents due to at the last minute the XXXX who i was originally signing my loan documents agreed to lower my rates so a possibility of some loan mixes up when shipping my final documents to the company actually the faxed them at XXXX office in XXXX due to last minute change. so anyway a few days later my loan was sold to XXXX and when i had just mailed my first payment to XXXX and received noticed that my loan had been transferred and in doing so it had the wrong interest rate and monthly payment. i kept explaining that documents could of possible got mixed up and in do so my loan was then transferred to XXXX XXXX and XXXX. where this took me 2 years to get them to put me into another loan term as well as stop 2 foreclosure procedures that were basically voided before they started and notice was sent to the attorneys so i had to proof to the judge and the attorney that XXXX and XXXX redid my loan with fixed interest in order to correct the interest rate errors after 2 to 3 years of dispute however it was n't free and clear to me it created an amount of about 4000 or more to be included as if i had defaulted on the loan or was in the rear of payments in their error. since i was on XXXX and had fought to be a home homeowner and not stupid just because i was on XXXX i took the offer of XXXX and XXXX to make my loan current so i could proof i did have an income on XXXX and just like i fight for my home i fought for XXXX rights. any way everything was fine until about XX/XX/XXXX and make affordable became able i had my loan reviewed again for my income. then inXX/XX/XXXX my mom passed and my sister who also was on XXXX we made XXXX person together, sadly moved out and in XXXX XXXX had reset my loan supposedly according to my income, and then in the end of XX/XX/XXXXmy boyfriend had gotten XXXX XXXX and went thru XXXX and XXXX XXXX as well, and unfortunately he is now going through XXXX XXXX and XXXX and preparing for XXXX and then XX/XX/XXXX of this year my XXXX passed., so as you see i have allot to keep up with and several other items have occurred on top of those major ones. that kinda brings you up to date on what i am inquiring about today is i every since i purchased my home it appears as if it 's been one thing after another and i have made previous complaints and or inquiries to the servicers as well as consumer protection however it appears as if i am getting no settlement of any kind was i included and no changes of my mortgage. i do n't know at this point where to turn or what to do in order to not lose my home and to get my credit back to where it should be. so that is why i am in research today to see if anyone in your office can explain or suggest answers or help of where or what to do if anything. in short i have 2 loans sinceXX/XX/XXXX with XX/XX/XXXX and XX/XX/XXXX 1. my 2nd loan was written off i beleive inXX/XX/XXXX and the lien was released however they say i still owe the loan when i refinance.never understood why it was written off because i had just got it modified and i was n't behind on it but when i went to make payment they could n't find the loan and a few days later they said i ca n't pay anything on it cause it was written off. then i read a document from attorneys that i thought stated that was like part of the settlement and help for home owners for the wrong doing. and XXXX sent me back a letter months ago stating that is not so. and i sent that information to the treasury department and never heard anything back. so it is on my credit report as a bad debt i 'm not paying but they wrote it off and released it. so why? when i was n't behind. <P/> 2. XXXX XXXX sold my loan to select portfolio inXX/XX/XXXX who i have been in dispute with every since, due to them not making my payments count. and i am still in dispute with them today. last week i got a right to cure which was the XX/XX/XXXX however since then i have sent them information such as they are not even listed on the XXXX inquiring about my mortgage.i have n't heard from them since. <P/> i received a phone call stated i was being sued but i do n't know from who or for what? so unsure if it is a debt collector casue XXXX wrote off and released my 2nd loan or select portfolio trying to take my home., cause my right to cure was the XX/XX/XXXXbut im not in default. anyway i keep fighting due to the fact that i am not in default with select portfolio i had missed over the 3 to 4 years 3 payments however i made double payments and i was suppose to pay XXXX a month and i paid double that at least twice and every since XX/XX/XXXX i have paid at least {$700.00} a month so that 's 3 years of overpaying that they said went towards my payment. anyway i made up the 3 payments so therefor i should not be in default however sps states i have the right to cure and that im 9 payments behind and there is no way shape or form i have every on any loan been 9 payments behind, i am on a fixed rate yet they charge me a daily interest. and they wont record my payments to make them count and even though i have proven time and time again that i made my payments and make them through XXXX XXXX every since they cost me {$470.00} insufficiency fees on a checking account of over 30 years that i shutdown and created me to pay extra fee to make my monthly payment as well as have proof my payments were made, which apparently they chose to ignore and after 6 months of payments being made they backed them out and input them with a different payment amount then what was required. so i 've sent prove of my payments to the credit bureau as well and received a letter back stating that sps has to be the one to record my payments have been made and sps states that the agency are not recording them correctly. so once again nothing is done, i make my payments and the credit agencies nor the companies are making them count, which i had believed due to me being on disability they are trying to force me into foreclosure. <P/> then the last few days i found information about XX/XX/XXXX and XXXX and the XXXX who is strictly an electronic document feeder however they supposedly have been enforcing foreclosures, sp this is where you can help me. the information i read states fbi investigation on XXXX and XXXX fka XXXX for bank fraud and it was datedXX/XX/XXXX of this year. my point being everything i read on this investigation is everything i have been disputing sinceXX/XX/XXXX and have not got to be part of any civil suit never received any documents to do so or letters or anything that could inform that i was part of anything that would give back to me for all the fraudulent activities and cost it has cost me over the years. and then out of the blue i run across this fbi investigation of XXXX XXXX, and the XXXX site advising to check my mortgage to make sure i was possibly not included in the company fraud which i believe i am. for years i 've inquired about my mortgage and who owed it so i could refinance with that company and i was told XXXX bank and for years they state they do n't find anything on my loan so then i look up the XXXX and it states both of my loans are inactive and that XXXX and XXXX fka XXXX as my servicer which when clicking on link it brings up ads for XXXX and XXXX investors, and that it held by XXXX bank as the trustee. <P/> so i email sps XXXX and XXXX XXXX and inquire about sps no where on the XXXX and that is who i make my payments to and set me the right to cure and that XXXX bank is trustee. this is all part of what the fbi investigated and cludes is fraud. <P/> my point being that XXXX and sps being the ones that seem to keep me in limbo to where my credit score is bad and my payments are n't being recorded correctly and most important have me in default that i should not be in, as well as when XXXX transferred my loan sps added in the forbearance a couple of times increasing my loan balance. so allot is wrong not to mention that i have documents as well as statements that have a different monthly mortgage payment such as contract in XX/XX/XXXXif it is a valid loan and valid transfer of my loan it states XXXX, other documents states XXXX and statements state XXXX until changed due to escrow in XX/XX/XXXX, which sps backed out 3 months and input payment to start inXX/XX/XXXX as currently should pay XXXX but i pay at least XXXX every month. <P/> so i 'm needing to know what i should do to get my credit corrected and to make my payments count. i should n't be forced into a modification just cause they do n't keep records correctly, when i 've already paid, nor should they be able to fraudulently force me into foreclosure, because they written off my loan and released it on my 2nd, as well i made up the 3 payments i was behind and they keep charging me property valuation when they know i do whatever to keep my home and fight like XXXX on they deceptive acts. i 've been here XX/XX/XXXXand i 'm not going anywhere yet they keep my credit bad and my payments as if i 've not made them so that i ca n't get out from under them. they offered a modification of a balloon balance of $ XXXX and added 2 years and reduced payment down by XXXX. and i did n't take it cause for 1 i 'm not behind and for 2 my loan would be paid off 2 years with a XXXX balance when they are adding XXXX and 2 years who in their right mind would agree to that and increase the loan balance by that balloon amount is what that adds up to. and how is that helping me when i 'm not behind and it would let them increase my loan as if i was in default and put that amount in the rears when i 'm not behind and never have been behind no 9 payments that almost an entire year and i do n't have no car payment because my motor went out no expense there i have no credit cards so no expense there and i only have my dog and my house and every day living so where would my income be going if i did n't make house payments? that 's almost an entire year and that makes o sense at all other than the fraudulent acts of trying to take my home for more money such as they did by the fbi investigation of turning in claims to the insurance companies as a bad debt they lost out and their insurance company pays them. and how can XXXX bank be a trustee? i found this information below is as an example of what to do is my loan paid for because my XXXX shows inactive? XXXX XXXX XXXXstatment or from all three friadent actives and the settlements against XXXX XXXX XXXX XXXX XXXX and XXXX showing inactive and the right to cure letters? <P/> am i paying the correct company my payments? who does own my loan? if no one owns my loan then i have no loan or do i? is the write off and the the not applying my payment to count all part of pushing me into a foreclosure and or bahow do i get them to make my payments and their records correct, with correct balance duje, correct monthly payment amount and that i 'm not in default.? <P/> d credit that i should n't have? exactly what does that mean on the XXXX account of inactive and servicer XXXX and XXXX fka XXXX and XXXX XXXX as the trustee is it fraudulently, do i have a loan or not who owns my note and i 'm payin the right company and if i am how do i make them accountable for my correct payments and balance due and all the daily fees and or advances that should not been applied? how do i know if i have homeowners insurance and why do i have a tax revenue out on public records how would i owe irs and why? i am on XXXX so i do n't have to file taxes and due to all my past badness of bad luck in the last few years i have n't had time to even file for my homestead. and according to XXXX county my taxes were n't paid in XX/XX/XXXXand should have been as well s insurance they keep paying late and it keeps increasing. so is there anyone who can help me get my loan correct or discharged? is there anyone who listens and cares about what i need answered and help with before i have a sheriff knock at my door and if they do come then what, i should no way shape or form lose my home over these companies fraudulent and deceptive acts, so who or what do i do? i know they attorney general office nor the consumer protection agency are not suppose to take on 1 on 1 cases but it would appear that they have to start with someone somewhere and these dispute of mine has been nothing but a circle of one thing after another and no resolution so where do i turn and who has the power to stop this circle and get all the wrongness given back to me and these companies to stop [ all the fraud and deceptive acts that it appears all they do is get fined and start over again. maybe if they had to pay for the mortgage they did wrong then maybe they would n't be so out for themselves and be more for a business and consumers who they steal from instead of make a business from and for. i do n't know what to do with this right to cure when i 'm not behind and my credit should n't be bad. however i ca n't refinance and wont with wrong numbers or while i 'm in a dispute to make my payments count, in my loan as well in my credit. so i ask once again if my 2nd loan was due to settlement and since it was release due i still owe it and if yes then why did they write it off, i was n't behind at that time and know i suppose they can say i am. and on my 1st that XXXX transferred and sps backed out payments months later and then does n't make my payments count and keep adding daily interest on a fixed loan cuase they keep me in default that i 'm not, and my XXXX is n't showing sps as my servicer. can they foreclosure and since its inactive is all these deceptive acts them trying to foreclosure and can they foreclose? Complaint: On XXXX XXXX , XXXX , XXXX ceased servicing our loan and sold those rights t o Select Portfolio Servicing. We disputed XXXX 's handling of the servicing and the late fees they had alleged were due and this dispute was ignored. Then, during the transfer from XXXX to Select, Select did not pay our Real estate taxes on time in XXXX . XXXX XXXX School District verifie d the receipt of the late payment penalty check # XXXX in the amount of {$290.00} prepared on XXXX XXXX , XXXX from Select Portfolio ( see attached ). ( This tax payment should have been made by the discount date as wel l ). Th is failure to pay our real estate taxes timely and had we not caught Select 's error, our home was placed in jeopardy of being sold at sheriff sale by them. Upon learning of the error we filed verbal and written complaints with Select that were initially ignored, acknowledged on XXXX XXXX , XXXX & XXXX XXXX , XXXX and eventually dismissed. They forwarded to the real estate taxing authorities amounts that were greater than the discounted amount and the face value. They have not refunded those penalties and interest to us. They had us absorb and pay amounts that we were not legally required to pay. This higher payment disbursement amount and their failure to fix what had been done was the direct cause of financial hardship for us. Select Portfolio then increased our escrow account monthly payment to approximately {$660.00} an increase that was calculated incorrectly and caused an even greater financial hardship. These errors and increases resulted in threats to foreclose on our principal residence. After getting no reasonable response to the above issues, we prepared and submitted a request for mortgage assistance and that was not handled properly. We provided Select with all of the information they requested timely. We have been paying 5.125 % interest on our loan when we should have been approved for a reduction to below 4 %. This would have resulted in a savings of at least $ 200 /mos. Their use of foreign call centers has contributed to this company 's failures as well.

Complaint: We had a home mortgage through XXXX XXXX that allowed us to pay the loan off a head of time without penalty. We put additional money to the payment to have the loan paid off in XXXX instead of XXXX . At the end of XXXX XXXX sold our mortgage load to a company calle d Select Portfolio Servicing , Inc out of XXXX XXXX XXXX , Utah. In the letter XXXX said Nothing about our mortgage load will change. We sent our first payment t o SPS, Inc o n XXXX XXXX . A little while later we check and saw the the check had been cashed. They never sent us a statement on how the money was disbursed. After contacting SPS customer service, they sent us the breakdown. The total payment was being held in a thing called unapplied payments because our account was paid up to date until XXXX of XXXX . Upon talkin g to SPS as to w hy, they said they are reviewing it. All we want is the same procedure that XXXX was doing with are payments. Ta king out Principle, Interest, and the add itional principle that we send monthly. We set up online payments with this company and was told we did it properly. but on XXXX XXXX we tried to do our payment online and was told we were ineligible. Called SPS back the account is still under review. It just seems like we ca n't get a straight answer.

Complaint: In XX/XX/XXXX we got a Home Mortgage Equity LOAN, not equity line, originating with XXXX XXXX. At that time and with our poor credit we had to go with a high fixed rate of 12.25 APR interest. We signed up for a 15 year loan that is supposed to be completed in XX/XX/XXXX. After getting the loan we put our heads down and just kept it paid. My wife and I have been paying this loan for 11 1/2 years. Recently XXXX sold (? ) our loan to Select Portfolio Servicing ( SPS ). Today I received the first statement by mail from SPS and was very confused when the figures were computed. In XX/XX/XXXX we took out a 15 year Home Equity Mortgage Loan of {$25000.00} ( XXXX XXXX XXXX dollar ) with 12.25 % APR interest rate, and as of today we owe, according to SPS, {$24000.00}!! We have n't missed any payments and have paid on time. According to the statement, the payment due is {$260.00} a month with {$26.00} going to Principal and {$230.00} STILL going to Interest. I called them today to find out about getting the correct amount owed where it should be and the lady I spoke to insisted that the numbers were correct. So after paying {$260.00} a month for 11 1/2 years on a {$25000.00} ( XXXX XXXX XXXX Dollar Loan ), we still owe ( according to SPS ) {$24000.00}. According to these numbers we have paid approximately {$33000.00} in interest, yet only {$3600.00} has gone toward principle on a {$25000.00} loan at 12.25 % for 11 1/2 years. When I asked how this loan could possibly be paid off by XX/XX/XXXX, she stated that " there will be a balloon payment at that time ''. I then asked the amount of the balloon payment and she said " It 's not on here. '' referring to our paperwork By my calculations our " balloon '' payment will be {$12000.00} IF every monthly payment from this point is applied to the principle, which it wo n't. The other issue I 've discovered is that in XX/XX/XXXX, XXXX had our loan balance amount at {$23000.00} outstanding, but somehow SPS has increased that amount to {$24000.00}. So they are charging us an additional {$610.00} for a " Deferred Principle ''. I asked that we be mailed the paperwork SPS has for our loan and they claim they will send it in 5-7 business days. This must get sorted out or e will never be free of a loan that is supposed to mature in XX/XX/XXXX.

Complaint: I have applied for a short sale of my home and have been in review for over a year. In XXXX XXXX my home was appraised and an offer was submitted however due to repetitive document requests we were forced to have our property valuation redone in XXXX XXXX . I was advised on XXXX / XXXX / XXXX that the value came in higher than my offer and that I could counter or dispute the value. I was given a list of items needed to dispute that value and was advised that I had time to do so, but was not given an exact time frame. I submitted the information to the bank on XXXX / XXXX / XXXX showing pictures and contractor information for the repairs of the home. I followed up with the bank on XXXX / XXXX / XXXX that the documents had been received as the account representative stated it could tak e 48-72 ho urs for docs to be uploaded, however the rep at that time advised the file was closed out on XXXX / XXXX / XXXX for an insufficient offer and that the sale date was set on XXXX / XXXX / XXXX . To my dismay I was not aware that the foreclosure proceedings were continuing while in active loss mitigation review. According to CFPB guidelines : Restricted Dual-Tracking : Under the CFPBs new rules, dual-tracking when the servicer moves forward with foreclosure while simultaneously working with the borrower to avoid foreclosure is restricted. Servicers can not start a foreclosure proceeding if a borrower has already submitted a complete application for a loan modification or other alternative to foreclosure, and that application is still pending review. To give borrowers reasonable time to submit such applications, servicers can not make the first notice or filing required for the foreclosure process until a mortgage loan account is more than 120 days delinquent. Why would this continue if I was actively being reviewed for a loss mit option? I would like to be allowed to have the valuation dispute reviewed and the opportunity to counter. 10 days is not enough time to do so in any regard. SPS now refuses to to give me the information I need to appeal the decision and the letter they sent to my authorized third party does not give a reason for denial or even information on how to appeal. Please help.
