Complaint: I have had an overdraft account with Santander for over 5 years now. I have not made any payments because the original balance of {$1900.00}, with interest, is now {$4700.00}. I keep waiting for this account to go to collections so I can pay a lower amount, but it never has. I just keep getting more and more interest charges.

Complaint: Hello CFPD. This complaint is related to complaint # XXXX. Santander has charge excessive fees to my XXXX direct deposits. Please review following XXXX U.S. Circuit Court of Appeals ruling. Banks may not use customers ' directly deposited Social Security and SSI benefits to cover overdrafts or pay overdraft fees, the XXXX U.S. Circuit Court of Appeals ruled yesterday. Federal laws giving special protection to Social Security benefits bar what is in essence an unsolicited loan from XXXX to its customers who have their monthly benefit checks deposited automatically into their accounts, the court ruled. Account holders who write checks for more money than they have in their accounts typically either have the checks returned unpaid, and have to pay hefty fees to the bank and often to the person or company awaiting payment as well ; or, with overdraft protection, have the bank pay the amount of the check and later reimburse the bank with the next deposit. That deposit might come automatically, if the customer has a direct deposit agreement for paychecks or most other payments. But if the direct deposit is a Social Security or Supplemental Security Income check, Judge XXXX XXXX XXXX wrote for the XXXX-judge panel, the bank ca n't touch it because of statutes that bar transfer or assignment of such benefits. The federal exemption statute for Social Security benefits, 42 U.S.C. Sec. 407 ( a ), reads : " The right of any person to any future payment under this subchapter shall not be transferable to assignable, at law or in equity, and none of the moneys paid or payable or rights existing under this subchapter shall be subject to execution, levy, attachment, garnishment, or other legal process, or to the operation of any bankruptcy or insolvency law. '' The term " other legal process '' has been given an expansive reading in case law, XXXX said, and takes in XXXX XXXX 's offset program, through which the bank reserves to itself the right to decide whether to reject a check that would overdraw the account or to pay it and reimburse itself from the next direct deposit. " By paying the plaintiffs ' checks when there were insufficient funds in the accounts, the bank essentially extended a loan to the plaintiffs and became a creditor, '' XXXX said. " XXXX XXXX then used the self-help remedy of setoff to recoup the plaintiffs ' debt to the bank and enforce the contractual account holder agreement, in which plaintiffs agreed to promptly repay any overdraft. '' But he added that the plaintiff 's " agreement '' was not true consent under the tougher standards for Social Security and SSI benefits, which require express notice that the benefits are exempt from legal process or otherwise require explicit permission from the bank customer each time Social Security deposits are used to satisfy bank debts. Unlike banks, creditors such as landlords and grocery stores can be paid with Social Security benefits without giving such notice or gaining such permission. " In such instances, however, the Social Security beneficiary is clearly exercising control over the benefits and directing the payment to such creditors, '' XXXX said. " In the banking situation, the direction to apply the deposit to the existing overdraft is only implied and the bank actually takes control of the debt directly, rather than making the full benefit available to the beneficiary to delve out as he sees fit. '' The ruling vacated a summary judgment for the bank and remanded to the District Court in XXXX XXXX. Senior Judge XXXX XXXX XXXX authored a separate concurring opinion. Complaint: XXXX/XXXX/XXXX Dear CFPB, My name is XXXX XXXX and I am submitting a complaint towards Santander Bank, N.A. ( with regards to being the successor to Sovereign Bank [ XXXX based ] ). My father-in-law, XXXX XXXX, and I have had an XXXX accident a couple weeks back ( XXXX/XXXX/XXXX ) and are at the point with the insurance claims adjuster requiring the title for the vehicle. The original title, and current title shown in the XXXX XXXX website, show that there is a lien on the vehicle. The vehicle is a XXXX XXXX XXXX XXXX, purchased in XXXX from a XXXX dealer here in XXXX, and there was a 5 year loan placed on the vehicle ; which means that this vehicle 's loan was paid off sometime around XXXX ; 11 years ago. After speaking with XXXX title department, it is to my understanding ( as well as theirs ) that Santander Bank, N.A. is the sole successor to Sovereign Bank and that they alone *should* have records of all previously paid auto loans. The representatives I have spoken to at XXXX title department have stated in order to have the lien released from the title, Santander Bank, N.A. is supposed to create a letter stating : " Santander Bank, N.A. is not interested in the vehicle or it 's previous auto loan. The loan for this vehicle ( with VIN #, year, make and model described ) is satisfied, and that Santander Bank, N.A. is the successor to Sovereign bank. '' This written document by an official of Santander Bank, N.A. is supposed to be notarized or signed by the official creating the document, then mailed to the recipient in need of the document ; this can then be submitted to the XXXX in order to create a duplicate title without a lien/lienholder stated. I have since spoken with multiple representatives from Santander Bank, N.A. personal consumer department and auto loan department, and neither have helped me in any such way. I have been told that because there is no account with regards to my father-in-law or his mailing address, or vehicle ( searched by VIN # ), Santander Bank, N.A. will not issue a letter of " No Interest. '' Without help from Santander Bank, N.A. in this matter, I am at a complete loss. I urge the CFPB to please help me resolve this matter so that my father-in-law can rightfully buy-back and repair his own vehicle, and that the title ( for which my father-in-law is entitled to having this matter resolved ) is corrected and either showing no lien, or that the lean is satisfied. For the past two weeks, I have not been able to create any progress with this matter ; I am exhausted and running out of resources to resolve this matter. Complaint: I have a checking account with Santander Bank, and I received a text message on XX/XX/XXXX alerting me to possible unauthorized transactions on my debit card. I was n't sure if the text was legitimate, but I immediately checked my account and there were XXXX unauthorized transactions. I then called the customer service number in the text message and was connected to the Santander fraud department, who immediately declined XXXX of the XXXX unauthorized transactions. They let me know that the fourth transaction, in the amount of {$50.00}, was already processing and would post to my account on XX/XX/XXXX. Their instructions were to call regular customer service on XX/XX/XXXX when the transaction posted. They also told me on the phone that the security breach affecting my card had happened XXXX days earlier and they were already in the process of issuing a new card, although they had not notified me of this and had left the old card open in the meantime. The XXXX unauthorized transaction of {$50.00} did post to my account on XX/XX/XXXX, and I immediately called customer service. They told me they would open an investigation, which would include sending me an affidavit in the mail, and after that it would take a minimum of XXXX business days until they could restore the {$50.00} to my account. I find it extremely disappointing that the bank will not credit back the money when it was the bank themselves who notified me of the unauthorized transaction. I asked for the money to be credited back immediately and was denied. I also asked what the bank is doing to protect me from fraud, and what benefit there is to me being a customer with their bank, and was given no good answer. I am filing this complaint because I am still without the {$50.00} in my account, and because I want to warn other consumers about how frustrating it is to do business with Santander Bank.

Complaint: I have been trying to get online statements for the past ten days from my checking account at XXXX Santander. I spoke to a supervisor, XXXX, on XX/XX/2017 after a 40 minute hold time. XXXX told me that she would have someone get back to me ... After a week of patiently waiting and hearing nothing I called again and waited for 33 minutes but got connected to XXXX who was going to try and connect me with XXXX but she hung-up on me. So I contacted the District Manager by phone and left a message for XXXX XXXX XXXX, To date I have not heard one word from this bank. I would like to start working on my taxes and need the ability to gather data on line and sort data. I have no idea why they are not providing basic services for my account. I know they have the capabilities but are unwilling to fix this issue. I am sure this is happening to other customers and this is a clear violation of federal law and banking regulations. I am reaching out to you in hopes you can get someone to at least contact me and get this situation resolved. Bad customer service is no excuse for no customer service. Complaint: I have a santander bank account -at the time of account opening -I opted for no debit card. Now when i am logged into the account and wanted to transfer money to my account in another bank - it is not letting me do that. It is asking me to enter the debit card # and PIN. As i do n't have that - i can do nothing. When called customer service they are not helping with the reason that i need to provide " debit card # and PIN ''. other option go to the branch ... i live in XXXX AZ and there is no way i can go to their branch for that. another issue - there is no security in their online banking ... i am inactive on that page for more than XXXX minutes -it has n't logged me out.
