Complaint: Our office represented XXXX and XXXX in the short sale of their home located at XXXX, XXXX, NJ XXXX. An approval for a short sale was received from Rushmore accepting a certain amount to payoff the mortgage granted by Mr. and Mrs. XXXX against the premises. The closing of the short sale took place on XX/XX/XXXX and a wire for the agreed amount was sent to Rushmore the next day as the closing took longer than expected and buyer was not able to send out the wire on the XX/XX/XXXX ( with the approval of Rushmore 's negotiator ). Rushmore accepted the wire the next day and their file was closed. Although our office and the title company has requested a copy of the Satisfaction of Mortgage/Release of Mortgage, Rushmore has not submitted one for recording in the County Clerk 's office and have refused to provide information on the release claiming that it needs to be requested in writing signed by the homeowner as our office is no longer authorized to speak on behalf of the homeowner. Rushmore has had 8 months to file a satisfaction/release and Mr. and Mrs. XXXX have not been the owners of the property since then therefore they do not feel comfortable authorizing anyone to obtain information on a mortgage that has been paid off as they were forced to give up their residence as they did not qualify for a modification.

Complaint: The Company locked me out of my house again for the second time after letting them know I was in the middle of moving and the house was not vacant! I still have my personal belongings in the house! I called the company several times and they have still not gotten back to me. What kind of monsters are these people? I am a XXXX, single, XXXX woman in Bankruptcy XXXX and I was working with XXXX to modify the mortgage. Rushmore hired a company to break in and change my locks. When I finally got into my home, I discovered the company they hired stole my personal belongs that I had packed in 20 boxes ' They have a sale schedule on the XXXX of XXXX. This is illegal ' I have sent them my authorization letter for them to speak with my attorney to get into my house and my attorney sent them an authorization letter and Demand. They are refusing to speak with my attorney and will not take his calls. They said they have to wait 24- 48hrs. This is my house and they have caused me emotional stress and harm mentally ' They also have advertised to sell all my possessions in the sale ' XXXX either sold, owns, or is the servicer of the mortgage to XXXX/ XXXX / Rushmore address. I send a Qualified Written Request letter to all companies to find out who the real lender is. I am also challenging all the security deeds as they said that I and my ex-husband XXXX XXXX executed them and that XXXX is out Attorney in Fact. The property description and the deeds are fraudulent.

Complaint: I was served a summons for foreclosure from my mortgage company on or about XXXX XXXX, XXXX. I was never sent any notice prior to recieving this summons. This violates XXXX XXXX the Fair Foreclosure Act which requires a creditor to notify in writting 30 days prior to filing for foreclosure relief. It must include a list of financial resources that may help the debtor. No such document was ever sent, certified mail or any other source. I recieved a modification Executed XXXX XXXX, XXXX. After it was executed, i recieved an interest change statement that lowers my interest rate consiiderably. The creditor failed to adhere to this. The statement referebced XXXX XXXX guidelines. XXXX XXXX doe n't own the loan. XXXX does n't own the loan. I was never told what type of loan it was. I asked every two months to have a forebearance, they told me they do n't offer that. If they would have after XXXX or 4 months, i would n't be here. They volated several federal and state laws. They never had their signature notarized or witnessed where it states on the modification it must be witnessed and notarized

Complaint: I am attempting to negotiate a restructured or modified mortgage loan with my lender Rushmore Loan Management Services. Despite repeated calls to their loss mitigation department, it is impossible to get a human being on the phone to speak with me and no one returns my messages. I have not been assigned a designated point of contact, and they have moved forward with setting a sale date for my property. Rushmore recently sent out a denial letter, based apparently on documents I had sent in months earlier. They stated that I was denied for help due to lack of income, but the figures they were using were not current or correct. But it is impossible to speak with anyone about this so they just move forward with the foreclosure. I bought this home in 2008 with a conventional first mortgage through XXXX XXXX and a 2nd mortgage through XXXX with a 10 % down payment. About a year after buying the home problems began as I went through a divorce which hit me hard in the pocketbook due to child support for XXXX kids and legal costs.. A year later I got injured on the job ( I worked as an XXXX ) and ended up having to file through workers compensation in order to collect XXXX. Due to this interruption of income and lack of any reserves I eventually could not keep up and missed some payments on the loan. I began trying to resolve this matter with the original servicers, XXXX and XXXX a few years ago, but it literally took over a year to make any progress with them. They offered me a forbearance agreement that gave me a XXXX5 month break from payments. But then I had to go into applying for a modification through HAMP and this was time consuming and difficult. Eventually I was offered a streamline modification, but instead of offering payment relief this actually RAISED my monthly payment. I appreciated the fact that I had been offered help and did my best to make that monthly payment, but after a few months I defaulted. I am in the process of getting my XXXX reinstated in the state of California, and once I am able to go back to work full time doing this I will be back on my feet. To supplement my income I have rented out rooms in my home and have worked as a XXXX and also still receive my XXXX. I expect to be back working as an XXXX within the next year but am concerned that by that time Rushmore will have already foreclosed on my home. I want to save my home, and I expect for my loan servicer to communicate with me. I also have major concerns about the amount of late fees, Attorney fees , drive by inspection fees etc. It seems like Rushmore is charging me duplicate fees on the same day in many instances and I believe they may be taking advantage of me by piling all of this on so that they can write it off as a loss when they foreclose.

Complaint: i did a modification through mortgage servicer. Just prio to the modification they sent me a change of interest, reducing by 1.5 %. They refused to honor it, stating it was ubder XXXX guidelines, but XXXX states they do n't own the loan. I have complained to them several times, they said they do n't have to honor it. They wont accept the payment based on the new rate, which will change in XX/XX/XXXX this year and agin to the orginal in XX/XX/2018 When i intitiated my modification they did an analysis that showed it was {$25000.00} less than wed but never reduced the principal,, stating they do n't have to follow hamp guidelines

Complaint: In XX/XX/XXXX I applied to refinance my first mortgage XXXX ( XXXX ). The process went along smoothly until I needed papers to subordinate my second mortgage with Rushmore Loan Management Services ( XXXX ). The request for subordination was sent to Rushmore in the first week of XX/XX/XXXX by XXXX, my refinance company. On XX/XX/XXXX, Rushmore promised the subordination documents in XXXX-5 days. So the title company ( XXXX ) scheduled the closing on XX/XX/XXXX at my XXXX County home. I did not pay my mortgage for the month of XXXX because I was advised the total loan would be paid off in the first week of XX/XX/XXXX. The fact is, after promising the paperwork a number of times since, Rushmore did n't send the subordination documents until XX/XX/XXXX. That caused my rate lock to expire costing more money, AND added more money to my mortgage payoff at an interest rate of just over {$81.00} per day. Now I am saddled with having to roll an estimated additional {$3700.00} plus filing fees because my loan rate expired. When you cost that out over a 30 year loan, I will be paying ( a very conservative ) additional {$210000.00}!!!!!!! I spoke with a member of Rushmore 's Consumer Service Department, who agreed I should be reimbursed. But, I received a letter on XX/XX/XXXX stating Rushmore made no error, and my request to be reimbursed was declined.Is there ANY help you can offer?

The representative said that would not be a problem and that they would work with me on modifying the mortgage. I also told her I wanted to make sure of the real owner the mortgage as XXXX send me another letter saying they are still the servicer. Then I received another letter that XXXX was and another that Rushmore was. This IS very confusing and unethical! I never received the paperwork for the modification and then received a notice of from their attorney, XXXX XXXX, XXXX. I replied to the attorney in XXXX and let him know I am in Bankruptcy as all their correspondence said they were a debt collector attempting to collect a debt. The next correspondence I received was a Foreclosure Sale set for XXXX XXXX in 3 weeks. I called the representation and explained again that I had never received the paperwork for the modification. She then told me it was too late to do a modification and that it was set for sale. I explained again that I am still in bankruptcy and she argued with me and said my bankruptcy was dismissed which it is not! I told her they could contact my attorney and he would tell them I am still in Bankruptcy. She said there was nothing she could do. I am still in Bankruptcy and it is active.
