Complaint: I Contacted your agency before. then i called planet home lending again and they sent an email with new terms to stop foreclosure but they doubled the payment amount saying im having to pay lawyer fees etc. and that the payment would be doubled until XXXX and in the email paperwork it said that the actual fees for the attorney etc, could BE MORE. and that the status is still foreclosure until all of the money is paid. In other words, I might pay this money and they foreclose anyway on a whim, at least that is how I am reading it.
Ever since I tried to make the payments on the property back inXX/XX/XXXXI have been given the 'we are foreclosing XXXX '. and they refused payment, even though I had a paper from them saying they would help, They even told me back then that since I 'm inheriting the property instead of being the actual owner of the loan, they were refusing payment from me and were foreclosing.
Only after I said i would report them for predatory lending to a federal agency and sent them paper work from the county courts office showing I was also adminisitor and executor of the estate, did they accept any money. And after that, when I tried to make another payment, I got the same thing, over and over and over.
I 'm not the only one this has happened to.
I looked them up on the Better Business Bureau 's website, and NUMEROUS similar complaints have been lodged against them. Their rating on the site is a C+ I have also seen numerous complaints against them via reviews on XXXX XXXX.
I believe my Civil Rights are being violated due to my age. and because I am a XXXX ( XXXX XXXX ) Now this is happening with the contract they have sent. no concrete fee 's from their attorneys and they can still foreclose at any time? Seems to me like MORE PREDATORY LENDING.
They even told me before sending me this contract, that I should send them {$1200.00} as a payment, even though they were going to foreclose on the property anyway. I 'm considering looking into contacting Civil Rights attorneys about this.

Complaint: I inherited my sister 's house, and took up payments on the Mortage from Planet Home Lending. The very first time I contacted them, they tried to refuse my payment and kept saying they were going to foreclose. It was only after I said I 'd report them that they agreed to accept a payment.
Time went by and I made another payment which was rejected by my bank for insufficient funds but I did not know it even happened. Planet Home Lending never contacted me to say the money was rejected.
I got behind on payments, then in XXXX I got a letter saying I was in a 45 PRE foreclosure. The letter was dated XX/XX/XXXX.
As I read down on the letter, it said PAST DUE AMOUNT {$2200.00} Representing payments from XX/XX/XXXX to XX/XX/XXXX. I got that letter on XX/XX/XXXX!!! They also added Late Charge of {$8.00} Bad check fee of {$25.00} and something called XXXX XXXX. {$42.00} I raised most of the money and contacted them to try and make a payment, but they refused and said I was in FULL foreclosure, they also denied that they sent the letter to me. I went to a bank and had the letter witnessed and notarized on XX/XX/XXXX Today!!! 3 Assistant managers witnessed the document, and they all said the same thing. How can you be owing a late payment on XXXX and XXXX when the letter was only sent out in XXXX?.
I called them again and again only to be told that the house was in foreclosure, but I was required to pay them the money I had on hand.
I retained the original with the XXXX XXXX from the bank ( XXXX ) seal on it.

Complaint: XX/XX/XXXX PLANET HOME LENDING increased my mortgage from {$500.00} to {$1300.00} stating that they had to add insurance. I called and instructed them that my insurance the entire structure is covered by the homeowners association. I submitted the first set of paper XX/XX/XXXX after not getting a response I called and was told I submitted the wrong information. I resubmitted the proper information in XX/XX/XXXX and was also called by one of their agents i told him i am willing to pay my regular XX/XX/XXXX and XX/XX/XXXX payment he told me no it had to be the entire amount due.I called the insurance department on XX/XX/XXXX to see if everything was in order and was told that they received the proper paperwork but was not readable, we did a 3 way call to XXXX direct thats the company for the insurance paperwork and it was faxed again I was told by the agent { XXXX } that everything was good and by Wednesday everything be sent to escrow to complete. I kept calling and each time i called i was told something different until i got an agent named XXXX i told her the story and resubmitted the documation to her this was in XX/XX/XXXX and XX/XX/XXXX i had to submit the previous year insurance and once again i have to wait on escrow this was not finalized until XX/XX/XXXX and now i am being charged an additional {$3000.00} in foreclosure fee. All the information was submitted that was requested there closest office is 4 hours away and each time i call its a different agent answering its an XXXX number. I just think its crazy for their delays. I am now being punished and threatened with loosing my home. Now they are listing my new payments as {$520.00} they are still adding on.

Complaint: Last year I was out of work due to XXXX. I fell two months behind on my rent. XX/XX/XXXX, I sent in a payment that was returned on XX/XX/XXXX. This caused my account to be over 90 days late. I contacted my loan servicer, Planet Home Lending, to discuss this problem. I was transferred to XXXX in their mitigation department. She told me that I needed to set up a payment arrangement. She suggested {$1200.00} per month to which I agreed. She told me that she would have to clear it with her manager. After calling her for over a week, I finally reached her only to be told that the arrangement was denied by her manager. I was also told that foreclosure arrangements had been started. I asked her why was I denied and she told me that I was denied due to not making enough money. I requested a expence sheet, filled it out, submitted it to PLH, and was approved for a payment arrangement for {$1400.00} per month. After two payments, I was given a sell date for my house. At that point, I borrowed money to bring my account current as of XX/XX/XXXX. Now my credit report shows preforeclosure, 120 days late. I have been denied credit opportunities. PLH now say I owe them over {$2700.00} for legal fees.

Complaint: After looking over my credit report, I noticed that there was a listing on credit report for a company by the name of XXXX XXXX ( on some credit report s ) & Planet Home Lending ( on others ), which ar e one in the same. I noticed that they have me opening a loan with them in XXXX XXXX , in which I have never opened a loan with them. My initial loan in XXXX XXXX , was with another company as shown through the recording information via verifiable proof on t he Hillsborough Clerk of Court 's website, where all recording for mortgages and the like are shown. I immediately contacted XXXX XXXX /Planet Home Lending and s poke with XXXX and explained to him the problem. I have contacted several people since that time, XXXX who represented herself as the supervisor as well as advised her of the situation, XXXX , and I finally got fed up and sent an email to XXXX XXXX on XXXX XXXX , XXXX who is shown to be the President of XXXX XXXX t/Planet Home Lending, with no response or acknowledgement. In the email I detailed my complaint as well as provided screenshots of their listing on each of my credit reports. Since I had n't received a response, I sent a follow up on XXXX XXXX , XXXX , still no response. Mind you, I was following up with customer service between these dates to see if maybe the email had been forwarded to another department to handle, but it had not been. I kept calling and spoke with XXXX again and explained this issue to her again, in which they are inaccurately reporting and explained I had not heard from their president in regardings to my issue. Complaint: Planet home Lending told me sheriff 's sale would be XX/XX/XXXX . It was delayed 3 or 4 different times. They even had some scheduled without notifying me, found out from a neighbor. I moved out before the first scheduled sale. At one point they had someone call me and offered me {$700.00} to get my stuff out so they could fix it up and rent it. Another time they falsely accused me of abandoning it broke in and changed the locks.i made a report to police and pictures were taken. I have been doing the yard work ever since I left. They had another sheriff sale XX/XX/XXXX . On XX/XX/XXXX they had a realtor put a sign on the door saying no trespassing and threatened prosecution. I called sheriffs off ice and they said the sale was not approved or signed by a judge and I have the right to go in.I m ade a report to local police.This home was at one point financed through XXXX and I believe something crooked is going on because of 2 years caused me to move out. They kept sending me @ {$1000.00} a month bill.I could have fixed this home and got some of my money back. It is a VA loan. They are ripping off me and the VA. I purchased it for {$140000.00} in XX/XX/XXXX . I wa s told they purchased it back for $ XXXX I b elieve with about {$20000.00} investment this home could sell for close to {$200000.00}. Complaint: Loan # XXXX A tree fell on through my home in late XX/XX/XXXX causing a large amount of damage. As is customary, my insurer issued the claim check to planet home, my wife, and me. The draw process in its " loss draft '' department appears to be intentionally designed to withhold funds as long as possible. I believe Planet Home Lending ( the Company ) is engaged in a scheme to perpetrate a fraud, misappropriate funds, harm its borrowers, and deceive its stakeholders. At best, I believe the company is engaged in willful misconduct and gross negligence. As further described, the company 's loss mitigation ( related to insurance losses and remediation ) creates undo burden on its borrowers at their most vulnerable time. I have brought to light my concerns directly with the Company multiple times in phone calls and emails from which the Company has extensive records. I have offerred commercially reasonable resolutions at every point of contingency. My efforts have been entirely rebuffed. One staff member of the Company has been better than all the others, XXXX XXXX. Should this complaint result in negative consequences for staff, I strongly assert that she should be excluded from such consequences. Her hands are simply tied by the policies and processes of the company, and she has no authority to act in a more reasonable manner. My experience with the Company 's " loss draft '' department has led me to conclude that the only remaining reasonable explanation for their ineptitude is to withhold funds as long as possible. The Company appears to operate with intentional inefficiency, both in action and negligence, and I ask that steps be taken by its regulators to cause the company to immediately caese and desist its harmful behavior, be formally penalized by its regulators, remedy this process, and compensate me for excess costs and other damages I have incurred as a result of their actions and negligence. Regulatory Issues : While I 'm not certain as to whether my loan is FHA, XXXX XXXX, or otherwise government-backed, I believe the company 's loss mitigation draw process is in violation of several XXXX XXXX requirements both in spirit and letter. I have not gone further in my research on other XXXX XXXX requirements, but I will. XXXX XXXX requires that servicers deposit funds from loss claim checks in an interest bearing, XXXX XXXX XXXX XXXX account. In the Company 's " Claim Procedure Packet '', there is no mention that this is done. Further, the funds are required to accrue at a market rate and be remitted to me and my wife following completions of the repairs provided the servicer receives appropriate documentation of completion and release of liens. This appears to be intentionally omitted from the Company 's Claim Procedure Packet. These facts have also never been mentioned in conversation with any staff with the Company, which appears to intentionally avoid an expectation of such, no matter how trivial the amount. XXXX XXXX requires that for loss claims over {$2500.00} : servicer must release an initial disbursement of insurance loss proceeds of 25 % of the total insurance loss proceeds but no more than {$10000.00}, and must disburse the remaining funds in increments not to exceed 25 % of the insurance loss proceeds following inspection of the repairs. My initial draw amount exceeded {$10000.00}, thanks to the speed of my contractor. The Company attempted to make me feel like they were doing me a huge favor in doing so, as a rebuttle to my assertion of how ridiculous their check cutting process is. The process of putting the check in the mail takes a minimum of 3 days. This does not include the two days following receipt of the inspection report. I was told that the company approves the check on " day 1 '', cuts the check on " day 2 '', and puts the check in the mail on " day 3 ''. I was further told that the Company did not have the ability to wire funds, in spite of my willingness to cover the costs. This was a clear lie. The company simply chooses not to do so, presumably so as to ensure maximum float on the check. The first draw amount was a violation of at least one XXXX XXXX requirements ( admittedly, to my minor benefit ). My second draw over 25 % of the total amount, was another violation. I was told at the outset that any claim damage amount over {$10000.00}, requires the company to issues draws as repairs progress and after periodic inspection. As a XXXX, I understand that this is reasonable. What is egregiously unreasonable is that there are only TWO draws allowed. Once at 50 % completion and once at 98 %. The Company 's " loss draft '' procedures state that draws are generally done 1/3 at a time. I understand the nature of the word " generally '', but the company has flatly stated its absurd " 50 %, 98 % '' policy multiple times in conversation. Undo Harm and Refusal to Make Commercially Reasonable Efforts to Resolve Disputes : When I challenged the company on how somebody without means to front repair costs, I was told that they try to work with those who ca n't. They have not. I have had to exhaust my credit lines in order to fund these repairs. Borrowing the money has caused me to incur interest charges. I 've been given every excuse possible for the absurdities of the process, and have had to front up to approximately {$20000.00} of my own money prior to reimbursement. Further, I 've been required to pay additional fees for the company 's own inspections. I 've been forced to pay for overnight delivery of reimbursement checks, which, to my detriment, was not followed through on by the company with the most recent draw. I had to escalate this problem to a manager twice, was promised it was taken care of, lied to about the company not having the ability to wire money, found ( after a lack of follow up from the manager ) that the check had gone out regular mail in spite of promise to the contrary, argued with about the need to immediately stop payment on that check and overnight a new one, then lied to again about the arrival date of the overnight. Both checks ( the one on which a stop payment was placed and the overnighted check ) arrived within one day of each other. I have been at 96 % completion for three weeks, and the Company has made no effort to contact me proactively to issue my final check. They are also currently withholding my check for the depreciation portion of my claim. I was assured that they would reach out soon after the last draw, and they have not. This whole process, begun around the beginning of XX/XX/XXXXwith FULL required paperwork provided to the Company, has caused my contractor to slow because of my inability to continue drawing on credit lines to fund him. My credit score has declined significantly as a result of line usage, and one of my card issues has reduced my credit line. These are long-lasting, damaging effects of the Company 's process over and above the additional monetary costs. Potential Criminality : The process is so obstructive that I can think of no other reason that Planet Home is using liquidity provided by the loss claims checks to bolster and perhaps leverage its own balance sheet. I have incurred costs as a result of the Company 's willful misconduct including interest on credit cards, damage to my credit score, extreme delay in completing repairs, costs of overnight envelopes, emotional damage, and legacy effects as a result of decline of my credit. On XX/XX/XXXX, I utilized the Company 's complaint section on its website to lodge a formal complaint. I felt compelled to do this because I was not offered a way to do so over the phone. After requesting such and waiting on hold 10 minutes, I decided the company likely did not have an adequate process in place ( in spite of it being regulatorily required ), and that I and the Public would be better served putting it in writing. Though this complaint is far more extensive, much of the wording accusing the Company of criminal behavior and potential civil and regulatory action should have caused it to reach the highest management levels. I should have also received an immediate response if for nothing else than to state that it was being reviewed. I have received no response Sometime in the last week ( XX/XX/XXXX ), I received a sales call from the company asking if I wanted to look at refi options. I declined and told them I had filed a formal complaint with the company, received no response, and asked that the agent raise the issue up. I have still received no follow-up. Coincidentally, in XX/XX/XXXX of this year, CFPB issued an enforcement action against the Company naming it a party to an illegal scheme that sounded eerily similar to the sales call I received ( and have received several times in the past ). XXXX XXXX XXXX I am not an attorney, and I have not yet involved one. I seek reasonable resolution to my personal losses and damages caused by the company. I also seek injunctive action from its regulators and further investigation into the reason it operates in this manner. I believe there is a strong likelihood of criminality at the core of my seemingly small problem, and I hope that this will be handled appropriately.

Collection activities and communications that do not otherwise violate this subchapt er may continue during the 30-day pe riod referred to in subsection ( a ) unless the consumer has notified the debt collector in writing that the debt, or any portion of the debt, is disputed or that the consumer requests the name and address of the original creditor. I am still being hounded by Planet Home Lending in clear violation o f US 15 1629g & UCC 3-501 that demands ceasing of debt collection attempts until the XXXX ( Presentment ) request has been made. Can you explain why one of Planet Home Lending 's agents car is in my driveway while that request has not been met, and why this is not a clear violation of both the codes? Or the emails from XXXX & XXXX ? Even continued communication from Planet Home Lending/ All debt collection must cease until the Presentment request is met per UCC 3-501 and US 15.1629g Why there is no apparent concern for these obvious violations o f U.S. codes and Statutes? I complained to CFPB that I thought Planet Home Lending and its agents were potentially commiting fraud. I asked for an investigation. Plane t Home Lending has acknowledged in writing to CFPB that they are currently commiting fraud since they can not produce evidence to the contrary supporting a claim that they even have the right person, let alone that I owe them anything. If there are UCC cod es and statutes that supercede the wording of " on demand '' ( not the 33 days I 've waited, nor the addtional 45-60 d ays CFPB intends to allow Planet Home Lending to comply ). The minute Planet Home Lending and it 's associates put documents in the mail attempting to extort money from me when by their own admission ( sorry for the redundancy, I 'm hoping this gets through to someone in ) to CFPB in WRITING that they technically are currently in violation of the codes outlined in this complaint. My current home mortgage rests with XXXX XXXX ( t o the best of my knowledge ), and the amount of that mortgage is approx. {$220000.00} In the documentation they sent me via certified mail, the claims of : {$320000.00} / This is about {$100000.00} more than my current mortgage with XXXX XXXX The threat to seize my assets ( though there is currently no contract between myself and or any of these entities ) The Declaration Page of the Foreclosure Loss Mitigation Form ( attached ) claims to be a true and correct copy though the document has clearly been altered. They also claim that they legally represent the note holder, and they may. But they have provided me with no proof of that and have not met XXXX requirement according to the UCC 3-501 Verification Standards. Without or until they provide verification, they have violate d : USC 18.2071,2073 .
