Complaint: To Whom This May Concern ; XX/XX/XXXX I am confused on the situation all this information this company and attorneys have documented is false, accept that we have not made a payment to Planet Home Lending, the company that bought the mortgage illegally, since XX/XX/XXXX since nothing that has happened is legitimate. We were not up to date on our payments in XXXX through XXXX, due to XXXX not accepting payments at that time. XXXX did, however, accept one last payment in XX/XX/XXXX. The payments sent before this monthly were refunded and refused, so when this mortgage was sold under false pretenses. I am sending along all the documents and the new ones from the present attorney trying to foreclose on our house, when none of the actions and activities leading to this has been within the law how can this happen. I have asked for answers from this company with no received none. I have more paper work I would like to send for more info, but I could fax it would be quicker. I have the current documents from Planet home lending 's current attorney and it is not correct.

Complaint: To whom it may concern : I am attempting to rectify a refusal from our new lender, Planet Home Mortgage, to acknowledge we did make our first mortgage payment and immediately demanding twice the payment for XXXX. Planet Home Mortgage, without good faith, erroneously believes we never made our first mortgage payment to the original lender. I have attempted to contact them by phone four times to resolve this, and email. Planet Home Lending refuses to acknowledge or even answer their phone today that we have already made two payments, not one. I think they either have a data entry error they refuse to rectify after numerous reasonable attempts to rectify the problem on my part, or are simply acting in bad faith violating federal law.
We originally signed a mortgage note to XXXX XXXX XXXX on XX/XX/2018. See Group Exhibit A, pages 1-4 as attached. Monthly mortgage payments for the original loan XXXX were to be made starting XX/XX/2018 of {$1000.00}. See Exhibit A pages 1-2, proof of original mortgage lender and payment terms. See page 3, which demonstrates we provided a cashier 's check on XX/XX/2018 via U.S. Mail to XXXX, which was indisputably the original lender for XXXX dollars with the original loan number on the Cashier 's Check, XXXX. See also Group Exhibit A-3, and A-4, and A-5 showing written acknowledgement by the previous lender which was still the lender on XX/XX/18 when the cashier 's check arrived, that XXXX received and cashed it.
See Group Exhibit C, a letter we received on or about XX/XX/2018 from XXXX advising us that the mortgage loan was being transferred to Planet Home Lending XX/XX/2018, and the new loan number would be XXXX, with new payments to be sent to Planet Home Lending LLC, XXXX. XXXX XXXX, XXXX, Texas XXXX. On XX/XX/2018, I called and emailed and spoke with XXXX XXXX at XXXX XXXX XXXX, who sent me an email acknowledging that XXXX did receive and cash our original payment of XXXX dollars made on XX/XX/2018, before we had ANY reason to believe that Planet Home Lending would be the new lender.
On XX/XX/2018, I received a telephone call from a woman named XXXX at Planet Home Lending, seeking to update my information, and reminding me I had never paid my first mortgage payment. I told her I had, and attempted talking to several people that day at Planet Home Lending. But obviously, proof by claim to have paid verbally is regarded as a nullity. So I emailed Planet Home Lending and XXXX XXXX XXXX showing that I sent a payment in already for XXXX dollars to XXXX, before we had any reason to believe that XXXX was not the lender on XX/XX/2018. See Group Exhibit B.
Planet Home Lending responded that my account would be credited for the original mortgage payment when my loan was truly transferred on XX/XX/2018. See Group Exhibit B.
Today, XX/XX/2018, I received a notice demanding payment immediately for {$2100.00} dollars from Planet Home Lending, reminding us we " missed '' a mortgage payment due on XX/XX/2018 for {$1000.00}. See Exhibit D.
We also made our next payment, due to Planet Home Lending on XX/XX/2018 via cashier 's check, Exhibit E, for {$1100.00} dollars on XX/XX/2018, which we sent Certified Mail, return receipt requested on XX/XX/2018 ( Exhibit F ), which the U.S.P.S. website shows was received by Planet Home Lending today, XX/XX/2018 ( See Group Exhibit F ).
I can not afford to eat another XXXX dollars and make a double payment for XXXX XXXX. We paid our first installment of {$1100.00} ( See Exhibit A ) more than a week before Planet Home Lending had anything to do with this mortgage to XXXX XXXX XXXX. Either XXXX XXXX XXXX never forwarded this payment to Planet Home Lending, or Planet Home Lending is disorganized, and despite my numerous attempts to rectify it with them, refuses to correct the error in their computer system saying we never paid our first mortgage installment, or this is a bad faith attempt by Planet Home Lending to have its cake and eat it too. They can receive full mortgage payments and still file a foreclosure.
If this were a dispute of ten dollars, or even 100-200 dollars, I would just make a double mortgage payment to avoid foreclosure, since someone at Planet Home Lending incorrectly believes we never bothered to make our first mortgage payment. But we can not spare an additional XXXX dollars to just settle this, nor should we have to.

We have been in contact with the Loan Mitigation Department because they said the Bankruptcy Department did not have a direct line of contact. We have - {$6800.00} in the Summary of amounts past due before bankruptcy filing ( Pre-Petition Arrearage ). Complaint: There is a summary judgment against my property ; which was adjudicated in XXXX XXXX Supreme Court. Due to the emergency of this situation, I would like to explain the history of my dilemma.
I purchased the said property above in XX/XX/XXXX. After 2 years, I requested a modification from the newly assigned company XXXX. Unfortunately, a representative of XXXX told me that the square footage of my studio ( 500 sq feet ) was too small to receive a modification.
Within the years of the constant reshuffling of mortgage assignments, only one servicer ( XXXX XXXX ) offered a modification ( XXXX ), which was 5x higher than what I was paying. In XXXX a Judge dismissed the case without prejudice requesting explanation of the lost note and allonge.
In XX/XX/XXXX a second judge partially granted and partially denied the summary judgment. In XX/XX/XXXX, a third judge granted summary judgment and I filed a OSC.
I am in receipt of a letter 3 denial letter for a modification by Planet Home Lending ( PHL ) dated XX/XX/XXXX, in reference to the denial of the requested modification. As a property owner, I am frustrated by the multiple servicers and investors that this " mortgage '' has changed hands. For the past decade, I have tried to secure a refinance when I was current only to be told that it could not be done. XXXX XXXX ( XXXX ) stated the condo was too small. XXXX couldn't modify-no reason given. Now Planet Home Lending has given no supportive argument as to the denial of the modification, other than the investor does not offer modifications.
Their decision was based on a consumer credit report not my actual credit report. Additionally, PHL acknowledges that the reporting agencies played no part in their decision to deny the modification. However, PHL failed to mention the reason of the denial, but directed me to run my credit report. I provided all the supportive documents and income, yet I was denied. The investors lawyers also discontinued a pendency in XX/XX/XXXX because the investor because the Plaintiff could not prove compliance with the mortgage by a non-party to this foreclosure action.
Here is a history of all the Lenders : MLN-Bankruptcy XXXX XXXX XXXX XXXX XXXX XXXX I XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXXXXXXXXXX XXXX XXXX Planet Home Lending I ran my credit score several times and the mortgage is not reporting at all. Please advise.

Complaint: I am coapplicant with exhusband on a home loan that we had obtained when we were married. There has never been a payment missed since we had the loan in 2008. My exhusband fiked bankrupcy an upon my notification of the bankruptcy Planet home lending would not take a payment from me nor allow me to make payments online or via phone automated systems. Planet wouldnt even send me a statement. I spoke to bankruptcy department many times an was advised that because they received notification of bankruptcy that I needed to talk to my lawyer in ref the account because they couldnt. After multiple failed attempts I finally got a hold of a mortgage counselor who was able to help me an apologized for what i was being told by other representatives. I was able to finally make payments an get account up to date. I was told by the mortgage counselor that i should not get a late payment an if i do to call back an they would submit to remove it. When I called back inwas told that if inwould have made the payment 2 days earlier it would not have reflected as late, but as i explained ine i couldnt an 2 i had to physically speak to someone to do it an they were closed on weekend an the XXXX fell on a Sunday.But Planet home lending still reported on my credit report as being late for the month of XXXX and XXXX when it shouldnt have because if i have no way to make a payment because they are closed an my due date falls on a Sunday they cant mark it as late because i couldnt use automated system it had to be with live representative.I am XXXX XXXX military an this late payment not only affects my security clearance but it also it affects my borrowing ability. I have never missed a payment ever an this one was clearly an error caused by the confusion of my exhusbands chapter XXXX bankruptcy. I contacted Planet hone lending an asked to speak with supervisor an was told that one would call me but never did. I also spoke with a rep an they said planet home lendings credit department stated that planet home lending did nothing wrong. I am not trying to say planet home lending is a bad company because they are not an they have taken care if me as a customer an thats why I have stayed with them for so many years. I just think that this was bad miscommunication due to the confusion of the bankruptcy an XXXX people being on loan where one did not file bankruptcy is complicated an I just hope an pray that planet home lending will continue to take care of me by fixing this critical error that could cause me my XXXX year career as an XXXX. I have reached out for a member of coporate to contact me via telephone annthey have not. I got a letter in mail but it does not include all details ... XXXX they left out calls to mortgage counselor an bankruptcy department.

XXXX for XXXX XXXX, agreed to correct the 120 days late reporting for XX/XX/2018 payment on my credit report, which was done for few days and was again reinserted 120 days late for XX/XX/2018 payment on my XXXX credit report, i waited for 30 days for this error to be corrected but it did not happen causing some of my credit cards to be closed because of this error.
i would like Planet home lending to correct the error with XXXX and have XXXX send me the updated copy of credit report with correction.

Complaint: XXXX is reporting an account named Planet Home Lending on my report as having a current status of 120 days past due when it should state closed and paid and they are showing account 120 days past due in history on XX/XX/XXXX. This account was closed XX/XX/XXXX so how is this possible after filing complaint with CFPB and waiting 30 days a response was sent by Planet home lending saying they arent reporting XXXX is and its XXXX responsibility to correct taking NO blame for negligent reporting but they stated they received a dispute prior to this and confirmed account so they confirmed these things then. Now XXXX sends me new investigation results dated XX/XX/XXXX and once again Planet Home lending confirmed current staus of a 2 year closed account as past Due 120 days and show it past due on XX/XX/XXXX. This is rediculous. In mean time I am the one suffering because of this gross negligence of both parties XXXX and Planet Home Lending. I dont want to hear its not our problem from Planet Home Lending its XXXX because XXXX just sent them in XXXX another dispute and asked them to confirm and the XXXX ( Im sorry I say as I see ) including the guy who responded back to last complaint confirmed everything asked to this includes current status being 120 days past due and the past due occured XX/XX/XXXX some 2 years after account was already closed. So what will Planet Home Lendings excuse be now? What will XXXX excuse be. like 2 peas in a pod both incompetent XXXX. Im not looking for any investigation as I have wasted a year with this account already. Both XXXX and Planet Home Lending have exactly 15 days to either remove account or correct to show current status paid and to remove the 120 late on XX/XX/XXXX history. After this amount of time maybe its time to let the courts handle and both can pay my legal fees and damages for their blatant negligence. This actually should also be forwarded to the FTC as they both have consistently reported incorrectly and refuse to fix each other blaming each other. Enough is enough. 15 Days

Complaint: I have been disputing with XXXX for 2 years now about an account Planet Home Lending that was paid in full and closed XX/XX/XXXX. Planet Home Lending keeps reporting current status past due one year after account was closed and now 2 years after account is closed but they show account closed. XXXX will do nothing as they lack common sense to realize an account cant be past due if it in fact was closed 2 years ago and they will do nothing but say its what creditor reported. Give me a break so its ok to report grossly incorrect information? How can XXXX report something past due in XX/XX/XXXX when it was paid off in XX/XX/XXXX? They show both on report paid and closed XX/XX/XXXX and current status past due in XX/XX/XXXX. This has been going on for 2 years after XXXX originally removed account from report in XX/XX/XXXX then put back on and never did an investigation after requested numerous times to do one and when they do they put current status XX/XX/XXXX past due and the circus begins. I feel like im dealing with both incompetence at XXXX as this should be seen and corrected but after numerous calls and disputes they say not their problem its creditor that is incompetent which I believe because in XX/XX/XXXX I contacted creditor too and was told to email directly to XXXX which is Planet Home Lendings email so I did. I was told they would take care of and send me a letter through US mail within 5 days. On XX/XX/XXXX I did in fact send an email containing 3 documents to Planet Home Lending and as of this date XX/XX/XXXX I have never gotten either an email back or US Mail back so I kept on disputing with XXXX to no avail and now Planet Home Lending has reported paid closed but current status past due XX/XX/XXXX. This has knocked my credit score down 100 points because they are showing current status of a 2 year old closed account as past due instead of paid as agreed as they were paid in full XX/XX/XXXX. XXXX on XX/XX/XXXX states file investigation there is nothing they can do even though they know is wrong they cant do anything. Not just wrong but grossly wrong. Both XXXX and Planet Home Lending are negligent. This account should have been corrected by XXXX if they were doing a proper investigation but its obvious they dont even investigate just send out a generic electronic questionaire aka XXXX XXXX asking creditor to ok. This is not acceptable. Planet Home Lending never sees actual dispute I send in but they too are incompetent because they are reporting an account that has been 2 years closed as current status past due instead of paid as agreed. My last resort before filing a legal complaint against XXXX and Planet home lending is the CFPB. After which if this isnt corrected immediately a lawsuit will be brought against both as the effect this has on my ability to obtain credit is extraordinary and has effected me both financially and physically as well as psychologically as I have been turned down for credit because of and I have numerous hours sending disputes for 2 years calls on phone too and emails sent to correct their errors and they do nothing. This is irresponsible and its companies like this that should be reprimanded and fined. Its ok to make an error thats how you learn to do right the next time but to keep repeating and doing nothing to correct over 2 years is gross negligence. I have everything documented from first dispute to phone call dates and sent emails and am preparing to take this to court. Im not disputing anymore nor making phone calls or emails. Now I will seek damages if this account isnt either corrected to show current status as paid as agreed or removed. I am attaching current Equifax report page showing the stupidity of both Equifax as well as Planet Home Lending. Pay attention to the history and current status as you will see the history chart shows XX/XX/XXXX past due 120 days but nothing late prior to XX/XX/XXXX this is funny so I guess not only 2 years after closed and paid items can be late but now a month must consist of 120 days. Current status shows 120 days late. How can it currently be late if closed 2 years ago. XXXX we have a big problem.
This account was removed once in XX/XX/XXXX I suggest either Planet Home Lending remove account from my Equifax report or correct to reflect current status as paid as agreed and remove the past due 120 days in the history on XX/XX/XXXX.
Because of damage caused over 2 years but mostly the last year of both XXXX and Planet Home Lending and CFPB can note this item has been disputed previously with them.but with XXXX and nothing has been done to correct that correcting this item doesn not in effect stop any legal procedure from taking place for the current and past time this has effected my ability to get credit. XXXX and Planet Home Lending are still liable should I decide to take legal action against them for the time prior to them correcting if they so choose to do which might save them some grief as it is very clear and documented the gross mistake made and anyone with an IQ of above 2 can see this mistake aka error. I expect this correction or removal be done promptly as the clock is ticking and Ive spent enough time being polite and trying to fix this without having to take legal action.Maybe the only thing these companies understand is legal action and it might take a several XXXX XXXX dollar law suit to wake them up.
