Complaint: I purchased my home prior to the recession in XXXX. When financial hardship hit, we attempted to get a loan modification to help us through hard times. XXXX/ XXXX/ PHH mortgage company offered me in XXXX of XXXX an Interest only ARM loan that was supposed to be interest only for the first 120 months ( Ten years ) and then would be principle and interest for the remaining 20 Years of the 30 year mortgage. However, in XXXX of XXXX, no change was made to the mortgage to reflect principle and interest. On XX/XX/XXXX I called the mortgage holder XXXX ( XXXX had sold the Mortgage to XXXX ), and spoke to XXXX ( Employee ID XXXX ) around XXXX XXXX. I asked about the mortgage and when it would change to reflect principal and interest. He had no idea ; but said he would open a case with an escalation manager. He stated that the process would take up to 5 business days. I waited On XX/XX/XXXX I called back and was able to speak to two escalation managers XXXX ( Employee ID XXXX ) and XXXX ( Employee ID XXXX ). The answer that was given to me at that time was that According to the origination document of my loan, it is not scheduled to change to principal and interest ( P & I ) until XXXX of XXXX. I didnt understand why since the mortgage documentation that I held said 120 months which should have been XX/XX/XXXX. Okay Maybe I didnt understand something in the legalesed jargon of the mortgage document. So, I waited until XX/XX/XXXX to see if anything would change. NOTHING My mortgage statements are still showing interest only and I owe more now on my home than the original mortgage price. I feel as though Im being had. On XX/XX/XXXX, I reached out to the mortgage holder ( Who is now PHH ) to see if the new holder would be able to tell any more about my mortgage. In order to confirm that we were speaking of the same mortgage agreement I ask for an amortization schedule to see if they could show me specifically when, and how much my mortgage would be principal and interest so that I could see the balance go down ( Im getting old ). I was told that because I have an adjustable rate mortgage, they wouldnt be able to provide an amortization schedule because the payment could fluctuate at any time. ( Which they have over the last 14 years ). They were however able to provide me with a copy of the origination document that they have on file. Sure enough, it is the same one that I have that clearly says that my payments should have been P & I back in XX/XX/XXXX. At this point, I afraid that if they were to make the payment principal and interest to cover the complete mortgage by the maturation date ( XXXX ) that my payment would be astronomical! I feel as though I have been victimized. I had a contract with my mortgage holder ( who sold my mortgage several times ) and they have not held to their part of the agreement with no consequence to themselves. However, if I refuse to pay, then I will be penalized harshly - super high balloon payments, penalties, or worse foreclosure. In fairness, since they have not held up to their side of the agreement, I would like a zero-cost refinance to a 30-year conventional Fixed rate mortgage. Why should my family suffer due Sheisty business practices? PLEASE HELP!!! I have attached supporting documents to assist in resolution

Complaint: In XXXX of 2018 my husband got sick and was unable to work. We immediately applied for a mortgage modification with our mortgage company, XXXX at the time. After several months of delays and requests to submit the same documents over and over I contacted the ombudsman. A short time later we were approved for a trial modification to begin in XXXX and continue for three months. I made each of those payments early. I hadnt received any other information so in mid XXXX I made a payment for XXXX. Shortly after I received an email that we had been approved for a permanent modification. I waited a couple weeks but never received the paperwork. I emailed XXXX to let them know I didnt receive it. During this time my account was being transferred to PHH Mortgage. My husband also passed away in mid XXXX. Finally at the end of XXXX I received an email containing the modification agreement. I immediately signed as successor in front of a notary and mailed the documents to the address provided. One of my coworkers is a notary so I signed in my office and walked the documents to the post office next door that same day. During the time between XXXX and XXXX while I was trying to get the modification paperwork I spoke with someone at PHH. I was asked to send in my husbands death certificate and I was assured that this would allow me to assume the mortgage. I faxed a copy to the number provided. Shortly after I sent in the modification agreement ( early XXXX ) I received a letter asking for additional documentation showing my right as successor. I emailed a copy of my drivers license, the original warranty deed showing my husband and I as joint tenants, and information from my county assessor showing me as the sole owner of the property. Colorado law states that property automatically transfers to the survivors on a deed when one dies. I didnt hear anything back and I was still unable to make any payments. In the beginning of XXXX I started contacting both customer service at PHH and the assumption department I sent my information to. After several emails I finally received a response just last week from customer service informing me that the modification was canceled because they didnt receive the paperwork. Supposedly a letter was sent informing me of this, but I never received it. I suspect it was addressed to my late husband whose mail is returned to sender by the post office as he is deceased, if this letter was actually sent at all. I sent that paperwork as soon as I received it at the end of XXXX. This is far too important for me to delay or put my home at risk. I just lost my husband and now I risk losing my home because my mortgage company is either incompetent or a scam, and trying to force me into foreclosure. I have done everything that has been asked of me and I would still be making my payments if my account information and payment access was correct and available. I would like this resolved and the modification I signed to be honored.

The trial paln mortgage payment was incorrect and when I contacted XXXX after 2 attempts and rude individuals they told me that was the information that was available at the time of transfer. That information is incorrect becuase XXXX approved me for a trial plain 2 months ago. My trial plan payment was to be {$1700.00} for XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. Yesterday, XX/XX/2019 I went to my XXXX XXXX office to make my quick collect payment. After nearly 5 attemtps trying to set up my quick collect same day I was informed that the NEW ACCOUNT NUMBER provided by XXXX XXXX is incorrect and does nut match the BILLER entity which in this case would be XXXX XXXX. I spent 45 minutes of my lunch hour trying to get this straightened pout by callin XXXX and the attempts went unsuccessful. First there are 3 phone numbers none of which anyone was helpful. One of the phone number is outside the United States of America.XXXX. I do not provide my personal information to anyone outside the United States and WILL not in this case. In an case the women could not help me and transferred over the the US and the call was LOST. I then proceeded to call back XXXX, and still the same situation, no one could help me or either explain to me why I was receiving the XXXX XXXX XXXX XXXX error with my NEW ACCOUNT NUMBER. I asked to speak with a manager, I was transferred and the call was lost for a second time. GREAT SERVICE SO FAR HUH???? I called back for a 3rd time now going on 45 minutes and received XXXX ID # XXXX, XXXX was unable to help me. He spoke with his supervisor and they did not know why I was getting the XXXX XXXX Error. He said I could make the payment over the phone using my checking account information which I am hesitent about, because never ever are the trial plan payments allowed to be paid by checking account. ONLY XXXX XXXX XXXX XXXX, BANK CHECK OR CERTIFIED FUNDS TRANSFER. IN THIS CASE NONE WOULD OF WORKED BECAUSE OF THE WRONG ACCOUNT NUMBER POROVIDED BY XXXX XXXX XXXX INFORMED ME THAT THEY ARE OPEN TILL XXXX IN THE EVENINGS SO I CALLED BACK WHEN i ARRIVED HOME FROM WORK AT XXXX XXXX. ALL 3 PHONE NUMBER S FROM XXXX XXXX TILL XXXX XXXX WERE UNAVAILABE AND HAD A WAIT TIME OF 20 MINUTES WHICH WAS THE REMAINING TIME LEFT TILL XXXX XXXX CLOSED IN NEW JERSEY OFFICES. GREAT SERVICE HUH????? AS A RESULT I STAYED ON HOLD TILL XXXX XXXX UNTIL WHICH A MESSAGE CAME ON TO PRESS 1 FOR A CALL BACK. Complaint: XX/XX/XXXX : My loan was transferred from XXXX to PHH Mortgage Services. XX/XX/XXXX : Talked with XXXX re : setting up a new on-line banking account. I was told to wait until the loan was officially transferred before we proceeded. XX/XX/XXXX : Received a letter stating that my XX/XX/XXXX unpaid debt was {$2200.00} XX/XX/XXXX : Called and no one answered XX/XX/XXXX : Talked with Agent XXXX, XXXX, XXXX and finally transferred to XXXX XXXX at XXXX. On-line account was set up and I noticed that my account was showing that I still owed my XX/XX/XXXX mortgage payment and the amount was incorrect. Talked with XXXX and he suggested that I wait until all files had been properly transferred to make sure that PHH system had the correct information. XX/XX/XXXX : Received two SCRA Notification letters regarding saving my home and applying for service-members assistance program. XX/XX/XXXX : Called XXXX and discussed the discrepancies in my accounts for over an hour with no resolution. He suggested that I send my payment history to PHH Research Dept., to bring my account current. XX/XX/XXXX : I submitted all payment history information to PHH as well as talked with XXXX ( XXXX ) for almost another hour. Mr. XXXX did nothing more than repeat information on PHH system. Informed me that I was missing a XX/XX/XXXX mortgage payment, did not acknowledge receipt of my payment history to PHH Research Dept and became upset when I began to challenge the competency of their organization and XXXX 's past lawsuits and legal entanglements. Mr. XXXX stated that he had sent me letter on the XX/XX/XXXX about the status of my account. When I got home on XX/XX/XXXX, I had two SCRA Notification letters from PHH regarding the delinquent status of my loan. In Mr. XXXX, Case Manager letter, there is a paragraph that states that " ... if a payment of {$720.00} is not received on or before the last business day of the month, that this situation would be reported to the credit bureaus ''. After reading this threatening and illegal language from an organization that has only had my account for 21 days, I knew that I and anyone else doing business with PHH is in trouble. As a matter of fact, there is a 60-day grace period during the transitioning of this account when no late charges can be applied according to their correspondence to me. It is obvious that PHH is an extension of XXXX and doing business with this organization is a detriment to any average working family or anyone period! Resolution : To bring my Account XXXX current ; To remove all late charges, collection cost, NSF fees and properly apply funds being held in a suspense account to my mortgage payment history ; PHH to stop sending harassing and threatening letters without factual information and within the policy and guidelines of best business practices ; and Remove MrXXXX XXXX as my Case Manager. If anyone can help me transfer, refinance or assign my loan to a normal, credible lending institution in America, my life and those like me who are experiencing this same never ending nightmare would be forever grateful!

They steered me to get a FHA rather than another conventional loan. They stated that I did not qualify for the any other loan other than an FHA and after having a family friend who is a loan processor look at the information, that just was not the case. I was told that they could have offered me another product and they failed to do that. I wish to file a formal complaint as I believe this is exactly what got us into the house crisis in 2008.

Complaint: On XX/XX/2019 our mortgage was transferred to XXXX XXXX to PHH Mortgage who merged with XXXX PHH informed us. For some reason PHH mortgage is charging my wife and I an additional {$150.00} each month for " hazard escrow '' and " other taxes. '' PHH mortgage told us that they provided their own insurance company for flood insurance for us without our consent. We have our own flood insurance we've been paying for on the building. Our building has insurance, as well as flood, we don't need insurance provided for us. I have provided supporting documents to the mortgage company several times. They told us an escrow analysis was completed and there is no additional flood insurance being billed to us by PHH mortgage. Today as of XX/XX/2019, we just paid this not needed flood insurance. We have overpaid for this 2 months in a row. Today at XXXX, I spoke to XXXX ( badge ID # XXXX ) from PHH mortgage. XXXX was not cooperative. XXXX said that we are not being billed for this, yet I still show I am being billed for it. I have all the evidence, and will submit the documents showing this. XXXX tried to tell me since we were a little behind in our mortgage, the account will NOT be brought up to the correct status until we pay the past amount payments including late charges. I was told 3 weeks ago that as long we continue to make our current monthly payments, the home is not in jeopardy of any kind of foreclosure. I also informed them that we will take care of this asap. I feel like they are trying to extort us. This is illegal practice. We didn't ask, or need flood insurance and need this removed immediately and need a check sent to us via XXXX for {$310.00}. Complaint: We were behind on our mortgage because of hospitalization. We caught up, but went behind again in XXXX because of a XXXX and more hospitalization. We got behind again with another stay in hospital for a month and numerous trips for follow-up. XX/XX/XXXX, we received a letter stating that the mortgage co. received a letter stating that they received our request for help on the 7th and that the account was incomplete and I have until the XXXX of XXXX to send necessary docs in to complete. On XX/XX/XXXX we received a letter from the Mortgage co saying that the account has been referred to an attorney to begin the foreclosure process. XX/XX/XXXX we received a letter from an attorney that they are proceeding with the foreclosure. On the XXXX of XXXX, I faxed the profit and loss statement ( they wanted this because my husband 's check stubs did not have the year to date earning on them ) and on the XXXX I faxed the hardship letter. These were the two things they said that I was missing. I ended up sending these docs many times because they stated that they either did not get them or I sent them to late and they were outdated. Finally, XXXX XXXX XXXX the mortgage co. sent a letter saying that the package was complete as of XXXX XXXX XXXX and it could take up to 30 calendar days from the date of completion. I had discussed during this time about foreclosure with their team members and was told that as long as the package was complete, foreclosure would stop. XX/XX/XXXX the mortgage co. informed us by letter that we did not qualify for any assistance. One of the reasons was a valid long term hardship was not documented. My hardship was temporary and we are both back to work now, I just assumed that it was benefit us for assistance if we could make payments without having a long term hardship? The other reason was " we verified the account gross income as {$0.00}. Both my husband and I are working full time. The letter also stated if we wanted to appeal that no foreclosure sale will be conducted during the 14 day appeal process where you send in a written explanation and supporting documents. I sent the appeal in with all the documents, including re-sending what I had originally sent. I received many letters stating that they needed more time to decide and I called the mortgage co. during this time and they assured me that foreclosure would/is stopped while they are making their decision. The last letter was XX/XX/XXXX and they still needed more time ... ..a written response would be sent by XX/XX/XXXX. I called later that week when I still heard nothing and still was told they have not made a decision. On XX/XX/XXXX I received a call from my son stating that he saw the house was sold at auction. I called PHH and indeed, it was. I asked how could this be since I was still waiting for the appeal decision and one of the team members told me they ran out of time, it was sold at auction so the appeal was denied., I talked to a lawyer and they said the foreclosure should have been stopped throughout the appeal and that when and only when they made a decision would it be back on foreclosure and that it was illegal to foreclose on an appeal. I just want our house back. Some tell me there is nothing I can do once it is sold other than buy it back and others say I can get a lawyer and sue. I want our home back and don't feel I should have to buy it back, since I was not represented properly. When I talked to PHH about the foreclosure being stopped during an appeal, they stated " It is not PHH 's policy to stop a foreclosure during an appeal '' I do not think they did their job to help me resolve this issue, I could have started making payments months ago if they would have approved us in the first place, like I said, both my husband and I are working full time. I called for the past two months and no one has gotten back to me Regarding my next payment. Before the loan was transferred, I completed a modification with XXXX. After the modification was completed by XXXX, XXXX charged me a {$99.00} 'Charge - Notice of Default Cancellation fee on my XX/XX/19 statement and the fee was listed with a date of XX/XX/19. I disputed the fee with XXXX but then the loan was transferred. PH Mortgage Services then charged me a {$99.00} 'Assessed Expense - RECORDING FEE Paid ' fee! They charged me on the statement with date XX/XX/19 and listed the charge with date of XX/XX/19. They also raised my principal, interest, and escrow payment portions from the agreed upon rate that was in the modification agreement I signed with XXXX.

Complaint: In XX/XX/2019, I spoke to XXXX XXXX XXXX with regard to lowering my mortgage payment and escrowing my real estate taxes. I sent them a letter of request asking them to advise me after a payment of {$180000.00} what my new monthly payment would be for the remainder of the original loan terms. I received a response that after receipt of the lump sum payment my mortgage payment would be around {$340.00} a month but since I have always paid my real estate taxes separately they would not be able to calculate a monthly payment with taxes included. I called XXXX to advise that I would be sending {$170000.00} on XX/XX/XXXX and the agent advised me that the loan would recast and XX/XX/XXXX statement would reflect the new lower payment amount due. On XX/XX/2019 I scheduled my XX/XX/XXXX mortgage payment with a lump sum payment of {$170000.00}. After a week I noticed that the check had not been cashed. I called XXXX to investigate and was advised that the new servicer would be PHH Mortgage Services, XXXX XXXX XXXX XXXX XXXX, NJ XXXX. The following day I received a letter in the mail with the new servicers information. On XX/XX/2019, I called PHH to see what the XX/XX/XXXX payment would be they advised me the new payment would remain the same and that in order to recast with them I would need to apply, pay a {$300.00} application but there was no guarantee it would be approved, however, if denied I would receive the {$300.00} application fee back. As a consumer I feel that I am being robbed of an exorbitant amount of money and requesting assistance in this matter. This was done to lower expenses since my income has changed because my spouse is currently battling XXXX. Now in addition to the fear of that loss I fear losing my home as well. If they were not going to honor the XXXX agreement they should not have cashed the check.
