This correspondence reference the complaint filed against XXXX XXXX. This was a firm that sought me out alleging that I was a victim of predatory lending with mortgage company ( Pennymac ) I had completed two trial payment plans ( 6months ) of {$1200.00} a month each to get an approved modification and XXXX in late fees and delinquent payments was added on.

Complaint: During the time of misfortune I managed to get behind on my mortgage from XX/XX/XXXX-XX/XX/XXXX. My loan is with XXXX XXXX XXXX.
I was told by a rep by phone in XX/XX/XXXX that we could get up to 6 months removed for our credit that was reporting 30 days late during this time when or at the time we could cath our loan up to date.
We managed to this and now they are saying that is nothing they can do and not sure why a rep for them said this and there is nothing they can do. If I knew this it would of helped manage and prepare for this time. We are in the process and selling and maybe buying again and this is holding us back.

Complaint: I called my mortgage company, PennyMac USA, about my Loan ( XXXX ) on XX/XX/2018. I'm currently unemployed and asked for a short-term forbearance because I'm struggling to make my payments. I was rejected because I paid XX/XX/2018 and wasn't in default. They said I didn't qualify for a short-term forbearance because I wasn't 3 months behind in my payments.
I told them I'm trying to be proactive and let them know that I'm struggling financially, but actively looking for full-time work. They said I needed to be 3 months without payment before I could qualify to " not pay. '' I'm afraid that if I don't pay for 3 months, they'll start the foreclosure process.
Please help. I want to remain in good standing, I'm looking for full-time work, but I need a short term forbearance while I regain income.

Complaint: My mortgage was through XXXX XXXX. It was bought by XXXX. Then it was bought by XXXX XXXX. Now I receive a letter saying it was sold to PennyMac, BUT the terms are not being honored. I had automatic payments through XXXX, XXXX and XXXX XXXX. This covered my Principle, Interest, Insurance and Property Taxes. PennyMac says they will not take care of that in this letter. XXXX XXXX NEVER said they were selling my loan. In this day and age of fraud and corruption no one needs this from finance companies.
When mortgage companies assume a mortgage are they not supposed to honor the terms and rates of the loan, especially a VA LOAN!? If it's not a law WHY DON'T WE MAKE IT ONE!

Complaint: I have three mortgages with PennyMac. I paid XX/XX/2018 mortgages through a bill pay service. One check was issued for all three mortgages. PennyMac held the check for several weeks and then posted to one account. I was made aware of this when I started getting robo calls regarding my two unpaid accounts. THREE times now I have called in to correct the problem. Yes, THREE times. I have to hold while they investigate, confirm my previous calls and then continue to hold while they make notes to repost the payments. Now one of my accounts is 30 days late. Enough. It shouldn't have happened in the first place, but after three attempts and my time and frustration and now that it is affecting my credit, it is time to take action.

Complaint: I closed on my house back in XXXX of XXXX. In early XXXX our note was sold to a new mortgage company, named XXXXXXXX XXXX XXXXXXXX. I bought my home for {$150000.00}, with a down payment for {$4200.00}. I financed {$140000.00} for XXXX years at {$1000.00} per month. When XXXX took over my loan they first raised my monthly payment to {$1100.00}. I was told this was due in part to my homeowners insurance going up. I was told I that I only had to pay this for XXXX months and then my payment would return to normal. When the XXXX months came and went, I was then told that this was my new payment. In XXXX XXXX we received considerable damage from hurricane XXXX. I had made arrangements with XXXX for me to do all the repairs. I am a licensed XXXX XXXX and own my own construction company at the time. In XXXX of XXXX XXXX called me and talked to me about putting me in a new program they had, to help people with problems from hurricane XXXX. This program, as explained by XXXX is to help me by not charging and fees or penalties and have no affect on my credit. In XXXX of XXXX XXXX raised my payment to {$1900.00}. XXXX I was told it was because of my property taxes had gone up. I went to XXXX XXXX court house. I found out that my property taxes had not gone up. I brought this to XXXX. I talked to so many different people there. none of them were willing to truly help me. Then in XXXX of XXXX, I was told by XXXX that the real reason they raised my payment was that, the original company who created my loan, had made some major mistakes. That this will be my payment til the end. I did my research and was told by XXXX, XXXX XXXX and a company who specializes in checking the paperwork from the mortgage companies. That there was no mistakes made. Not when you have all of these protocols in place. XXXX refuses to help me. even when I do get someone there who tells me they will look into the matter for me, plus call me back. They never do. Now they tell me I am XXXX months behind, which is not true at all. I was told of their Loan Modification, which states I now owe more than when I purchased the house. I am a XXXX XXXX, XXXX because of an XXXX I had to XXXX early from contracting. I am on a fixed income. I can not pay their payment. I am also a XXXX father of a XXXX son. I will lose my home to a foreclosure. I need someone to help me.

Complaint: They mis-handled an extra payment I sent to cover for insurance rate increase. They were suppose to back it out, apply it correctly and then all would be fine. That was in XX/XX/2018. I have called every month after getting threatening letters, and they always say they will re-do it. The last time I called in early XXXX, they told me I was 2 months behind! My mtg pymts go out from auto-pay every month on the same day. I've never been late. They keep me on the phone for 2 hours, and then promise to fix it. But nothing changes, and I keep getting threatening letters.
I'm a XXXX veteran [ 100 % ] and part of my XXXX is XXXX. They keep me on the phone for so long it wears me down. I also have XXXX XXXX XXXX problems, so I can have a conversation and 10 minutes later I can't remember what was said. So I have tried to keep short notes of each of the last 3 months of calls. On XXXX XXXX, PennyMac responded to the Texas State Attorney Generals complaint I filed. Here is my note : XXXX : PennyMac called me XXXX XXXX. XXXX ext XXXX Dept : Priority Complaints. He advised me that he was recording the call, and when I told him I would do the same, he told me that XXXX would not talk on the phone with me if I recorded the call. I told him 3 times I would stop recording if he would answer my questions. He would not talk to me or answer any questions, and then hung up. I asked him if they were going to foreclose on my home and he would not answer that either. I asked him this question at least 3 times with me, and he would never answer.
This produces great stress with me. I really don't know what to do at this point. I'm afraid of becoming homeless.

Complaint: My property was Foreclosed on on XX/XX/2016 by, XXXX , XXXX . not in its individual capacity but solely as Owner Trustee for XXXX XXXX XXXX XXXX-1. I believe this was a fraudulent action, and am trying to get answers to long awaited questions, and concerns I have related to this matter. My complaint is that I can not find any viable Trusts in this name.
I have been filing a specific request to this Association, " Trust, '' and it has continuously been sent to the Servicer, PennyMac. This would have been ok, if they would answer my questions appropriately, yet they have not. They continue to send information I have, know, and am not inquiring about.
PennyMac continues to respond by explaining very well who 'they ' are, the " SERVICER '' and their role of, and being " SERVICER '', but this is not the information I have asked for, nor need any education in the duties of.
I evidently need to be even more direct.

Complaint: I had my mortgage with XXXX until XX/XX/2018 when it was sold to PennyMac.. I got a letter from both companies and was told I did not need to do anything but change payment to new company. Then I get a letter from PennyMac XX/XX/XXXX saying I did not have homeowners insurance and I needed to send proof I have it and if not they would get insurance and I would have to pay.
Then I get a letter from XXXX XXXX my insurance carrier saying that they had tried unsuccessfully twice to contact PennyMac and they would not reply. Penny Mac Maliciously tried to get me to pay for a bogus insurance they have. This was a threat and a scam. I have never been late paying anything and PennyMac is a unprofessional mortgage company.

Complaint: I have reached out to PennyMac on several occasions concerning their misapplication of my mortgage payments. Each time I speak with a representative, I am given the run around, given a different answer or I have been spoken to flat out rudely and unprofessional ( most recently by XXXX, XXXX and XXXX ). I asked to speak to a manager and I was transferred to XXXX who I later found out is not a manager. When I asked her to let me speak to a salaried official, she did not know what that was. I advised her I would be filing a complaint with the Consumer Finance Protection Bureau and she said she did not care.
I need some assistance in getting these payments applied correctly. I am the customer and I do not deserve to be disrespected.
