Complaint: I originally received my mortgage loan from XXXX XXXX XXXX in XX/XX/XXXX and I felt they were great. I did run into some hardships with them and was late on a few payments in XXXX but with there patients I got caught up in XXXX. In XXXX they sold my loan to Penny Mac. Penny Mac has been nothing short of fraudulent since then.
In the months of XX/XX/XXXX, Penny Mac, my loan provider waited until after the due date of XX/XX/XXXX to process my payment and charged me a fee of approximately {$100.00}. On XX/XX/XXXX and XXXX the payment line of Penny Mac was down and I could not make a payment until the XXXX and they charged me another late fee of approximately {$100.00}. I called several times after that only to enter a phone tree in which I could never talk to anyone. When I finally talked to someone they said they would wave the fees in which they never have. I have called several times and Penny Mac representatives said they would wave the fee but they never have.
In late XXXX I noticed an additional fee under other fees which was approximately XXXX dollars but continued to go up every month. I called several times to ask what it was for and never really got a good answer. Today, I opened my latest bill and the " Other Fees '' had reached {$24.00} so I called Penny Mac. The Penny Mac representative said the fee was because my Mortgage was delinquent from the XXXX incident described above and I would have to pay this fee to " have someone come to my house to make sure someone was still living there FOR THE LIFE OF THE LOAN ''. This is clear Fraud as no one has stopped by my house to make sure I am present. This is clearly Fraud because I was never late on my loan with Penny Mac.

Complaint: I HAVE APPLIED FOR FINANCIAL ASSISTANCE ON MY FHA LOAN WITH PENNYMAC, I WAS RECENTLY DENIED STATING THAT PENNYMAC DOES NOT HAVE TO FOLLOW FHA GUIDELINES. I ASKED WHY AND THEY SAID THAT THEY ARE THE INVESTOR OF THE FHA LOAN AND THEY CAN MAKE ANY RULE AND NOT FOLLOW FHA GUIDELINES. THIS IS ABSURD AND NEEDS TO BE CORRECT AS I HAVE READ THE 1009 PAGES OF THE FHA GUIDELINES AND IT STATES THAT IF I HAVE MADE 4 PAYMENTS AND HAVE HAD THE LOAN AT LEAST 12 MONTHS SINCE ORIGINATION WHICH ALL HAVE BEEN MET I CAN BE REVIEWED. Complaint: On XX/XX/XXXX I closed on a home through XXXX Mortgage and XXXX XXXX XXXX. XXXX XXXX XXXX received {$2200.00} in for XXXX Winter Taxes in my Escrow along with other closing costs on the day of closing. According to my contract XXXX XXXX XXXX was responsible for appropriating my tax payments. I received a letter dated XX/XX/XXXX stating that my mortgage loan had been transferred to PennyMac Loan Services , LLC . I was instructed to pay them {$1000.00} monthly per my original contract and was insured that my payments and loan conditions would not change. On XX/XX/XXXX a whole year later PennyMac Loan Service, LLC unexpectantly increased my monthly payment amount to {$1100.00}. When I called and asked why they made a change they stated that the increase was to pay them back for the XXXX Winter Taxes. When PennyMac took over the loan from XXXX XXXX it was already in the contract for XXXX XXXX to disperse the funds to cover the XXXX taxes. PennyMac did not inform XXXX XXXX nor myself at any point of a payment being made outside of the original contract. They are now adding additional amounts to my monthly payments for the next twelve months to recover their {$1300.00} mistake. This appears to be a breach of contract and a violation of my consumer rights therefore I am requesting an investigation to search for illegal practices. My taxes did not increase therefore my payments should not increase on a fixed FHA loan. I have contacted them many times and they admit that they should have sent me notification of that payment sooner and want to discuss easier payment plans so they can recover their {$1300.00} on taxes that I had already paid at closing.

Complaint: Pennymac wrongfully denies my loan modification based on my race and decides to use the typical standard statement they tell others stating claim my debt to income ratio was high. Well thats totally un-true and Ive provided plenty of evidence showing the expenses related to the house which will show my expenses pretty much totals or exceeds my income. My mortgage shouldnt have been more than {$1500.00} but of course, I got ripped off by XXXX XXXX XXXX and now Pennymac. I put 20 % down and still Im paying Mortgage protection insurance which doesnt benefit me at all. I demand a modification or Ill never stop complaining and making accusations..

Complaint: Last XXXX we had some extra money after taxes, so we decided to send it to the mortgage company to apply towards our principle. Our payment each month is automatically drafted, and never have we missed a payment. On XX/XX/XXXX I noticed that my payments were not being drafted as usual, so I called the company. They couldn't tell me why the auto draft wasn't working, but at that time he told me that I was paid up until XX/XX/XXXX. They had taken my payment of {$5100.00} I sent extra in XX/XX/XXXX and reversed it the next day and applied it towards monthly payments instead. This didn't reduce my principle like it should have and I continued to pay interest on a higher balance. The customer service person said they would fix it and I see there have been many adjustments to my account, but not in my favor. Currently they say I owe exactly the same principle balance that I did last XX/XX/XXXX that I do now. I have paid a total of {$16000.00} over the past 7 months, and over {$6200.00} was extra principle payments above my mortgage payment. If PennyMac is doing this to my account, I can only imagine how many other accounts they are doing this to.

Complaint: I recently filed Complaint No. XXXX. The response received from PennyMac was inaccurate. The response suggested that I did not provide instructions as to how additional monies should be applied to my account. This statement is untrue. I have spoken with multiple representatives throughout the duration of my loan and it has been suggested that a code would be applied to my account. Furthermore, the representative who responded to Complaint No. XXXX also suggested that she would speak with her Billing department to ensure that all payment overages were applied to the principal mortgage balance.
Notably, I recently remitted a payment and the overage in the amount of {$88.00} was not applied to the principal balance. Please review the attached screenshot for confirmation. This is becoming extremely annoying always having to follow-up and ensue that my payments are applied to my loan properly.

I followed up with Penny MAC on Monday was told they have paperwork for XXXX was put on hold briefly a different pert came on call I was then told they I need to follow there instructions and they was accepting paperwork for XXXX that I need to do it directly. Complaint: While refinancing my loan back in XX/XX/2016, I had a long conversation with PennyMac Loan officer XXXX, regarding my PMI while refinancing, I asked when it would fall off, how it works and everything like that. A year later while talking with PennyMac they stated that my PMI is for the life of the loan. This is NOT what I was told from XXXX XXXX Loan officer # XXXX, we had a conversation specifically about the PMI. I would have never signed this knowing that when we had verbal over the phone communication regarding this. I have since complained to PennyMac and have gotten nowhere. Complaint: I have a loan with Pennymac Loan Servicing, I have not ever missed a payment. Each time I call they tell me that I am missing a months payment, I have contacted them several times and they can not tell me where the breakdown is, and I have also sent in bank statements, and letters on bank letterhead stating that ALL of my payments have been made and not one has been returned unpaid. Complaint: i, a woman in flesh and blood purchased a home on XX/XX/2018 in XXXX XXXX NV. The original lender was XXXX XXXX XXXX XXXX whom was paid in full. On or about XX/XX/2018 approximately three months later a new company came on the scene requesting payments for a debt. That company name is XXXX XXXX XXXX located in California. Since the inception of the purchase the questions where asked as follows ; " Have you receive full payment and compensation as agreed upon between buyer XXXX XXXX XXXX and lender XXXX XXXX XXXX XXXX? '' That answer was yes. The next question that was asked, then where is the proof of payment received type of currency needed and on what date. That question was not answered. On or about XX/XX/2018 i received a letter from a company located in XXXX XXXX CA stating that they where the new lender of my alleged mortgage. i responded immediately asking them to validate and varify the alleged mortgage note and or security. i asked how did you become the lender when i never met with anyone from XXXX XXXX XXXX nor with XXXX XXXX a none profit corporation whom came on the scene around XX/XX/2018 claiming they too where the original lender. i responded the same with " please provide any and all communications in person with anyone living in flesh and blood of the same kind that alleges this debt. The persons addressed are the CEO 's of both XXXX XXXX and XXXX XXXX XXXX, they the CEO 's never responded. Rather a letter from XXXX XXXX XXXX named XXXX XXXX, and a XXXX XXXX from the same Research Department PennyMac Loan Services, LLC from the " Research Department PennyMac Loan Services, LLC '' stating that they are both the lender and the servicer. As well they made changes to their claims stating that XXXXXXXX XXXX is the lender, when all of this is false. The lender was and only XXXX XXXX XXXX XXXX located in XXXX NV. They failed to answer the letters in a timely manner. i personally mailed them notification that the debt was being disputed due to the new and false information regarding my purchased home. Each time they would continue to send letters well after i mailed a cease and desist notice to them on XXXX showing that the debt was being disputed due to false information, lack of accurate information and the history tied thereto the purchase. i have yet to receive any response from the CEO 's of all companies involved as well from the CEO of the true and original lender whom was paid that being XXXX XXXX XXXX XXXX. They continue XXXX XXXX XXXX and XXXX XXXX through Penny Mac insisting that a debt is owed without proof, wet signatures and verification and validation. Such is fraud, extortion, harassment, slander defamation and libel. Now the facts remain un-rebutted such as, verification and validation of the alleged debt, failure to respond by the CEO 's whom the letters where addressed thereto, and not any other. No wet signature produce, and upon the documents presented by Penny Mac and XXXX XXXX have issues that should have been corrected before this time of the complaint filed here and now. Also they failed to state who is XXXX XXXX and why the name change? They failed to prove that a debt exist and any use of XXXX XXXX XXXX be it lower case and or all capital is copyright infringement and an attempt to create a dead corporation in my name without my consent or knowledge of such. The signatures do not match that of XXXX XXXX XXXX please Cc the Certificate Of Administrative Judgement via USPS registered mail. For all other questions comments and concerns please see the attachments hereto this complaint. Also the language within the produced alleged mortgage agreement is not in english, does not make sense, unclear, and has multiple issues that needed to have been corrected before now, and they have failed to do so.

Complaint: We have a conventional home mortgage loan with PennyMac. The home value is {$340000.00}. Our initial loan was for {$310000.00}. We then paid an additional {$40000.00} in principal in XX/XX/2018. This should automatically qualify to eliminate PMI. Our balance is now {$260000.00}.
We have contacted PennyMac several times on this and each time they claim that they will send us paperwork to complete and return. This has never happened. Every time we call they state that they have no record of our request and that they will start the process all over again. This has happened three times now as of XX/XX/18.
I have attached my loan statement information and loan activity statement to show additional principal payment.

Complaint: I generally pay an additional amount each month with my mortgage payment to be applied towards the principal balance. Twice, I have experienced PennyMac applying the additional monies a day later. For example, PennyMac posted my XX/XX/XXXX payment on XX/XX/XXXX. However, they then posted the additional principal on XX/XX/XXXX.
In speaking with several friends who also have loans with PennyMac, they suggest they have encountered these same unscrupulous behaviors. Indubitably, if PennyMac is intentionally doing this to borrowers, they should stop immediately.
